"outnumbered" starts now. >> melissa: fox news alert, the midterms may be over, but the show down is just beginning for the period over to high stakes races. now florida governor and senate candidate, rick scott, is filing lawsuits accusing top election officials in two heavily democratic counties of trying to steal the election as a result tighten up there. a mandatory recount appears imminent in that contest, and in florida's gubernatorial race between republican ron desantis and democrat andrew gillum. this is to is "outnumbered." i melissa francis. here today's harris faulkner,

fox business network anchor dagen mcdowell, national security analyst morgan ortagus, and joining us on the couch today, christopher bedford. editor in chief of "the daily caller" news foundation. he is outnumbered. >> harris: qaddafi. happy friday. did you ever think he was going to get here? >> >> chris: happy friday. i think so. i love elections. there have been highs and lows. >> melissa: it is unending. as the midterms going to overtime, you can't help to think back to 2000 and the battle of the hanging chad's. president trump says law-enforcement is now looking into possible election fraud. here he is as he left for paris today. >> all of a sudden, they are fronting votes out of nowhere. rick scott, who won by -- it was close, but he won by a comfortable margin. every couple of hours it goes down a little bit. what's going on in florida is a disgrace. go down and see what happened

over the last period of time -- ten years. take a look at broward county. take a look at the total dishonesty of what happened with respect to broward county. >> melissa: last night, top senate democrats chuck schumer tweeting "in a democracy, no one, not even the president, can prevent the lawful counting of votes. will not allow him or anyone else to steal this election." phil keating's live in miami with the latest. >> melissa, in the sunshine state the votes are still being counted. the final results are unofficial results by each county. still not done it. here we are, already headed to the court. three hours from now, in downtown fort lauderdale, lawyers for the two candidates will be facing off in a specially called emergency hearing. all of this to deal with a lawsuit filed last night by republican governor rick scott against the supervisors of elections in broward and palm beach counties, two of

florida's democratic stronghold. he is accusing them of rampant fraud and incompetence. democratic senator bill nelson has provisional and mail-in ballots added to the total towels on wednesday and thursda thursday. his lead from thursday night had shrunk to 15,000 votes. that is .18 of 1%. >> they found 78,000 78,002 voe election day, two days ago. in broward county. 15,000 more votes in palm beach. we don't know how many more votes they are going to come up with, but it sure appears they're going to keep finding as many votes as it takes to try and win this election. i have act the law enforcement do an immediate of elicitation. we are filing lawsuits. we will fight this, and we will win. >> any race decided by half a percentage point goes into an automatic recount. this race is well within that threshold. boards in each county met again

the yesterday, and will again today, to finish tabulating outstanding provisional and mail-in ballots which have not been validated and i would to the totals yet, or haven't been discarded. in broward county last night, things got heated. voices were raised as republicans accused democrats of trying to change the outcome of tuesday's election. democrats are countering that as preposterous, that this is simply the process in florida and it's called democracy. a spokesman said this -- "the goal is to see that although votes in florida are counted, and counted accurately." rick scott's action appears to be politically motivated and bored out of desperation." the governor's race also appears to have an automatic recount. as of now, ron desantis' tuesday night lead has narrowed to 36,000 votes, or .44 of 1%. that gives gillum a reason to unconceived his concession speech.

in a call from the media this morning, the recount attorney for the senator nelson team told generalist on the phone that this morning the nelson team has now fired its own lawsuit in the northern district of florida, alleging potential voter disenfranchisement of their as to how the election officials were matching or on matching signatures on mail in and provisional ballots. all of this, of course, do in tallahassee from every county by noon tomorrow. we will then read all the numbers, add them up. as expected -- and he expects it himself -- he will order that mandatory recount to commence for these two races. sweetie what a mess. phil keating, think of that before this even started, broward county was under scrutiny. before the election even happen. if you look in the "miami herald," they are writing about this on november 2nd, focusing on the broward election supervisor, who had just faced a court ruling in may that she had illegally destroyed ballots from

2016 in a congressional race there. now 78,000 ballots have shown up. rick scott has asked to even know the total we are coming to question like they are to that. they are very defensive this point about what is going on in that county. it comes down to broward a lot. there's a lot of voters there. >> chris: chuck schumer says nobody, not even the president, but can make sure votes aren't counted. he's obviously never heard of her. after lawsuit was lost by democrats, we he thought he had been treated unfairly prayed he ran against debbie wasserman schultz in the primary. to have a recount. during that recount, she signed a document saying these ballads are okay to destroy. there is no court out of it. that's why they had election supervisors visiting, like a sub-saharan country that has election problems. if the deal with that in

broward county. >> melissa: that's was amazing. everything you are talking about happened before the selection. lo and behold, the focus comes back to the same problems in this area. >> harris: while phil keating was supporting, i was going back to my notes be really familiar with the words "over vote" and "underfoot." remember, back in 2000, gore, bush, the recount -- i don't know what role he was playing in terms of these, but, yes. the under vote is what they are concerned with again. did something get missed? in machinery? were votes left out? where their votes left at a school in a back room? there is some really interesting stuff going on across more than one state. you've got georgia, too, that is in the mix, too. you ask where people are doubtful that their vote counts. i say that they may be doubtful that it's counted. this is problematic.

backyard. one of the point he made is that the counties that have a category 4 hurricane hit them still managed to get their votes in on time. what's the excuse for broward and palm beach? i would just say, finally, the law in florida states that the ballots have to be -- the supervisor of elections have to show these ballads within 30 minutes, i believe, of the end of the election. where have these -- not tens, not thousands -- where have these tens of thousands of votes been? >> harris: can i read a marco rubio tweet really quickly? >> not very comforting florida voters that the broward county supervisor has in the past one. this is according to senator rubio on his twitter feed. legally destroyed ballots, which is what you were talking about. a secretly opened mail ballots. sent a voters to many valid pas and left some questions off the ballot. constitutional issues, off the ballot. that's according to marco rubio.

>> melissa: the "miami herald" went into great detail about all the events you're talking about. that's not opinion. this is the history of this county. what has gone on in this area. dagen, the other side says "well, sometimes it takes time to count the votes. if people mailed them in or whatever happen, every vote counts." there are charges that republicans come in this case, are against counting every vote. >> dagen: broward county is having problems compared to every other county in the state of florida. based on what we know. >> melissa: except for palm beach. palm beach is the everyone. >> dagen: the point i was going to make -- as of 8:00 p.m. last night, the same time the governor scott summoned the reporters to the mansion. i'm reading from a "miami herald." broward county was the only one of the counties that had not reported to the state that it had completed its tabulation of early votes. early voting ended on sunday in broward county. the elections website, broward county's elections

website, was updated to indicate that it was completed -- i completed that count of mail votes. this is before 8:00 p.m. last night. that wasn't reflected on the state website. the issue here is that you have an individual who is the elected supervisor in broward county, who was there -- she says it's a mistake, i say malfeasance, in terms of the destruction of these ballots. >> chris: how many mistakes does it take? >> dagen: to the point that the state was standing people in to observe what's going on in the selection the season. >> melissa: and they still can't count them all. they still can't get the results and prove that's some amazing to me, all this focus was already on this county before election day. and here we are. >> morgan: both of these races are, i think, two of the most important that happened on tuesday. especially, here's why, now -- republicans in the senate thought that before we went into

the florida and arizona recount that we had a pretty comfortable margin in the senate to finally get some things done. to get some judges 'confirmations through. to get the people through. if we were to lose -- which is not projecting well and arizona, clearly -- if we were to lose florida and arizona, that is chipping away at that comfortable position that senate leadership, a republican leadership, felt they were in. number two, when you look at florida and georgia, georgia has positionally been a red sea. you've got governor recounts in both of those states. but georgia's turn is becoming less red, moving more purple. going into 2020, this is why the recount is important. going into 2020, both party machines know that having a governor in florida and in georgia, republican or democrat democrat -- >> dagen: to harris' point, this is people's votes not getting counted. mismanagement. >> harris: and somehow votes being found. that's what i want to talk about. how do you find -- and i know

that mistakes happen. but how do you find votes? what kind of confidence does that give the american voter? we are looking at a midterm election where $5 billion were spent. $5 billion. we could have fed some people, we have done a whole lot of $5 million. what we got was friday afternoon -- i just got a note from the election officials and arizona. we all did. it was a press release note. that we could be looking at next week before we know what the vote count is. >> chris: when we were watching closely in florida, when we got to the point where rick scott was 50,000 votes ahead, we said "this is look like it's going to go to rick scott. they will be able to find the votes in broward county." it's important to make sure everybody's vote is counted, but we have and article with dozens of problems in broward county. that's an issue. >> melissa: i want to point out -- because this is exactly what you are seeing on the screen here right in front of you. this is outside of that

broward county election supervisor office. brenda sniped outside her office, this is a protest that is going on. as we said, there is just a lot of focus. i'm being told it's a little far for my vision to see, and they are, as well. no matter what happened here, and americans need to feel like there is fairness of the ballot box. it's one of our most basic things. every vote counts, and it only counts once. you need to have the right to vote, in order to vote. >> harris: what you are talking about is the over vote. we only know these terms really because of situations like this. that's what they call it when the machine read something, like you voted more than once. that's what we had in 2000. that's what they were trying to figure out. the problem with the hanging chad's, so and so forth. what this really speaks to the issue of, we said that we have this. we just have been election

statement that is enough is en. we will make a pass for protection for those who need it, while stopping our generosity from being abused. chris, i will ask you -- this get so emotional. if it's possible to set the emotion aside for a second, people who are sincerely coming here to seek asylum are coming because the rule of law in the country has broken down. if you like their lives are in jeopardy. if you come to another country, like ours, it's because you think the rule of law here makes you safe. >> chris: exactly, and it does. a speech he why would you, then, break the law? there's an opportunity to come to the port of entry, as opposed to crossing illegally, and presenting yourself and making a case for asylum if that's really what it is. on the economic front, we need more workers. happy to have them, but we've got to do it legally. the >> chris: is the exact opposite of what senator warren said. president trump didn't shut the door -- president trump said "here's the door." and if you are worried about

your child being subjected to sexual violence, gang violence, narcotics, trafficking, all of those things, that door is the only way to go. one of my colleagues brothers is in the border patrol. and they have plan b with them because they know the child will be subjected to sexual violence on the trip. if does make sense at all. if you want to keep your children, your wife, your daughter safe, you need to bring the men legally. instead of saying "hey, i'm here." isn't going to work. >> melissa: it puts the coyotes out of business. if people came to the door -- that's one of the big points. if you come to the door and you ask for asylum, or you apply, you put the coyotes out of business. >> harris: i think they would find a lot of ways to be in business in a lot of different ways. many of them, as you say, are resourceful in that way. i will say this, though, melissa -- we know from our own reporting exactly why they don't want to knock on the door and put in a claim of asylum.

because many of these men traveling -- not all, but money -- i've been very open about the fact that "we probably wouldn't meet all the criteria." some of them -- a smaller number as far as we know from our own reporting creed william la jeunesse traveling with the caravan -- some of them have been as bold to say "we will take matters into our own hands and enter illegally." they will look for porous entry points. there were fewer of today, because of the barbed wire that our military has started to put up in no gallus and other places. that is helping create having a presence there was more border patrol, as a of the military bs them up, all of it helps. you still have, at last estimate, 20,000 people. >> chris: mostly men, to your point. >> harris: we only know that from our own reporting. that's not guesswork. we have people in with the caravan. >> melissa: dagen, for the

president. >> harris: why do you think they didn't? >> dagen: i think they are weak. i think the people in the house ran every two years. i don't think they are willing to stand up for what's right many instances. i just want to point out, there are 768,000 pending cases right now in terms of the backlog on people who have it come into this country and are expected to apply for asylum pre100,000 immigrants traveling as families were caught crossing the board in the last year. that's a record number. >> harris: can i ask you a question, morgan? we seen a number of men in the caravan. tiny babies, families. people making -- >> morgan: heartbreaking. this b when they've done it for more than a century. people coming for the beacon of light. how can we get beyond? you've worked for other and ministrations. had we get beyond the point we are separating of the border? can't some of these other countries work with us before the people get to the border? so that we can put some things

together? >> morgan: i think that's an excellent point. first of all, i would say that instead of going for some kind of competence of immigration plan, when we come in, the president can do a simple deal. trade for the wall funding he wants. let's get some short-term wins. when you look at other countries, the administration has been pretty complement tree of mexico and how it worked with us. i know you and i talked about this before on the show. we have a problem of failed states and central america. we have been, from the u.s. perspective, former foreign aid perspective, we been throwing monies of these countries for decades. we have dealt with failed states in iraq and afghanistan, for example, very differently than we did in central american. we need to think of radical solutions of how we deal with central america, latin america. we haven't really paid attention to this region since the reagan administration in the way that we should. it's time for radical change about how we do with failed and central america. the two it brings back to that

first point, the very definition of somebody come here seeking asylum is because the country their income of the rule of law, has broken down. they no longer feel safe. it is the rule of law here in this country that gives us our freedom and allows us to feel safe. we can't let that be broken down. they wouldn't want to come either. >> harris: many of them are coming because they don't have financial wherewithal. and asylum doesn't work that we. >> melissa: we need workers, also buried there is to do it. some house democrats are poorly worried that they could face consequences if they don't support nancy pelosi for house speaker. and a small group are banding together to create a support system. whether pelosi helps or hurts democrats, as they look to recharge the party a head of the 2020 election. we will debate. ♪ are you a veteran, own a home, and need cash?

mobility. at least eight incoming democrat members have also distanced themselves from pelosi on the campaign trail." or expressed a desire to change. this is democrat congressman tim ryan who challenge pelosi and 2016. she has become a polarizing figure, and the party needs to rebuild the blue wall in places like the midwest. so fascinating to see this playing out. still, we haven't seen one person step up. i have some thoughts on that. what are yours? >> chris: tim ryan was interviewed by kennedy last night. when she brought up "when will you overthrow the queen?" he got so comfortable, laughed so nervously. it was so funny. >> harris: the overthrow, or the fact that she's the queen? >> chris: at the overthrow. people like to think -- he hasn't so far, but they run on nancy pelosi because they've got a lot of conservative voters. she is extremely unpopular outside of san francisco and los angeles. when they get to d.c., she's in charge. they need a support system.
