. in the phoenix metro area, there's been almost 4,000 of them really since october. they are coming here seeking asylum. we pay them whatever because we can't afford to hold them. that's what's happening is catc and release theme or giving the notice, please come back for your court hearing to prove tha you are really someone that qualifies. almost 90 percent of them don't even qualify for asylum, yet they're already here in this country. most of them neverer go back further hearing. that's what's going on with the asylum policy wesy have today. >> not reported is much as the steel with mexico and keeping asylum-seekers in mexico while they're waiting for their immigration cases. as you pointed out, 90 percent don't actually grant asylum in the court. they go missing between that time and when their cases come up, soso why is this so importa? >> if you can keep them in

mexico which has offered asylum to most of the asylum-seekers bread they'veof offer them asyl if you keep them they are, then it gives us time to process the before they gett released into the interior. once the released into the interior, they're effectively lost until they commit a crime or something w like that we can track him down. we have all kinds of obstacles that keep us from actually controlling the folks that are coming into our country. that's why in mexico basically keeping them k there in until they're ready to come in and were qualified to comment is so important because it's going to reduce the number of people coming into this country illegally that we can't track. >> is congress doing anything t address thees asylum issues wer seen? >> we have basically put together a series of bills, i know the freedom caucus has put together some ideas and bills t try to get this going, but then

passive, texas. the boys father were according to cbp officials given regular food, water, and welfare checks before being transferred to the border patrol station on december 23rd. on the 24th at around 9:00 a.m., an agent noticed the boyntic was coughing and his ey were puffy. he was taken to a nearby wi hospital. he was diagnosed with a called and given tylenol.pi around 30 minutes later his fever spiked to 103 degrees. he was held for further observation, but 19 minutes after that at about 2:50 p.m. h was released from the er with a prescription for marks a solin and ibuprofen. the boy and his father were taken to a temporary holding facility where at 7:00 p.m., felipe a fama did. according to cbp, his father said the boy was feeling better and declined further help. at about 10:00 p.m., fully pay was again conscious and was

definitely be prosecuted for child neglect or child endangerment. it is very tragic. >> what are the conditions like. >> conditions weather being held ? >> you know, i was just there a few days ago one of the detentions facilities here in arizona. some of the doors were open and they allow the children to come out and talk to us once in a while.as there was one particular 13 -year-old guatemalan boy that i saw and i called him over towards my computer that i was at and i asked himas where he w from. he said he was from guatemala. we spoke briefly he said he didn't know where his parents were buried at that point i sai okay, be careful. stay safe and everything he walks back to the area where he's being detained and i said grab some cookies. he grabbed some cookies. he said thank you, i gave him some juice, but there was other kids outre there watching movie as they're being taking taken care of.

that's not the actual detention facility where they're being held for longer periods of time but none of these kids are bein mistreated. it's a very tragic thing that happened, but i think honestly people need to go and talk to the see what kind of misdiagnosis was done on this child. >> the dangerous journey and different things involved. why would the media, why don't they discouragehi this kind of journey because it seems to me the way to keep people safe is to discourage people from makin those kinds of trips, so why aren't are they doing moree to that? he gave the journey has already happened. they've already here they are here with their kids. what the issue is. >> but even before that. to prevent further children and parents making this dangerous journey, i understand some people are always all bc here they've arrived at the southern border, but what about future people, future caravans. shouldn't members of congress,

democrats try to encourage people not to make that trip, not make the dangerous journey? >> i have said for a long time, and like i said it's not a republican or democrat thing, the department of homeland security, u.s. immigration services, they need to do a better job of that in these cases and setting up postwar these people can get for a silent before they have to trac all the way through mexico. the problem is is that you have a lack of those resources. that is a problem. i see it firsthand. it's a major problem. there are times that for years and years, for them it's worth the risk to come over here.wo >> what do you think of that? >> even know, i think it's a copout. i think it's a copout. put the blame on the united states. to put the blame on the u.s., t put the blame on the department of security. there is a right way to do this in the wrong way to do this.

far-reaching consequences impacting monuments across the nation including some at arlington national cemetery. the memorial at the center of this case is a cross that honor world war i veterans in maryland . its construction was started by community members and mothers whose sons died in world war i and it was completed by the american legion. the lower court has ruled that the cross should be removed because it is the establishment clause of the constitution whic of course reads congress shall make no law respecting an establishment of religion or prohibiting the free exercise thereof. but a brief filed by 30 states since the supreme court should reverse the lower courts call for destruction as it's placed in our national tradition and broader cultural context makes clear the memorial honors both the service members it was buil

the fourth circuit, we could be dealing with a situation where hundreds of morals across the country may be forced to be tor down. just as you indicated, the purpose of this memorial is to honor the war debt. we know when the peace cross wa first put together, this was done to honor 49 individuals wh fought in world war i. they were commemorated. across the country, there are memorials similar to this, but you have to look at the context in which these memorials are se up. that states and individuals hav the right to commemorate the dead. that's different, that's not a purely religious purpose, quite the opposite. that's a secular purpose. so we think this fits very cleanly within, we think the co clarify this going forward, but i think that this peace cross i done with private funds, this
