that's why we saw rising premiums and deductibles. >> the supreme court upheld the individual mandate during the obama administration in that 5-4 decision with chief justice roberts being the key one and he said because it was a tax because of the commerce clause in the constitution. but then under president trump congress eliminates the tax penalty last december. >> the aca has been on the chopping block twice. it's been upheld twice. however now the tax has been repealed. that's why it's seen as unconstitutional. you no longer have a tax penalty. but this hasn't been heard in front of the kavanaugh court. although kavanaugh has stayed tight lipped op how he feels about the affordable act, he does follow the law. and without the tax penalty i think he's going to favor it and say it's unconstitutional. >> preexisting conditions.

fleeing. and that is what the trump administration seems determined to do. >> thanks, chris hayes. so what do we know and ask this death being used as a political football. a senior policy director with the conservative partnership is here to weigh in. thank you for being here, rachel. a tragic story. no one takes away from the tragedy of losing a 7-year-old. yet as the father of the girl said, he said, i have no complaints about how border patrol agents treated him and his daughter. what do you make of this case? >> well i think what happened was tragic and it was awful. but i think what we're not hearing is that it was also avoidable and that's a conversation that we can't have in this mainstream media. we can't talk about how our policies at the border, the asylum policies and the catch and release policies incentivize people to take these incredibly

dangerous risks. when you look at the fact that border patrol last month alone stopped 62,000 people at the border and these were people that were putting themselves in tremendous physical peril but exposing themselves to sex trafficking, drug trafficking and this is the result of the policy to incentivize these people to come here and take dangerous risks. until we can talk about that, we're going to face tragic outcomes like we saw this week. >> it's horrific to me, the vilify daitio occasion of the bl agents. many assumed that the border patrol agents were at fault. we have a statement that says, in this case unfortunately we did not encounter the child sooner. traveling north into the united states is extremely dangerous. please, present yourselves at a port of entry and seek to enter legally and safely. your response to that. >> that's exactly right.

we're tantamount to a humanitarian crisis at the border because people know they can come and cross the border and be released into the interior of the country. until we can get a handle on that again we're going to see these tragic outcomes. but again you don't see the media reporting this. you saw this again when we saw the migrant caravan at the border. you saw the media gloss over statements from dhs saying, there were aggressive assaults at the border by primarily single men. you see them sensationalizing people putting themselves in harm's way. we needs to enforce our laws at the border so people don't put themselves in harm's way. >> i want to go to the human aspect of this. i know border patrol agents and folks who serve in i.c.e. can you imagine a 7-year-old man

as to not want to find out who paid for the dossier? >> yeah i've really been taken aback by the number of things that people didn't want to know in this investigation. it is the federal bureau of investigation. the sort of thing that if you're going to get -- if you're going to present something toe somebody that you're asking them to make critical decisions about, granting a warrant or briefing the president, you might want to be able to answer basic questions. and it seems to me that that's not only a pretty basic question but in the two-page summary that we've now seen, the fbi takes pain to say the fbi did not fund the source, meaning steele. to say that to the president or to say it to anyone implies that you think that it's pretty important who did the funding otherwise why bring it up at all.

enforcement and investigative integrity and you know, what you present to the court in making sure that you don't get political influence and all of that. that's exactly appropriate 90% of fbi investigations. national security investigations, counter intelligence investigations by contrast are done for the president. that's the purpose of them. they are done in order to help the president perform his national security responsibilities. so if you're going to play close to the vest with a court because you're worried about what might eventually get disclosessed in litigation, i get that. but if you're briefing the president on a national security investigation in counter intelligence when the whole point of counter intelligence is to inform the president so he can perform his mission, why would you play close to the vest with the facts on that. >> andy, comey is about to head back to the hill tomorrow. and you know, we've heard a lot

of i don't know, i don't remember, i don't recall from him. what do they need to do tomorrow to get some answers from him? >> jedidiah, you know, we're asking the wrong person. and i feel like a broken record on this. there has not been a day since his first day in office that president trump hasn't had the wherewithal to release the documents that would give us some light on this story. jim comey is a very smart, very disciplined, very articulate witness who will come in prepared to say what he thinks needs to be said and what he wants to say. and he's become very partisan in recent days about the need to defeat trump and all of that stuff. the only way that you can control a witness like that is to walk him through the documents, which stops somebody from being able to stray and actually force forces them to sy within the four corners of what you want to ask about. if you don't have the documents,

who had killed americans in the past. he admitted to that saying he did it. talk to us about his defense of that action. >> let me tell you two things. first about the actions you just described. you know, matt is one of the most humble people i've ever met and he has a chest full of awards for valor. the incident that you just described is a battle where his patrol, it was approximately a 50-man plus patrol was under attack by a superior enemy force and matt engaged the enemy directly calling indirect fire, calling in air support, deploying rifle rockets at the enemy. it was an heroic battle. and matt was recognized for that and it has absolutely nothing to do with the allegations that have been made against him. yet the army with no due process rights afforded to matt rescinded the distinguished

service cross that the secretary of the army had signed and revoked his silver starmed dal. had nothing to do with the allegations facing him today. what's super important to understand is that the army has known about his allegations, these actions that matt described to the central intelligence agency when he was being highly recruited in 201 is. they've known about it since 2011. and they were investigated thoroughly and they were disposed of through an administrative process in 2015, three years ago. and at the conclusion of that process matt was being processed administratively for discharge and concurrently being processed for medical retirement. and then it was after the brett baier interview that they did reopen the investigation. but what's important for the public to understand is there was nothing described in breath's interview that the army didn't have in 2011. >> phil, why? here's a statement from the u.s.

when congress then repealed the individual mandate the tax went away. that is the underpinning. like pulling a stepladder from underneath a guy cleaning out his gutter. he falls. that should happen to obamacare. this should go back to the supreme court. i don't like one single federal judge decides a district for the whole country. if he makes a decision, it should go up to the appellate court and ultimately decided at the federal level. let's let it do that when it gets there, john roberts said it was a tax, that saved obamacare in the beginning. without being designated as a tax, even though you can't force people to buy an individual product on the marketplace and that was the crux of what the argument against obamacare was. take that away, it collapses. that is what the judge ruled. he is exactly right. he didn't have a choice, whether he liked it or not. it was a proper legal decision. now it will go back to the

20-state coalition challenging the affordable care act and essentially, we anticipate that this will be appealed but what happened when the president and this congress eliminated the tax penalty associated with the individual mandate, the affordable care act can no longer stand. the entire thing is unconstitutional. that is essentially what this judge recognized and ruled, without the individual mandate to prop up the affordable care act, the entire affordable care act would be deemed unconstitutional. we do anticipate this will be taken up to the fifth circuit and probably to the u.s. supreme court. pete: leslie, a big decision, bold move by you and other states take head on the constitutionality of obamacare. say you win. say the supreme court sides with your point of view, what is the next step? what is arkansas going to do? what do republicans do to fill the void for people that no longer have access, as flawed as

it may be to obamacare? >> i think it is important right now for arkansans and americans to understand nothing is be changed about their health care at this time, however it is time for congress to act an address preexisting conditions to make sure that americans are taken care of. that the, tone down the skyrocketing costs of healthcare so that way we can have access to it. but we cannot do so in unconstitutional law such as the affordable care act. what it required was this individual mandate forcing everybody to buy insurance they did not need or want. i have always been opposed to it. what the laws and constitution says, congress can regulate commerce but it cannot compel commerce. and that is what the affordable care act has done all these years is to compel commerce by forcing individuals to purchase health insurance. jedediah: leslie, just a quick

question on messaging, democrats will come out strong opposing it. republicans don't say about the health care. are you prepared to take that on pretty strongly, with policy but also with a messaging component? >> absolutely. we do care about health care. and whether it is republicans or democrats, i would say republican attorney general, i absolutely care about americans health care. we want it to be affordable. we want congress to pass law, put a new health care law in place in place of the affordable care act in compliance with our u.s. constitution. that is essentially all we're asking. if you're going to pass something. make sure it is constitutionally sound. the affordable care act never was constitutionally sound. it was rushed through. in a fury several years ago. it is time to correct that. it is time for congress to take action now to correct that to make sure we have affordable health care, take care of americans, those with preexisting conditions but we

we see what judge roberts down at supreme court. both sides have totally divergent ways to fix it. medicare for all. republicans talk about competition across state lines, transparency in costs not mid of which are silver bullet. this will be a 2020 campaign issue. ed: no doubt. pete: i don't think anybody happens. i appreciate the president's optimism in front of democrats. one or two or three democratic friend he used to have, no longer has about i don't see it being litigated -- jedediah: that might be his friends, doesn't mean they see the role of government the same way. this is big issue, very polarizing issue. you feel the government's responsibility to do this, the government is the most efficient mechanism to do it, that will go head-to-head with free market review. ed: they're more likely frenemies. front and center in 2020 is not just health care but the economy and immigration. the president has a good story to tell on the economy. on immigration it is very mixed bag. he was ahead of the curve saying

we need to crack down on illegal immigration. he hasn't gotten funding for the wall that he wanted. even though he had republicans in the house and senate. he needed 60 votes in the senate. we're shedded for a shutdown because the president is demanding five million dollars in wall funding. that is a down payment. not enough to build the whole wall. but democrats say no, no. jedediah: does anyone feel we're in a episode of "groundhog day"? every few months we have the conversation, republicans talk about border security. same conversation with the debt. we have to care about the debt. all of sudden looming shutdown. oh, let's kick the can down the road. enough is enough. so many stories about threatens national security. so many people concerned about that. if you push this, kick this can down the road you will never get the done. at some point you have to do a partial government shutdown, make sure that border security take as priority. pete: every time the story comes up, establishment republicans
