every act in this office. i hold myself accountable. >> reporter: the new numbers were good for rick scott. communication director tweeting scott's margin increased by 865 votes and went on to say it is time to end this, time for senator nelson to concede but don't hold your breath, that's not going to happen because we are headed for recount. volunteers are lining up behind me. six people at each table, that starts at 7:00 am. the governor's race will come to a end finally. the margin of error between desantis and andrew gillam is 0.41%. the clear resolution will happen on a certification that they come monday. desantis saying those returns were made clear and unambiguous

as they were on election night. at every point throughout this process. mayor gillam said our races fallen outside the window for recount but we still believe before the election results are certified the state of florida must count every legally cast votes. once the state certifies those it will be run desantis as governor of florida. the recount will continue in palm beach although there's been more trouble getting it together. it may happen midday. rob: i love the stories out of broward county. thank you so much. 650 illegal immigrants busted in arizona in two days. border patrol agents say they are mostly family units, unaccompanied minors from guatemala. troops along the border hard at work awaiting the migrant caravan, barbed wire and putting up barriers. the first wave of the caravan in tijuana south of san diego. it could take six weeks to process their asylum claims. potential progress on the border

way to the coast and gave 3 inches of snow to dc, 6 inches of snow in central park. a lot of snow in a short time but you can't say we didn't know about it. it is hard to predict where the heaviest band will come on shore. this storm was an overachiever since it began in texas. the bottom line is in new york city it was bedlam. salt on the roads, people getting ready to leave work at 3:00 pm and that is when the heavy snow came so there will be a lot of stories in the northeast about people not prepared. 6 inches in central park, normally that is not a huge deal but early on in the season, some folks, government officials, not prepared. not done yet. parts of new england, interior northeast sections, still a winter weather advisory, storm warning affects, several inches of snow as the storm exits the

>> democrats now in control of the house but in fighting over leadership at legislative differences keeping them from attempting a policy agenda. rob: will they get anything done for the american people. jillian: here is mark w smith. it is not making their case for 2020. what do you see them doing? >> they will do a lot but what they are going to do is be motivated by public relations, grandstanding, virtue signaling, they will pass feel good legislation that has no chance of getting through the senate never mind gun control, free college for everyone, free healthcare for everyone, free puppies for everyone. they will pass laws along those lines and that is their strategy. for 2020 they will say all this

great stuff would have become reality if we simply had democrats in the senate. >> they can say we tried. >> from their point of view their strategy will be they will do a lot of stuff that may sound good and appear good but really in the real world won't work out but they never pay a political price for policies that don't work in the real world because those policies they will pass in the house will never become law and will get jammed up in the senate. rob: you mentioned immigration. a chance we see some kind of reasonable immigration bill to get through both houses? >> i think that is unlikely. rob: does either side want to deal? >> there should be talk about immigration but at the end of the day such a complicated issue they can't get the wall funded. unless it is fully funded you won't be able -- rob: what if the republicans

offer daca? >> the same debate that has been going on if you look at history to predict what happens in the future suggesting nothing will happen. it will be a lot of talk and debate. democrats are looking for the abolishment of ice. and civilian leadership. jillian: do you think they fully fund that? >> i would like to think so. as to whether that happens republicans on capitol hill need to be more forceful the democrats in the house, no wall funding from their point of view, they want open borders, antithetical to open borders which is the new democratic strategy and policy position. rob: when you had the tea party come up, made it tough for republicans to get a sense of something done, democrats have the socialist wing, the highly

progressive wing. will they run into the same thing? >> it is less likely to occur with the democrats right now. the democratic party has become much more of the urban party and a lot of value we see with urban democrats in chicago, san francisco has become the position of the entire party. i don't think you see that split you saw 20 years ago with democrats from rural areas in the middle of the country with a different view on things like guns. the parties have been more aligned on policy than they used to be. the democrats will move in the house a little more in a uniform way and not have infighting about policy positions but given the chance they would make sure there is open borders that would pay for everything with taxpayer dollars. and gun control if they had this.

.. rob: julian assange facing secret charges in the us they could have major implications for robert mueller as russia probe.

jillian: ellison barber has more on the explosive court filing we were not supposed to see. >> reporter: prosecutors inadvertently identify julian assange in a court filing in an unrelated case suggesting prosecutors with the department of justice have prepared charges against the founder of wikileaks under seal. the news first reported by the washington post described as a development that could significantly advance the probe into russian interference in the 2016 election and have major implications for those who publish government secrets. and the court filing prosecutors said charges and an arrest warrant for assange would need to remain sealed until he's arrested in connection with charges and the critical complaint and can no longer avoid arrest or extradition in this matter. how assange's name is in court filings remains to be seen. the washington post says people familiar with the matter, the

disclosure is true but unintentional. a spokesman for the eastern district of virginia told the associated press and the washington post that the court filing was made in error and it was not the intended name for this filing. mueller looked at wikileaks as part of the special counsel's investigation into russian meddling in the 2016 election including hack and publication of emails from the dnc, emails from hillary clinton's campaign gerund communication from former trump campaign advisor roger stone and wikileaks. the president tweet about the probe calling mueller conflicted and accusing him of protecting people on the other side. the special counsel's investigation is still ongoing. mueller's team has charged 30 people and three companies and gotten guilty pleas from four former trump campaign aides.

jillian: now this story. a homeless veteran and a couple who went viral for heartwarming story we followed and told you about are facing criminal charges for an alleged scam. new jersey prosecutors say the trio made up the story the homeless that spend $20 on gas for the woman stranded leading to go fund me campaign that took in $400,000. that is believed they met each other near a casino at least a month before the campaign started. investigators discovering text messages reading, quote, the gas part is completely made up but the guy isn't. i had to make something up to make people feel bad. she had numerous text messages. if convicted they could face up to ten years in prison. the race for georgia governor could be called today. counties scrambling to certify election results after a federal judge ordered some absentee ballots to be counted with mistakes including those with

missing or incorrect birthdates. it is unclear how many votes might be affected. brian kemp is leading stacy abrams by 55,000 votes. in a few hours donald trump will honor 7 people with a nation's highest civilian honor. the presidential medal of freedom. the honorees are babe ruth, antonin scalia, orrin hatch, former judge and football player alan page and hall of fame quarterback roger sawback, recognized as americans who made a significant contribution or impact to the united states. rob: democrats divided over health care, progressive democrats pushing to force a vote on a single-payer system, while moderates refused to support the motion over cross concerns. is this a sign of things to come for the democratic house agenda for the next two years? here to debate that is

democratic strategists and one seeright. where are the democrats on healthcare? >> a mixed bag of ideas in the caucus right now and that is not necessarily a bad thing. at the end of the day what is most important is when we take a vote whether it is on policies that new members want or whether it is on the policies the more seasoned members want, at the end of the day we must be locked up on trying to fix a broken health care system and do the opposite of what republicans want to do. that is why democrats were elected so heavily up and down the ballot. the american people want to deal with healthcare. the republicans refused to do something. rob: democrats want to deal with it but i would ask what is the point of passing a bill in the house when republicans have the senate and presidency? >> i was just going to bring that up. in the house it is great to have all ideas brought to the table

and we will definitely see this being brought forward but i do agree with the republican-controlled senate it is not going to go anywhere. when california alone was taking a look at single-payer just for their state it was in an analysis brought forward, up to $400 billion which is not feasible or sustainable. if they lose an argument. >> you assume at the end of the day, you don't know what the bill will look like and it will be political malpractice for the republicans to automatically say we will kill any bill from the house desk. the argument was always anti-what democrats want. rob: the numbers, prediction from george mason university,

$32 trillion over ten years. a lot of people on your side argue if you take the pile of money we as americans spend on healthcare in every form over ten years, that $32 trillion is less. is that right? >> what i am saying to you and amy on the other side is you're making an assumption that at the end of the day the bill that comes out of democratic congress will be medicare for all. what i know, the members i'm talking to once a bill that will reflect what the american people once, democrats and republicans want to do what is in the best interest of all people. some in our caucus have different ideas, once medicare for all but i'm not convinced that will be the bill brought to the floor. rob: one arguments against medicare for all is when you take the profit motivation out

of healthcare the reason healthcare is so expensive, this country innovates and create a lot of healthcare to save lives. if you take the profit motivation out of it, will you lose the innovation? why are people going to try to cure diseases and create medical equip and if you can't do it and get a yacht? >> i caught a video put together by john stossel. i recommend people watch it. they point out, they make suggestions like more competition between hospitals because there is the benefit of monopoly. we take healthcare insurance away from employers giving more power to the individuals to pick and choose what they need to. there are definite changes that need to be made. we have a republican congress that wanted to do. you love the affordable care act. that didn't happen. now on the left -- okay. it may be true but right now we need to take a step back and fix and repair certain parts of the affordable care act that are fixable.
