this is the judge is saying that the whole law, the entire affordable care act should, in fact, be torn down because the individual mandate demanding that you buy health insurance is unconstitutional. quickly, here's what he said. the district judge reed o'connor the individual mandate can no longer be fairly read as exercise of congress' taxpayer and is still impermissible under the interstate commerce clause. meaning the individual mandate is unconstitutional without it congress and the supreme court have stated the architectural design has failed. jedediah: about time. we have been having this debate so long. this was unconstitutional from the start. does put a little bit of pressure on republicans now. democrats have always said listen, if you are going to criticize the affordable care act which ended up not being so affordable for everyone, you should have a replacement. which is good. step up to the plate and provide pro-nongovernment

it since it passed, right? now they have responsibility to govern. you have a republican president. a republican senate with a bigger majority in 2019. but, but, but, as the president points out, the democrats have a responsibility to govern. they campaigned on healthcare. they said and let's find out what they want. as you know, it's not about saving obamacare. a lot of the democrats, like your favorite socialist in the bronx, bernie sanders and others want medicare from all. jedediah: which they did frankly. this was about medicare for all. they wanted obamacare. they knew it was going to have problems and people were going to object and hope was to bring in medicare for all. when you start doing government-run heck people instinctively say why is this the government running this for me. why is the government managing my personal decisions? what doctor i can go to. let's not forget this thing was pushed through with a bunch of lies. told they could keep their doctor and costs go down. that's not to say republicans won't have to step up to the plate like i said there are a lot of people still struggling with healthcare coasts and want

someone who thinks like him as his chief of staff with a possible government shut down looming, the president certainly has that in mulvaney who pushed for his fair share of them as he was one of the founders of the freedom caucus. back to you all. pete: he is one of the founders of freedom caucus. a movement conservative. a true believer. the only thing he has been an outlier on with this white house is on defense spending. he has wanted to cut that budget. a lot of the president's supporters think it should be bigger. interesting pick. jedediah: i like him. budget hawk not afraid of a shutdown. the left talking points government shut down end of the world. government shut down means a lot of the government still stays open and at some point you have to draw the line and debt is out of control. it's a national security threat to have your debt thatch out of control good for him and i hope he sticks to it. ed: big stories we have been talking about all morning and something big coming tuesday the sentencing of general michael flynn. the question now is did he lie to the fbi or not?

pete: that's what new documents show the fbi agents didn't think that he did. in the interview, again, and there is questions about that interview itself. should he have had a lawyer. what should he have been notified about. but ultimately the fbi agents, this is what we are getting this morning from exhibit b of the fbi. this is from the fbi. strzok and redacted, person we don't know, both had the impression that at the time that flynn was not lying or did not think he was lying. flynn struck strzok as bright -- get this, but not profoundly sophisticated. ed: it could have been a setup. the fbi did not basically tell him the consequences of lying. pete: they bum-rushed him. ed: we are coming over. we want to talk. they didn't make clear it's part of this full-blown investigation. why was andrew mccabe number two at the fbi maybe look like he was setting him up? jedediah: in fairness, some

will argue do you have to be cold the consequences of lying to the fbi. that's something that you should know all of us sitting here if we got questions from the fbi we all know going in you don't lie to the fbi. he will be held accountable. ed: bob mueller,special counsel, his team is saying regardless of what happened with the fbi security advisor former of an intelligence agency, retired lieutenant general and 33-year vet of the armed forces knows he should not lie to federal agents. he does not need to be warned it is a crime to lie to federal agents to note importance of telling them the truth. pete: michael flynn gets no lawyers but hillary clinton gets like 15 in her interview including lawyers who are witnesses in the case? it's a complete and absolute double standard. i also look at what strzok said. flynn is bright but not profoundly sophisticated. do you read the strzok page text like gossip girl. peter strzok. ed: toward trump officials, trump voters. they talked about how people at walmart smelled.

the far left portion of that border, i feel like it's just kept the security issue stomped on and illegal immigration has continued to fester. the difference between -- what happened in israel, ultimately, after we saw that the wall was extremely effective against terrorism, by around 2008, 2009, israel faced a very aggressive index of illegal population from various is a heroin and african countries. israel went why aren't we doing the same thing with the egyptian border which was extremely porous. israel extended the wall over on the egyptian-gaza side. we went from 50,000 illegal west african immigrants who were spiking the crime in tel aviv to less than a dozen illegal immigrants today. pete: 55,000 to less than a dozen. that strikes me as something that works. aaron cohen you know of which you speak. thank you very much for your time. we appreciate it.

try to hide behind jesuit values allow students to external with ice. we brought up the administration a couple weeks ago that ice does a lot more than enforce our borders. they enforce the drug trafficking international child sex trafficking. so there a lot of social justice issues that ice actually tackles. it's really disingenuous and seems to me to be a political maneuver because they disagree with the president's enforcement of border policy. >> tom, the program director actually gave a statement on the suspension saying students raised concerns after ice presence at annual externship fair caused unsafe. we believe a real possibility exists placing a student in ice externship may force them to act unethically or unlawfully. what is your response to that statement? >> yeah, well, you know, we have seen this a lot throughout other college campuses, the leadership institute campus reform has done a great job on reporting on that. what's really interesting is that in a law school, we are

really faced with these same issues with our student body where people feel unsafe and, it's frankly, there is no justification for that when we're lawyers being trained on the rule of law being trained on, you know, having -- knowing both sides of an issue. so, to me, why would we want to limit opportunity. we are not forcing students to extern with ice that opportunity should be available for students to pursue in law enforcement. they are being shut out. it's not fair. pete: not a mandatory externship. you can if you want to. we have some stats about ice's legal team. they have 1200 attorneys. 300 support staff. covered over 900,000 hearings in 2017. turns out immigration and immigration law is a big practice. our government is involved in it. yet, the first statement i read i'm stuck on it. your school says no, you are trained to be a peacemaker. i thought you were being

trained to follow the law and the constitution. >> well, absolutely. there is really no respect for that. >> you know, what about -- my thing with the peacemaker issue is what about -- not everybody that's crossing our borders illegally is a peace maker. so, really how as if we want to enforce our borders, we have to -- we need lawyers to be able to help support those ice agents and enforce our law and especially here in washington state where we are a border state, we have really large ports. ice needs legal exterrence to bexterns toassist issues that our community here. to me it, really is just political maneuver by seattle u. it's really unfortunate and honestly embarrassing as a student to have just another political decision made by this administration. jedediah: it's unfortunate, thomas. it's not surprising. i have taught in academia. i know how this works in terms of the manipulation and trying to get their message across.

ice actually issued a statement as well. saying it's disheartening that an institution dedicated to the teaching the laws of this country and core values teach justice and diversity would prevent its students from gaining valuable professional experience. i'm tending to agree with that and i'm guessing you do as well. >> yeah. i do. it's really sad because the school's ranking has dropped and since 2012 we were ranked in the low 80's. last year ranked 128. we have fallen 40-some odd spots in the last five years. in large part because they are not focusing on the rule of law. they are not focusing on training students to have experiences that will actually help them in the real world. they are focusing on racial justice book training clubs and gender and the law. i had to fight to get a basic tax class offered this semester. those are the kind of classes that are going to help me. not these social justice oriented random sort of classes. pete: a basic tax class. i have a feeling you just

ed: mueller investigation shifting gears. $25 million and counting. enough to it's become almost a regular owe curensz now that every friday there is some sort of a document dump this time this past friday special counsel's office reacting to general michael flynn's legal team and what they were saying about how they don't want any jail time well, there is new questions in these documents about the fbi agents who handled the flynn case and how they never believed that he was lying during the meeting they had. pete: that's right. here's a portion of a document released related to michael flynn. it said strzok and redacted, we don't know who that is, both had the impression at the time that flynn was not lying or did not think he was lying. film struck strzok as bright but not profoundly sophisticated. that's rich coming from the guy who sent -- do i know about gossip girl. i should not admit that but i will. the guy gossip girling with lisa page. ed: peter strzok. pete: he said michael flynn is not sophisticated. save it. a lot of people close to the

campaign. it goes to show that the rules didn't apply to donald trump when it came to targeting him. and they were holding him out to a standard that they held no one else out to. pete: thank god for those so sophisticated text messages and how much bias they truly revealed. ed: there was another very important development. maybe buried. take you back to january 6th, 2017 i believe it was. president-elect donald trump is getting briefed by james comey at the fbi. this happened at trump tower here in new york and other intel officials, james clapper and whatnot about threats. pete: made a big deal in the book. ed: at the end of that meeting i believe he then pulled aside the president-elect and said basically, we got some dirt on you. you know, there is this dossier. there is this stuff maybe sexual nature some stuff you should be aware of. i have talked to people inside the white house around the president who felt like the president felt pressured that comey was sort of trying to hold this information over his head. and there is a lot of talk well, that was christopher steele and the dossier and

that it wasn't made clear to the president that this was funded by the dnc and the hillary clinton campaign. guess what? we now have evidence of that because in these documents they released what they call annex a, which basically it's sort of a two-page memo that comey had. it's finally been released of what he briefed the president-elect on and among other things it says, quote: the source is an executive of a private business intel firm and former employee of intelligence service meaning christopher steele but don't name him who has been compensated meaning paid. the source collected this information on behalf of private clients and was not compensated for it by the fbi. private clients, you mean hillary clinton's campaign and the dnc? this is the document that james comey was using to brief the president-elect. he says private clients were behind it, mr. president-elect. why didn't he disclose to the incoming president of the united states, this dirt was paid for by the
