heather: counties have hours to finish recounts as the heated battle over the u.s. senate seat is stirring more controversy. rob: griff jenkins in the thick of it in broward county. >> reporter: good morning. you can see the machines behind me stopped because they are almost done. they have a few more to go. look at the scene from just after midnight. the staff celebrating because they run everywhere except 80 or so damaged ballots that have to be duplicated and approved. we expect that to happen at 7:00 or 8:00 tomorrow and they will complete the recount but it won't get done in palm beach county. the election supervisor saying she is in, quote, prayer mode as she tries to complete the recount in one race, very close

race, the senate race between bill nelson and governor rick scott. in broward county coming back for a minute preparing for the hand recount, 30,000 votes have to be hand-counted and they will bring in 6000 people. two representatives in broward county and two republican lawyers. that will be announced later today, governor scott leading bill nelson, 12,000 votes and a lot of lawsuits out here. rob: let's see what happens. a federal judge siding with democrat stacy abrams as hillary clinton questions the legitimacy of georgia's governor's race. >> if she had a fair election she would already have won.

rob: abrams clinging to hope in her race against brian kemp after a judge ordered some absentee ballots with mistakes to be counted. those that were missing or incorrect birthdays, unclear how many votes might be affected. kemp leads by 60,000 votes at this point. jillian: michael avenatti, famed attorney for stormy daniels, denying domestic violence allegations. >> i have never struck a woman. i never will strike a woman. i am looking forward to a full investigation at which point i am confident i will be fully exonerated. >> reporter: he is facing a felony charge. he posted bail last night. the attorney was arrested after an alleged confrontation at the los angeles apartment with an unidentified woman. her face was swollen and bruised.

rob: jeff flake taking a final stand on capitol hill refusing to vote for any of donald trump's judicial nominees until the senate votes on a bill that would protect the mueller probe. flake's decision comes as the judiciary committee moves forward with five of the president's nominees, 40 more before the new congress begins. he's in the president to try to stop that. 's and senator mccullough blocked a vote on the protection the president's critics are afraid he will try to fire bob mueller. senator lindsey graham says that won't happen. >> this is a manufactured problem. donald from will not fire mueller, he will do his job and we need conservative judges on the bench, as many as we can as often as we can. a great chairman of the committee. judges and more judges. at the end of the day i'm convinced mister mueller will be

buildings go far enough. there are real opportunities especially after the florida referendum to restore voting rights, four convicted felons. if these individuals do server time and get out of prison properly, they should be full american citizens after they leave jail. jillian: the mandatory minimum sentence from 25 to 20 years, reduce mandatory minimums for the other crimes from 20 to 15 years and make no dissension between crack cocaine, some of the things that are in the bill there. what do you think? doesn't go far enough? >> it is a great place to start, it has been in the works over eight years, senator lee has been working with cory booker and a host of others, president obama when he was in office. this is one that proves when you go in surgically and specifically you can make change and this is about showing the american people that not only can we do bipartisan but this is about showing compassion and

will of law are compatible. i think the big battle that is ahead is not left or right but mitch mcconnell. will he bring this to the floor? am confident if it was brought to the floor you would have 65 or 70 votes and a great place to get things started and start the process of getting dads, brothers and uncles in the communities where they belong. >> doesn't get done before the end of the year? >> hopefully it does. needs to happen, president needs to lead. ivanka and jared kushner are pushing, it can get done, should get done, the american people should expect more. jillian: yes and hopefully yes. we are getting along, leavitt. the next topic, nancy pelosi's because ship campaign hit a snag as potential challenger emerges, incoming house reps say they will not support her bid. as of right now most people saying it looks like she will

not have enough to retake the speaker role but do you think ultimately she does? >> she has the advantage. steny hoyer is a viable alternative. we've seen that on both sides of the aisle, you can't beat somebody with nobody so you have to have somebody willing to step into the fray. we see that in the senate, schumer and mcconnell by default are back in but you have a young group of new freshmen coming in that ran against nancy pelosi even as democrats, so she will be severely tested on this. i don't know if she survives it. jillian: seems like the want for change, for fresh ideas and new faces and perspective versus someone who has been there a long time, that experience. >> there is pressure mounting. leader pelosi has heard it but
