never came home. while in the same county, not one but two wild fires have thousands of people on the run. and in northern california, new reporting. a fire has killed five, devastated a town and is threatening thousands of homes urgently. reporting begins now. we begin with reporting on breaking news in south florida. an emergency hearing is about to start at any moment now. the state's senate race possibly headed for a recount. at least check, the republican governor, rick scott, was leading the democratic senator bill nelson in that senate race by less than half of a percentage point. under florida law, a half a point triggers an all recount. in the race for governor, officials say the republican ron

desantis lead over andrew gillum is now below a half a percentage point. with gillum's campaign point says they're getting ready for the possible recount. florida is not the only state with races up for grabs. team fox coverage to start the hour. dan springer on the neck and neck battle in arizona. steve harrigan reporting on the georgia governor's race. first to phil keating in south florida. phil? >> this 3:00 p.m. hearing aiming to resolve and deal with the fraud alleging laud filed last night but governor rick scott who happens to be the republican senate candidate in this razor tight race. a similar hearing on the same issues was held in palm beach county. the judge's ruling there still pending. looking live right now inside the broward county elections canvassing board. the members are now going through all of the ballots left in broward. about 200 provisional ballots to check voter intent and see which

ones get added to the count and which ones don't. to 2000 recount, partisan sides yelling and screaming at each other of election theft. the supervisor of the state's most democrat voting county under attack defending her process. >> we ran 22 sites, we ran 14 days, we ran 12 hours, we had a big vote by mail. so don't try to turn it around to make it seem like i'm making comedy out of this. >> in every election, canvassing boards go through the provisional ballots the days after tuesday. nobody talks much about them because in most years the races are pretty much decided and not this close and critical. on "the daily briefing" scott targeted broward county. >> my obligation as governor to make sure we have free and fair

elections. i want everybody to vote but it has to -- can't be any fraud. has the be free and fair. >> how do you come up with 78,000 more votes in one county? no other county has this problem. >> now, the next deadline for all 67 supervisors of elections in the state of florida is noon tomorrow. all the results must be submitted to the secretary of state's office. that's what's going to happen. the secretary of state will go over those numbers and then in all likelihood order an automatic machine recount for the senate race and the governor's race in florida and most of the county supervisors of elections are indicating their staff is prepared for saturday afternoon to start the process of feeding the tabulation machines one more time, shep. >> shepard: phil keating live. georgia as i reported, the democrat stacey abrams is still

fighting to become the first block governor in u.s. history. she said there's enough uncounted ballots to force a run-off. brian kemp has declared himself the winner. steve harrigan reporting live from atlanta. >> shepard, you can get a sense of confusion when you talk to georgia voters about who has won the governor's race in this state. on the one hand, you have brian kemp who says he has won the race. you can see him on television meeting with his transition officials and 11:00 a.m., we had a tweet from the president that said brian kemp ran a great race in georgia. he won. it's time to move on. and yet the vote itself has not been certified in all georgia counties. right now kemp stands with 50.3% of the vote. his democratic opponent, stacy abrams says there's another uncounted votes to drive that below 50%. if that were to happen, that would mean a run-off vote. the first of multiple lawsuits by the abrams camp has been launched to try to count those

provisional votes. abrams says this is part of a bigger struggle. she wrote on twitter, it's about fighting for every georgian that cast a ballot with a promise that their vote would count. there could be up to 25,000 uncounted provisional votes out there. the kemp team has dismissed the lawsuits as trivial and they say the democrats are just trying to steal the election through the court system. shepard? >> shepard: steve harrigan reporting live from georgia. in arizona, the democratic candidate for senate taking a narrow lead for the first time in a race that is still too close to call. the judge is the starting to hear arguments in a lawsuit from the gop side. dan springer reporting live from phoenix. >> shep, we'll got a lot more votes later on today. so far only a few thousand have trickled in. they haven't changed the lead. kirsten sinema surged into the lead and appears to be in good shape to turn this senate seat in arizona blue. the key is what she did yesterday in maricopa county.

she extended her lead by 27,000 votes, her lead now 6,000 votes but nearly all of the almost 500,000 votes yet to be counted are here in maricopa. the sinema camp released a statement saying trends will continue in kirsten's direction and she will be arizona's next senator. martha mcsally. she's just as confident that the trend will change back in her direction. there's still 500,000 votes to count. nearly all are in maricopa. that's where legal drama is brewing. this were several ballots that the signatures department match. the republican party chairman accused the reporter, a democrat of destroying ed by mixing disputed in ballots in with the others.

the statement reads that adrian fontez put himself above the law and the judicial process. such a man cannot be trusted in arizona. we reached out to the recorder's office for a comment and have not heard back. we should hear more from their office and democratic party at that 2:00 court hearing. shep? >> shepard: dan springer reporting live from phoenix. president trump on his controversial move to replace his attorney general and what the president says he needs from democrats. brand new this hour, a challenge to the president's latest move on immigration. a legal challenge as our reporting continues on this friday afternoon.

his problems with rosenstein in the past. shep? >> shepard: just in, the aclu is suing to block president trump's order that denies asylum to migrants if they cross the border without documentation. this would be a direct challenge and not unexpected. >> no, not unexpected. what is not unexpected, this was filed in san francisco, which just happens to be in the jurisdiction of the ninth circuit court of appeals which yesterday ruled against the president on the deferred action for childhood arrivals program. the president saying he signed the executive proclamation to change the rules regarding asylum and the people now who enter the country illegally would no longer be able to claim asylum. listen here. >> we need some votes from the democrats or we need support from the democrats and hopefully they see what is going on. the republican this is happening is we've created such a

successful country economically that everybody is flooding in to our country or they want to. but we're stopping them at the border. that's why we have our great military there. >> so the presidential proclamation means that no longer can a person claim asylum. they would have to do it through a port of entry. not likely in the broader contest that the president will get a lot of support from democrats under his immigration proposal. they might see eye to eye on daca. but democrats will never go for the wall. by the way, shep, the president seeing it as a good thing that the ninth circuit court of appeals turned down his executive order at least ruled against his executive order to end the deferred action for childhood action program because it now kicks to it the supreme court where the president has a comfort 5-4 conservative majority. shep? >> shepard: john roberts reporting from paris.

breaking news now. this is the emergency hearing on the possibility of a recount in broward county, florida. this is the spot where they have begun the process. they found more votes. now the hearing is beginning. live coverage. listen. >> i don't know if you had any objection to them intervening with regards to making that argument. >> briefly, your honor, yes. because the intervention would be a side show, the very ney xhur of the action -- nature of the action. access to if information that we think we're entitled to. it has nothing to do with canvassing votes. the information that the elections supervisor did not provide is required that she has. specifically 1.2043.

she should have already submitted that information to the department of state. that information should be readily available. this should not be a drain on resources and interfere with the supervisor of elections. i want to end with this complaint to narrowly teller what we're thinking, this has nothing to do about counting votes or sections of votes to decide whether they're in or out, this is simple information about how many votes should be counted, how many are counted and the daily reports required by statute to provide. >> your honor, they have -- >> the letter -- [inaudibl [inaudible] >> the statute says they should be provided under reasonable circumstances, not the next day when they send a letter by lawsuit and having a hearing in

the court during an election, to have the supervisor stop -- we have a definite interest in that -- >> sir -- i will grant the motion to intervene. >> thank you, your honor. >> thank you, your honor. >> so we argued about the substance of our complaints and the immediate request for a hearing. i want to address two quick points outside of the complaint. the fact that the statute provides public access to that information such as this is unquestioned. chapter 119 references ballots and ballot's information within what is permitted in the record. in fact, this morning, we had a case in palm beach county in which the democratic party brought and it was undisputed this information is a public record. >> shepard: let's get some context on this hearing which is expected to be a little bit in the weeds.

"fox news sunday" anchor chris wallace is here. can you put this in context? >> in general i can. rick scott, the governor of florida, that is term limited and running for the u.s. senate is say they keep counting votes in broward county and in palm beach county. his margin, which was 50,000 is now down to 15,000 since i collection night and he says the election officials in those two counties won't even tell us how many votes are out there. i guess the argument is we would like to note what the total universe of votes is even before they're counted so we don't have this constant erosion and more votes they're alleges just showing up and appearing. they're saying under state regulations, they have the right to know how many total votes are out there even before they're counted. >> shepard: the other side is saying it's not appropriate nor the governor to exercise his powers over such a matter when

he is a party to the event. >> yeah, obviously this is before a court now. so the judge is going to decide what to do. of course, to a certain degree, a lot of this may with settled tomorrow because all counties by law are forced to report to the state election board what their tally is by this saturday afternoon the tuesday of the election. but you know, we saw this in florida back in 2000. as long as you have a lead, you have an advantage. if the other side gets the lead, then it's harder to reverse that. so i suspect part of what you're seeing here is that rick scott is saying, you know, this 50,000 vote lead is now already eroded to 15,000. who knows what happens over the next 24 hours. he's trying to intervene to the degree that he's able to before he suddenly is behind in this race. >> shepard: that means big news this sunday on "fox news sunday." a couple of important guests. out of time.

he didn't come home last night. i don't want prayers or thoughts, i want gun control and i hope to god nobody else sends me any more prayers. i want gun control. no more guns. >> next, 20-year-old christina morisette. she worked at the front desk at borderline bar and grill. 22-year-old cody gifford kauffman. he was said to be talking with army recruiters and preparing to fulfill his dream of serving his country. his father said he adored his two little brothers and brimming with excitement for his new little sister to be born this november 29th. >> i don't know what to tell to the other people or how to console to the other people going through the same situation as i am. i'm so sorry for their loss as well.

colleague, adam housley. and 54-year-old ron helus. the ventura county sheriff sergeant that was talking to his wife when he got the call about the shooting. he rushed to the shooter and exchanged gun fire with him. he was a year away from retiring and is being called a cop's cop. >> he and the officer looked at each other and they said they heard the shots being fired and saw people screaming. people running in all directions and they said we have to go in. and finally, two friends, 21-year-old blake damen and jake dunham. they were buddies and avid off roaders. 12 amazing people that lost their lives wednesday night. they will not be forgotten. back to you.

people to leave their homes. two of the fires near thousand oaks, north of los angeles where the gunman killed a dozen people just two days ago. let's begin up north where fire officials say the camp fire spread overnight because of high winds. here's someone driving through that fire near paradise, california. about 80 miles north of sacramento. a man that lives there tells us his entire neighborhood is gone. his home burned to the ground. that is also where investigators say they found five people who died. that is new reporting in the last hour. the fire has reached the border of chico, which is a town of 90,000 people. to the south, the woolsey fire is burning 30 miles north and west of l.a. the entire city of malibu has

been recommended to evacuate. the fire jumped the 101 and finally the hill fire, the third fire, burning about 13 miles west of there. we have team fox coverage. first, claudia cowan reporting from paradise. >> shepard, these five people died as they were trying to escape. their bodies were found in their cars on the same road a few miles from here. it's unclear what happened. local media reports that this was a dead end street. we know the roads in and out of paradise became congested very fast. many people abandoned their cars and the flames came to town. all the smoke and ash turning the skies dark adding to the chaos. >> both of our driveways are engulfed in flames. i can feel the heat in my car as i'm driving. >> i'm numb.

i don't know what to think what will happen now. >> we don't know. >> we have nothing now. >> the fire took out the local hospital and high school and scores of businesses. 27,000 people were told to leave and evacuation orders have speed to chico, a large college town where 90,000 people are on alert. the camp fire has grown to 70,000 acres. it's 5% contained. the winds have died down considerably and a red flag warning that had been in effect for much of this week has actually been lifted. as the leading edge approaches chico, crews will get a line around the fire and hoping to boost the containment numbers and make some real problem on this deadly devastating fire, shepard. >> shepard: claudia cowan reporting. south to jeff paul reporting live in west lake village, which is about 40 miles north and west of l.a. jeff?

>> yeah, shep. you can see what the woolsey fire is doing in the hills. burning holes right now. about 14,000 acres so far burned. a lot of people holding their breath worried their home is next. the winds will pick up and seemingly one area that seems safe doesn't become so safe anymore. a lot of residents, if you take a look, they're getting out of their cars trying to see if their home is next. we saw one man out here who had to be evacuated. he had his binoculars out, just trying to get a good idea if his home was safe. he was looking through the black flames to see if his home had been -- we got some flame retardant coming through here. this is some of the actions out here that they're doing. they've had choppers overhead, dumping water, dumping retardant. the residents out here holding their breath. we spoke with one. here's what he had to say about the current situation.

>> i always used to say to people, how do you like living up there? i said we're definitely not afraid of floods. i don't think fires can get to us. so much for my prognostication, huh? >> firefighters out here as well as law enforcement telling people to get out ahead of time. what makes this particular fire and this particular area so dangerous is that there's really only one way in and one way out in certain portions. so once that fire starts sweeping through, which is very unpredictable, some folks could get trapped. they're stressing get out now while you can. this kind of stuff can be replaced, shep. >> shepard: great. thank you. let's go to mark bass in chico, california that lives in paradise. officer bass said he and his family made to it safety and went back to help others, this is video that his partner shot from a body cam. you can see the flames are literally all around them. sir, thank you for being here.

>> how are you, shep? >> i'm okay. i'm looking at the situation along route 99, which leads from sacramento up to chico. the roads closed all over the place and looks like the flames are lapping up on your city. >> they lapped right through the city. went through paradise. 6:30 a.m., before you knew it, they went through town. >> shepard: can you describe for the viewers how widespread the damage is and what you've seen? >> you know, i lived in mare dies 18 years and never seen any kind of devastation in my 26 years in law enforcement. the town is -- looks like a black zone from some sort of explosion. multiple cars, vehicle left in the roadway burned out. one car wouldn't be burned. it was -- it's an unbelievable

scene. >> shepard: do you believe most people were able to get out? >> you know, i can't say. we're up there checking addresses from people that called for assistance. we're just being able to get to those. we were doing that last night. the fire came so fast. i lived probably 15 miles from where the fire started as the crow flies. within two or three hours, it had come all the way through my neighborhood. >> shepard: has it gone across the town? for people that are familiar from sky way all over pierce and all the way over to 191, has it wiped out the whole place? >> that's affirmative, yes. starting from pence to clark to sky way and down into the canyon. it's the worst case scenario. >> i just -- we haven't been able to get the aerials to understand the full perspective

referred questions on this to president trump's outside counsel who refused to comment. there are a number of by-lines on this story. many reporters for the "wall street journal" joining us on settle. the point of this whether there was the possibility of campaign finance violations and the possibility of obstruction. >> correct. in august when michael cohen, donald trump's former lawyer, pleaded guilty, he said that he committed these two campaign finance violations at the direction of the candidate. that candidate was donald trump at the time. our question or one of our questions was, what does the direction look like and can we describe that more clearly and fully. what our reporting showed is that he was involved in on or briefed on every stage of the agreements as they played out in 2016.

after the access hollywood tape in october 2016, weeks before the election, there were behind the scenes efforts to figure out if they would play stormy daniels and there's this key moment that we highlight up top and explained later in the story that then candidate trump directs michael cohen to get it done. get the payment done and take care of it. >> shepard: that wasn't the only one. >> correct. he had been part or been aware of efforts to pay or to have ami, american media, pay karen mcdougal for her account of an affair with the candidate. >> shepard: according to the article as i remember it, this began with the then candidate donald trump speaking with david pecker, the head of this media organization saying how can you help me and my campaign. >> right. they had this meeting in august 2015 in the early days of the president's campaign.

he was just becoming a republican frontrunner. he and david pecker have a meeting in trump tower at which donald trump says to his old front, they had known him for a decade, how can you help my campaign. david pecker said among other things, i can flag for you and help prevent stories about -- if women come forward with stories alleging sexual encounters with you. >> shepard: when these woman came forward, david pecker paid to kill. in other words, gave money for their stories so that nobody else could publish them and didn't publish them themselves. >> that's how it worked with the karen mcdougal case. she was coming forward with a story and an agreement with trump and pecker helped a range -- to sell the story to american media. she appeared on some publications covers and in turn they basically killed the story and it would never go somewhere

california comes as a new fbi report shows that the number of active shooter incidents in america is going up. trace gallagher reporting live from los angeles. trace? >> the 18-page report only deals with active shooters which the fbi defines of one or more individuals attempting to kill people in a populated area. this report covers 2016, 2017 when there were 50 active shooters in 21 states. that's a dramatic increase from 2014 and 2015 when there were 40 active shooters scenarios. the big take-away and possibly the scariest part of this report is that over each of the past several years, the number of shootings has gone north. for example, in 2016, there were 20 active shooters. in 2017, there were 30 killing 221 people and wounding 722. that does not include the shooters and keep in mind that number spiked because of the las vegas shooting last october where 58 people lost their

lives. experts have not yet pinpointed why the recent trend of shooters keeps going up. back in the days of columbine, the protocol was not to engage the shooter, but now most police agencies do engage active shooters. if 2016, 2017, law enforcement officers exchanged gun fire with the shooter during 14 separate incidents, 13 officers were killed and 20 were wounded. it appears they also neutralized a number of shooters which clearly saved lives. and then there's the debate over arming citizens. that's where the information gets a bit more muddy. some experts say the numbers show it could help if the armed guardians are properly trained. there's little evidence to show that armed security guards can curtail mass shootings. all of the active shooters were males between 14-66, there's been three female shooters in
