her coffee canker 200 miles. katie: traveling mug. they call it that. steve: here is mine. here is katie's. where is yours? brian: it's coming' soon. brewing as we speak. so much to talk about in terms of immigration, in terms of elections and more. steve: well, because the midterm elections are far from over. democratic election officials in florida now being sued by current florida governor rick scott, accusing them of trying to steal his election to the u.s. senate. katie: that's not the only race hitting a snag. griff jenkins is in washington, d.c. with the contests around the country still yet to be called. griff? griff: good morning, guys. here we go again to the nation's recount capital of florida. governor rick scott's lead over bill nelson appears to be narrowing out of 8 million votes scott leads by less than 18,000 or point

22%. broward, palm beach counties accusing them of rampant fraud and calling on the indictment of law enforcement to investigate. >> we won. i'm going to be the u.s. senator. i'm going to fight this all the way. we're going to do everything we can. we are looking at every legal remedy we can exercise. we're going to fight this and we are going to win. this. griff: now under florida law any race with a margin of half a percent or less automatically goes to a recount. attorney mark allies now representing nelson said we are doing this not just because it's automatic but we are doing it to win. and in the race for governor there, also in the razor. desantis leads gillum by 36,000 votes. gillum who conceded the race to desantis indicated through his lawyers that they're also gearing up for a fight.

now, florida has 67 counties, they all have until noon tomorrow to submit their unofficial vote totals. one thing is for sure. it's good to be an attorney for election law in florida in november. guys? brian: thanks, griff. you are not kidding especially if you are mark elias. he says he is out to win an election for nelson. oh, isn't that nice? mark elias the same one for perkins couey, same one who hired fusion gps. who hired christopher steele? are there any other organizations left in florida or is it all about marc elines again? >elias again? katie: a number of lawyers are going to florida many pointing out for the recount. here we go. steve: this the is reason that rick scott has sued palm beach and broward county. suddenly, mysteriously, broward county is finding more ballots. katie: all of a sudden. steve: as griff just said, you know, of the 8 million votes cast in florida over

the last month or so with early voting and, of course, on tuesday, they are can you recollectly just about 17,000 votes apart. and what is curious as well is that apparently 24,700 voted for governor in florida in that county, but did not vote for senate. so, in other words, they thought, okay, i'm going to vote for the gillum or desantis race but i'm not going to vote in the scott and nelson race. brian: do you know why? they are saying that the senate ballot punch, whatever they are using, was down at the bottom of the ballot. and they are going to sue because they don't like the way -- they thought the ballot was unfair to the voter. that's what they are going to find some type of legal remedy for. katie: rick scott has issued this lawsuit. president trump is paying attention to this and tweeting law enforcement is looking into another big corruption scandal having to do with election fraud in broward and palm beach. florida voted for rick scott so he, i assume, has has

contacted the department of justice and attorneys over there to look what is going on in florida. steve: he has called in the florida police to do just that. the highway patrol, et cetera. rick scott in his lawsuit actually singled out brenda snipes who is the county board of supervisors' head down there in broward county and marco rubio says look, she and her office have a history of not doing the right thing when it comes to counting votes. watch. >> they healed press conference and said we are not just here to have a recount. we are here to win. look, we have procedures in the law for close elections and recounts. i have no problem with any of that my problem is this is focused on two counties and in particular one county. so let me use an example. bay county, florida, where panama city is, was hit by a category 4 hurricane about four weeks to the day of this election. they were without power. they did all their ballots, submitted them on time.

they were done basically on election night. problem number two is, we don't know how many votes they have. either they don't know or they won't tell anybody how many ballots are left to count and so forth. steve: senator rubio in a series of tweets yesterday said the courts found improperly handled votes and destroyed ballots in 2016 in violation of state law and federal law. and so you have got that as a background as they are mysteriously finding more votes. katie: other issue here in terms of legal problem is the early voting numbers that were in on sunday were -- they are counted on tuesday by florida law standards. and here we are getting to the weekend and those early totals are still being counted in broward county. steve: they were busy. katie: very busy. brian: you have some power in florida. when you see marco rubio that exercised. he is not known as a fire brand orsonizationalist. he sees something going very, very wrong.

fox gave scott this win. desantis has the win, too. we do not know if gillum is going to rescind his concession speech and go back. but it's not even up to gillum if it's so close. steve: it's automatic. brian: go to machine so close and then go by hand. katie: numbers on recounting, two candidates within .25 points of each other automatic machine count with a margin of 2.5 it is a hand recount. steve: go back to 2001, the difference when it came to gore vs. bush, it was just, what, 500 votes? here we are talking tens of thousands. but, nonetheless, some mystery revolving around this. brian: they cut it in half since election day. i don't know what's going on. president of the united states knows that the caravan is getting closer. there is another one behind that and another one behind that we also know that 1,000 are coming to our border on a daily basis. and they are all claiming some form of amnesty trying

to get in -- asylum, without going through the normal immigration process. he is taking action. steve: the department of justice and homeland security going to look at new measures that if you enter the country illegally, in other words, if you enter between one of the ports, you know where the ports are that's where the guards are if you enter the country illegally, you cannot ask for asylum. apparently the rule change is expected to be published in the federal register later today and of course you can expect quick legal challenges. katie: white house released numbers yesterday they made the point they are trying to cut down on people crossing the border at every single place and turning themselves in to customs and border protection and border patrol and claiming asylum. they are hoping this will be a orderly process they can siphon out those who truly need aid and asylum and those who don't based on the number of asylum cases that get thrown out.

brian: under these current changes if this is indeed upheld and most legal experts say executive order is going to do it. migrants cross illegally would be ineligible for asylum. could still be spared by deportation by qualifying for a lesser status by removal present them from ever becoming naturalized citizens or going through the green card process. there is still something in there that they could still get in for, but this is also supposed to be a deterrent. spread the word central and south america even though things aren't great there, they have never been great there it's not that things are that bad now. the signal was sent to those areas, not to mexico that it's okay to come in. and that has happened since senator feinstein sponsored law passed in 2008 and passed in 2009. you have got to send a message back it's not okay. the u.n. is sending buses to get these caravans up to mexico city. how unbelievable is that?

in 2016 in 2020? let's ask washington examiner columnist kristen soltis anderson. you knocked it down to four signs that trump could win in 2020. first off, number one, his ability to turn out the base. we pretty much saw that didn't we? >> yeah, typicfully these midterms, incumbent presidents have a challenge convincing their voters to think about hey my name is on the ballot. even though it's not there you can't check a box that says i'm voting for trump, turn out to support me. this was something that barack obama was never able really able to do. he was able to win re-election. both of his midterms were really bad for democrats, because his base was really about him and not the party. donald trump has persuaded his base look have you got to turn out even when i'm not on the ballot which portends will he be able to get his base two years from now. brian: has a shot better than he did this time.

ohio and florida still look winnable. in ohio they have a governor who is republican again and looks like they had one we thought in florida, too. you like what you saw in those two key states? >> yeah. i think especially, you know, if you take a look at ohio. they reelected their democratic senator, so can you still argue that ohio is a swing state. but, in the last presidential election, ohio and texas voted about the same, almost 10 points for donald trump. now, whether that says more about is texas becoming a swing state or is ohio pretty solidly red, i think the president can think of ohio as a fairly safe seat which really helps the electoral college map. brian: you say the dems have ownership now. they are no longer out on the sideline they have the gain because they have the house. >> unlike heading into this midterm whether you have a lot of americans who feel things are on the wrong track, even if they may like the president a little. if they just want change, now change can also mean throwing out the democrats again. they control one the chambers. he can also cut some of

trying to avoid the border patrol, they run to the border patrol. they wave down the border patrol come rescue us border 35 control picks them up and drops them at the trolley stop on our side of the border and says hey, see you later, come back in a year or so for your trial. that's insane. that has to stop. and all i'm calling for and all the people of san diego are calling for is order at the border. not cut it off totally. order at the border. and that's what trump's policy does. it's great. katie: we want to get to a city up north. you are down south in southern california. up in san francisco they voted to implement a new tax on businesses they say will go to fund the homeless population. they already spent 250,000 to $300 million per year. they are going to double that with this new tax. a lot of people are saying it's unfair, including jack dorsey who is in charge of twitter. what is your response to san diego raising taxes on the job creators? >> it's very simple. if you tax something, you get less of it, if you

subsidize something you get more of it. in this case we are taxing businesses you will get less economic growth and subsidizing homelessness and you will get more homelessness. the reason this effects the rest of the country becoming pretty oppressive in california with the highest taxes, all the taxes the highest taxes in the country. people are leaving, businesses are leaving california and moving to places like texas. the problem is they are taking the same failed policies with them to texas. and they are going to screw up texas just like they have screwed up california. so we were just talking about the migrant caravan coming from the south and mexico. i'm here to tell the rest of the country, there is a caravan coming from the west and full of disgruntled californians who haven't learned their lesson and coming to invade your red state and turn it blue. we need to build another wall to keep all the californians out of texas and georgia. katie: what about you? do you get to go to texas? >> i'm here for the fight now in california, right? someone has to stay behind. steve: you are there for the weather. >> that, too.

steve: with this particular initiative as you know, mike, it has been, the chamber of commerce and twitter, they have teamed up against the largest employer in san francisco, which is sales force. jack dorsey at jack as he is known at twitter he tweeted this out. we are happy to pay our taxes. we just wants to be treated fair whether i respect to our peer companies many of whom are two to 10 times larger than us. otherwise we don't know how to practically grow in the city. that's heart breaking for us who love san francisco and wants to help continue to build it there you have one of the biggest influencers in the world saying this is a bad idea. >> again, it's saying that they are going to move somewhere else, right? there is a lot of reasons for homelessness, right? we can talk about that another day. what's frustrating is whether you have politicians who come up with the same one size fits all solution which is take homeless people and put them behind a door without addressing the root causes of it and tax and spend more money. that's the solution to every

property breaking in someone's door that's actually a violent trespass and that's exactly what they were doing which is why the police are looking into it. brian: he nights off and had nothing to do with the fact that there were protests the night before. even though tucker is on vacation. he called in to his show. >> what's it like to find out that your wife is hiding in the pantry because people are threatening her? i mean, it's upsetting. i have characterized the antifa people and people like them as protesters. but they are not. i mean, they weren't protesting anything. they weren't trying to change my mind or advocate for a position. they were threatening my family to get me to stop talking. our conversation publicly has been hijacked by extremists like this and i worry that if we don't stand up to them and say i'm sorry, it's not -- this is not allowed. you can't threaten people into silence. the rest of us are very passive in the face of this. i think one of the people screaming at my wife last night has been a guest on our show. i can't prove that we're gonna find out. if you have something to say, you are always welcome

him and his family are completely unacceptable. we as a nation have become far too intolerant of different points of view. recent events across our country clearly highlight the need for more civil, respectful and inclusive national conversation. those of us in the media and in politics bear a special obligation to all americans to find common ground. there is common ground. it's not -- it's not just people at fox denouncing this. it's fox rivals. it's all sortsdz of people. steven colbert put out a statement fighting tucker carlson's idea is an american right. targeting his home and terrorizing his family is an act of monstrous cowardice. obviously don't do this but also take no pleasure in it happening. feeding monsters just make more monsters. brian: it hurts your case. it galvanizes people who normally would be in your corner or share your beliefs against you because you just now went violent. you went to intimidation and

battlefield we need pain control out on the battlefield. what was happening they had these vials and they were injecting immediately but it wasn't necessarily working that well. now we have this dissolvable tablets that they will put in someone's mouth and gets right into their system gives them immediate pain control by the way fast immediate pain crowl on the battlefield has a less of a chance having ptsd in the long run for those injured. in that sense, i like this idea. most people would think we need a new opioid like we need a hole in the head and i get that we still haven't gotten a grip on our opioid crisis. when you can get a bag on the heroin for $5 but you still have to pay anywhere from 150 to $1,500 for the reversible medication. unless we can narrow that, we are not tipping the balance. we need to continue making sure that we are treating those that are addicted while also making sure that provide adequate pain control. katie: people who hear this headline about a new opioid and get concerned about contributing to the crisis. can you talk about what's driving the crisis and why this may not be part of it

as the prompter moves. sued by governor rick scott accused of trying to steal this election to the senate and also the governor's race too is up in the air. katie: not the only race hitting a snag. steve: griff jenkins is live in washington, d.c. with the contests around the country still yet to be called. griff, down in florida, it's very curious because in broward county, according to the papers down there, they are mysteriously finding more votes three days after the vote count was supposed to be done. >> yeah yeah, good morning. steven for turkey, mistletoe and hanging chads down there. lead appears to be narrowing out of 8 million votes scott leads by less than 18,000 votes. and, as bill nelson gears up for a fight, scott is suing the election supervisors in not only broward but also palm beach counties accusing them of rampant fraud and calling on the florida department of law enforcement to investigate.

was losing the dialogue and the message. that's why he called the press conference last night about 8:15 eastern time. listen, i'm governor of this state. i know exactly what's going on. there is a problem in broward county. there is a problem with the woman there in particular, brenda snipes. she is in 2016 she posted the elections results before the polls were actually closed. she got in trouble for throwing away some ballots. katie: destroying ballots. brian: broward county is the problem again. steve: rick scott wants to know how many ballots have been counted and how many more votes remain uncounted? i mean, this is very simple. just say okay. this is how many we have done. this is how many are left. because, some of the counties are going look, we finished two days ago. and one of the counties had a big hurricane. katie: big question is how many votes have been cast? if they can't answer that question even though they keep coming back hour by hour overnight with new vote totals but they won't say what the total is and all of the sudden the vote totals

keep ticking in the direction of bill nelson with a goal of triggering a recount either by hand or by machine. steve: well, broward county is largely democratic and so that is good for the democrats. president of the united states weighed in on twitter. he said. this. law enforcement is looking into another big corruption scandal having to do with election fraud in #broward and palm beach county, florida. florida voted for rick scott. brian: they did. fox gave him, you know, you worked election night. he won the state. his 30,000 vote margin roughly is now down to 15 to 17. and he is just watching it dwindle. senator nelson did not give. in senator scott immediately -- governor scott immediately came back and said it's not a great way to end your career and now all of a sudden he is lawyered up. among the democrats who landed in town is this marc elias. steve: lawyer. >> same guy from perkins couey who hired g.p.s. fusion gps who hired christopher steele.

elias, a long-term clinton attorney saying i'm not here to get justice. i'm here to get this election for nelson. katie: other implication here is ron desantis who won the governor's race against andrew gillum the tallahassee mayor. andrew gillum conceded that race to ron desantis on tuesday night now saying he may rescind that concession as these numbers get closer not just for bill nelson against rick scott but for gillum against ron desantis. steve: curiously, what they have netsed is that 24700 voted for governor but did not vote for senate. it's like were they just in a hurry and went in and marked the governor thing and that's it? i have looked online, the florida ballot was lengthy, two pages in some cases with a lot of questions. so, people just went in, stood in line for an hour, did one and then left? a lot of questions about that. and the fact that suddenly mysteriously more ballots are showing up in broward county. katie: under florida law they were supposed to be in by tuesday.

all the early voting was supposed to be counted by tuesday it is now friday morning. steve: it is and we are talking about it. meanwhile, the administration as well looking to crack down on migrants coming into this country who have used the explanation they're coming to the country to ask for asylum. and new measures, if you do not enter the country at a port of entry, you know, where the guards are, then you will be viewed to be in the country illegally and you will not be able to ask for asylum. katie: president trump held the announcement at the white house in the roosevelt room to talk about how they were going to implement this new policy of only taking asylum claims at the ports of entry. kirsten nielsen explained why she is doing. this:

brian: so, here we go. this is what the president is doing through executive order. is he getting push back already from democrats and the person implementing this order is the acting new attorney general. so, there is some addendums to this. these people who cross illegally, illegal aliens could be spared deportation by qualifying for a lesser status called withholding of removal. that does not provide a path to a green card or citizenship but they still might get a chance to stay. steve: immigrant groups are already talking about a legal challenge. they say american laws clearly extend asylum protections to anyone who reaches american soil. they say this business about you got to be at a port that's something they're going to fight it out in the courts. katie: earlier in the hour we had mike slart a talk radio host in san diego on. he had some thoughts about this. >> absolute common sense has

cleveland. so we were happy to see him. steve: mike, it's been kind of complicated between the white house and the governor's house there in ohio in the last couple of years because the president, a republican, the governor there john kasich a republican, he didn't even show up to the president's nomination at the convention in ohio, so they have had a rotten relationship for the last two years. >> i kind of joke that the only thing that governor kasich and the president agree upon is mike dewine. they both endorsed me. governor kasich had a nice endorsement on friday before the election. and the president came in on the monday. i appreciated both of them. katie: mr. divine, i know you haven't taken your seat yet in the governor's mansion, however, 2020 is right around the corner. what is state of ohio politics as you see it for the next two years. >> we have come a long way in ohio. we have to build, continue to build upon that our economy is moving forward.

i think the tax cut, the president's tax cut, congress' tax cut made a big difference. you know, i think we have had good republican administration for the last 8 years. what we need to do is build upon that we have a couple of challenges. we have a drug problem. as many states do. we also have a skills gap for some 21st century jobs. so, john husted, my running mate and i are going to focus on those two things, the most important things that we can focus on. brian: your state is in good shape overall compared to the other 49. what about the trade deals? these sanctions, these tariffs, excuse me, and the trade deals, what would you -- what would you urge the president to do on this? >> well, i think the people of ohio generally support the president in trying to get better deals. i think there is a feeling that we have been run over in the past. to some extent. you know, we don't want a trade war. buff we want to get these other country's attention.

lost. so, what similarities does this have to the infamous 2,000 recount between president bush and al gore? here to react is brad blakeman former deputy assistant to president george w. bush and h.w. bush and advisor to the bush-cheney campaign. brad, what's the difference between these two recounts and one big recount for president? >> in 2,000 and this election, it's numbers. it was 537 votes in the state of florida. the millions of votes cast in 2,000. now it's like 30,000 votes. but it's always the two counties, the democratic strong holds that seem to have the most shenanigans played. that's broward and palm beach county. i saw it during the 2,000 recount. it's basically telling the campaigns how many votes do you need as opposed to how many votes do we have? and they find votes in the trunks of carses. they find them in hallways. they don't use the -- they use an expedited voting system. which is totally subjective.
