lawsuit officer as we learn more about the victim. also, supreme court justice ruth bader ginsberg in the hospital after a fall. new reporting live from the supreme court. and some democrats demanding the new acting attorney general recuse himself from the russia investigation because of his past comments. while the white house says there's no constitutional crisis. reporting begins now. america woke up yet again today to another mass shooting. this from college night at a country bar in thousand oaks, california outside l.a. a night of dancing and hanging out with friends turned into a massacre with 12 people plus the shooter dead. people desperate to escape the crowded bar using chairs and bar stools to break the windows. here's some of the survivors.

>> it was a normal wednesday. we were at the bar having fun, dancing. and then all of a sudden, you hear like the bang bang. gun shots. >> i heard the gun shots. i turned around and i saw him shoot a couple more times. within a split second, everyone yelled get down. >> we thought it was a joke. sounded like firecrackers. >> the gunman was throwing smoke grenades all over the place. >> so i ran to the left of the dance floor where the back door is. everybody was piled on top of each other. it was silent for a couple seconds. and then all of a sudden a couple guys that were closer to the bar, they got us and started running for the back door and said he's coming. >> he kept firing. i ran out the front door. i heard chase being thrown out the window. people were trying to get out the window.

>> my friends started slamming them against the windows so we could get out. that's how we got out. he broke the window. they broke the window and we climbed out. >> some were injured on the broken glass. the suspected gunman, a 28-year-old marine corps veteran. the shooter used a glock handgun. but the gun had an extended magazine that is not legal in the state of california. a heart breaking scene outside the hospital where family members waited for word on their loved ones. some have now received it. our chief correspondent jonathan hunt live at the scene in thousand oaks. >> shep, good afternoon. the borderline bar and grill a couple hundred yards behind me here remains at the words of the sheriff a horrific crime scene.

there's blood everywhere the sheriff told us. earlier today, the first 911 calls came in and witnesses we spoke to in the early hours of this morning talked of a man clad entirely in black shooting a security guard at the door and walking in, throwing smoke grenades and shooting anybody he found in his sight. it was obviously a terrifying time for the 150 to 200 mainly young people that had gathered there simply to drink and dance as they do every college wednesday at the borderline bar and grill. listen here to one of the witnesses talking about the flight to get out. >> he didn't say anything at all. he just started shooting. i should have stayed until he changed his clip.

i was worried about my boy. it was just some low life taking lives that shouldn't have been taken. >> the gunman has been named by officials as 28-year-old ian david long. he's a u.s. marine corps veteran, served in afghanistan from late 2010 to mid 2011. fbi and sheriff deputies teams are going through his house right now in nearby newberry park trying to find any clues as to a motive. we know, shep, that he had mental health issues. the law enforcement authorities here were in fact called to his house in april of this year for disturbance. he's apparently inside screaming and throwing things and neighbors called because they were concerned. as part of that response by law enforcement, a mental evaluation

team went to the house, but they did not find any reason to hold him or to take any further action at that point. they did talk about the possibility of him suffering from ptsd as a result of his combat. but shep, as any mental health expert will tell you, there's so many that come back from afghanistan and iraq and the other wars with ptsd and they don't necessarily pick up a gun and carry out a mass shooting. so while it may prove to be a contributing factor, it doesn't explain why ian david long carried out this massacre, shep. >> shepard: jonathan, i'm so sad to report that one close to us has a victim in his family. >> yeah, adam housley is a former fox news correspondent. his brother, eric, who i can tell you personally is a

life in that bar. among the families, the family of sheriff's sergeant ron helus, one of the first three law enforcement personnel to arrive at the scene, shep. he heard shooting, he ran straight in through the door, was met face to face by the gunman who fired several bullets at him and later in the hospital. sergeant helus succumbed to his wounds and died. the sheriff talked about him emotionally earlier today. listen here. >> we lost a great human being. it's part of the loss, again, of the 11 other victims in there and all part of the suffering that we're all going to go through as family members and parents and brothers and sisters on this tragic senseless loss of life. >> one more point about sergeant helus, shep.

as he arrived or was near the borderline bar and grill, he was just doing a normal nightly checking call as he always did, apparently, with his wife. he got the active shooter call. he said to his wife, i have to go. i love you. shep? >> shepard: jonathan hunt reporting from the mass murder scene in thousand oaks. police officers, firefighters and other first responders saluted the sergeant who died trying to save people in that bar in an astounding and heart warming sight it was. a hearse carrying the body of sergeant helus from the hospital to the medical examiners in ventura, a long line of police cars and deputies on motorcycles escorting the hearse and by the hundreds and hundreds and hundreds along the busy freeway. you can see on this overpass here. some others that serve. stand in salute.

sergeant eric boucho worked for the ventura shear's office and was a friend of sergeant helus. sir, thank you. so sorry. what can you tell us about him? >> he was just a true professional. you know, i told people earlier, i'm not surprised at all that he was the first one in. that's just the way he was. truly dedicated, dedicated public servant. served with the highest standards of professionalism and a gentle, patient guy. yet he was always a student of the process, always honing his skills. he was a member of our swat team for many years. he was a firearms instructor, a defensive tactics instructor. i have no doubt that he went there with the intention to stop

the threat and save lives. and he -- i'm sure his actions were tactically sound. at some point you have to go through the door. unfortunately the suspect was ready. just -- it's an unspeakable tragedy. obviously this tragedy the idea hearing gun shots and running to them with no backup to do whatever you can with very little protection and losing your life in the process. it's just so honorable and unbelievable on some level.

how was he such a hero? >> that's who he was. he literally trained for these kinds of things his hole career. he experienced other critical incidences. certainly nothing of this magnitude. again, as a member of our swat team, he was a very talented investigator. he worked in our narcotics task force for many years. even though he was a year aware from requirement, he worked just as hard on his last day working as he did on his first. he was that kind of guy. truly dedicated. i -- processing this is really difficult. probably the emotions will come later when we're wrapping things up here. but i -- he was truly a cop's

the 11 victims were vegas survivors. in the hours after the attack, there was some concern about that. watch. >> there's a handful of people that i have not been in contact with because he was really worried about them. >> because there's been so many mass shootings in the past 20 years, it's a genuine phobia. numerous studies have been done to ease people's fear. the national safety counsel said your odds of dieing in a mass shooting are 1 in 110,000. we don't have information on the odds on being in a location where a mass shooting but to be involved twice in 13 months is astonishing. in june of 2012, 24-year-old jessica gowey survived a mass mall shooting in toronto only to be killed a month later in the aurora colorado theater shooting.

shep? >> shepard: trace gallagher reporting. sarah joins us now. she lives across the street from the bar in thousand oaks. her daughter's friends were there during the shooting and one is still missing. thanks for your time. i'm so sorry. >> thank you, shepard. >> i understand it was late and you were getting ready for bed. is that right? >> yeah, we were getting ready for bed. the older kids were out for the evening. a bunch of college kids come out to borderline. it's a 18 and older age group. the ones that aren't able to drink legally can still go out and hang out there. the music stopped, which was unusual. i thought maybe they wrapped up early and i should be preparing dinner or a snack for the kids. instead, there were sirens.

i started to go outside to see what's going on. i live 30 seconds away. my daughter called, said lock up the house, don't go anywhere. there's an active shooter at borderline and they don't know where he is. i said how do you know this? are you there? she said no, i'm not there. i didn't go but my friend is there and i talked to her. she's hiding in the bathroom. so i just put on my jacket and ran outside. i came to the intersection pretty much after the first responders went inside. there was a wave of injured kids that were coming my way, missing shoes, missing clothes, holding their friends. it was like a war zone being evacuated. like taking soldiers out of a battlefield with the kids

screaming for their mothers. there was two boys in front of me that found each other in this chaos. and they thought each other was dead. when they found each other, they wrapped their arms around each other. you're alive! you're alive! where is my friend? she got shot. they took her. we have to go and see if she's okay. they took off. half of the kids got in their own cars and took themselves to the hospital. thank god for the first responders, for the two officers that came. they saved lives. the rest of them that were in there. sadly sacrificed one of their own. but you hear about cops sometimes not doing what they should do. these guys did everything that

you pray they would do. they didn't hesitate. they were so fearless. there's going to be a lot of stories of heroism that comes from this. this nightmare. >> shepard: sarah, have you heard anything about your child's friend? >> my daughter spoke to her while she was hiding. we haven't heard anything since. there's been no answer with her phone. i know that a lot of these kids ran and left a lot of things behind. we're praying that's the case. we don't know yet. >> shepard: wow. what will you and your family take from this? is there anything? sounds like the unending and undying respect of the people that went in that building like

>> shepard: the mid-terms are over but not every race is settled including in florida where we appear to be headed for a recount. bill nelson facing off against rick scott for that senate seat. scott holds the lead by less than half a percentage point and in florida, that means a mandatory recount. the secretary of state there is set to make a decision this weekend. phil keating reporting live from doral. >> shep, in 15 minutes at the top of the hour, miami-dade county's elections canvassing board will convene here at the building and start going over all of the ballots and numbers submitted tuesday as well as the provisional ballots that were turned in as the late-arriving mail-in ballots, this is happening all over the state today and tomorrow. and then by noon on saturday, all 67 county canvassing boards must admit their unofficial results to the secretary of state in tallahassee.

provisional ballots are for people that voted tuesday but didn't have i.d. and showed up to the wrong precinct. every single vote counts especially this year in florida. the florida race for senate between republican scott and bill nelson keeps getting closer. right now scott leads by .22%. that's under 18,000 votes out of 8.1 million votes counted. that seems to be headed to an automatic recount. that will probably be official saturday afternoon. leading late tuesday, governor scott called the race over. nelson has not appeared since tuesday and never conceded he lost. the florida governor's race has gotten into the automatic recount threshold under half a percent. right now ron desantis leads democrat andrew gillum by .47 of a percentage point.

that is just about 38,000 votes and gillum has been closing that edge since wednesday morning. tuesday night appearing to have lost, gillum called desantis, congratulated him and conceded that he lost. things have all changed dramatically over the last day with gillum tweeting this afternoon "every voice must be heard in this race." so on the senate side at least, they have attorneys and volunteers staffing all 67 supervisor of elections offices to make sure everything is on the up and up. it's tight. five races in florida looking like a recount. >> shepard: phil keating reporting live from south florida. we may have a few days to wait now to see which arizona congresswoman will make history as the state's first woman senator. the race between the republican, martha mcsally and kyrsten sinema is too close to call.

workers still have to count hundreds of thousands of ballots. dan springer reporting live from phoenix. >> shep, martha mcsally's lead grew to 17,000 votes but this is far from over. 16% of the entire statewide vote is yet to be counted. today we received the first lawsuit. it was filed late yesterday by the republican party in four counties. it alleges that the process being used to verify mail-in ballots when the signatures don't match is not the same across the whole state. some counties throw them out if the vote can't be verified by election day. maricopa county and three others are calling voters that dropped off the ballot on election day whose signatures don't match to verify if they voted. republican party leaders call it fairness. democrats say it's voter suppression. the party chair just said the republican party is doing everything they can to silence

georgia's secretary of state earlier today. he and his campaign team claim the race is over and kemp won. steve harrigan reporting live from atlanta. >> shepard, you have the unusual situation here of one side going on about its business as if this campaign is over. brian kemp said he won the election as governor of georgia, that he's forming his new team to take over. on the other side though, stacey abrams is saying there's still enough votes out there to possibly force a run-off. >> stacey abrams has been fighting for people her whole life. we're going to keep fighting for every voter. >> camp has 50.3% of the vote out of four million votes cast. he has a 60,000 vote lead. this has been a bitter campaign from the get-go. there's 25,000 potential votes out there, absentee and provisional votes that have yet to be counted.
