chris: whitaker decides in any way to limit or curtail the mueller investigation, are you okay with that? >> look, it's going to be up to him. i think he's very well aware politically, i think he's astute politically, she's a very smart person. i really believe he will do what's right. rob: that's going to get a lot of attention from if media, president trump defending whitaker as democrats demand recusal from the bob mueller probe. jillian: our next guest argues that there's no evidence to support the left's call, senior fellow at heritage foundation joins us now to explain. guess, why do you make that argument?

>> well, if you look at the actual regulations that govern conflicts of interest mat whitaker doesn't have one. he's being criticized because when he was a private citizen, before he went to work at doj he said that there was no obstruction of justice charge to be had here. that's actually true, remember, it's doj's long-held position that a sitting president cannot be criminally indicted or charged, all he did was relate what the policy is of the justice department. he's also been criticized for waying, well, he saw evidence that there had -- scarce evidence that there was collusion, frankly that's correct, mueller has turned up no evidence of any kind of any collusion between the trump campaign and the russian government. so there's no -- there's no conflict here. rob: yeah, this maybe a witch hunt as the president says, you're right, that they haven't

turned audiotape a lot of evidence and hasn't been going out from the probe, nothing has been leaking out which is surprising, why go around rod rosenstein for ag if he's the deputy, isn't he is next in line, that's concerning for everybody that believes in the investigation? >> yeah, look, there's nothing that unusual about a president making appointment like this, don't forget, remember, tat beginning of the trump campaign when they came in they didn't trust the obama appointees like sally yates and i don't think anybody questioned at the time that the fact that they went down into the attorney's office to put appointment in.

jillian: once it happens, do you think this will be over at some point shortly thereafter? >> i think so, when they are investigating large operation, is they stop with the -- they start with the employees down at the lowest levels. they take that information and then they use it to question people middle management basically rolling up the organization until they get to the ceo at the top. the fact that they've now gotten to the president that's head of campaign and gotten answers from him to me indicates that they probably talked to all of the witnesses they were intended to talk to in their investigation and they're now going to do either simply write a report on what their findings were or whatever finally indictments they have will come out. rob: let's go now to hillary clinton investigation and we have james comey, loretta lynch, remember the tarmac meeting and all of the, you know, a lot of scrutiny on all of that that

happened leading up to 2016 election, let's actually read a james comey tweet here which was from friday, house republicans can ask me anything they want but i want the american people to watch, so let's have a public hearing, truth is best served by transparency, let me know when it's convenient. the republican don't want this thing to be public, right? >> well, i don't know, i would have a problem with it being public because comey can explained why he made a fundamental legal mistake, what i would consider malpractice when he said there wasn't sufficient evidence to put out an indictment for hillary clinton for the mishandling of classified information. he's just wrong. any prosecutor would have concluded that there was enough evidence for that and he's got to explain why he made that decision. it looks like a partisan political decision not one based on the facts and the law.

in florida he has a point, georgia was a red state, should that have been that difficult to win the governor seat? >> well, i think the president was smart in going into the state specifically in georgia, he rolled out what we think we are going to see for 2020 -- i'm sorry, his reelection campaign and the most important thing is that when our president goes to these states he speaks directly to the voters and they love it. they love what he has to say, they love that he's here and you can see repeated across the country for reelection and even in the senate, you know, the president was able to help bring in a few more republican seats in the senate, you spoke about florida, that was a tough fight, that was a really tough fight even for several votes, we came out ahead. rob: chris wallace did the interview yesterday with the president on fox news sunday and in one of the points he really try today push home was that voters love what the administration is doing, they have issues with the president's rhetoric and his behavior. there was some -- there was a lot of things that he should

have learned from the midterms, i think, he lost a lot of support in the suburbs it appears and a lot of places that probably should be red are now blue, do you think he learned any lessons? >> well, i think that the most important lesson that they took away that there was a blue splash, blocked by red wall in the rural areas. he still has, you know, very strong support in the rural areas and that's what counts when we need to get to 270 votes, electoral votes to make sure that we win. rob: but that's not all that counts. like at orange county, california. look how tight in texas, the race in texas with ted cruz was tight. that should make him nervous i would think. >> well, i think it makes us pay attention. i'm not quite certain it should make nervous. beto o'rourke was not able to win in texas, we expected to be increase in blue in coastal cities, that's not anything that's new, it's been trending that way for several years now,

what the president needs to focus on is supporters, you know, the issues that are very important, of course, immigration which also have to think about, consumer confidence is up, the economy is doing well, there are more jobs in this country that they were before he took office and those are the things that will drive the voters to the polls. rob: the economy was certainly a big boost for the republicans absolutely. let's talk about the florida election, the mishaps that we saw in broward and palm beach counties, brenda snipes leaving her post after the election and says that she believes that racism was probably some type of a factor in the attacks against her regarding her handling of broward county in this election, what do you think about that? >> i think democrats leave to talk about identity politics instead of focusing on the administration, thousand handle the electoral process and the issues at hand here that when things don't go their way, when they lose they throw that term

what do you make of what you heard from president trump? >> i have to wonder exactly why the president is supporting pelosi and i wonder what is in it for the president, i mean, this doesn't really seem like someone he would want supporting, she's a power house as a speaker and she's a power house for the democratic party as well as as far as raising funds but i will say that there's some risk obviously with ousting pelosi. i mean, she has the experience, she has the ability like i said to raise money but i think that she does not recognize who her supporters are and when you think about this black women have been the base, backbone of the democratic party and yet we have not had a seat at the leadership table ever, 1789, that's how long, it's never happened for african-american women since 1789, so i think it's time for democrats to stop using the votes of black people while ignoring our voice. julie: so far about 20 democrats oppose nancy pelosi, you know what happens as this draws

closer, what do you make of it. >> good morning, jillian, i think that what you have right now a little bit of a coupe but not enough to overtake pelosi. they would need about 28 votes to overturn the speakership and have it go to someone else. right now there's been a challenger marsha fudge from ohio who is a black woman, who is challenging nancy pelosi but it's probably just an attempt to obtain better committee assignment or some time of concessions from nancy pelosi and political favors being what they are. jillian: rochelle, do you think part of the problem is there's no real clear front runner to go against her? >> i think that's true, we don't have a strong contender that we are seeing come out but after thanksgiving a lot of people, members will make decision on whether or not they will run and marsha fudge is one of them as well as jeffress who is running for chair as well.

look, i think pelosi is a power house in the democratic party but the president supporting her just makes me wonder why, what is in it for him, he seems like he's supporting her to get her out because, you know, the president is not very popular obviously with democrats especially the new comers that came in, him supporting her is a way to push her out which could ultimately hurt party in 2020. jillian: none of us know what the president is thinking. i want to ask both of you this question, shantel i want to start with you, i wonder, just a question if having nancy pelosi as front runner, speaker of the house will put more of a rift in the democratic party, a lot of people do oppose her, a lot of people don't want her in the role and because there's nobody else could that cause potentially more problems? >> i think that the risk in the democratic party is not only the

gender rift and the black women in the democratic party wanting somebody else, it's generational, she's 72 year's old, so there's a generational rift and the fact that they all ran, all the new members to have house ran on this idea of change, they represent sort of the establishment, just like the republicans had the same issue last week with the election of kevin mccarthy and jim jordan's challenge to kevin mccarthy, you the same thing going on in the democratic party. it would be short-sided for the democratic party to ignore the fact that nancy pelosi has been in power for she's long, she's part of the reason that they're in power now. for president trump to support her tells me that he wants another poster child for the next election to say this is what you're getting, he would rather have maxine waters speaker of the house but nancy pelosi is a nice second choice.
