yesterday. >> people will cast their ballots in one of the most important senate elections of your lives, of all of our lives. cindy is so important, so respected. we got the sent her back. if we win tomorrow, we will be 53-47, which is substantially more than we had. >> harris: do not adjust your television. the audio was a little weak for everybody, but we wanted to show you. democrats see an opening for an upset, hoping that espy is generating higher enthusiasm among voters, particularly african-americans. meanwhile, hyde-smith also looking to connect with voters during last night's rally. watch it. >> i tell you, in the beginning, i said "this campaign, this election, it's not about me. it's about the people of mississippi. it's about what you believe in, and what you care about." >> i've seen palpable enthusiasm all over mississippi.

you could see it saturday, in the absentee in-person voting. here in jackson, mississippi, there were record absentee ballots returned. >> harris: jonathan is where it's all happening, mississippi, with the latest. jonathan? >> hi, harris. mike espy cast his ballot here at this church outside the city limits of jackson. he, of course, being the democrat in this race. he enjoyed strong support among african-american voters in the state. the state, by the way, is 38% black. it's the highest rate of any state. a democratic strategist tells fox news, espy is going to need to get more than 20% of the white vote if he's going to win this runoff. >> if only african-americans come out to vote for me, they come out in record numbers, i won't win. i know that. i have known that all the time. i have known that throughout my career. we have to have a good number of crossover. we see that.

>> republican senator cindy hyde-smith has tried to tie her opponent the national democrats, as a republican running in a solidly red state she should have the advantage. but, hyde-smith made several gaffes during the campaign including a joke about attending a public hanging. yesterday president trump tried to short of her support with rallies in tupelo and biloxi, where the two made the case for expanding republican control of the senate. >> lower taxes! less regulations, supporting our military! supporting our veterans! supporting our law enforcement! protecting the life lives of te unborn! [cheers and applause] it's about standing firm on this second amendment right, all day long! [cheers and applause] >> police are investigating nooses that appeared on the grounds of the mississippi state capitol, along with signs referring to lynchings that occurred in mississippi's past.

those items have been removed but they've added to the tension and debate surrounding this high-profile runoff election in mississippi. the polls in this state remain open until 7:15 p.m. central time. >> harris: jonathan, on the ground for us in mississippi. great to see you, thank you very much. we bring it out to the couch. this is a very red state. it is down to the wire now. how do you call it? >> pete: if it's a red suit, hyde smith is going to win. the polling shows that. the attempts by the media to further -- listen, you can say graceless things, foolish things, does make them racist things. i think people that know her -- >> jessica: do you think talking about a lynching is not a racial connotation? >> pete: i don't want to get into the semantics of it, but there were -- >> jessica: you have too. she said "lynching." >> pete: she did not say lynching, she said public hanging. that would refer to lawful

executions at certain times in the 19th and 20th centuries. i'm not saying -- you are playing in the field he want to play in. we just thing that she is racist. her public shows that she isn't. their issues people fight about, but they are making it about race at the last minute. this is a republican seat. she's going to win. i don't think playing the race card wins at the polls. >> jessica: okay. >> pete: she didn't say lynching, you did. the >> jessica: public hanging, public lynching, it has connotations. especially in the south, for the fact that african-americans were lynched. she also wore a hat with a confederate flag on it. she went to a segregationist school. i'm not here to call her racist, i'm here to say that she is going to win this election and that i agree with you. it's not like doug jones, running against an alleged. he only won by 1.7 points. i understand it's the deep south. free to say that this is graceless, to make a joke that is so utterly inappropriate, and she isn't condemned by everybody. i think it there as possible. >> pete: you are impugning her

motives in saying that it's racist -- >> jessica: do to get spiny? is that your sense of humor? >> harris: jessica come he didn't say it was funny. >> jessica: if it gets a little more than graceless. >> harris: you know who will decide this? the voters of mississippi. just as he sought in alabama and other areas of the candidates have stepped in. by the way, mike espy has had some gaffes along the way, as well. if there is a racial component for her to try and defend, she has apologized. there is a history in mississippi that you can't run away from. she's been in public life long enough to know that. what really counts right now is what's happening on voter day. just yesterday, air force one landed there. will make a difference? >> dagen: i think it will because she has definitely been running with the president. she has been very vocal in her support and vote for brett kavanaugh. if you take the recent controversy and some of the things she said, some of the pictures that have surfaced, she is one of those republicans that has benefited from tethering her reputation to the president. as we have seen, that can be hit

or miss depending on what part of the country you are campaigning in. and the votes that you are appealing to. in mississippi, the president still has quite a bit of sway. i don't think she's an ideal candidate. i think this is one of those turns of phrase that is so deeply baked into the culture and the way people talk when they're trying to express something that they no longer remember what it means. sometimes you do have to look back and examined that painful history so that you can hopefully have an honest discussion and move on from it together. >> harris: very astute. >> dagen: i think this should serve as a reminder, the republicans as well, it will take more than just running a female candidate to win back the female vote. it has to go much further than that. i just was remembering back to -- i think it was 2010, remember christine o'donnell in delaware? "i'm not a witch, i'm you!" [laughter] and sharon angle in nevada.

those were flawed female candidates. we've got a long way to go in republican politics for them to win those female votes back. what you saw numbers in the midterm election. college-educated women went for a democratic house candidates by 26 percentage points, and suburban women, 17 percentage points there. that should be the focus, here. by the way -- and with roy moore, same issue -- it's a candidate-by candidate thing. even before the allegations against roy moore, he had been removed from his court seat twice for define court orders. he was a terrible candidate to begin with. republicans need to wake up. >> harris: really quickly, jessica -- if this happens tonight, and it looks statistically that she's never lost her lead by , hyde-smith. it looks like it will happen for republicans. that broadens out. it's a bigger issue for democrats than focusing in on florida or mississippi or alabama or any of those states

where vote counts were close and some of the arguments have gone outside of the voting polls. >> jessica: absolutely. every seat counts, and we know that -- especially when there are a few moderate republicans who always seem to be on the fence about whatever the big vote of the day is. this wasn't a seat the democrats came into the 2018 midterms expecting that we were going to pick up. people were hopeful about it. >> kennedy: doug jones is still walking around going "really?" [laughter] >> jessica: exactly. >> dagen: since 1982, democrats haven't won a sent a campaign of the state mississippi. 1982. >> and not since reconstruction. the >> pete: if she wins, the pressure really moves toward republicans and the senate. can they, to your point? if they have 53 votes. >> probably not. >> kennedy: let's switch chambers. house of public and leaders adding to the white house this afternoon, ten days until the government partially shuts down,

unless several spending bills are passed and signed. front and center, the border wall. president trump not budging from his demand for $5 billion to fund the wall along the mexico border. according to politico, senate g.o.p. leaders have discussed with the president the possibility of giving him that $5 billion spread over two years. the president has reportedly not ruled out that idea, but it's unclear whether democrats will go along with such a concession. counsel to the president, kellyanne conway, taking lawmakers to task for not doing their jobs. watch. >> congress must now do his job and act. the present has acted in good faith. he has been very clear for three and half years now that border security and our national sovereignty is imperative, and if people care about these folks, they won't just go to the optics. they would focus on opportunity. just take a picture of these people and use them, or you want to give them the opportunity. get them to stand in line, come through one of the 26 ports of entry legally, and come into this country legally.

>> kennedy: pete, who is winning this war in optics? in terms of immigration, and border wall funding? >> pete: for funding, i think the president is winning the war in optics. i think the republicans in the settlement look bad. time and again, he said he wants money for it. they control both chambers and haven't been able to deliver. if you remember, mcconnell and the house republicans promise this president "let's just pass it, let's not have a budget battle before the election. let's get through the election. then we will do the border wall." i think the president will end up looking bad if he doesn't stand up for the board while at this point. he was promised, he said he would wait, here we are, they still control to chambers, it sound like is only going to get $5 billion. that sounds like the highest end of what's feasible. i think he said a sand that ground and say "i will shut it down if i don't get my $5 billion. you said it would be done, it's time to do it." once it's in democratic hanscom it's over. >> kennedy: you can't keep threatening a shutdown but there are political high-stakes. it's after the midterms, 2020 is

still a ways away. if you would launch a shutdown, would now be the time? >> jessica: i guess it would be the time. i don't think i ever really is a good time to do it. [laughter] there don't seem to be real long-term consequences for president trump about the way he plays the game of shutting it down or not. we have seen in the last six or eight years, whenever anything gets shut down, no matter whose fault it is, republicans get blamed. i imagine the scene would be happening here. if you can get that $5 billion, he would claim a victory on that ahead toward 2020 with it. and still get to separate himself from the republicans. on this issue, he runs as a party of one. >> pete: correct, he's running against the republican party. >> dagen: you know whether republicans really failed him, as well? i've said this on the sofa repeatedly. not attaching restrictions to the funding of century cities in that omnibus spending bill earlier this year. >> harris: that's an interesting -- >> dagen: that was shot down in the courts when they tried to

remove that funding. that is the power of congress, the power of the press. "no stock market." i said this briefly yesterday, but the stock market is in the tank since october, moving into november. the president watches that very closely. he watches the stock market -- used to brag about it when it was hitting an all-time high, one after another. i would argue that the stock market and investors are not going to like a government shutdown. i think it would avoid doing anything -- >> kennedy: last time we were on the brink of that, the market -- there was barely a blip. if you end the fed and cut entitlement spending, than the economy -- >> dagen: i want to be blonde and 100 pounds and 8 feet tall. >> harris: here you go, harris. [laughter] what i think is really interesting about this is that the president can be a party of one. he can be that come on so many different issues, because he was

elected to be different. let's not make it sound like the establishment and republicans were ever really with him to begin with. the >> pete: that's exactly right. your point on securing funding -- the point about the wall. here they are, to use in, they haven't done it. they haven't been with him for this is his fight, alone. >> harris: the president's right, none of those republicans can lend their plane and make a difference on a political stage like this president can for candidates. i'm curious, who among them stands up and comes up with a bright idea that we are going to resist trump? if you will. some of the more important promises -- not everything. >> kennedy: with the republicans are starting to sound like adam schiff. here to talk about former trump campaign chair paul manafort appears to be in hot water with robert mueller, who said he violated their plea deal by repeatedly lying to prosecutors and fbi agents. that's not good. what it says about the probe, and what it means for the president. plus, president trump touting border security days after

>> harris: we are going to go to the tensions at our southern border with mexico, now. mexican officials say they are deporting some 100 migrants who rushed the border on sunday at the san isidro crossing into san diego. tijuana's major is calling this -- mayor, rather, is calling the situation a humanitarian crisis. meanwhile, president trump at a rally in mississippi for cindy hyde-smith touted the need for better border security. watch. >> when you have open borders can be of crime. when he of century cities, you have crime. republicans are committed to defending the sovereign territory of the united states of america. >> harris: meanwhile, homeland security secretary kirstjen nielsen is defending the response to the migrants at isidro. in her statement, issued last night, she also said "we have confirmed that there are over 600 convicted criminals traveling with the caravan.

ignored. criminals could want to use this caravan. i will also note, under the obama administration, at least once a month, gas was used as aborted by border patrol. 26 times in 2012, 26 times in 2013. 29 times in 2017. pepper spray 100 times in 2012. this is what is used when you don't have deadly force. it's actually not horrifying. it's humane. >> harris: as a veteran, you have seen this probably of clos close. it's called rules of engagement. he won't shoot a people, but you prevent massive mobs of people from overwhelming your position. if you don't have a wall, you have to do things like that. >> harris: i talked to the president of the border patrol council yesterday, and he gave me hard numbers about where people are. in tijuana, you have between 4,006,000. try to absorb that level at a city that size. >> kennedy: have you been to tijuana? >> harris: i have, many times. >> kennedy: that's first time a lot of americans actually see real poverty.

i have wrecked everything." we may have a wall, but that's only part of it. we have so much chaos and confusion with these laws that people don't know what to expect when they come here. >> dagen: touch on the point "the wall street journal" addresses an editorial today that the violence and lawlessness erode public support for a generous asylum policy. americans will be watching -- there were 69 migrants who rushed the border on sunday, they made it to u.s. soil. they now get to stay here, waiting -- they will be detained and prosecuted. but they are -- as they apply for asylum. that is despite their lawlessness. in those instances, their lawlessness was rewarded. what does that do to turn public sentiment against people who want to come here legally? >> jessica: i think what doesn't help in terms of sentiment for people who do want

to come here, looking for port of entry and to seek asylum, when you see those shots of tear gas and you see women running with kids with no shoes on, it pulls at the heartstrings, as it should. geraldo rivera yesterday, on "the five," made an impassioned defense on the part of people he calls economic refugees. that they are coming here for a better life, for a job. a speed when he knows, though, that the enumeration of things that qualify for asylum do not include you being poor. >> jessica: he does understand that, but he also understands that we are a nation of immigrants and that we do -- you can legally come to seek asylum. you can plead your case. that is your right. you're totally cracked, a few people may have ruined this. at least in the next few days, by throwing those -- >> harris: you know what really ruined this? congress did not handle their business. >> kennedy: amen. >> harris: oh, yes, ma'am. speaking of tensions, some among house democrats now are bursting into view ahead of tomorrow's caucus vote for house speaker.

he provided truthful information, and that he upheld his side of the bargain. the president ripping the special counsel in a series of tweets, saying "the phony witch hunt continues, but mueller and his gang of angry dems are only looking at one side. not the other. he's a conflicted prosecutor gone rogue. the fake news media builds bob mueller up as a saint, when in actuality, he is the exact opposite. he is doing tremendous damage to our criminal justice system." as you might expect, one of the top democrats on the senate judiciary committee has a different take. >> manafort has lied repeatedly. he is a chronic liar and a crook. his word is always going to be suspect. but, it shows that mueller knows a lot more than man of thinks, and maybe the trump thing. >> dagen: in the meantime, a former watergate prosecutor came

with the stake. >> i think there is a theory that makes us probable and sensible, that he would have pled guilty to avoid the cost of a trial, knowing that he would get pardoned at the end. and, that he may be able to get away with lies because he is reckless and arrogant. if he could get away with them, he might actually be able to help donald trump. >> dagen: pete, your take? >> pete: i think all along, whatever shady dealings existed, were brought to the trump campaign by manafort and his history of those dealings. it didn't happen because of the trump campaign. to me, he has said all along that it had nothing to do with collaboration or collusion. i don't think there is much -- it's hard to know where it cuts, because you don't know much about what bob mueller knows and what he's doing. there hasn't been a ton of leaks coming out of his efforts. i think if there was a big bombshell, we probably would know about it. it would probably be in "the new york times," it would

find its weight there to shade the public narrative. i think this is last-minute wrangling so that he doesn't spend more time in prison then he needs to. >> dagen: what we do know, kennedy, is that paul manafort is no longer a credible witness. [laughter] even if he gave more information to help the mueller campaign build a criminal case, or criminal cases against other individuals, he can't testify because the mueller team is saying he repeatedly lied. >> kennedy: yes, this is either total exasperation on the part of the mueller team, because they haven't been able to get a straight answer from manafort for the whole time -- he probably thinks he's telling the truth. that's one of the most entertaining things about this whole team, manafort probably -- according to his lawyers, he has lied at all. either that or they are trying to squeeze him like an orange at a juice bar. one last time, to give the last bit of information they need for some heftier charges. or, at least something in writing against the president that they can present to the dems in congress. >> harris: is the argument there -- because maneuver

setting this up, is the argument that paul manafort would like to show loyalty to the president? how do you get to presidential pardon? i just want to follow that trail. you mentioned easing his prison time. how do you do that? do you just give miss information >> pete: it could be the case that he tried to get a plea deal and get away with not exposing certain things when the point of the plea deal is to then be honest with the -- >> harris: is that too far shark jumping? [laughter] i'm just following the trail. >> dagen: if andy mccarthy, andrew mccarthy -- >> harris: good point, we don't have the information so it's hard to follow. >> dagen: andy mccarthy, fox news contributor, he writes for the national review. he wrote this. "many will thus detect a play for a pardon in manna for its ad breaching of the plea agreement, coupled with his public stance then far from lying he has been resisting the heavy-handed attempts to make him lie.

this take find some support in the president trump tree going back to august 18th. there was the tweet president put out saying "i feel badly for paul manafort is wonderful family." a member that one? took a 12-year-old case, applied tremendous pressure on him. unlike michael cohen, he refused to break and make up stories in order to deal. such respect for a brave man. >> harris: those were the facts in the context of that -- yeah. >> dagen: andy mccarthy, always. >> jessica: there's that, but there's also the fact that paul manafort is a criminal and a liar. so you might just be being a liar because that's what he does. there's also a new bit of information about paul manafort going to the ecuadorian and emby to meet with julianna's launch. then he goes in season, june 2016 becomes the is campaign manage, and they start dumping democratic emails. without information from which but mueller certainly had will before i did, maybe there's more to this and it's not paul
