"the five" is now. >> dana: i am dana perino with dr. nicholas affaires, juan williams, lawrence jones, greg gutfeld. it's 5:00 in new york city and this is "the five" ." massive vote recount underway in florida. new lawsuits are flying and the rhetoric are ramping up in the senate race between rick scott and bill nelson. scott's election night lead narrowing to just under 13,000 as he accuses nelson and democrats of trying to steal the election. >> bill nelson is clearly a sore loser. he can't stand the fact that

he's not going to be elected for the first time in decades and he won't -- he is here to steal the election. that's what he's done. his lawyer said i'm here to win the election. not here to get a free and fair election, make sure votes are counted. no, he wants to win. that's his only purpose. we still don't understand how they went in these counties. they came up with 93,000 votes after election night. we don't know how they came up with it. we are trying to figure what happened. i have asked the law enforcement to go in and do an investigation and find out what happened. we know that the judges have said they clearly violated the law. >> dana: nelson is calling on scott to recuse himself in the recount process. >> rick scott isn't interested in making sure every lawful vote is counted. the second is he's using his power as governor to try to undermine the voting process.

>> dana: president trump tweeting that florida's elections are "massively affected after reports that provisional ballots were mixed up in broward county." here we go, greg, one big difference between this recount and the one everyone remembers from 2000 is that bush and gore were separated by a few hundred votes. this is at least 13,000 votes. most people that i talked to today said they expect once the recounts are done that scott will be the winner. >> greg: i love the phrase massively infected. they act like it's a first time. this is an oil change and a tuneup for democracy. they are like soap or characters with amnesia. oh, my god. we had no idea we had to do this. in the same two counties. it's typical bureaucratic incompetence that drives me nuts. i know that we blame florida but it's actually the counties.

broward county. if florida with the brady bunch, broward county's cousin oliver. comes late, very irritating, ruins the whole show. i'm really annoyed by people who say if you dare to question the voting system, it's an attack on democracy. the same people who said that if you doubted russia affected 2016, it was like treason. >> dana: lawrence, they are not sure they can finish the recount in time. the judge says you have to do it. it's mixed up in the courts. >> lawrence: they didn't meet the deadline, which was saturday. i think a lot of people debating the reasoning. it's irrelevant. when you look at broward county, there's a lot of shady business, destroying ballots. counting on lawful votes, not meeting deadlines. all of those, whether it's because you are supporting a democratic candidate, you're not meeting the standard. this didn't start with the new leadership in 2003 but her boss

got fired for neglect, mismanagement and incompetence. this is a history in broward county. the question is why didn't rick scott fire her when he had control of this, before this became about his race? this incompetence has been going on a long time. i think this is how you got a donald trump in office. if he was running this state, she wouldn't have fired him a long time ago. >> dana: did he have power to fire her? >> nicole: i think rick scott did say he didn't have the power to do that. >> dana: juan, your thoughts. >> juan: is there any evidence of fraud? they say no, there's no evidence. you ask republicans what evidence do you have to say we should stop the recount, they say we don't have any but we are suspicious. what you hear from president trump is how come they

never find any republican votes. they do find republican votes what you're dealing with broward county and i think it's pretty clear that nelson, it's a stronghold for senator nelson. it's also true, to pick up on what lawrence was saying, i think i have numbers here to indicate 4,600 recounts or reviews between 2000 and 2016. 26 of those 4,000 that resulted in any change in the outcome. we have president trump on the republican saying stop it, boy, does it look political. you know who they are stopping? as we celebrate veterans day, overwhelmingly the mail-in ballots come from the military. >> dana: there was a question, the ballots that didn't counted correctly in the different ones. not hanging chance, dr. saphier, but it is of concern. the integrity of the election is in question. at this point, it seems like no matter how it turns out, half the people are going to think it

was rigged against them. >> nicole: recounts don't change when you have a five digit lead. we know that. i take juan's pragmatic approach. as soon as the recounts are done, the republicans are still going to win. the thing that bothers me, it became more political than it needed to. legally it was a narrow margin in the knee need to do the recount. that's following the rule of law. we are doing the recount and now it's getting politicized, your tweets on both sides yelling at each other and it does cause consternation for the american people and following the rule of law, i don't really like seeing counting ballots past the deadline, saying that invalidated ballots are going to get validated. take those on election night, count those. >> juan: when i have trouble with is the idea that in georgia, u of brian kemp who is running for governor but also the attorney general in charge the election. in florida, here you have the governor rick scott now trying

immigration, health reform and if they can work in a bipartisan manner, i think 2020 will be interesting. if they focus only on these investigations and i think everyone's going to be very upset in the next two years are going to be a waste of everyone's lives. >> juan: lawrence, what do you see it? what you hear from nancy pelosi, it's not going to scattershot. they have specific targets. >> lawrence: what are they requesting? it's traditional that people give up their taxes but there's no legal right for a candidate to give it up. it's political. >> juan: no, i don't think it's political. >> lawrence: there's no investigation that needs to happen. he has the right to withhold his taxes. colluding with the russians, where they getting involved in this and they told us they were wanting mueller to finish the investigation. >> juan: i think they do want mueller.

>> lawrence: no, they don't. they want their own separate investigation as well as robert mueller's investigation. we were talking about the case in florida. seems like the democrats are targeting their potable opponents right here because they don't want -- for months and years, they said trust robert mueller, let him complete his investigation. now they want their own investigation. they are going after his taxes when they have no legal right about it. then there's this notion that they say they want to investigate the president for going after the press. this president has been very open to the breath. he has a hostile relationship with them but as far as access, i think he's been one of the most transparent. sometimes he says too much to the press. i think it's all politics. there's no legal recourse. this is just the democrats taking control of their power. >> juan: data, clearly the voters thought that having a check on president trump was important. what pelosi, what schumer is

talking about, does it constitute that check? >> dana: americans do like divided government. the pattern is that whoever the president is in power, they lose seats in the first midterm, often the second one as well. i think nancy pelosi is trying to same going to be very measured. there are five things working against that notion. one is the committee chairman have a lot of power at their disclosure. think about devin nunes for example. he was able to do things. second you have at least six senators who want to run for president in 2020. how are they going to get attention? they're going to talk about donald trump. it's the only way for them to get attention. the third thing is, the restless base. these democrats believe their voters want them to investigate donald trump. four, the media. there's going to be leaked to the media. the media's going to look for stories and it's going to be everywhere the fifth thing is

some people, in the president's cabinet or in the administration, make themselves ripe for targeting. while nancy pelosi might say she wants to be measured and cautious, i don't think these things are going to allow that to happen. >> juan: picking up on what dana said, i saw 64% of democrats want the president to be impeached. >> greg: i think this is a great move for the democrats. why 85? go to 100. i'm sure barron did something on the playground that warrants investigation. i think the chef may be did something. they should appoint avenatti and have them in charge because if you learned nothing from the kavanaugh hearing, using your power to run people over politics coming or going to lose an election. your point about adam schiff, calling on a hearing about criticizing the press, how 1984 is that?

for adam schiff to pull it off, he has to believe trump is claiming that the first amendment is the enemy of the people when he was just talking about fake news but adam schiff is saying let's galvanize our political power to go after someone who criticized the press. that is scary. >> nicole: 1998, clinton, republicans were focused so much on clinton that they lost popularity and seeds. the democrats are going to do the exact same thing. >> greg: the subpoena cannon, it's like a t-shirt cannon. you're going to sit in front of the white house? >> juan: i want to talk about the press. i was listening to you, but isn't it true that in fact in the case of jim acosta, cnn, they took his credential. you can't come in. or when you stop and think about the steps they took with the video where people say essentially they doctored a video and then pointed out as an official -- >> dana: let's see if they are listening in on reporters phone calls. >> greg: no one is shutting them up. you get a 90 minute presser.

>> lawrence: democrats reportedly ready to hitch their wagons to beto o'rourke and a potential 2020 run. if that doesn't work, former advisor to the clintons says he believes hillary is gearing up for yet another run for the white house. >> don't underestimate hillary's positioning to run again. she's got a 75% approval among democrats. she has positioned herself with the core of the democratic base. i think she's going to sit back, see how this develops. if she does go, it will be because no one emerges as a clear front runner. looks like the party is splintered and lots of different ways, and she can come in. clintons never stopping until they get to where they want to go. >> lawrence: dana, i'm going to go to you. how many times do voters have to say no? >> dana: i'm going to refuse to speculate on a hillary clinton run until she says she's actually running, because i think that this is not

true. i don't think she's going to run again, but there are couple pieces in there that i think are true. one is that she feels extremely aggrieved and that it was unfair and that this election was stolen from her, perhaps with russian involvement. i think perhaps she does think that's true. but i also think when mark penn says she has a 75% approval rating among democrats, i think that's because they think she's not running again. you are nice to people when they've lost and they are moving on. she's fine and nice. but if she were to run again, there are so many democrats would say we cannot afford to run that same race again. a midterm is a referendum on the president's performance. fine. but an election for president as a choice between two people, and that choice last time around, president trump won. why would they do it again? >> juan: she is an icon among democrats. i think you're right in saying lots of democrats think the russians and the russian propaganda and even jim comey coming out when he did stole the election from hillary clinton,

the first woman to be the party's major presidential nominee. the thing is, and i agree with you, i don't think most democrats think she's the one. i think they want fresh faces. i think they want some energizing focus here. potentially, given what we saw the midterms with a a lot of women coming out, a lot of veterans, young people, i think they are not after sort of fier fiery, go at trump, they are looking for pragmatists who come at it in terms of the issues that took democrats over the finish line in 2018, things like health care, a focus on jobs and a focus on income inequality in this country. i think you're going to see a large number of people. my senses let 1,000 1,000 flows bloom but i don't think hillary clinton is a rose. >> lawrence: a lot of people shifting to beto o'rourke even though he lost in texas because his numbers were so close. it wasn't that because ted cruz

is just a bad candidate? >> greg: i think another middle-aged white guy, how racist. i don't think it's happening. i believe hillary is going to run and i've said it before, i said it months ago, she doesn't want on her obituary she lost to donald to be the lead. a heroic rematch could change the story. there's a story of her coming back outweighs the disdain the party feels for her for not running a strong campaign. my dream is for hillary to reenter and it look like, looks like it's hers and then bam. michelle comes in and pushes her aside, just like 2008 all over but it's the other obama. that's my dream. >> lawrence: do you think michelle would run? >> greg: it's my dream. i have a lot of dreams. sometimes you are in them.

9/11, heroes like pete's father. i will say pete, never forget. >> never forget. >> greg: that is legitimately awesome. there were three winners, crenshaw for his response to a careless comment, "snl" for finding a clever way to clean up a mess and america were being handed an honest to god's blueprint for dealing with future outrages. instead of ramping up the rage, it dialed back. we've set up before it's beyond time to stop chasing scalps, demanding apologies and then refusing them. haven't we had enough of the mo mob? i know i have. to hear crenshaw initiated a new way forward, express your opinion, don't condemn, and see what happens. "snl" responded with humble, good humor. it's all good and dare i say human. finally a skit worth repeating. i thought, dana, perfectly executed on both sides. >> dana: and they kept it a

secret so everyone was surprised. that helped. i find dan crenshaw quite refreshing. i remember when he was in a nine person primary. there was an open seat in houston and he was trying to get attention. there was a woman running on the republican side. she was very, very wealthy and spending all sorts of money. he didn't have any money to run, so and what he decided to do was run his district, 25 miles over four days and try to get attention. i think what's happened is houston has found itself a great new leader. they have this congressman. pop culture, it's not going to be nice to him forever. take this moment. it was a really good lesson about leadership. i also appreciated the suggestion for what to say to a soldier. rather than thank you for your service, to say never forget. i like this. >> greg: i think this needs to be reposted every time there's a new outrage. this is kind of how you solve

the problem. >> juan: yeah, to me, it was so classic and so good. i can't get over crenshaw. >> nicole: you are agreeing with greg. >> juan: it's not often but it does happen. i thought dan crenshaw was super classy. i thought he was classy from the start. i thought when he said i don't need an apology. people say silly stuff all the time. i think it was really, you know, above and beyond for him to actually come to new york and go on the show and go through the whole thing. i just thought it was terrific. what's interesting to me about crenshaw is he's not your prototypical politician. he's a guy who was a republican but he's been highly critical of president trump, for example. it strikes me that we need more people like this in public office. >> greg: a veteran especially. >> juan: especially on veterans day. i think there's a class of 12 or something veterans coming in this time. seeing more veterans and more female veterans and i think

that's a good thing. in fact, there's a pac that promotes veterans running. veterans know each other in moments of real threat as americans. >> greg: in reality. >> dana: they don't care if they are republican or democrat. >> lawrence: it was a great moment. something that country can embrace. i don't think it was necessary, personally. i think so often people on the writer on on the receiving end of this and the tone normally is to fire that person, get rid of it or go that person. you say one thing and it destroys your career. i don't want to get on constant apology tours. i've seen it on college campuse campuses. the mob it will take over something so simple that could've been handled behind closed doors. good gesture, very polite, cool to see. i'm just not big on the celebration of it.

[laughter] >> greg: i want to ask you about the placebo effect. there was a big article in "the new york times" about how the placebo effect obviously is real. it's kind of interesting. i keep thinking. if we believe the placebo effect has this influence, should we get rid of the side effects and drug commercials? when i watch drug commercials, and i know i'm not the only one. here are the side effects and i get very, very uncomfortable. >> dana: you start to feel the side effects. >> greg: isn't it a safety hazard to read side effects and millions of people? >> nicole: that is legislative action. they mandated that side effects on the commercials. i don't think drug company should be on commercials. i think this is between a physician and patient and not on tv. you have patients coming to the doctor, demanding what they feel they should be on. the placebo effect, if you hear the side effects, yes, sometimes

you think you tend to get them or you're too scared to take a medication. you can't not tell patients about the side effects unless they're going to take away the repercussions of suing the physician if the side effects -- or the drug company. >> greg: how come some red wine makes me need to go to the bathroom? >> nicole: number one or number two? >> greg: two. there are certain red wines i could drink in certain that i can't. >> nicole: it's about the acids and stuff. i don't know about your habits. >> greg: i have a chart. >> juan: by the way, when you were talking about vitamins, lots of reporting about vitamins d. do you think it's a good thing, bad, should we take it? >> nicole: if you are taking vitamin d or fish oil, there is nothing to say to stop taking it but there is data coming out, a government-funded study with 26,000 patients that say it might not be doing anything for cancer prevention heart health. eat a diet with fish and plenty
