governor rick scott announces 3 more lawsuits against officials, trying to commit voter fraud as gets off to rocky start. griff jenkins with details, good morning, griff. griff: good morning, heather, no sleep for the election officials or lawyers here in broward county, this is the election office headquarters and you see attorneys for the republicans and democrats in here. the board of canvas members is also in session, they have to be here along with court reporters but this is really the most interesting part of it. if you look in here this is the actual recount, if you will, 10 machines in there, two more being brought in. let me quickly tell you about what's happening, what's happening right now separating first before recount begins, they want to find out what number of total votes there are.
1:03 am
attorneys tell me it's over 700,000 but part of governor scott's lawsuit is against supervisor here brenda snipes in relevant to that total number of vote counts. yesterday i spoke to lead attorneys for both democrats and republicans about the supervisor here dr. brenda snipes, here is what they had to say. >> brenda snipes might be under person and might have too much, you know, dropped upon her suddenly, i don't think anyone thinks she's dishonest or lack integrity. >> there were 30 of them that people voted twice, if somebody cheats and commits a felony, should their first vote count, i don't think so, i think they ought to strike them all, welcome to sunny broward county. griff: dr. snipes and board
1:04 am
unfazed by this, governor scott on fox news sunday on chris wallace, here is what he had to say. >> somehow they came up with 93,000 votes after election night, we still don't know how they came up with. i've asked florida law enforcement to go and do investigation to find out what happened here, clearly know that judges have said that they clearly violated the law. griff: senator nelson responded in statement scott is worried that when all ballots are counted he will lose election, protect right of florida voters, all eyes on broward county, heather, one last look, the counting of these ballots, once they separate the first page i talked about, they will begin actual count but it's going to take upwards to 80, possibly 90 hours to run the machines but if that number is well over 700,000
1:05 am
when they count first pages it'll be a storm breaking out here in the next couple of days, heather. heather: what is the deadline they have to get that done? griff: so deadline is thursday 15th, hopeful that they will meet that. heather: always working, speaking of people not getting sleep. instances like democratic lawyers fight to go count votes from illegal immigrants. founder of turning point u.s. charlie kirk says he's not surprised that the development isn't getting a whole lot of media attention. >> my favorite part of the whole thing which has not received basically any media coverage lawyers from the gillum campaign and nelson campaign objected to noncitizens votes not being counted. noncitizens should not be near voting at all.
1:06 am
the lawyers for campaign said object, object and got some social media coverage yesterday but this is where this is headed, steve, there's going to be a movement to get noncitizens to allow representation in democratic elections but congressman gatez said it best, they lost, they thought they could turn florida blue, the little blue drip hit big -- heather: results of recount are due as we said thursday november 15th, griff said they hope today reach that deadline. well, breaking overnight, some other stories, two american fire pilots rescued after jet crashes into the philippine sea, navy pilot ejected because of a mechanical issue during routine exercise, rescue crews from uss

1:09 am
russia and the trump campaign. here is kellyanne conway defending whitaker during interview on fox news sunday. >> if you're talking about matt whitaker's statements as private citizen a year and a half ago when the mueller investigation started what he said on cable tv, i don't think that disqualifies somebody from being the law enforcement officer. >> conway said it would be a mistake to shut down the mueller probe because the white house has been compliant with regard to everything that was promised but that wasn't enough to stop the threats. >> i want to make this very clear, if he doesn't recuse himself, if he has any involvement in russia probe, we will find out whether he made commitments, whether he's serving as back channel to presidents or whether he's doing anything to interfere with the probe. >> keep in mind that a department of justice spokesperson added that whitaker

heather: recounting chaos is rocking florida as governor rick scott slams democratic opponent nelson for trying to, quote, steal the senate seat following new lawsuit to secure ballots and all eyes are on brau -- broward county, election swamp having sued the supervisor and won, tim canova, thank you so much for joining us, we appreciate it.
1:17 am
>> thank you. heather: tell us about your personal experience dealing with broward county specifically? >> sure, i ran for congress in democratic with debbie wasserman schultz, i had to sue brenda snipes the supervisor of election, a close ally of debbie wasserman schultz, they campaigned together just a couple of weeks ago and i sued, we won, we showed that she destroyed the ballots, that's violations of federal and criminal statutes, some are felonies, she lied to the court and really conspired with her own staff to commit the crimes. heather: so hearing you say that, this was 2016, she violated numb race state -- numerous federal states and statutes, why is she still in charge? >> that's a great question and i called on governor scott many months ago to fire her to
1:18 am
conduct a criminal investigation and not just governor scott, reached out to florida attorney general, florida department of law enforcement, the u.s. attorney could not be bothered, these are federal offenses as well and i warned at the time if they didn't prosecute her or remove her from office she would be a walking flown, moral hazard problem, she would engage in this kind of illegal activity in the future and we would lose faith and confidence in the election, all of that has come to pass. we have seen how it is for 11-year-old to rig the machines, we've had to report in weeks and debbie wasserman schultz boasted that they have many ways of rigging elections. heather: as we talk about this i want to bring up latest numbers that we have in senate race between scott and nelson,
1:19 am
difference .16% and governor of .4%. what do you think needs to happen in order to -- in order for people to be confident that their vote is counting? >> i tell you, the recount whoever comes out in losing end half of the voters will feel it's a rigged election, i think there's plenty of grounds to talk abinvalidating this election, we have seen breakdowns in the chain of custody of paper ballots, with somebody who has the record that brenda snipes to engage in these deceitful dishonest illegal activity, i say invalidate the election and have a revote, now it's more complicated to do it statewide for governor's race and senator's race but candidates in broward county have no confidence that i lost legitimately a week or two ago, we left snipes in office,
1:20 am
instead of punishing her she punished me, the vote total i got was laughable, really almost a joke, i'm not surprised, i think we should talk about invalidating the election and revoting, i think that would be the only way to have real legitimacy going forward. heather: you originally ran as of democrat because of this as a result you became independent? >> well, that's true, i reached out to the democratic party leaders in broward county, miami-dade and tallahassee and none of them would even respond to my request to join me in calling for an investigation but the republicans were no better, rick scott was just completely silence on all of this when he had the power to do something about it and to tell you the truth i wrote to every member of congress from house and senate and got no single response, the political doesn't mine stolen elections when it doesn't happen to me, when it's a progressive challenger to incumbent and now they wake up to my god we have
1:21 am
somebody conducting elections in broward county that can't be trusted. heather: we will see what happens for sure, a lot of people talking abit, maybe something that happen this time, tim, thank you so much for joining us, we appreciate it. >> thank you, heather. heather: time now is 20 minutes after the top of the hour, we light -- we will be right back

1:24 am
heather: well, president trump is known for his america first policies and and avid supporter of nationalism. >> it's the exact opposite of nationalism. nationalism is a betrayal of patriotism. heather: on a day known bringing peace and end to world war i, french president emmanuel macron
1:25 am
insults president trump and his nationalist views, joining us now to discuss macron's latest jab and the true meaning of nationalism president of security's studies crew army special forces veteran jim hanson, thank you so much for joining us on this day of all days. >> good to be with you, heather. heather: you say that macron is wrong? >> he's factually inaccurate about the meaning of nationalism i guess, opposite of betrayal of patriotism but they are extremely closely linked. patriotism is shared values for your country and nationalism is putting those into action as a governing principle. i don't understand how you could say that's the opposite it was a rude jab and unnecessary thing to do given president trump recently saying that he's a nationalist. heather: what do you think macron's reasoning would be to do this?
1:26 am
>> i think there's a feeling among some european friends that the united states with president trump's america first policies and some of the things he's done that our nationalism is a little bit too muscular and aggressive and doesn't sit vel with globalist view, they want the u.s. to be another member of global community and fall into line and trump has done things like pull out of paris climate accords and tell europeans that they need to pull weight in nato and other places, that doesn't sit well with them and this was his chance to take a jab at the president when he couldn't fight back. heather: and then you also said that patriotism deals towards ideals and values and nationalism to the country itself? >> yeah, and i think what it is that it's a question of is your country's values and is the governing principles for your country worthy of being put forth as your governing principles externally as well,
1:27 am
it's funny, criticize call for macron because the french love to push the idea that the french language should stay in diplomacy, they force nato to use it and a bunch of other things in a very nationalistic way and so to say that somehow the u.s. as the exceptional nation, as the example of individual liberty and freedom should not put our values forth and put america first is absurd, it's not a dangerous thing, it's not like we are trying to take over the world. we are simply saying that our country is good enough to stand up for. heather: since we have that up as you are speaking, white and black nationalism that is all hate, that's not what we are talking about when we are talking about america first policy. >> that's a proversion of nationalism, the idea that you would organize a state around ethnic group only, around a race only and exclude other people with hate in mind is an exact proversion of nationalism, it
1:28 am
can be used that way and the one excuse macron had was that nationalistic tendency were serving part of the cause of world war i, but the idea that that alone and that is a reason to say that nationalism is no good is absurd, it was something that he shouldn't have done and i think we can go ahead and say that nationalism by itself is a good thing. heather: all right, jim hanson, thank you so much for joining us, we appreciate it. >> good to be with you. heather: thank you for your service. >> thanks. heather: fox news alert for you, terrifying scenes as outof control wild fires claim dons os lives, firefighters in california race to go contain flames, we are live on the ground up next. ok,

heather: we are back with fox news alert for you, look at this 31 people dead more than 200 missing as trio of fires devastate california,
1:32 am
firefighters racing to try to contain them as strong winds just continue to fuel those flames. ray vief in ventura county, florida, i'm sorry, ventura county, california with the very latest, good morning, ray. >> good morning, we are standing in front of road block on highway 23, there's some power lines down just on the other side there, we weren't allowed to go any further. to give you an idea of the scale of this fire and the operation, there are nearly 7800 firefighters in the state of california trying to get blazes out, here in ventura county with the woolsey fire, last update 85,000 acres and 15% contained. firefighters are dealing with dry conditions and steep terrain but one of the biggest struggles is the wind, it's pushing the fire fast and blowing embers into areas that haven't burned including residential neighborhoods, that's why firefighters don't expect to have a full containment for
1:33 am
another 5 days, this is how ventura county chief described conditions yesterday. >> mother nature is still working against us, we saw yesterday we had lull in weather and obviously today the winds picked up and that's what we will see in the next 3 dais, flows of the wind and challenges that that causes us. >> up north in view county, campfire last update was 111,000 acres and there 29 people died and over 200 are missing in what has become the most destructive wild fire in california history, heather, we can report to you some good news, mandatory evacuations in ventura county have been lifted and residents are starting to make their way home. >> my message is stick together, people, we are a community, we are a family, please stick together, we need everybody to stick together in this, we are soldiers and survivors.
1:34 am
>> there are red flag warnings from southern california border all the way to northern california border and the wind is expected to keep up until tuesday. so it's going to be a fight. heather, back to you. heather: ray bogan, thank you so much, prayers with everybody out there in california including firefighters, let's talk about nancy pelosi, sounding confident for chances of speaker of the house. >> what is your level of confidence that you'll be the speaker to have house? >> total. >> 100%? >> 100%. i feel confident where i am and overwhelming support in my caucus that will go to the floor. heather: but it looks like most of her party isn't so sure, look at the new poll, finding more than half of more than democrats don't want her to have the job, so should the former speaker be so confident about it, here to debate democratic strategists howard franklin and former trump campaign director of data and
1:35 am
strategy matt brainer, thank you for joining us, appreciate it. >> good morning. >> good morning. heather: howard, i will start with you as democratic on board, should he have feel confident about this? >> she's a historic candidate that represents diversity that is surely missing in republican party and frankly in the year with 91 women serving in congress with long record of service, not just in the house but also as fundraiser, as a very efficient and vote counter i do believe she's got a lot of reason to expect that even some of the people who have said less than positive things about her coming back in role will ultimately vote to support her. heather: she has lead the democratic caucus for 16 years and at this point 8 sitting lawmakers or their offices said on thursday that they will oppose pelosi on the floor, two candidates that won on tuesday previously said the same thing, what do you think? >> i think my colleague here is correct, historically the
1:36 am
winning party tends to dance with the leader that got her. now it's probably not the time to go, her negative ratings are twice what the president's are, if she cared about interest, she would take time to step back, groom a successor which she has not done and allow fresh face while remaining power, force behind the scenes, unfortunately for her the speaker's gavel is white whale and she can't let it go. she could have stepped back long before election and may have won more seats because we wouldn't have run ads against her, she will continue to be part of leadership, she's been around as you said 16 years all the way -- leadership since 2002. you know, she's way past the time to step back.
1:37 am
heather: howard, let's get you to reference that, is she doing what's best for nancy pelosi or is she she's doing what is best for the democratic party? >> i mean, i think that's a question with an answer that remains to be seen -- >> the poll has an answer. >> i know the -- well, certainly, i think democrats are going to be reluctant to allow republicans and republican ad make toaster choose their leader for them and i think even if you can show this poll, i think a lot of americans probably don't have a full appreciation for all of the roles that the speaker is ultimately responsible for in addition to presiding over chambers but i certainly understand and agree with some of the sentiments that were shared here, as a political question there's definitely an issue but i think you've got to acknowledge that a lot of what she's done is outweighed the political -- heather: if you look at other polls specifically dealing with say the mueller investigation, she has said publicly that she thinks that mueller doesn't have to indict
1:38 am
trump or president trump for congress to impeach him, so are democrats going to legislate or investigate and i will start with you, howard and, matt, you get the final word on this? >> sure, i think democrats will try dual track strategy, i don't believe that leader pelosi or speaker pelosi is wrong in her assertion, i think a lot of other democrats have floated the topic and had serious conversations about impeachment based on a number of different things the president has done in the last two years, i don't think she's alone there for starters but i do believe that there will be both investigations from the house and also a prosecution of his record as president on the campaign trail which we all know will probably start for president pretty soon here. heather: matt. >> pelosi is smart enough to know that there's no way to move forward with impeachment hearings without at least plurality of peaking back it.
1:39 am
they are no where near that and unlikely to get there. she has to straddle from moderate members from swing districts in own caucus against lunatics who are in complete safe seats as well as low-dollar donor and big-dollar donors like tom styer who are banging the drum for impeachment, subbings so much oxygen away for people to vote for democrats in next election. heather: all right, we will see, thank you so much howard, matt, we appreciate you joining us this early in the morning. >> have a good day. heather: christmas holiday controversy, holiday picture based on popular holiday movie is sparking backlash, thousand photographer is now firing back and president trump running on a promilitary platform, don't miss the panel of american heros.

1:50 am
>> thank you for having us. >> let me tell you there's nothing more pro-american than our promilitary then a president who will defend what so many of us would have readily lay down our lives for, that's the security of our nation, i had the opportunity with black women walking, mom for america and liberty rising to go visit our southern border wall and walk and talk to moms that are living there, let me tell you my life is forever changed by doing that, i know that wife the jim acosta's over the world, immigrant, invasion but i was talking to mom who literally sleep with ar15 next to them, the threat for them who who are the first line of defense is real, i also talk today some of the military personnel that president trump has sent down there and when i asked them what do you think, they said this is where we belong and i say if we can send troops to secure the border walls of south korea, we
1:51 am
should be able to do the same thing in our nation and as far as i'm concerned, there's no better thank you that this president can give to me than to protect what i would have layed my life down. heather: what about you? >> if you look at historic pay increase, great for military families, if you look at the fact that the sequester ended so we have more money going into military budget, means better equipment, not only make makes us more effective as military but has to help morale to be in new gear, and if you look at the people around the president, key advisers have great military background, secretary of state mike pompeo, west point graduate, army officer, general mattis and general kelly, that makes me feel good as veteran, active duty, somebody who had walked in the shoes has the ear of the president. heather: that makes people feel better, dr. porcher?
1:52 am
>> i can't say enough, military has been decimated as a result of that, moving forward what we see is greater logistics and more pay going to military members and this is a very important not just military members but people who are looking to join, in addition to that, i think president trump has layed out an agenda for civilian contractors to hire prior military people as well civilian organizations to allow things like veterans and preference becoming employed by the organizations moving forward, when we look at the grand scheme of things, trump has done phenomenal job for veterans and stood by the sign from the context of moving forward and infusing back into society and i salute the president for his agenda. heather: speaks of jobs, veteran unemployment is improving 2.9% in 2018, 4.3% in 2016, so that's
1:53 am
good news for veterans. >> it is, listen, a rising tide lifts all boats, as our economy improves, we should expect veteran situation to improve. we have over 600,000 manufacturing jobs coming back to the nation, thanks to the president, lowest unemployment thanks to our president, we see him working feverishly to -- thoughts of self-medicaid pain and we have him working feverishlyilily va hospital. >> there are some issues, things we need to work on, returning vets suffer from ptsd and what happens in some cases they are suffering, they don't wanting to to the va and get ptsd treated because they don't want to
1:54 am
prevent a future employment opportunity because of something in health book. heather: interesting. >> a lot of people want to come back and be in law enforcement but you don't want to have long ptsd history in record book because it can hurt getting job, it's a complicated issue, one thing i've seen great success on veterans becoming entrepreneurs, there are good programs, helping veterans putting together business, growing business, greater awareness would allow veterans to benefit from them and when a veteran owns the company you see more veterans getting hire. heather: good for everyone, final word here. >> we look at 3% growth in gdp, it's having phenomenal on not just military members but as a country as whole and the military members are able to capitalize on this moving forward and it goes back to the president's agenda if not just the military but putting america first and he's clearly demonstrating that madel and we
