critics, some accusations that you were not truthful about an incident that involved climbers on mount everest? >> absolutely fake news by local media and the ap. on the mountain there was compliments exchanged that were not remembered directly but in no way was intentionally deceiving anybody. i looked up to the climber i had a conversation with, never claimed to do anything, nothing i didn't do that is in dispute, just a compliment that was misunderstood after the earthquake and several fatalities. pete: tell us about your service in the military. >> i served ten years starting in west point, class of 99 and was stationed in alaska, and outdoorsman at heart. after 9/11 i was scheduled to get out of the military but voluntarily extended to afghanistan, served in the province there.

an originalist majority on the court and everyone at the institute extends congratulations to brett kavanaugh and encouraged the donald trump is fulfilling his promises to the american people. now that he will start his new job come tuesday there are a few cases on the docket dealing with administered of law issues, holding administered of agencies that are not in the constitution and act functionally is legislative, executive and their own enforcement and interpretation accountable. we heard the term chevron deference. that means brett kavanaugh and the conservative majority will make sure those agencies stay in bounds. the other big case to look at is a death penalty issue. there is a lot of criminal law issues and some freedom of religion, free speech cases that will be coming up in the docket.

better president he really -- pete: he really laid it out for the future, rachel, you've done a great job laying it out this morning. it's resist versus results. finally a politician, who wasn't a politician before, was a businessman, delivered. rachel: he absolutely did. and he also laid out, listen, if you want rule of law, remember, that's what he ran on in the 2016 campaign, rule of law versus rule of mob. and this week the left really did a good job of showing what the mob looks like and what they're willing to do in terms of dirty tricks in politics and also shouting down death threats to our members of congress and really kind of tearing down our institutions. the president laid that out, and i think that's a decision people are going to have to make in november. griff: he did. i mean, the history, you cannot overstate the history of brett kavanaugh being appointed to supreme court. but it was rooted in the president's willing to face that mob, take 'em head on, head

first, and in doing so, inspired mitch mcconnell to do so and then, ultimately as i mentioned yesterday, even susan collins finally said, you know what? the democrats have crossed the line. they've gone too far, and that's why she had that great quote which is when you become too hysterical, fairness goes right out the door. pete: you made this point last hour, so i like to steal your best points -- [laughter] and use them as my own. conservatives and elsewhere you have wanted a cowt faithful to constitution, this truly is that moment. and no one thought it would be that businessman, donald trump, but it took someone who was willing to fight, didn't back away from a nominee who had been totally smeared. and ultimately are, as a result today, it's five -- wrong camera side -- 5-4 on the supreme court, in favor of conservatives. and that means your second amendment rights are safe, your freedom of speech, the religious liberty, the rights of unborn children.

this president delivered on. griff: we should take a sunday morning before you go to church -- pete: think about that fact. that is a huge victory for this country. griff: that's right. if you look at really what the conservative think tanks, the heritage foundation, have talked about, they all heark back to president ronald reagan and building a shining city on the hill. a conservative court, a strong military, a booming economy, fair trade deals, he's delivered all of them. rachel: when i think about some of the never trumpers, and we all have them in our lives, what more do you want? pete: never drum possessor seem to be what -- trumpers, never happy. rachel: eric holder, here's what he had to say about brett kavanaugh's confirmation. he put a tweet out. it said with the confirmation of kavanaugh and the process which led to it and the treatment of merrick garland, the legitimacy of the supreme court can justifiably be questioned. the court must now prove through its work that it is or worthy of

the nation's trust. very interesting. already setting up the delegitimacy of the supreme court unless, you know, roberts or somebody else on the court votes the way the liberals want. okay, then we'll say it's legitimate. pete: look out for that. they're going to start pressuring roberts to become the new kennedy and the swing vote. we'll see what happens there. all you can do is nominate someone you think is good. griff: it's not isolated to eric holder who, by the way, the former attorney general you'd think would not go so strident on matters of legal fairness. but you've also got dianne feinstein who was the ranking member on the judiciary committee challenging the legitimacies of the court that she just went through the process. pete: we have one institution that americans generally trust to be fair -- rachel: but that's sort of a socialist thing, tear down these institutions. i think it's important, why brett kavanaugh's seat is so important to them, why this fight was so important to them that they were willing to do just about anything to take him down, and that is because the

left doesn't like to win -- or can't win on their ideas, on the power of their ideas and arguments, so i they use the deep state and the courts to get what they can't do in the elections. and so with this vote being so crucial, that's why -- pete: it's pivotal. and earlier on the program, this is what andy mccarthy had to say. >> the fact that they hold high ranking positions doesn't mean they're not part of the hard left, and the argument doesn't make any sense. for example, i think the justice department is a legitimate institution. the fact that when eric holder was deputy attorney general, he used it to carry out the corrupt pardon of mark rich doesn't mean to he there's something wrong with the justice department, there's something wrong with eric holder. that's kind of the way politics works. pete: and elections have consequences. griff: maybe eric holder is going to rub -- to run for

style he's already ready to litigate the success of his last two years versus the resistance that he's faced. he didn't just mention spartacus, which will be his nickname forever in cory booker, but also he mentioned elizabeth warren, pocahontas, daring her to take a dna test which will haunt her until she does. rachel: no question about that. he's so smart to lay out these wins because they really are significant. this is a presidency that has had, you know, the media pound on it nonstop. and so, you know, there's -- the obama administration, i think, was a lot of hype, and this is a presidency built on solid ground, on results. so you can knock him for his style, but imagine donald trump without these wins. i mean, this is a presidency, you look at a 51%, it's not about hype, it's totally about results. pete: yeah. because the media will never give him credit. on the failing new york times this morning just one little column about the supreme court.

unique biography and independence from the beltway establishment that allow this moment to happen. rachel: michelle, you've had your pulse on the base for so long. this is something that's always frustrated you about republicans, that they always crumble, they always get weak-kneed when they hear sexist, homophobic, misogynyst, racist. and this is -- you're right, this is a big moment. do you think republicans are learning from donald trump on how to fight? >> they better be, and i think that we saw some of the beltway senate republicans more emboldened than we've ever seen them before. and the contrast between the rule of law and rule of mob really is the ultimate theme of the midterms leading up until 2020. and it is probably the most unifying theme that we have been able to define over these years. because whether you're an economic conservative, more of a

investigation of the senate democrat wrecking machine. even in the wake of this victory, there are still a lot of unanswered questions about who on the judiciary senate committee among those democrats were handing out the senate gallery passes like pez canty to likes -- candy to likes of piper perabo and the hundreds of people that were interrupting the senate judiciary hearings from minute one, day one, second one of the hearings. and i think that there should be an investigation of the protest orchestration as well as those leaky leaks. and, ultimately, the accuser procurement machine that i believe existed between the senate judiciary committee, i believe senator dianne feinstein's office is and all of these soros satellite groups that obviously were doing this for months and months in advance of the late hits that failed. griff: well, it's not even a guess, michelle, because we saw

temple of justice where procedural fairness rains. brett is a respected colleague among all of his colleagues regardless of their philosophical outlook. all of those judges on the court of appeals with whom he served so brilliantly are real judges. what we are seeing in the streets is frankly mob rule. rachel: we are seeing the new strategy on the left, eric older says the confirmation of brett kavanaugh, the process, the treatment of merrick garland, the legitimacy of the supreme court is questioned. the court must prove that it is worthy of the nation's trust. what you make of that is that a threat to justice roberts and everyone else if you don't rule the way we think you should on the left, you are not legitimate? >> it is an idle threat, more

political rhetoric. i regret that it comes from the former attorney general of the united states. i talk about him in my book. in any event let's rise above this, let's have the court honestly wrestle leave questions. i think brett kavanaugh is going to be a great and true and faithful friend of the constitution including protecting those basic liberties. i start with the first amendment. congress shall make no law respecting establishment of the state religion are preventing free exercise thereof and freedom of speech and of the press. i have every confidence that brett kavanaugh will become a great and faithful jurist just as he has been so respected on the court of appeals, he will be a great justice. pete: one of his colleagues is concerned about the court being politically divided. >> political parties have adopted the academic discussions that judges were having for the

longest time about how to interpret laws in the constitution and when the political parties adopted that language as their own, they have now superimposed that on the court. i think that institutional he has heard the court a lot. pete: your reaction? >> i think justice sotomayor who i respect, i disagree with her jurisprudence, signaling something we should take seriously but i have a very different take which is every justice confirmed to this court, i know the mall, each take the oath so seriously, they will shield themselves. i argued 36 cases of the supreme court of the united states and had justices, i am going to get that justice's vote or i didn't or i'm not going to get that justice's vote and i didn't. they take that oath so
