the president has room to do something, let's look at what he might be able to use, he could authorize his building wall without congress. you can see code 2293, civil works project redirecting troops for national defense projects and one that permits military construction projects not otherwise authorized and permits funds being spent on counter drug activities which is another good one and heroin is coming from there. can he do this? >> that remains to be seen. first thing the president would have to do is declare a national emergency under the national emergency act and tell congress why this is a national emergency and define the scope of that emergency and tell congress what other statutory authority he is

relying on in order to give funds to build the wall. you cited a couple statutes, there are 130 odd statutes in the federal code that empower a president to do this kind of thing under appropriate circumstances but it would be challenged in court. >> a lot of people waking up this morning surprised the president didn't declared is a national emergency in his address. where do you see this happening from here? do you think at some point he will declare a national emergency? >> i don't know he will have to, he may very well. i was surprised he didn't do it last night. he's looking to apply public pressure over the hearts and minds of the american people which is why he gave the speech last night but if these negotiations dragged on for a time and if the government shutdown starts to bite on the economy he might do that. rob: he made the case, medline points, people were eager to fact check him. the fact checking didn't go as well as democrats hoped because most of what he said was pretty accurate. there were some things they said needed to be put in context but

i guess the question is do democrats care about any of these facts? did it change their minds in the response? he certainly didn't? >> know. public pressure is what is going to change minds and that will not happen in a 45 minute meeting today. he laid out a rather compelling case, talked about drugs coming from the border, talked about the violence committed by people who are illegally in this country already, talked about the plight of migrants brought into this country suffering violent assault, women being sexually assaulted and the money made by coyotes the bring them across the border. but the american people put pressure on legislators. jillian: is he to declare the financial emergency what will happen from the democrats? >> somebody will challenge it whether they have standing to do so remains to be seen, the house has a body of proceeds to legislators that might have standing and they will go to court and this is not a true

national emergency, this is a manufactured crisis and he lacks the authority to do what he is purporting to do and courts are reluctant normally to weigh in on national security issues but there were a lot of judges that were not a reluctance when it came to the travel ban so we will see what they do when lawsuits get filed if they get filed. rob: the question is can they freeze the project where it stands or does the project continue until there's a final verdict? whatever happens will be appealed and appealed and appealed. >> the pens whether a judge has the temerity to enter an injunction and possibly nationwide injunction to stop the president from doing what he wants to do. that would escalate the crisis and make it more likely the supreme court would step in and step in early. democratic socialist alexandria ocasio-cortez thinks immigrants
