family institute, jenna ellis. thank you for your time. we appreciate it. a number of things will be discussed in 2019. let's start with the asylum band. >> reporter: all these cases come down to the fact that the aclu, southern poverty law center and leftist groups are trying to target trump and make sure he doesn't have any wins on immigration. for the asylum band in particular this case is constitutional. he has congressional authority to determine a procedural question. it comes down to the fact that if congress wants to change their delegation of power to the executive branch they need to go through the legislative process and provide common sense immigration reform and the gop didn't do that between 2016-18, but if they want to come together and have a bipartisan measure, they can do that in 2019. todd: why do you say this is constitutional?

the supreme court came down 5-4 with justice roberts being a swing that everyone is expecting him to be in 2019 and beyond. why do you say this is constitutional? >> it is talking about not changing the law but just a procedural aspect the executive branch in terms of their enforcement of the law has constitutional authority because congress has said to the executive branch that you can determine some things in terms of immigration. like the travel ban case everyone is talking about, that was ultimately determined to be constitutional because congress provided that authority to the president and executive branch. heather: do you think something gets done on the 8ca? >> interesting question. when you look at the constitutional perspective the aca was not constitutional because it was changing the law through executive order and when donald trump is saying let's halt this he has the power to

rescind prior executive orders. if we have a 5-4 majority of originalists it should be in favor of trump as well. todd: the census citizenship question. how does that come out? >> this goes back to a prior longform used in censuses from 1970 until 2000 so this isn't something new. it is just the doj reinstating that question once that was taken away in 2000. the fact that it has been part of the census since 1970, they are just going back to that, that should be constitutional. it should not be as controversial, this is about free and fair elections, not citizenship question. jillian: to these come down to brett cavanagh? >> it is justice roberts with his twitter war going on with the president. it will depend on him. with brett cavanagh proving himself to be a faithful originalists he will side with

heather: taking a look at that picture on your screen of officer singh before he was shot and killed, this is christmas with is my wife and 5-year-old son. will this change anything? >> i don't think it will. i agree it is so tragic. we have an immigration problem but let's not forget congress has approved $1.6 billion expenditure to build a wall. they are starting to build the wall. they are building a wall in texas and arizona and california. there is a wall being built. the issue is the size of the expenditure. congress does not believe $5 billion is the appropriate amount. we as laypeople don't get into how much is needed but they approved $1.6 billion and there are other ways. if donald from believes a wall must be built there are other ways to get the money, other

departments, the executive branch areas, there are ways to do it. congress is not going to allow for $5 billion. we are just not. if trump, if it is an ego thing he has to come off of the $5 billion number. it will be spent on the wall. heather: we are talking just because this is the latest situation, there have been multiple people who died at the hands of illegal immigrants who entered this country. >> there have been. you talk about how this is an ego issue for the president but not any go issue for democrats who want to hand house and home over to illegal criminals who are coming into the country? ice deported 250,000 illegal immigrants. the amount of resources that cover those folks in california they get free medicare, free college education. instead of using the funds for illegal immigrants why not use them to secure the border?

it has been an incredible year for cinema. i have seen 120 films this year in theaters and these are my top 5 favorite, number 5 avengers infinity war. this movie blue me away. you are dealing with a director who directed captain america civil war and winter soldier and they have taken dozens of characters and flawlessly and effortlessly it seems like, combined them all into one film. you have josh bolin, an incredible film. not just a superhero movie but one of the best movies of the year. todd: what about infinity war? >> roman. a huge film at the oscars, a movie directed by alfonso cuaron who did gravity, and children of men, a very personal story set

in 1970s mexico city, about his own family and his own made growing up. it is one of the most powerful and poetic and beautifully shot movies i have seen in years. you want to watch it on netflix it is available on netflix now but i recommend going to movie theater if you can because the cinematography is gorgeous, heads-up it is black and white and subtitled, but an amazing film that is definitely worth your time if you have patience to sit through it, an amazing experience. jillian: let's go to number 3. >> first man. this is a bit controversial earlier this year. the director directed lala land and whiplash, focuses on neil armstrong. the movie is very documentary style, shot in a way you feel your with neil armstrong and these american heroes who got to the moon and the movie focuses a lot on the sacrifices our american heroes made to get to

the moon and ryan gosling pl. neil i'm strong, it is a great job making you feel your with them in the cockpit during these amazing takeoff sequences and launch sequences. the score is brilliant and they didn't use any green screen. they had projectors with actual images outside the capsule at the model done for the actors to give them a realistic sense of what it was like to do these launches. amazing movie, number 3 of the year, first man. todd: number 2 is a phrase we use when jillian walks onset. jillian: not true at all. >> exactly true. i have been there and seen jillian walk, a star is born, every single time. it is an incredible film. i love this movie, bradley cooper directed this movie, lady gaga in the lead role as well. the fourth movie we have seen. bradley cooper actually shot some of these concert scenes in real concerts so in between sets
