griff: president trump giving the green light to expand the military mission on the border as thousands of migrants wait to claim asylum. rachel: the plan includes using force, if there is an attack. ed: big story and garrett tenney is live in washington with more. good morning, garrett. >> good morning, y'all and happy thanksgiving to you. new order from the white house allows the military to have expanded powers on the border protect border patrol agents and briefly detain migrants. defense secretary james mattis told reporters the order won't significantly change the troop's role at the border. they real main unarmed and if border patrol agents come under attack, military police armed with shields and batons could step in to help. mattis said if troops are given powers to detain migrants though, it would only be for a few minutes, describing it this way. if someone is beating on a

border patrolman and we were in a position to do something about it, we could stop them from beating on them and take them over and deliver them to a patrolman who would then arrest them for it the important caveat here this new order allows secretary mattis to expand the military's duties. he says that will only happen if the department of homeland security requests it and at this point it hasn't happened. rachel, griff and ed. rachel: so many different reports. tornadon the one hand they could use force on the other hand -- ed: lethal force is an option if the situation gets out of control on the border. this is more to help protect border patrol agents. griff: it's a cabinet order, right? so the white house has issued this to stay within the bounds of the 1878 order which basically says under our constitution that you are not going to let the

military take action. it's the home landing. at the end of the day, you have this sort of unprecedented swelling on the border. you have assaults on our border a patrol that happen every single day. many of them don't get reported. i have been down there. they talk about the fact that they are being insulted. that's why in garrett's report he said if the military does intervene it will only be for a few minutes to get control of the situation. because, without something in place to properly secure the situation,. rachel: border patrol do it themselves? why do they need the military backup? griff: it's a numbers game. 2 to 8,000 people swelling across the border and they start to assault, remember, our border patrol, who get up every single day many of them on patrol right now, are not facing just families looking to surrender themselves at points other than point of entry, but also narcotics, drug deals, smugglers, they have skin in the game. they want to fight back.

ed: president trump has been saying going back to the 2016 campaign these border patrol agents are under assault. it's essentially an invasion. have you heard the mainstream media say that's not true. secretary mattis has gone down to the border to say yes we are moving forward with this order. that suggests to me that the defense secretary believes that these border patrol agents need support and logistical help and remember the u.s. military is the greatest fighting force in the world, if you need logistical help, they he would be the ones to turn to in a situation like this. this also ties into the battle the president had yesterday with chief justice john roberts. you had this federal judge in the ninth circuit out west which often gives very liberal decisions blocking the president from saying that if you are seeking asylum you have to go through certain centers at the border. this judge saying no you can't do that called him obama judge.

griff: step back for a second. as you mentioned ports of entry. we have them for a reason so can you come legally in here and the president has gotten a lot of praise from the border patrol in particular saying please help us drive traffic to that port of entry. now, there is the pro-immigration folk folks that say no, we don't have time to wait in line. we will go across the river and around the fence and claim anyway and claim asylum. the president takes the step and say we no longer allow to you claim asylum if you cross illegally. if you commit the crime crossing illegally, you have a judge out in san francisco that's going to rule not only in the case of a california situation but he is going to rule universally across the border anywhere. rachel: this is how chief justice roberts responded to president trump's criticism of that judge. he said we do not have obama judges or trump judges. bush judges or clinton judges. what we have is an extraordinary group of dedicated judges doing their

level best to do equal rights to those appearing before them. that independent judiciary is something we should all be thank will for. ed: pretty extraordinary statement from the chief justice. the president was back on twitter to fire back sorry chief justice john roberts you do indeed have obama judgment and they have a much different point of view than the people who are charged with the safety of our country. it would be great if the 9th circuit was indeed a quote unquote independent judiciary. but if it is why so many opposing views on the border and cases filed there and vast nun of cases overturned. please study the numbers. they are shocking. we need protection and security. these rulings are making our country unsafe and very dangerous and unwise. you see liberal groups going venue shopping. they say we want to block the travel ban. we want to go after this asylum issue. let's go to the 9th circuit. it's very liberal out in san francisco. >> we will block the president. later on down the road the 9th circuit gets obliterated

because their opinion is not actually going to hold water. rachel: right. griff: interesting to me that chief justice roberts would attack president trump and paint him in the light that he is the first to criticize the supreme court because president obama himself. ed: absolutely. griff: here is president obama criticizing the supreme court. listen. >> last week the supreme court reversed a century of law that i believe will open the flood gates for special interest, including foreign corporations. springfield owns a house. >> affluent. ed: people have a lot of property horse country in new jersey. in initial reports i had heard about the fire. i didn't realize i thought they had potentially died from the fire. you are saying they were stabbed inside. >> they were murdered first, the wife and children in the house. the brother was murdered. he was found outside the house but with gunshot wounds. >> so the two brothers owned a couple of businesses together. consulting company, a tech company, i believe, and a pest company. what if you are an investigator trying to piece this together. you see two fires. the murders, where do you start? >> the good news is and not to use that word because there is no good news here but it's a closed circle. you don't have a random killer or victims that you need to identify. you still have to identify the bodies inside the house sadly before you can charge a murder. so, depending on how badly they are burned. fingerprints could be gone. next go to dental records

a particular bent of mind where they are very sympathetic to open borders claims. the whole idea of national sovereignty is something that they sees a passe and they want to push the needle more in the direction of global organizations. and they think of the constitution rather and the courts rather than the place where americans go to protect themselves from government action and other action. they think of the constitution as kind of a global charter of rights that everybody can use, including use as protection against the united states government and the national security measures that our elective representatives take. it's just a philosophy of governance. griff: andrew, let me focus real quick. we are talking about one federal judge in the ninth circuit in san francisco simply as it relates to president and this asylum issue. are we seeing an unprecedented level of

judicial activism, specifically out of this court that the president was criticizing. >> well, i don't know if it's unprecedented. you are seeing a lot of judicial activism. we had a lot of judicial activism, for example, in the 60's and 70's. you get the space of judicial activism. guess when it happens? when left wing judges are spread throughout the courts and i would point out in 8 years obama put 329 of these judges on the federal bench. we all look at the supreme court where the action is in federal litigation is in the lower federal courts where most of the rulings are made. but if it wasn't targeted. why do you think people would go to these particular courts to bring these suits? rachel: right. how has trump done in terms of putting his judges n federal level? >> is he doing it -- rachel, is he doing a terrific job. they have gotten, in terms of a two-year period, they got close to a record, if not a record number of

judges on the circuit courts of appeal. now, there are a lot of vacancies on the district courts. i think there is 111 the last time i looked. really vital to fill those. as long as you have divided congress, the one thing they can get done is to get these judges confirmed. ed: he has a bigger majority in the senate to fill those judicial vacancies. real quick, is it smart for the president politically to take on chief justice roberts. you need him on other issues. >> you know, ed, i don't want to blame president trump here because i think it was unseemly for the chief justifiable to go after the president if the first place these are 5 to 4 cases. president trump is giving incentive to vote with the left block, if it does the supreme court stops being the place where president trump can block the judicial

>> that's a really great question. we get that a lot at the butter ball turkey talk line. all you need to do is use a meat thermometer to cook your turkey to the perfect temperatures. 170 in the breast. and 180 in the thy. ithigh.it will be warm juicy. rachel: have a meat thermometer. >> oh say i will willing the leg when it falls off it's done or juices run clear it's done. those two things when it happens. it's way above the temperatures it needs to be at. your meat thermometer is your best friend. griff: this is the universal question on thanksgiving day. every chef will cross this threshold whether they want to or not. to stuff or not to stuff. >> it's like the eternal question. so, for me, the answer is definitely stuff. i think this depends on how you group and what your mom did and if you liked her turkey you want to do hers.

it's absolutely okay and safe to stuff your turkey but, again, you need to use your meat thermometer because your stuffing isn't safe to eat until the stuffing is 165 degrees. so if you stuff your turkey it's safe. just check the stuffing itself for the temperature. rachel: my husband won't eat the stuffing if it's not the one from the bird. >> i love that. rachel: here is another question. a lot of people are tricked how often do you need to baste or do you need to baste. >> if you buy a butter ball tucker you don't need to baste it it's prebrianed for you. super moist and juicy. think about it this way. your turkey's skin is like a rain coat. when you pick up juices or spoon them or put them back over the turkey. it just rolls back off into the bottom of the pan. it doesn't penetrate into the meat itself. all have you done is opened up the oven door, let a lot of heat out and prolonged your cornerbacking time. griff: throwing something out there. when you baste you are not actually moist ter rising

continued political career, the better way is to go out gracefully. accept the decision of the voters and come back and fight another day. he had. griff: all right, brad. who else do you have on this list? >> dianne feinstein has to be on this list. before the kavanaugh affair in late accept, democrat enthusiasm was much higher. republican edge enthusiasm bounced back. that probably allowed the republicans to gain two seats in the senate and dubai feinstein misplayed that. rachel: you say bill nelson is a turkey. >> i do. bill nelson is well past retirement age. he probably should have gone to one voluntarily rather than make the voters send him there. griff: a little one sided now. is this a bipartisan list. >> it is. republican donors definitely belong on the turkey list this year. if you look at the 3 dozen or so seats the democrats flipped in the u.s. house, the republicans were outspent by $86 million. if you look at places like oklahoma 5 or california 48 on the west coast, democrats outspent republicans by about triple.

republican donors asked for a tail whipping this year and they got it. ed: what about you say florida democratic primary voters are on the list as well. >> florida democrats had a very competitive primary for governor. a lot of really high profile candidates. they ended up choosing andrew gillum. and andrew gillum had more baggage than hotel bell captain. in the end other candidates might have won that race and andrew gillum lost it. ed: he didn't lose by a lot. >> sea very energetic candidate but the problem was his ideology was too far left. city under fbi investigation. too much baggage. that's why i say almost any other candidate probably wins that case. ed: moderate democrat probably would have won. griff: i would add to your list election supervisor in florida. a few weeks covering it. ed: any names come to mind. >> we did there might be a whole poultry farm down there, ed.

military advise and assist in logistics capacity, if one of our border patrolmen who is being outnumbered by the overwhelming numbers showing up on the mexican side, they are going to at least secure the situation. ed: they will have some backup. rachel: when you were down there, you saw it first hand, griff, could you see from what you saw the capacity or the potential for violence? griff: as an observation, i have numerous times witnessed the assault of part-time coming across the border on our border patrol. remember, they are facing now with this migrant caravan upwards of 8 maybe more thousand folks coming. they are saying not happy port of entry and don't want to wait in line. they don't know what they're going to face. almost like being on the football in the nfl like right on the line and you don't know what's coming across that you have got to bring everything have you got because security and safety is primary concern. ed: so this cabinet order, one lever the president is using on executive basis. another was trying to make

sure that those seeking asylum would actually go through ports of entry as griff was pointing out last hour. well, a federal judge out in california, the 9th circuit usually comes up with very liberal decisions decided to block the president. you saw the president a couple days back tell reporters before he headed down to palm beach for the thanksgiving holiday that this was an obama judge and that in the long run, the president thinks he is going to win on this issue. chief justice john roberts, you see him there, took the extraordinary step of putting out a statement yesterday pushing back on the president saying, quote: we do not have obama judges or trump judges, bush judges or clinton judges. what we have is an extraordinary group of dedicated judges doing their level best to do equal right to those appearing before them. that independent judiciary is something we should all be thankful for. the president fired back pretty quickly. rachel: he sure did. he tweeted sorry chief justice roberts do you indeed have obama judges and they have a much different point of view than the people charged with the safety of our country. it would be great if the

ninth circuit was indeed an independent judiciary, but if it is, why are so many opposing view on border and safety cases filed there? and why are a vast number of those cases overturned? please study the numbers. they are shocking. we need protection and security. these rulings are making our country unsafe. very dangerous and unwise. griff: you know, in the last hour we had andrew mccarter who is a former u.s. attorney in the southern district of new york. he was pointing -- asking him about judicial activism which appears to many happening out in mexic mexico nw mexico in ninth circuit. obama judges, obama had this to say. >> transnational progressives in the obama mold, that's the reason they were picked. it's the reason they were put on the bench. obama judges are of a particular bent of mind where they are very

sympathetic to open borders claims. they think of the constitution global charter of rights that everybody can use, including use as protection against the united states government and the national security measures ha that our elective representative takes. ed: you see it right there what he is jumping on. the democrats still, they are resisting, basically, right? rachel: right. ed: these judges are part of the resist movement. they tonight want to admit that elections have consequences and as the president says, obama judges holdovers, there is a new president. he is trying to put on the federal bench his judges. rachel: we have obama judges and trump judges. there is a difference. because trump judges or conservative judges, if you will, follow the constitution. and you talked about activist judges. liberal judges tend to be activist. that means they are following their heart and ideology. i think most americans want judges to follow the constitution. that's the fairest way to get away from the bias is we all naturally have.

griff: that's a great point. should this topic come up at your thanksgivin thanksgiving dr table today we have checks and balances in place. that's why the judiciary should be independent. it is hard to ignore what is clearly an effort of the 9th circuit at least in this one issue. rachel: sure. ed: what about chief justice roberts nominated by republican president george w. bush. a couple years later he saves obamacare and upsets the right. now he is taking on a republican president. this is setting up potentially a monumental battle because there is going to be a whole bunch of issues that go up to that supreme court and chief justice roberts is now seen as kind of the ideological center moved to the right with justin kennedy retiring and justice kavanaugh being there. the judge is going to need chief justice roberts. rachel: is he not the only supreme court judge who has taken this political stance against or at least the appearance of political stance against the president. we know that ruth bader ginsburg also said things during the campaign. it is interesting and you

wonder if this case in particular makes its way up to the supreme court. ed: rachel's point is for supreme court justices to say they are shocked, shocked, shocked that politics has been going on when they have been playing politics. rachel: would there be pressure for him to recuse himself since he has already politically weighed in on this? griff: will we see the jurisdiction of these courts become an issue? again, when we go back to the travel back case which is in the same court and now the asylum which a lot of -- is the jurisdiction ruling unilaterally not only apply in this case but also apply across the country: go against the chief justifiable to rule, to tell certain courts that are deemed to be politically active to stay in the lane. ed: if i rule we're going to go to jillian. jillian: i'm here and ready to jump. in i'm a team player.

mouthing the words not true. they said at the time supreme court justices should not weigh in. they should be silent and stoick. now that very same liberal media giving justice roberts praise for pushing back on donald trump's position which is the right one. because the ninth circuit has been a court which is widely overturned. individual judges setting national policy. and if judges want to do it. they need to step down and become a legislator. rachel: why the disparate here? is it because the is it just that barack obama delivers in much more professorial way and president trump is tweeting it. >> if you criticize barack obama, then you are a racist or you just didn't agree with him because you were too conservative. the bottom line is justice roberts had the opportunity rightfully to criticize

barack obama nine years ago on a major supreme court decision, which was voted 5 to 4 in the united states citizens united case. he didn't do that now, in a case where a single judge in the ninth circuit is once again putting a stay, a temporary restraining order on something that this administration is trying to do, the judge is deciding to weigh in because the truth is the ninth circuit is very liberal and they judge shop all the time when it comes to issues of immigration and we have seen this in the past where the supreme court had to step in and in a 9-0 decision to overrule the 9th circuit to say that the executive authority of the president was allowed to take place and limiting the number of people who come into our country from foreign countries. look, the bottom line is justice roberts shouldn't be involved in this because this case may very well end up in front of the supreme court. ed: corey is, it particularly rich that democrats want to now they say get politics out of the judiciary just weeks after trying to destroy justice kavanaugh's life?

in i think when you pan the camera, i think when you have a correspondent that's out there and you see these people pushing back and i think what president trump kind of resonates with people is who are these people? why so many people that are coming and trying to get through the border and seeking asylum but don't want to do it the legal way? and this is one of the things that i think republicans get a bad rap for. republicans are, you know, they are for immigration they just want legal immigration. a lot of democrats use this as a way to say that republicans don't wanted anyone to come over here. they just, you know, they want to keep immigrants out. that is totally false. we just want legal immigration. do it the right way. not pushing through. griff: michael, you understand this issue as a former ins guy. is it your take that americans that generally don't pay a lot of attention to this issue are finally

like alexandria ocasio-cortez? >> of course. this is what is so scary is that ocasio-cortez pretends to be fighter for the people. represents ideology that has destroyed cultures and destroyed civilizations and countries. talking about democratic socialism or socialism in general. pelosi is bought and paid for by a lot of special interest. alexandria ocasio-cortez fights ideology justs even more harmful than special interest. at least those special interest relatively want some form of a market system. ocasio-cortez wants an ideology that's so corrosive and destructive to civilization and the world. one thing i say is this i find on college campuses every day at turning point u.s.a. ocasio-cortez is campus coming to congress. unbelievably dangerous ideas that originate on our college campuses that are now really, you know, materializing in congress which is unabashed marxism.

not legislate security, safety at the border or anything else, they know nothing about it, making the country and say, law enforcement professionals must be allowed to do their job or there will be bedlam, chaos, injury and death. we want the constitution as written. the president getting a lot of flak but he went after this judge on the ninth circuit which is very liberal and not usual the president does this but we have examples of president obama doing it. he is upset as he called it an obama judge trying to block his move on asylum. the chief justice pushed back and the president is saying something we heard before, don't legislate from the bench and stick with the strict interpretation of the constitution. >> they don't like constitution -- we have former us attorney andrew mccarthy on earlier, here
