white house counsel he wanted the justice department to prosecute james comey and hillary clinton. even though the dag did not fil charges, democrats and the medi wasted no time making this out to be a major story. take a look. >> this is what happens in the garden country. the president orders the president of the the leader orders the prosecution and of his political enemies. >> i think this is a i think this is absolutely off the charts. donald trump is basically running his office like he's ahead of the t banana republic. >> if i had to channel some mikal richard nixon i think he g would tell this president is going too far. >> today i read the articles of impeachment and everybody shoul go read article two of it and how similar it is to what we've

seen trump do here. >> elected president what did president trump do here? comey and clinton are being prosecuted. this comes as president trump submitted his written llanswers robert mueller as the special counsel investigation appears t be winding down. tining us now with reaction from the health, fox news contributor shara carter and civil rights and criminal defense attorney, good evening, all. david, i will start with you. you're the attorney here. as i understand it, you think that the written answers by the president was not a good idea. i have had to join it in that. but the president and his attorneys made the decision tha he should do that. the special counsel, mohler is not limited to russia under the as it relates to the special counsel investigation. is it everything at play here i
10:03 pm
terms of perjury and everything else he wants to look at? f >> absolutely. that's why i fundamentally tt disagree with the idea of submitting even written answers to the questions. under section six under . 4 of the special council regulation brand-new crimes are lreated simply by the appointment of the special counsel he has the authority to determine on his own, but the president has lied about interfered in the investigation or obstructed the investigation and he can charge a crime simply by virtue of being and unilaterally on his own decision without any other witness having contradicted the president. one of the problems that we are seeing is that everyone thinks that this is winding down, but is the president still in >> of course he is, he's in greater jeopardy now since he submitted his answers to the questions, this isn't really an investigation going on.
10:04 pm
they're not looking for information from the president and no all they want to know, this is a group with an agenda. robert mueller made a choice when he chose his team.wh the whole universe of lawyers t choose from and he chose only lawyers with an agenda and into trump agenda, people who are against trump, hate trump, and really was a po result of the election. if the american people would have t confidence in the investigation. >> we just heard some of the sound of what's going on on the other channels jeffrey toobin who is a legal analyst saying that the attempt to prosecute clinton and comey is worse than watergate, but let's get to the facts here. is this such a bombshell report this new york times? it never says that the presiden directed that they be prosecuted . it's not even clear what he said . the lawyer, white house counsel lawyer says that the president never ordered anyone to prosecute anyone.
10:05 pm
>> if you go back, judge and just watch h.president clinton' then candidate clinton i'm sorry , candidate hobbs rallies back in 2016, he said and i'm quoting from one of them i will ask to appoint a special prosecutor,ry we have to investigate hillary clinton and we have to investigate the investigation. those are his own words.co he saw, clinton he's talking about combing. this is from campaign promises that are stalled it included th senate so the new york times ha this bombshell that he ordered this, but he's been talking about a going back to his candidacy. the bottom line is the proposal goes nowhere and then there is no action carried out. we don't live in an authoritarian country. there are checks and balances. if it actually never comes to fruition, how is that the climb or a bombshell in any capacity. when the american people are
10:06 pm
numbed by it because when you scream constitutional crisis, authoritarian dictator, wersel margate impeachable offense and you get to about a million is and over again people start tuning out because the hyperbole is just lost. you can't keep repeating that over and over again. >> that claim that authoritaria trumps attempt to prosecute clinton and comey. what i took a quote out of one of their statements, this is what happens when you attempt t prosecute your enemies. and, to your experience in what you have been reporting on for the last year when you attempt to prosecute your enemies wouldn't you say that these our counterintelligence investigation against trump, wouldn't you say that bringing paid for document by one candidate against another is basis for a bias towards. it's exactly what cnn and all o them are talking about.
10:07 pm
>> absolutely. i was going to say that. the banana republic that they have been talking about is what happened when they started this investigation against candidate trump and 2016. they exonerated hillary clinton ithough there was a slew of information that they should have followed up on and at leas taken to the department of justice so they could be investigated to see whether or not it should be brought to the grand jury. no doubt what is happening here is this information in the media . what the president doesn't have the right inside the white hous to a talk to his attorneys and look, i've may have investigate and there is never been any evidence of crime. we have a mountain of evidence in you know pointing in the direction of hillary clinton, and he can't even question that because all of a sudden this is becoming some kind of he's taking some kind of prosecute prosecuted prosecutor authority.
10:08 pm
it is a joke. >> what can the president do? >> i want to ask a question before i even get to that. that is, we never hear about eric holder, or read a lynch, nobody talks about their conversations with president obama or any of that. it's only with this president that the leaks are out there. to me it speaks of the establishment. david, i've got to go back to you with the question, what can president do. they keep talking about corruption, can we look at it? >> he has a right and responsibility too. he's the chief executive of tha branch. it is his justice department. he has a responsibility at all times to refer both comey and hillary clinton to the justice department to the full investigation. they both need to be investigated.
10:09 pm
rasmussen poll, 46 of the public believe that comey should be prosecuted. there is something there. those were attacks on enemies. here there is real evidence of wrongdoing. criminal wrongdoing. it's preposterous that anyone should suggest that what comey did as fbi director with the leaks that went on in his agend was appropriate or certainly a breach of contract. >> we are short on time so i'm going to go to job. jail. what do you think this when you think the molar probe will be over? >> i think we saw the midterms come and go and he wasn't going to obviously release anything before then becausee he didn't want to seem political my comey did before the 2016 election. we have to see it went down to the president has submitted his

you have to give rush limbaugh his doom. that was really funny. talk about it, the private server in the bathroom. but i'm going to go to you first , doug because you have a democrat onset right now. does ivanka have a problem like hillary did? >> she has a problem, but candidly not the same problem a hillary.rv i don't think private servers should be used, but i think rus missed the point. if it's a private server was used in the private address, an classified information as far a we can tell may well have gone to our enemies in ways that. >> with hillary. >> yes. >> don't question. >> and that is more serious tha anything alleged everywhere else . >> it was simply that of mongo was appointments with families in a family e-mail, but what doug is saying is accurate. first of all, she didn't delete any e-mails did she?
10:13 pm
>> no,n in fact our reports ar that she turned over all of her e-mails. and what we're seeing here, judge is the democrats are in the batters box. they're getting ready for an investigation investigation after investigation after investigation into the trump administration with the icing o the cake being an effort that will be made to try to impeach president trump. it's what they campaigned on. evil will say this is hyperbole we know what nancy pelosi is going to do is bigger, she put hendry waxmanan in charge of investigations during the bush administration and every mid-level staffer that the bush administration appoints go get lawyer to defend themselves against frivolous lawsuits whic he was the speaker of the house back during the bush administration. >> mark water, comey made a lot about intensity and hillary had no intent to violate the law even though intent isn't
10:14 pm
required, but how do you compare the intent that ivanka has as it relates to the hillar situation? >> first of all there can be no intent. classified information does not go over your normal white house .gov e-mail account.ed there are special servers that are required for those. she had to have the intent to take itt off of those servers a put it on a private server. ivanka sending a few e-mails back and forth about family logistics and planning those kinds of things to government officials while she was transitioningin into office is intense, there's no classified information. every e-mail she sent to a government staffer while she wa transitioning and was automatically captured by the system. to keep mark, that is exactly the point that people are not recognizing. everything she did is captured there. if it were classified and it couldn't have gone through.

meadows if you were to look at all of the money tom stier has put into democratic organizations to elect people that all they want to do is investigate this president and ultimately tried to impeach him. let's not forget what the core of stiers grassroots effort is and that is to impeach the president. in these final weeks that meadows is chairman of the committee and can call on investigations we ought to be able to get into things like that. >> what's interesting also, mar is that meadows, the house caucus leader is seeing his committee is also trying to secure testimony from whistleblowers who could've had more information about the clinton foundation, but do you think anything will happen in this department of justice. there is talk that the clinton global initiative got their status from none other than ...
