informed about that. prosecutors reject the notion but at the sentencing, not expected to receive jail time for what they call a sense of cooperation. jillian: a fox news alert, two police officers are hit and killed by a train in chicago. officers on the tracks looking for a shooting suspect when they were killed instantly. >> these brave young men identified a potential threat to their community and safety of others above their own. jillian: they found a weapon and are questioning a person of interest. both officer served less than 3 years on the force. they leave behind wives and young children. rob: the man suspected of supplying the gun used in a deadly christmas market shooting in france is facing terror charges. according to local reports the

suspect is a relative of cherif chekatt who killed 5 people in strasburg, france last week. he was shot and killed by police after a massive manhunt. cherif chekatt's parents and brothers were questioned but have since been released. cherif chekatt's father says his son supported isis. jillian: a government shutdown looming over capitol hill as donald trump and congress fight over federal funding. rob: todd pyro joins us on a temporary deal that could avoid a friday shutdown. >> reporter: it is getting interesting. a proposal out there would keep the government funded until september of next year which would avoid the shutdown in time for the holidays. john roberts reports it would provide $1.6 billion for 65 mile border fence through the rio grande but senate republican leader says he hasn't seen a deal on the hill and it will probably be a few days before there is a solution.

the deal would build a wall along one of the most dangerous parts of the southern border. democrats indicating they might support the measure before heading home for the holidays. >> the house is on recess until wednesday night two days before the trump shutdown would start. it is because house leadership has no idea what to do even with a republican congress, no threat or temper tantrum will get the president his wall. >> reporter: the proposed $1.6 billion is much less than donald trump's $5 billion demand to build the wall and more than $1.3 billion democrat offer for border security. we are also learning the pentagon is sending 3000 american troops on the border home for the holidays. back to you. rob: there's a lot to this. we will keep following it.

hearing that took place. the focus will turn on subpoenas issued to the trump administration and not calling jim comey for more marathon closed-door sessions. jillian: he was outspoken in that interview. what did you make of what he said? >> he was invited as a former fbi director to answer questions and it seems he has a personal vendetta to try to bring down the presidency of donald trump. my view, i know jim comey from my time at doj, people who live in glass houses should not throw stones. this is a guy who had no problem violating protocols when it came to make decisions to open and close and open and close the clinton email server investigation. his own memos violating protocols with respect to the michael flynn interview. if jim comey decided he thought something should be done he has no problem setting aside rules meant to apply in situations when no investigation was fraught with political peril. he should not be throwing stones at anybody.

rob: a lot of people say he is political, a democrat, pro-hillary clinton but democrats say he cost hillary the election by reopening the investigation. interesting to hear that side of it from republicans. i don't see that. >> at the time jim comey aside nobody thought he acted appropriately and nobody thought he was doing a good job but the moment he got fired, it became something donald trump was up to something nefarious even though lots of people on both sides of the aisle thought his behavior had not covered him or the fbi with glory. jillian: let's talk michael flynn because robert mueller releases a witness report. i went to go to this quote where it says the interviewing agents asked flynn if he recalled any conversation in which the expulsions were discussed, or flynn might have encouraged him not to escalate the situation to

keep the russian response to engage in a tit-for-tat. flynn responded not really, i don't remember, not don't do anything. there were a lot of i don't remembers in that. a lot of people talking about that. what did you make of it? >> it was a strange 302, the number the form uses for its witness interview notes. he asked about comments, jim comey and other people, bob mueller decided this conversation was very important, he has to have remembered he talked to sergey and at other times in that memorandum, flynn appears to have acknowledged he knew his conversations had been recorded and if you knew your conversations had been recorded and why would you lie about that? i don't recall, i don't think so but he has admitted he made a false statement. i don't think he's going to try

to do anything to undermine his plea particularly since he's likely to get no jail time. what judge sullivan is going to thing about, how the fbi behaved in these charges, information means to be seen. rob: flynn and two former associates charged with doing turkey's dirty work, pulling this out to a ruling back to turkey because president erdogan has a real problem with this guy and associates were trying to do some foreign work with our politicians trying to convince them to do that for them. >> this came out of michael flynn's cooperation. his company, the flynn intel group paid $600,000 by the turkish government to try to lobby in order to get the government to buy president erdogan's nemesis and two other associates, one in turkey, one in california did a lot of that dirty work and said they were being hired by a dutch company

have to put it into perspective. rob: it is obscenely high, the market's. wasn't long ago we were at 8000, 9000 under obama, now 20, crazy to think about. let's look at this. he blames a lot of this on the fed and consistency on the rates. it is incredible with a strong dollar, the outside world blowing up around us, paris burning down, china way down, the fed even considering another interest rate hike. take the victory, they might raise it again tomorrow, jumping the gun trying to protect this. >> trump has a point because when trump decided to go with tax reform that was to save corporations money. the market is made of companies. they save money. the rising rates in companies have expenses. so even though rates have risen they don't have to rise as quickly. i wouldn't be surprised if they don't raise rates tomorrow.
