decades all, snow balls were identified as missiles in the town. the good news after the laws were updated, best threw the first legal snow ball. thanks for joining us. i'm dana. here's shep. >> shepard: it's noon on the west coast, 3:00 on the east coast where we're tracking some fast developing news. robert mueller and michael flynn, today's the day. the special counsel expected to drop some key details about what the former national security adviser did. also, did donald trump profit from the presidency? the accusations and brand new subpoenas from two attorneys general. republican senators say they're more certain than ever that the saudi crown prince was indeed involved in the killing of the columnist, jamal khaishoggi.

what they have been saying after a sit-down with the director of the cia. and our reporting begins with the diving dow. a sharp downturn after investors lost confidence in a temporary trade truce between the united states and china. they say they're unsure now whether a deal with china will be done after 90 days. a lot of investors selling off stocks and looking for something safe like bonds and as a result, yields have dropped. you can see we're off 670 points at the moment. at one point, just before 2:00 eastern time, the dow was off 800 pounds. same for the nasdaq and the s&p in percentages. gerri willis is live at the new york stock exchange. gerri? >> yes, shep, it's been a brutal sell-off. the dow at one point off 700 points. right now down 662 or 2.6%.

all of these indexes coming down 2% and change. the s&p 500 down 2% and the nasdaq down over 200 points. you said it, it's worries about trade, worries about tariffs. can we get an agreement with beijing. that's a big question. all of this nonsense started this morning after trump's tweet, i'm the tariff man, he wrote. does this mean we won't get a deal with china or not? the first thing, you saw a sell-off in the dow. caterpillar, who has much of their sales going to china, that shot down 5.4%. nowhere to run, nowhere to hide here today, bank stocks down as well. jp morgan chase down 3.9%. one of your favorites, apple down 3.7%. they have a lot of sales in china as well. continuing to watch this here. a little bit of improvement as we come to the close. the sell-off not accelerating

here, shep. >> shepard: gerri willis live at the stock exchange. the big story today, a deadline in the russia investigation which could tell all of us how president trump's former national security adviser has been helping prosecutors since he flipped. and it could offer new clues about possible indictments that might be coming. the special counsel, robert mueller's office, is set to release memos on michael flynn about his cooperation for his sentencing. the retired army lieutenant general served on the trump campaign, served in the trump transition team and served in the trump administration. he was the president's national security adviser for a few weeks when he admitted that he lied to president pence about his contacts with russia. he was the first high-ranking trump official to agree to cooperate in the special counsel's russia investigation. a year ago, michael flynn pleaded guilty to lying to the fbi about reaching out to the russian government officials on

trump's behalf. specifically michael flynn admitted that he made false statements about his contact with the russian ambassador to the united states. the talks happened during the transition period when president obama and his staff were still in the white house. michael flynn admitted he spoke to the ambassador after the obama administration hit russia with sanctions for their interference in the 2016 election and michael flynn urged russia, don't retaliate. michael flynn said the members of the president's inner circle had directed his actions during that transition period. president trump at the time said he had nothing to hide. in the year since, flynn's confession, we haven't heard from either side about the details of his deal. we don't know what flynn told robert mueller's investigators or what he's set to receive in return. that could all change at any moment. catherine herridge reporting live from washington.

>> shep, it was a midnight deadline tonight. the memo could come at any time documenting his cooperation and shed light on contacts with russian officials. the ambassador, sergei kislyak after the election. flynn pled guilty to lying to the fbi over his post election contact and faces a maximum five-year sentence. with this plea agreement, it's expected less if any jail time. there's mysterious and complicating factors in this case. the march house russia investigation while flynn was lying to agents, james comey and his deputy, andrew mccabe testified their agents saw no signs of deception with mccabe telling the committee didn't think flynn was lying. later this week, mueller's team is expected to submit briefs on manafort, they accused him of

violating his deal with the special counsel as well as michael cohen. >> shepard: katherine, how have lawmakers reaction? >> the reaction is split along party lines. the three key filings from robert mueller made signal a road map to the investigations final stages. >> we'll see the president respond badly to this as the walls are closing in on him. >> the president says there's no collusion. mueller has nothing except commitments and perjuries and other things outside of this. >> one of the questions marks is whether robert mueller will issue a final report, if you will, to the justice department and they will clear it for a public release. a former prosecutor said to fox today that they believe this week's filings in combination with the filing last week from cohen, which was so detailed are like a proxy for a final report because it's already out in the public domain. >> shepard: catherine herridge reporting live from washington. a lawsuit accusing president

trump of illegally profiting off the presidency. here's what is new. now a federal judge is giving attorneys general in maryland and washington d.c. the okay to hand out more than a dozen subpoenas, this particular case focuses on trump international hotels, which is blocks away from the white house. whether president trump has made money off foreign and state governments spending while he's been in office. the two attorneys general are expected to subpoena the trump organization, the internal revenue sayings and other entities in the lawsuit against president trump. john roberts reporting live from north lawn. >> shep, we thought the subpoena would have gone out but now but seems to be a delay. the attorneys general from maryland and the district of columbia issuing subpoenas to more than 20 trump companies and other entities trying to get a look at the finances of the trump international hotel and whether or not the president has

been personally profiting from foreign dignitaries to stay at that hotel. all of these companies, you can see them rolling here, were served with preservation subpoenas last year ordering them to preserve all records deeping with the trump international hotel. the attorneys general also planned to subpoena three non-trump hotels to help prove the unfair competition aspect of their arguments to the irs. the attorneys general allege that the president's continued ownership of the trump international hotel violates, as you put it at the top here, the emoluments clause of the constitution, which prohibits elected officials from profiting from foreign governments. there's been many lawsuits that have been filed against the president in this regard, this is the most prominent. friday, attorneys for the department of justice suggested that they may be filing what is

called a writ. so far they have not taken any action, nor does any action appear imminent. again, these subpoenas we expect would have been out a couple hours ago, but there's a little bit of a delay. we should get them sometime this afternoon, shep. >> shepard: john, on another matter, the president issued some tweets yesterday that a number of lawyers have suggested are tantamount to witness tampering in the mueller investigation. >> one of those lawyers happened to be the muscle of a very prominent member of the white house senior staff. george conway, kellyanne conway's husband has been a frequent outspoken critic of president up from. yesterday he took aim at a tweet the issued. the president praised roger stone and quoted what roger stone had it is a. in the tweet the president said i will never testify against trump. that's the quote from stone.

the president said at the end, nice to know some people still have guts, to which george conway retweeted and added a comment say file under 18 usc subsection 1503 and 1512. those are federal statutes involving witness tampering and influencing jurors. eric trump criticized conway. he said -- >> kellyanne conway has weighed in in the past on some of the tweets that her husband has tweeted. she said he's an outspoken and he has his own views. she might not share them.

he was both a consequential president and a kind person. and very funny. i mean, when we won in 1988, he went down to florida to go fishing. he wrote me a handwritten note about thanking him strike the right tone, put the right words in his mouth, say the right things. when we lost in 1992, i remember the period after that election. he was sad not so much for himself but he was sad that people worked so hard and they were let down. he wished he delivered for the team. but he was a terrific guy and funny, too. >> shepard: you mentioned the sadness in 1992. you spoke of him running then and he opened up about how he felt about those around him. >> he saw us all working hard. you work in the white house, work like crazy, travel to four state as day. he would say, are you getting enough sleep?

he was more concerned for the staff than himself. like i said, he wanted to win that race. people say oh, you know, he really wanted to win that race. i believe he thinks he would have if ross perot had president run. it's funny to see him in the end. i had the honor, the pleasure of going up this summer to maine. it was a couple days after he got the world famous sully, his dog. you know, we talked about his accomplishments. the clean air act, the americans with disabilities act. i talked to him around r&d and how he launched a high performance commuting initiative that gave way to parallel computing, which is how all data centers are organized now. he kind of leaned forward in his wheelchair and he got that empty smile and he says does that mean i was the father of the internet and not the other guy? >> shepard: that's good. >> that is -- gene vecker came

>> shepard: a major cyber attack targeting the national republican congressional committee happened during the mid-terms. gop officials confirmed that to fox news. the website politco first reported the hack with new that the cyber criminals broke into

four senior aides e-mail accounts and exposed thousands of sensitive e-mails. again, that was this year's mid-terms. back in 2016's presidential electors, hackers linked to russia leaked more than 150,000 e-mails from big-name democrats. the fox business network's kristina partsinevelos reporting on this new information. hi, kristina. >> the nrcc, the campaign arm of the house republicans, were hacked. the nrcc confirmed to fox news that yes, there was a cyber intrusion but an unknown entity. even though politico came out with the news, they revealed it to the public. there was four senior nrcc aides that were hacked. thousands of e-mails that were exposed. this attack was detected back in april. so there's a timeline too in terms of when they decided to come forward with the information. the nrcc was asked why they

waited so long. they didn't want to share any confidential information. they say there's one line in the report that stood out stating that party officials would not say when the hack began or who was behind it. although they privately believe it was a foreign agent due to the nature of the attack. if we're speaking about who knew about it, right now many big republicans in the house are unaware, paul ryan, speaker paul ryan was not aware and several others have no idea about the hack. this comes at a time in the 2016 election, there was hacking but not even with the political world. they're seeing it across many businesses, too. in the past week, starwood was hacked. they operate all of these hotels, 500 million people. and then cora, the data branch. 100 million people. >> shepard: kristina partsinevelos live in new york. the mid-terms happened a month ago and a congressional seat in north carolina still in doubt

after accusations of voter fraud. jonathan serrie reporting. >> we thought these mid-term elections were over. the north carolina board of elections has yet to sercertifye district 9 race in north carolina. a number of ballots were never returned and some alleged door-to-door solicitors came to their home and collected their ballots. >> there was a county that should -- seemed like historically would have had more democratic absentee ballots, had more republican absentee ballots. >> democrat dan mccreedy conceded the race but four weeks later the race is still officially unresolved. mark harris leads why 905 votes. but democrats might not seat

harris unless the issue is resolved. the governor has named a replacement for former elections board chairman, andy penry. he stepped down over the weekend amid criticism for posting a series of anti-trump tweets. the board has plenty of work to do this month. on the 21st or before, they're going to hold a hearing. if they determine that a second election is warranted, the district 9 congressional seat will not be filled until after the new congress is sworn in hahn january 3. shep? >> shepard: jonathan serrie reporting from the southeast newsroom. the news continues to break on wall street. the dow is off almost 3% on the day. this is the least of the worries. the s&p is off more than 3%. the nasdaq off more than 3.5%. the nasdaq down 272 points. analysts say there's concerns about the economy slowing and investors have doubts about the u.s. reaching a trade deal with

china because of all of the mixed messages coming out of washington. susan lee with more on this. >> a good way to put it. we're down at one point 800 points on the dow. that's the worst sell-off that we've seen in six weeks. the last time that we dipped to 800 points on the stock markets. you're right. the concerns are two fold. the china trade truce and there's more willingness from the white house, messages on twitter that they're willing to take up higher terraces. that had a lot of investors rotating to safety. i want to show you something. this is very complicated. i'll try to explain this in basic terms for you. the government bonds, the ten-year note, the interest rate on a ten-year note close to dipping below the two-year note. one of the longer temp interest rates dip, that's a presession ordinary indicator. that's preceded ever recession

in ukraine. jennifer griffin reporting live from the pentagon. >> shep, this is a treaty signed by ronald reagan at the end of the cold war known as the intermediate range nuclear forces treaty or inf. signed with gorbachev, it bans all land cruise missiles 310 to 3,500 miles. russia was treating on these missiles under the obama administration. secretary of state mike pompeo announced that the u.s. would pull out if the russians don't comply. >> today we must confront russian cheating on their arms control obligations. always i told my fellow ministers, our nations have a choice. we bury our head in the sand or take common sense actions to russia's disregard to the inf treaty. >> president trump said he wanted to tear up the inf

treaty. jim mattis convinced him not to go it allow but by bringing european allies on board. nato issued the following statement. nato said we support the following that russian is in material breach. russian's foreign ministry spokesman said they comply with the treaty and the u.s. knows it. >> shepard: it doesn't. they know for the last five years they've been out of compliance. why the request to pull out now? >> the u.s. feels their hands are tied by the treaty in the middle east and in asia where china is not bound by the treaty. 90% of china's missiles fall into this range. iran is also not party to the agreement. the u.s. has leverage over russia right now with the capture of the sailors and ships. today russia opened the strait where the incident occurred but the ukraine says they have

evidence that russia attempted a cyber attack on its judiciary. that attack was thwarted. shep. >> shepard: thanks, jennifer. an israeli military officials say hezbollah is digging tunnels across the border to try to shift the battlefield to israel. the israeli military shot and tweeted this video. officials say it shows one tunnel that has electricity, ventilation and a communications cable. all 80 feet below ground. no word on how big this tunnel network could be but israel has launched a military operation to thwart it. this puts the new attention on israel's northern border after months of fighting in the south. >> minutes before this operation was announced this morning by the israelis, i spoke on the

phone with a lieutenant colonel in the israeli army that wouldn't confirm how many tunnels are believed to have been dug by hezbollah into israeli territory but said there's one and israel plans to destroy all of them. here's what we know about the situation. overnight, israel launched operation northern shield to identify and destroy tunnels created by hezbollah. a new video shows two hezbollah militants approaching an israeli camera before it debt canadianed. the tunnel was 80 feet deep. that's about the equivalent of a self story building underground. the tunnel is two football fields long. certainly a concern for not only the military but civilians in northern israel that this could be used by hezbollah fighters to enter israel in a ground operation were launched. when it comes to israeli reaction here in jerusalem, many

of prime minister netanyahu's opponents saying the political timing of this operation is questionable. it comes days after the israeli police recommended for the third time this year that the prime minister should be prosecuted for criminal fraud. the charges have been recommended by police here in the city of jerusalem. also moving forward, there is certainly concern in the region about iranian influence because hezbollah receives a lot of funding from the iranian regime. shep? >> shepard: more about the football star, careen hunt, after he kicked and pushed a woman on camera. now there's a new video of another violent incident. we'll hear from hunt, one of the victims in the video and his former football team. as our reporting continues. higher! higher!

the nfl was notified, but now nfl investigators have undisclosed information about that incident that may add time on to hunt's suspension. as for the january bar fight, the nfl did not know about that until very recently. it happened hours after the chiefs lost their playoff game to the titans. a male customer says he was jumped by a group of men, including kareem hunt and former chiefs running back george atkinson, both of whom delivered the majority of the blows. no charges filed. this will clearly damage kareem hunt's case. and then there was the incident where hunt appears to shove and kick a 19-year-old woman at a cleveland hotel in february. here's kareem hunt telling espn the alleged assault is way out of character. watch. >> you can't really explain it. the video shows i was in the wrong. i'm not that type of person. i'm really disappointed and embarrassed for myself and my
