overnight a federal judge ordering robert mueller to turn over all the highly secret documents on michael flynn. it comes just one day after donald trump's former national security adviser's legal team alleged the fbi pushed him to not bring a lawyer to a 2017 interview with agents. >> in that meeting with anti-trump fbi agent peter stzrok. flynn at sentencing is scheduled for next tuesday. >> rudy giuliani is demanding mueller put a end to the russia probe telling yahoo! news, quote, our strategy is to do everything we can to try to convince mueller to wrap things up. if he has got anything, show us. >> democrats coming out swinging after donald trump's former lawyer fixer michael cohen is sentenced to three years in prison. >> todd pyro live as democrats use the opportunity to revisit the possibility of a presidential impeachment. >> it is unclear that i role was because of this dancing or this, the sentencing of michael cohen quickly became about donald

the nfl applauding donald trump's prison reform bill, a bipartisan bill, the league issuing a statement saying the national football league applauds the leadership of donald trump and bipartisan members of congress on criminal justice reform, we offer full support for the revised first step back and urge passage this year. prison reform has been a key issue in the wake of colin kaepernick's national anthem protests against racial injustice. >> nancy. the striking a deal with democrats likely securing her place as the next house speaker saying she will relinquish the title by 2022 if she gets the job. the agreement falls in line with the new proposed term limits, change that skips two the two year terms with the possibility of a fourth, they will be voted on in february. nancy pelosi needs 218 votes to become speaker when the house voted the beginning of next month. senator orrin hatch bids farewell to the senate.

defense policy, national security, we are shoulder to shoulder around the world. this is an important issue and it is important for donald trump, this is a key ally, he and the prime minister have a generally good relationship but occasionally strained. as it develops in parliament, in europeans, donald trump could be salvation for the prime minister if he endorses what she is doing, that could get her to the finish line on this issue. >> it is important to keep an eye on germany. >> the more the uk moves towards the us and away from europe there is a logical geostrategic shift where germany will end up close to russia and that is happening. we should be in addition to

>> fox news alert, international manhunt intensifying for the terrorist to opened fire at christmas market. jillian: cherif chekatt is accused of killing two people and injuring a dozen. mike tobin with his ties to extremism. >> reporter: the man that involves hundreds of security officers on french and german side of the border. the alleged gunman was well known to police, 29 years old, cherif chekatt had already wrapped up 27 or more convictions in france, germany and switzerland. he was in and out of prison, ran with street gangs. during a 2-year prison stint from 2 to 13-2015 he fell in with islamic radicals. there were a list of criminals who had been radicalized. the problem is 20,000 people are on that list. 4000 were considered problematic

requiring more surveillance. after the attack and two gunbattles with police cherif chekatt commandeered a taxi to make his getaway. the driver says cherif chekatt was bragging about the people he killed in the christmas market. driver says cherif chekatt was wounded, shot in the arm and says he dropped the alleged gunman off in an area 10 minutes away from the site of the attack. that is where cherif chekatt kept an apartment. it was rated after the attack. that was in connection to an armed robbery last summer but developed into an attempted murder charge. when police got in the resident they did not find cherif chekatt but they found a rifle, ammunition, hunting knives. french officials but the prospect of returning to prison triggered the attack. yesterday the information was five people were detained in connection with the attack, the number has been adjusted to four and the individuals have been identified as cherif chekatt's parents and two brothers.

we mentioned at the beginning, either too many? do they need to be streamlined? do they need to be fewer that will be more impactful? >> absolutely. we tend to solve every problem by throwing money at it, telling which programs work and which ones don't, we have different rules, eligibility requirements, people in the same situation can have different benefits because they circulate through bureaucracy. it is not fair to taxpayers or recipients. rob: a book called losing ground that i have been reading lately he alleges the more welfare you create, the more poverty you create. by giving people more you create more dependence. >> incentives matter. the highest marginal tax rates in the world for someone who takes a job, you start paying taxes on the first all you weren't, losing benefits as soon

as you start earning income on your own and incur expenses with childcare, clothing, transportation and you can end up worse off if you take an entry-level job and if you are on welfare. jillian: what happens when democrats take control the house? >> we will not be doing anything in terms of efficiency consolidation. we will continue to make poverty less miserable. instead of making poverty less miserable we should be concentrating on how to get people out of poverty. >> you criticize both parties in your book on how they handled poverty and tried to do this. what is your biggest criticism of both parties? >> on the right, we have largely victim shamed and victim blamed, people living in poverty it is their own fault and we shouldn't help them. on the left this idea that you solve problems by throwing money at them. what we need to recognize is poor people are not lazy or stupid but are trying to make
