opening monologue. storm asked let's be honest, border security is a deadly serious issue. according to the senate for immigration studies since 2001, 15 suspected terrorists have been apprehended at our southern border including islamic extremists from al-shabaab, and isis. meanwhile, over 25,000 other known criminal immigrants have been arrested since 2016. this includes over a dozen murderers. 370 convicted sex offenders and nearly 5,000 individuals convicted of illegal drugs or weapons charges. now of course i would tell you that the vast majority of people who went across the border illegally probably are people that want a better life for themselves or their family but even the illegal immigrants with the best of intentions are costing the taxpayers an enormous amount of money.

according to a recent study, every illegal immigrant that successfully crosses all border costs you will come of the american people, $70,000 per year. on december 3rd, over 3,000 people were caught illegally crossing in just one day. in november of 2-year-old toddler was found crossing the border without her parents. we must have the ability to decide who comes into our country to ensure the safety on both sides of the order, the event people and make sure they can take care of themselves. so now more than ever we need a massive wall. it's a common sense strategy that actually works, keeping potential terrorists and those that are criminals, human traffickers and drug traffickers out of this country. that's a national security issue. the president has long promised to build the wall and now he's fighting to do just that, he's fighting for what's right. he fought hard and this is his history for tax cuts. he fought for new trade deals

and he's waiting on that front. he fought back against obama's and less bureaucratic regulations and he has created an environment for businesses that are now thriving. he fought for energy independence and for the first time this week, and 75 years, we are energy independent. he fought for the confirmation of qualified originalists, justices and he has one and now he's fighting for the wall on the southern border in a big way and confronting nancy pelosi and chuck schumer for playing politics with what is the safety and security of every american citizen. take a look. >> president trump: i would like to not see a government closing the shut down. we see what happens over the next period of time. border security is extremely important and we have to take care of border security. when you look at what happened with the caravans, with the people, we shut it down. we had no choice, we shut it

republican in congress and you vote no, i will tell you right now that we will be highlighting your name and your record and holding you all accountable. this is about our nation security. it's about stopping drug traffickers and human traffickers, it's about safety for the american people. none of this seems to matter to the left and yet again, they are on the wrong side of what is a monumentally important issue. according to a harvard harris poll, a majority of americans support the president. 79% want more secure borders. and 68% want an end to the visa lottery system. democrats don't want to listen to the american people, maybe they should listen to themselves because they are such hypocrite hypocrites, they sound a lot like donald trump and we have the tape to prove it.

the security of capitol hill. he actually then questioned the president's manhood, telling her fellow democrats, it's like a manhood thing for him. as if manhood could ever be associated with him. this wall thing that shows you i get into a tinkle contest with the skunk and you get tingle all over you. that's the leader of the democratic party. you watch in the first three months, this will be entertainment at its highest level. let's contrast those petty statements. >> president trump: i don't might have an issue of border security on my side. if we have to close down the country over border security, i actually like that in terms of an issue but i don't want it to be an issue.

and having the chaos. but 80% of the fentanyl comes in through the southern border. this is about life and death for americans and citizens that come into this country. we want to stay the country that people want to come here. but also, with that scene in the oval office where democrats continued to clown themselves, it's the best chance for americans to see president trum president trump's commitment to transparency and throwing them that kind of meeting. but $5 billion for a wall, that's a lot of money in human history. they were able to find 150 billion for barack obama to give to an american enemy, to the biggest state sponsor of terrorism around the world and to a country that murders americans and kidnaps them and holds them and it disappears them, they found 150 billion for that but they can't find

5,000,000,002 secure the american people. why is that the case? why does $5 billion to secure the border, why is that not possible for them? but they found that kind of money, and extraordinary amount of money. since 1990, the five sectors where we had built the wall, over 90% of illegal traffic was ended. that cut it down by over 90% in every single place where we build a serious secure wall and barrier. that's what we know, that's what the american people want and that's what the president must, and i know you would agree, must play hardball here. he is our only chance to get these things right and stop the wall. >> sean: i like that he owns it. we all make decisions in life and i think the american people

respond very favorable to this. he also has another option. by the way, lindsey graham said, don't give up mr. president. we have a $750 billion military budget, this is not a national security issue. at the end of the day of the president needs to go that route, i don't see any problem in that being plan b. >> let's put this in context. this is not nichols that we are talking about, but in the scope relatively speaking about federal budget, it's nothing. the fact that as tammy indicated correctly so, we were able to shovel pallets of cash to the iranians but we were not willing to dedicate a fraction of the budget to secure our southern border with a wall that the american people know works, is ridiculous. it's not just a national defense issue though. secondly, it's an economic issue. milton friedman said it best,

washington, frustrated that too many elected officials don't follow through on their promises, and they want us to do what we said we would do. i watch that whole exchange with the president and chuck schumer and nancy pelosi and i think the president was terrific. he said we will secure the border and build the wall. one of the surest indications on how unhappy they democrats were in that exchange is come over and over again, nancy pelosi said, can we turn the tv cameras off? we are not supposed to be doing this publicly. you can tell she's scared and the cameras are showing that she and the democrats are for open borders and the president is fighting to do with the american people want which is secure the border, build the wall and keep our country safe. >> sean: i was down with rick perry on the border, and i've been down the border 13 times. i sat through a security briefing, 642,000 texans were the victims of crime in a seven

year period. but here's my question. i have to give lindsey graham credit. here's my question. everybody seemed to fear a government shutdown. don't essential services continue? the elderly will get there social security checks, medicare continues, so why the big fear about the shutdown? >> essential services continue during any shutdown, and at this point about 70% have been appropriated. now i personally hope we don't have a shut down but i the president is absolutely right to say the american people want the border secured. they are opposed to do border security and i'll tell you that's a big reason why the republicans grew the majority of the senate in the election, and

as we have not had sufficient accountability in the department of justice. i want a department that is faithful, and we will see that at the department of justice. we need to make sure that everyone is held accountable. >> sean: i had this woman alice marie johnson. how'd do you feel about the prison reform bill as long as violent felons are not included? >> i think we are about to have a major bipartisan victory. i'm a longtime advocate of criminal justice reform and i think reducing mandatory minimum sentences for nonviolent drug offenders makes a lot of sense. there are far too many young black men in prison for decades for simple possession, and

that's not right. my big concern, you just put your finger on it, we should not be releasing violent criminals. violent criminals are totally different. what happened last week, i drafted an amendment to this bill that excluded violent criminals that said we will focus nonviolent criminals but, murderers and violent criminals will stay in jail. they took my amendment word for word and i'm now supporting, i'm a cosponsor and i urged mitch mcconnell to take it up and schedule a vote. just today he announced, we will pass this, which will be a major, major bipartisan victory. >> senator, well said. it's good to see you. i'm getting used to the new look. if it gets wider and longer, next year you could be santa claus. storm back up next, next year aa

>> sean: breaking news, this is a fox news alert. ap is now reporting that general michael flynn has requested probation and community service. earlier today there was also a deadly shooting in france which is now being treated as a terror incident. trace gallagher joins us live in our west coast newsroom tonight for the latest on both of these stories. >> let's begin with the shooting. the attack happened near the stroudsburg famous christmas market which is one of the city's biggest attractions. the same christmas market was the focus of an al qaeda plot

back in 2,000, although it remains unclear if the market was targeted this this evening. the gunfire came in several bursts, sending people running and panicking into nearby buildings and restaurants. authorities have now confirmed that four people are killed, and a dozen wounded. six of the injuries are said to be minor. investigator said the 29-year-old gunman was born in strasburg and is well known to local police as a terrorist suspect. in fact before today shooting, police converged on the suspects apartment in connection with an armed robbery earlier this week. it grenades were found during that search but the suspect fled the apartment before police arrived, despite heavily police presence at the christmas market, the suspect also got away there. they do be believe he has links to extremist groups.

separately tonight, we should say that breaking news ahead of his sentencing for trump national security advisors, they are now asking that flynn get probation and community service instead of jail time. this is key because prosecutors have also agreed that retired army lieutenant general should spend zero time behind bars. the sentencing is next week and prosecutors have until friday to reply to flynn's request for community service. they are asking for 200 hours of community service, no more, and no jail time. >> sean: he spent only 33 years serving his country. trace gallagher, thank you. i think he's been through enough. we will continue to monitor both of these stories. also at u.s. district judge has ordered stormy daniels to pay president trump for her legal

fees. meanwhile, more signs of corruption. did the clinton foundation lead the irs? we were told in part these are minor infractions, similar to a speeding ticket which is only bad if you are a republican. joining us now, john solomon. sara carter, gregg jarrett. did the clinton foundation mislead at the irs, and why was the home and the whistle-blower, why was that home rated? >> i think that one whistle-blower -- and by the way that's not a whistle-blower that will be testifying thursday. i think there was concern that the government wanted to make sure that they were still at the proper storage facility. in 2005, utah regulators were reviewing their license to

operate in the state of utah and they said, we see some missing data on your form. you should amend your form. not disclosing your fund-raising fee is on the line, amend that and we will get that licensed. in the clinton foundation said, no thanks. i go through about 2,000 pages of documents on this column and you will see numerous instances where they have a consent agreement and they admit to wrongdoing in mississippi. they are forcibly, involuntarily closed it down in massachusetts over a technicality. they don't have a perfect record in complying with regulatory compliance and that's one of the issues that you will see thursday during the hearing with mark meadows. >> sean: it will be fascinating. let me go to gregg jarrett. i know all of us know william campbell. that's going to be a big issue only because that, too, is connected to the clinton

foundation. we knew that they were bribed with money, extortion, and kickbacks. between that and the dossier that comey admits he never verified. all of these clinton issues are now definitely going to be in the forefront. my sources tell me, and a major way, in spite of all the double standards that exist until this point? >> yes because it's a crime to confer against a foreign government or anyone in exchange for money. one has always wondered why the clinton foundation wasn't seriously investigated, not to mention hillary and bill clinton. at the same time they were investigating the russians over this extortion, bribery, and money laundering, et cetera, it turns out there were four people in charge of that investigation.
