normally you are in this room doing the five. right now you are doing the 6:00. jedediah: i have done the weekend show pete and ed. it was about time i got here. what took so long? steve: good question. we have got three hours it starts right now with this news. hundreds of additional troops headed to our southern border as we expect more shut downs and confrontations according to what the government has heard. brian: wait. i thought this wasn't supposed to happen. the migrant caravan includes 600 known criminals. jedediah: griff jenkins is live on the ground in tijuana with the alarming new details. griff? >> good morning, guys. jedediah it is the middle of the night here 3:00 a.m. look outside the main sports arena which is the largest shelter for the migrants here in tijuana. and bring you this way and show you over here if we look inside this stadium, you will be able to get a look at just how many are here. we learned yesterday from dhs secretary kirstjen nielsen there is some 8500 total migrants a little over

6500 here. another 2,000 over in mexicali which is about two hours ahead. we learned, of course, the stunning number which is that 600 of them believed to have had criminal histories. we also learned another figure that's very interesting. that is 90%, they believe, are not eligible for asylum, which is, of course, the main reason why they are putting the central american countries, they tell us from honduras, guatemala and el salvador and, of course, there was the attacks we saw on sunday that the border patrol had to employ tear grass across. we learned at least four border patrol agents were injured in those attacks. actually sending an official letter to the u.s. side wanting to know why that was used an investigation of sorts. i talked about a dozen folks here, all males. that is, of course, something that nielsen has told us is mostly males here and that's what we have seen this morning. 12 to 14 of them actually about two hours ago tried to scale the fence. i will show you the fence

even though it's dark you can see along the highway that structure in the distance sort of a metal, that is the u.s.-mexico border across that highway is san diego. the san ysidro port of entry just about quarter of a mile from this place where we are standing right now. all 14 of them got over that fence a little farther to the west of us. the border patrol told them to turn back. the border patrol calls that a turn back. they see that as a success. they didn't climb the fence and ask for asylum. these people came back and they told me in three days they will try again, guys. steve: i know on sunday when there was that race towards the united states border, hundreds were involved. apparently they have identified via videotape 500 of them. what's going to happen to those people are they going to be deported or are they going to be allowed to stay there? griff: great question, the mexican officials tell us they intend to deport not only the 500 or so that they

arrested and apprehended and identified on this side of the border, but also anyone else that does try it now, one thing that you have to take into consideration. i will talk perhaps later in the day about this. this is impacting the business. when that border shut down 8 hours on sunday it absolutely froze business that normally happens. legal business between san diego and tijuana and that is a real concern for the folks that live here in the real wai weight that this caravan is bringing on top of them. we will get in later and talk to some of the folks. we are not aware to your question, steve, of anyone who has actually been deported. it's early yet. we'll talk to some officials later on this morning. steve: griff jenkins live on the border in tijuana. thanks, griff. reading in the san diego paper this morning there are a number of doctors if tijuana. we have a lot of patients who live in san diego that come down there. because the border was closed on sunday and crackdown, it's hard for them to see their patients.

jedediah: it's really crazy if you think about this. what is the solution going to be? what are they actually going to do? trump is saying i will shut down the border it seems like he doesn't have the authority to actually do that he would need congressional authority to do it. what's going to happen here? brian: 98 people involved in sunday's raids were sent out by mexico. they have no shot of asylum. their names have been taken and they have been tossed. if you want to send a message to these migrants and if you want to send a message to mexico sings this is their problem as well as our problem, maybe they will get tougher on their southern border and won't be so permissive sending buss in some cases to expedite their trip up to our border. we might be on the same page right now because of scenes that you are looking at. steve: the president did a pair of rallies yesterday for the republican running for the u.s. senate in the great state of mississippi, cindy hyde smith. he was very clear when he was in biloxi, people have a choice. when it comes to the republican party that is a

party that is going to respond to the trouble on our southern border and for those people down in tijuana and elsewhere, the president's message was turn around, please. just go home. you look at what is happening on our border coming up by the thousands. frankly if we didn't show them strength and a strong border, if you would have hundreds of thousands of people pouring into our country, we are doing a job and we will continue to do a job. we're doing what's right. republicans are committed to halting this incursion and defending the sovereign borders of the united states. in. brian: remember, this wasn't supposed to be a problem. remember, the president was talking about this caravan because he wanted to do the best he can to keep the house and expand his lead. the republican lead in the senate. so, that looks like the president sings the midterms i believe are virtually over with one senate race to go and handful of house race. i don't see a political a vantage of the president doing this two years away from his election. i do see real legitimate danger for border authority. kevin, the commission of u.s. customs and border protection. he told yesterday dozens of assaults committed against his agents projectiles. four had to have medical attending to. protective gear prevented some serious injuries. and, again, getting hit by things, by people who are storming the border, trying to create havoc there in order to get into our country. but, for some reason, we seem to be making the border guards the enemy. jedediah: i think there is a high expectation that president trump, you talked

about why he is talking about this far from his election. remember, this is a election he ran on. arguably this is a reason why he run. he put this front and center and talked about border security. people are deeply concerned whether you have people from dhs coming out and saying 600 of the 10,000 people in these caravans are convicted criminals. this is an issue dear to people's hearts. they wanting to protect their families and they want the security of the nation to be a top priority. that's why he is out front and center making this a key issue regardless how far the election is from it. brian: is he addressing an emergency. if this wasn't his issue, if any president in office right now, this would be their issue. jedediah: right. brian: he just had predicted it ahead of time. steve: as we look at some of that video, if an agent with the u.s. border patrol is struck by a rock in some sort of confrontation like you are seeing right there, they are going to respond. so says rodney scott the chief patrol agent for the san diego sector. listen to this.

our agent dechingsded themselves and those around them by deploying the safest tool we have is pepper gas if you will. pepper-based gas. it's an irritant. there is no long-term effects. i inhaled quite a bit of it myself. i was out there on sunday as well. we did that to protect the crowds. we took this caravan very serious from day one. it's like no caravan we have ever seen before. you've heard reports that caravans happen all the time, that's true but not caravans that have a propensity for this type of violence and not these massive numbers of people. steve: and the president yesterday, as he was leaving the white house. he said very clearly nobody is going to get in this country illegally. jedediah: these border patrol agents cannot be vilified for doing their job. what are they supposed to do. if you have people throwing rocks at you. steve: and hitting you. jedediah: and hitting you. that is an attack. you have to do something to protect. your job is to secure and protected that border. that's what you need to do.

what is the expectation? otherwise, supposed to just get hit with rocks and stand there? brian: also plays into the president wanting to fully finance that wall or get 5 billion to build a wall. this is a problem. weave can't keep sending troops down there to put razor wire up in the huge gaps in our border. makes him want to double down. he will shut down the government if he doesn't get his money. steve: listen, on sunday, i think it was about 50 people got through a hole in the wall. we have been talking about that wall in between san diego and tijuana for a long time. why is there a hole in it? jedediah: also, they are never gutsy enough. they worry about shut down the government. they feed into this frenzy about it. you have to do something about this. this isn't just about a wall. this is about the entire immigration system needs to be looked at. what qualifies for asylum. whether or not these people need to be at a port of entry. all of this stuff needs to be carefully looked at. now is the time to do it. brian: now is the time to go to jillian mele. time to look at you as you

>> obama had a separation policy. we all had the same policy. i tried to do it differently but obama had a separation policy but people don't like to talk about it. brian: president trump defending zero tolerance policy at the southern border pointing out his administration not the only one separated children from their parents when they separated illegally. why was it instituted? let's ask andrew ar arthur study for immigration studies joins us now. is it true, same policy? >> president obama had a policy in which there was separation of families but that primarily existed for parents who had drugs and serious criminal records and also for parents who posed a danger to their children or where there was fraud. the trump administration has had to respond to a much different situation on the ground where massive numbers of individuals have realized

if they come to the united states with their children that they could exploit our very lax immigration laws at the border. last month or in october we saw 23,121 family units enter the united states illegally, 150% increase over just july of 2018 president trump is facing a different situation today than president obama faced even four years ago. brian: this is getting worse and worse and one thing is consistent nothing is ever done. ben cardin yesterday says the administration has done nothing to help our administration system. i think it's been the president's focus from day one. operation streamline though is an example of an operation that was put in place in 2005. president bush had a problem with illegals. it was started by him. it was referred all illegal immigration for prosecution except for adults traveling with children. next thing we got

unaccompanied adults by the time president obama -- unaccompanied children by the time president obama came into office so that wasn't taken well. >> right. and president obama attempted to detain those unaccompanied adults but, unfortunately, under what is now a 21-year-old settlement agreement called the flores settlement agreement, we are only able to detain those children in dhs custody in 20 days and then they have to be released. needless to say if you know that you come to the united states and you are only going to be detained for 20 days it's going to make it more likely that you come to the united states. worse, parents paid smugglers, some of the worst human beings on the fails of the earth many are in lead with the cartels being paid by cartels to bring their children to the united states. in essence dhs completed that job by bringing those children to the united states absolutely

when it comes to genetic medical ethics. anything you want to call it what was done is actually in china now this has not been published in any sort of reputable journal for us to look at. this is something he said he did to the associated press. we can't confirm or deny that this happened. if he did it, he has gone against all of u.s. regulations and even though chinese regulations are lax, they said they had no awareness of what he was doing. what he did was he altered embryo d.n.a. before putting it into a woman so that they would be resistant to getting h.i.v. which their father had. however, the huge problem with this, by the way i should say gene editing is big in the medical industry right now. we are using it in the united states. we are not using it routinely but we have a lot of studies right now to help people who have genetic mutations or cancer or disabling diseases we are trying to fix that what he is doing is making a healthy individual almost super human. but when you put it into an

have criminal histories that is certainly a point as we continue to sort of learn about what's happened here as we also look into the tear gassing and the situation we saw just on sunday with the folks here. we did meet a little bit earlier with a second group this morning that we have already seen that was returning from trying to go over that wall. there is clearly a lot of folks still trying to get across but clearly not the situation we saw on sunday, steve? brian: griff, a lot of those border patrol agents will tell you that the people in these countries that come here know our policies better than we do. so, it's important if they hear that we are accepting a lot of migrants. if they hear it's going to be tough sledding, they might stay. do you think they're getting the message, the message is getting down that america is saying we are taking a stand now? not yet, brian, the gentleman i just spoke to is

there more caravan on the way we have heard that does he know he? says he knows for a fact there is at least a third or fourth caravan still coming with about 1,000 people and when you talk about the border patrol having pull factor meaning it's a pull factor to bring more caravans. people are in route from central american countries until they fully know exactly how we, the united states and the tijuana officials at least here is the san ysidro port are going to handle the situation. another final point very quickly is that eduardo said, listen, anybody could quickly pay money to one the criminal organizations, the cartel and get across. but they want to do it either legally or illegally on their own without spending money because they have no resources. steve: all right. griff, thank you very much. jedediah: what he said in spanish he wants to talk to someone who will listen. steve: there you go. meanwhile the president said

he didn't tell the truth and now is he in trouble. judge: that's what the government says. very, very complicated plea agreement i have never seen anything like it in high life. 175 pages. most plea agreements are to 5 pages. why? because they very shrewdly had him plead guilty not only to the federal crimes he was indicted but for stated crimes in new jersey, new york, and california. steve: no pardon. >> no pardon power to the president which he has not been indicted. if everything falls apart the attorney attorneys general f those three states could diet him. tell us what you know your investigation translate the president. we will ask the judge to go easy on you. yesterday when they were required to report to the judge are you ready for sentencing. he lied to us. we are not going to ask to you go easy on him. want to you sentence him to the max right away. p.s., we're probably going to indict him for lying to the fbi. it's the same crime that

papadopoulos went to jail for. brian: how rare is it to cut a plea deal and go out publicly to say i'm lying during my plea deal, i'm not living up to it? why is it public? they easily could have said no there is going to be a delay in sentencing. judge: two questions. how frequent is it that a person would lie in this context? very infrequent. he is really at their mercy. steve: his attorney says he didn't lie. judge: well, that's the issue. is there going to be a trial over what he lied about? and if so what are we going to learn in that trial? here's what he told us. here is what we have to contradict him. here is why what we have to contradict him is the truth and here is what he said a lie. that could take days. probably about the president. jedediah: these the key. most of the country is wondering does it involve the president. what's the prediction here. judge: my prediction is sentence to the max. i doubt he will seat light

interview? jedediah: ken comey from ramsey solutions is here with win the interview that helps land the job. this is amazing to be the academic dean of a high school heangsdy for students. what are some questions that people can expect to face when they go on an interview? what are the top couple of questions? >> get questions why do you want the job? many people are not even prepared for this. a lot of hiring managers want to see are you enthusiastic and passionate about this particular place to work? so have you got to be prepared for that why do you want this job? steve: so have you five steps to win a job interview. go over on the big board. first of all, research the company. know what to expect. dress for the job. be aware of body language and ask the right questions. all right. let's start at the beginning. research the company. that's pretty easy, isn't it. >> it is you will be shocked how many hiring manager people come in and don't know much about the company. this is important for two reasons. one, you need to make sure it's a good fit for you.

immigrants coming. in how many are saying i will sponsor i will take them into my home and they can stay with me until they find work and i will pay for their expenses and i will take care. how many of the celebrities are doing that i have not heard of a one. when they are willing, that's different. i think there is a way to balance this. it doesn't have to be either-or. it should be both. take care of people who are truly seeking asylum who are in danger. that's what we does a country. we are a good country. you don't just say doors are open. anyone come in. it doesn't matter if you are waving the flag of another country, if you actually mate america but you want to come here for all of its benefits u no, we have no obligation to open the doors for that. steve: governor, both sides are using this issue for political purposes. ultimately though, people are watching and they are saying you know, that's a mess down there. they've got to do something. ultimately, this comes to congress. >> it does come to congress who could have fixed it already if they wanted to by having a secure border. steve: why wouldn't they will want to?

coming? seeking better economic opportunities. may be notable reasons but not qualifying reasons for asylum. brian: if you want to come into the country, don't assault the border agents. one of the commissioners said there were multiple assaults against the agents. you come streaming in holding your country's flag, that you are evidently running from. the mexican government says they have tossed out 98 people involved in sunday's raids. they have been able to identify then. that means they will not get asylum in mexico or u.s. steve: they have been deported. one of the reasons so many people joined the caravan is because, with the caravan, there is safety passing through mexico from honduras. you don't have to worry about the drug cartels and gangs as well. but the president last night was down in biloxi as you know. tupelo as well. stumping for the republican candidate for the u.s. senate. he said, folks have a choice tuesday, when it comes to voting, if you're looking for a

has come true. in fact there was a caravan. there are violent people in there. secretary nielsen last night released on social media an eight-point statement. i would commend everybody to pull it. it is shock full of information. she makes very clear in there, she commends the customs and border patrol, our dod, and the president for going ahead and bolstering security forces at the border. why? because there are violent elements in the caravan. mainstream media only wants you to see the children, the families. they're telling you that most of the caravan are males traveling by themselves. of course projectiles and rocks were thrown at our brave men and women at the border. they used non-lethal force in response because they have a right to defend themselves, to make sure others who are there are not harmed. and secretary nielsen also points out about 90% of the people coming through are likely not eligible for asylum. the dhs processed 38,000 credible fears of asylum claims

just last year and she also says, that the violence and surge was entirely predictable. it has nothing to do with the base. are you telling me that national security is a base issue? this is everybody's business. she also says, and i want to repeat here on behalf of the president, congress must now do its job and act. the president negotiated in good faith. he has been very clear for 3 1/2 years now, border security and national sovereignty is imperative. if people care about these folks. they won't just go for the optics. they would focus for opportunity. take a picture of these people, use them, or you want to get them the opportunity, get them to stand in line, one of 26 points of entry legally. president made it clear time and again, completely. steve: he has. in the last year or so when it sounded like the president and chuck schumer had a deal. essentially the president was told by chuck schumer, we'll give you money for the wall.

you have to make a deal for the dreamers with us. but the president said, you know, i want other stuff with it. was that a miscalculation? should he settled for the wall for the dreamers? >> how is it a miscalculation, steve, respectfully, other things the president is looking for end to chain my greiges and visa lottery system? he put point a 70-point plan to congress october of 2017. that is 13 months ago. then it got boiled down to the four points. president for the whole world to see in the cabinet room last january, almost one year ago. held forth for an hour talking about making a deal on the dreamers. congress has not negotiated in good faith for many years on immigration. they failed to do their job. i think a large part how the president got elected. why this continues to be a big issue. these people were also -- brian: president reach out, being we're in a crisis point at border? i think both sides realize something has to be done? will he reach out to leadership

saying, come to the oval office, democrats, republicans let's get something done in the lame-duck session? >> they're always welcome in the lame-duck session to reach out, you know that. the president works 365 days a year. congress isn't always here. they're welcome to come in the lame-duck session. he made very clear, where he stands on this. because, courts are misinterpreting our immigration laws. a few judges making immigration law for the entire country. we can't have this this is legislative duty. also, i just want to make clear that the people who are really harming these folks who think they can come over the border are coyotes and others who took money from these people promising things that simply are just not true. you can't break the law. you have to come here legally. we're the most generous nation to immigrants in history. we allowed 33 million people to emigrate legally. jedediah: i want to pivot to russia. tensions are escalating between russia and ukraine. you saw a strong statement come out from nikki haley, mike

pompeo as well. what can we expect from the president on this? >> president is keeping a close watch what is happening there. i think it is incredibly important that the u.n. call this emergency meeting yesterday with the ambassador haley and obviously secretary pompeo has weighed in as well. this president has shown his willingness to sanction russian officials when necessary. he has done that. he expelled some from this country. he sanctioned others. he pushed back on putin, not once but twice, when assad was gassing his own people for example. so america first means exactly that. it is an ongoing situation. it's a fresh and unfolding situation. so he will continue to monitor it. brian: is he considering not calling off the meeting with vladmir putin or, has he changed the agenda if that meeting goes forward, putting this first? >> there will be a series of bilateral meetings at the g20. i will allow the president and his national security council to make those announcements. obviously mr. putin and president trump will be there,

as well as a number of other leaders. steve: meanwhile the house ways and means committee chairman kevin brady has a 297-page tax and irs package ready to be talked about tomorrow, perhaps voted on bit lame duck house later on this week. then it will go to the senate. it does need 60 votes. do you think there is bipartisan support to do something about fixing our tax situation? >> there ought to be, if i were one of democrats i lost my senate re-election bid, i'm in the lame duck, one thing i should learn from my loss, voting against a tax cut was probably very costly. it literally produced wealth and job security, job mobility and opportunity for the men and women in all of those states. north dakota, missouri, indiana, florida, for example, they voted judge kavanaugh, that hurt them too. voting against the tax cut was breach of faith with their constituency a year ago. perhaps they would do the right thing, to protect and create

political issue. you have the direct threat that the is at the border, well the president is doing what he feels is necessary to deal with that. the bigger political issue though remains immigration as issue in the country. it has been a big deal for the last few years. a lot of people are concerned about it. the president wants to get the wall built. one of his major promises in the campaign in 2016. democrats don't see any need to do it. they think security, agree more security is needed but won't agree to the wall. this is probably given we're in lame-duck congress. we have legislation coming up. we have a vote in the next week to fund the government. otherwise there is portion government shut down. the question is will the democrats agree what the president wants? seeps unlikely to me. brian: if they want daca, chance to get it in the lame-duck session, maybe they go ahead, mr. president you walked daca, walked away from 25 billion for the wall, work out interim deal? >> the wall is symbolic issue both for the president and for

the democrats, i just don't see likely there to be any kind of bridging it because the democrats say, there is no need for a wall. it is unnecessary. sends wrong message. we can do other things, improve security. president says i have to have my wall. democrats won the midterm elections in the house by quite a significant margin. they're focused on a lot of other things like investigating president. doing other things they want to do particularly on health care. i don't think there is any desire on the democrats part to give the president a win by giving money to build the wall. brian: don't want to do criminal justice reform. mitch mcconnell doesn't anyway. chairman of ways and means, kevin brady came out with idea how to revamp the tax system. really didn't tell many people about it. does it have a chance going through? >> very unlikely. need support of senate. we're down to last few weeks of lame-duck congress where republican majority in the old senate is 51-49. would need some democrats almost certainly support it there. they're not not mood to give a

win. they think the tax cuts, despite what kellyanne conway that the tax cuts help republicans. democrats take a very different view. they think the big tax cut didn't help republicans, actually if anything may have helped them giving a sense it was for rich and corporations. they're not in any mood to support a tax cut right now. there isn't just enough votes. there what they're talking about relatively technical measures, probably beneficial extending tax cuts already there. i just doubt there is enough political support. brian: see if we get judges through or last-minute deals to fund the government. they haven't funded homeland security just for the wall reason. we'll see if there is any type of break. your brand new show on fox business network? >> i will launch on friday.
