[laughter] >> melissa: just like a shutdown. that's perfect. new reaction to the president's speech last night on border security, and the democrat rebuttal. speaker nancy pelosi accused the president of manufacturing a crisis. the president laid out his case. watch. >> this is a humanitarian crisi crisis, a crisis of the heart, and a crisis of the soul. democrats in congress have refused to acknowledge the crisis. they have refused to provide our brave border agents with the tools they desperately need to protect our families and our nation. >> president trump must stop holding the american people hostage. let's stop and manufacturing a crisis. let's reopen the government. >> melissa: all right. this morning, senate minority

leader chuck schumer taking to the senate floor to double down on their criticism. watch this. >> so, the president continues to fear monger, and he makes up the facts. this is a presidency that is in crisis. in no way to the president's speech last night make a persuasive or even a new case for an exorbitantly expensive border wall. a wall that the president guaranteed would be paid by mexico. he says "i ran on this!" yeah, he ran on it saying mexico would pay for it. >> melissa: white house counselor kelly and connolly responding today to democratic cynicism criticism. watch this. >> the idea you could say these crises are manufactured when you know the suffering and the pain that so many families have endured, because their love ones have died at the hands of illegl aliens who should not have been here, the president detailed some of those real-life accounts yesterday. and said, "what if it was your child, your husband, your wife,

your loved one?" for the democrats to call it manufactured what it's very real and raw is very unfortunate and insulting. speak to pete, there are real things going on, here. there are ridiculous things going on here. the fight over now, whether or not -- there are so many semantics. whether or not it's a crisis. i thought it was clever for the president to switch the idea that it's a humanitarian crisis, because in the past -- and i'm sure we could pull the sound bite -- democrats have said "it's a humanitarian crisis, if you look at all the people. the caravan coming." anytime you see people -- children have died, people are lined up in shelters waiting to see what's going to happen. that's humanitarian crisis. >> pete: it can be both, and it is both. it's a humanitarian crisis but it's also a national security sovereignty crisis at our border. the democrats refused to acknowledge the national security side of it, hence, they don't want to discuss it. they want to emphasize the humanitarian side. >> melissa: they don't even want to's a humanitarian

anymore. it's not a crisis at all. >> pete: something we can manage through components of immigration reform, but not a wall. the wall can be part of it because then men and women can't stick down i could sneak across the border. i would like the president to say it's not $5.7 billion anymore. it's $10 billion. but crisis is so big, i want to go for the whole thing. that was not the time to back away at all. the pressure at a house hot as it is, keep pushing. >> melissa: what can be done now, that's the single biggest of the mind of folks to fixity. lindsey graham said so clearly, let's put deals on the table that makes sense. put stuff out there that the democrats have brought and voted yes on before in the past. that's so logical, i want to fall on the couch onto the grou. >> katie: correct, including the fencing. he has gone from saying we want these concrete barriers to the steel structure. he talked to border agents saying the sea would be better

for the pain he continues to talk to them on the ground to see what they need. to get back to the negotiating table, hearing from people on the ground dealing with the implications. and the mentoring crisis. the fact is the circuits are completely overloaded. if democrats don't think it's a crisis, what exactly do they think it is? every backlog of 800,000 asylum cases prayed 9 out of 10 of those get thrown on the first cd shelters are overloaded. democrats don't want to give border patrol and i.c.e. agents more resources for beds and medical supplies, even though the white house has put that on the table as something they have requested. and then they turn around and try to hold ice and border patrol responsible for deaths that occurred in their facilities. while the facilities continue to get overwhelmed because you can't cut off the thicket as a result of the standoff, democrats refusing to do anything, resources are completely limited and there is a serious humanitarian crisis when it comes to this impacting real people. both central americans, mexicans

who are upset about the caravan being stuck in tijuana, and american citizens who have suffered at the hands of illegal immigration. whether it's economically, or through paying with their lives. >> melissa: 90% of the heroin coming into the country comes over the southern part of bord. it seems meaningful. >> kennedy: doesn't necessarily come in through holes in the border, and a wall isn't necessarily going to stop that. most illegal drugs -- and there's a bigger influx now because the legal cannabis market in this country has cut into the cartels' profits. now that people in the majority of states can obtain either medical or recreational cannabis, they are not relying on the narco's terror cartels any longer. that's a different conversation. but katie brings up an interesting point, which is about mexico. they don't have the resources to prop up the number of people have been trying to enter the united states and who are stuck there. that particular juncture.

why not bring in the u.n.? why not have -- that was something that was talked about a couple months ago. >> melissa: didn't they try that? >> kennedy: they did. when you are talking about refugees and delivering aid to people who really are in a crisis, you have to -- >> harris: if we call them refugees, doesn't that also help the asylum case? >> kennedy: i don't think we have to get hung up again, on another semantic distinction. i think if there are people and they are hungry and sick and they are immobile, then you have to send the u.n. end. also, it was very relieved to see that chuck schumer was actually moving his body on the senate floor. i worried that he was a malfunctioning automaton. [laughter] >> harris: a couple things for both political parties to consider. you've got democrats calling for more people, no barrier, more people. do you know that, according to the border patrol, there are 2,000 job openings?

that is not breaking news. recent reporting shows that -- >> with the border patrol? >> harris: yeah. they are having severe retention issues. the cartels are raising about $65 billion a year. our resources to fight them are staffed at about $61 billion a year. as representative will hurt has set out of texas today, would you think is willing win that e question argue got job openings, and a call by democrats to say "no, no, no. the people are going to be an answer. people and technology." you need the third thing, the barrier. the democrat out of michigan told me that yesterday. they might be closer than we think. the president and republicans -- i was surprised last night to the president fall short and not talk more about what's happening with the shutdown. he's talking about drugs, but the dea is going to be part of what is not funded at this point. why not get those six appropriations bills passed, pete?

"we are doing very well, except for the borders," he says, calling border security "a big problem and a dangerous problem. we have to take care of the border." here's the part i want to share with you most -- he said "we are all working together. i really believe the democrats and the republicans are working together. otherwise, we will go about it in a different manner." he added. nominee william barr is confirmed by the senate. nominee barr on capitol hill today, meeting with senator lindsey graham. senator graham saying that barr has assured him that he will allow special counsel robert mueller to complete his investigation. this comes amid a new development in that probe. court documents revealing that paul manafort, the president's former campaign chairman, is accused of sharing polling data with a russian-tied criminal and operative. catherine herridge on the job for us today to bring us up to speed with the news. catherine? >> the white house characterized the decision to leave after a new attorney general is confirmed as part of a smooth transition. >> i don't think there is any willingness by the president of the white house to push them ou out. my guess is that he is making room for the new attorney general to build a team that he wants around him. >> rod rosenstein left his home

in suburban washington this morning without speaking to reporters. last month, house republicans closed out their russia probe and it singled out rosenstein for failing to come to the hill to answer questions under oath. his role in surveillance abuse allegations during the 2016. after the former top lawyer for the fbi, james baker, backed up accounts that rosenstein was serious when he discussed secretly recording the president and invoking the 25th amendment in may of 2017. after they fired it then-fbi director james comey. they said that his comments were misunderstood and sarcastic. this morning, william barr is on capitol hill, as you mentioned, for a series of senate meetings in advance of next week's hearings. the treatment of the powerful judiciary committee said he will do a deep dive on fisa abuse allegations once he takes the gavel, adding that rosenstein will be part of it. he also pressed barr on how he will handle the special counsel report. >> i asked mr. speethirty

directly, "do you think mr. mueller is on a witch hunt?" and he said no. "what do you intend to do with that?" "i will go through the process of erring on the side of transparency." >> a develop meant late tuesday, a glitch in new court filing revealed that the special counsel accused paul manafort of sharing 2016 polling data with a russian-ukrainian political consultant with suspected ties to russian intelligence. he has previously denied any relationship to russian intelligence services. also, this group of bipartisan senators will renew efforts to put robert miller through legislation. going back and forth, for a couple of months. >> harris: catherine herridge, it's always good to see you. thank you. happy new year. senator graham, the incoming senate judiciary committee chairman, had a lot to say about this today.

where do you think we are going forward with rosenstein leaving? by the way, or member of a scuttlebutt about the president not firing him? it looks like he's just leaving. because it's been a couple years. he said that was a total commitment. >> pete: absolutely. this looks like a new attorney general should have the ability to have a team around him that reflects the priorities and the approach that they attorney general's going to take. barr is very well-respected, i think he will be confirmed. he has taken a measured approach on mueller. all of this about protecting mueller is a bunch of nonsense. how many times do people have does it give them a chance to give him a chance to finish the investigation, before someone believes them? >> harris: it's a chance to say "we don't know what mueller has." and that it's almost over. [laughter] that we believe they just apply for some extension. maybe not. katie, i want to get back to this point. the president obviously meant when he said when he said he's not firing him, and he may very well have known. to your point, he may have known

that was coming. that's part of the president's job, to know what's coming up. he certainly is willing to make some changes on his staff. >> katie: if the president wanted to fire rod rosenstein, he could have done a very long time ago. this is not the white house pushing him out, this is a very basic transition of a position. when a new leader comes in, we saw this with john bolton, when he came in as the new national scary divisor. we saw a couple of those people live, new people comes in. this is what happens when new adventures in command, of cours course. in regards to protecting mueller, lindsey graham is part of the committee. chuck grassley who was in charge before got that bill out of committee to protect the mueller probe. everybody's freaking out that the probe is somehow going to disappear after millions of dollars, hundreds of thousands of hours of work being put in, just because there is an absence of this deputy attorney general position paid that's just not going to happen. >> harris: can i ask it this way, too? democrats have said they could jump-start with investigations. they don't even want to wait for

the probe to yield whatever information it may. where are they so worried about the probe not yielding whatever information it may, if they are willing to subpoena and go after the president anyway? >> kennedy: that's a great question! [laughter] can i jump in with something else? >> katie: they haven't gotten the results they want, and they want to go on their own witch hunt, so to speak. >> melissa: i'm interested in the new information on the manafort prayed he sent 2016 polling data to a business associate and the translator, talk to him about how to influence u.s. policy on the ukraine in order to benefit russia. that doesn't sound good. i would like to know, if that's true, was that in exchange for money? did the president know about it? there is actual material here that i want to know about. >> kennedy: that is a key question. is there a connection between the president, and was there some directive, to manafort?

that somehow you have to exchange information in order to bolster business deals later down the road. who knows? we don't know that yet. both sides have to stop asking as though we do know. because we don't. it also goes to show why we need the full results of the mueller investigation, once he reaches his conclusion. >> harris: is the reason we won't get those customer do think this back and forth about the legislation is anything more than an exercise? >> kennedy: yes, because government likes to protect itself and shield itself from embarrassment. which is what we saw so many ongoing questions at the fbi and doj. >> harris: look at that. you don't mince words, girl. >> kennedy: i men's onions! -- bicameral leadership, they will be coming down to the situation. calculate down to say "look, i want to work with you. i think we can looked dull my together. we could have a deal and ford have minutes and put this thing altogether and open the government and get funding for border security, including construction of the steel fence." but the democrats of course, last night, were bulking at that idea. saying you've got open government first. the president today come in that pool spray, is signing and antihuman trafficking bill. he said "look, if you can't get some agreement, we may have to go to a backup plan." that backup plan would be to declare a national emergency and use the enhanced powers of the presidency after the declaration of emergency to get the military to build a wall. sitting in a pool spray again, which will you will hear very soon, saying he believes he has the absolute right to do it. again, 3:00 this afternoon. there will be no tv cameras, the participants will have to leave their phones outside the

situation room because it's a secure facility. they will sit down and talk and try to hash this out. if the press conference that was just held by nancy pelosi and chuck schumer is any indication, they don't want to talk about border security until there is some kind of agreement to reopen the government. listen to what chuck schumer said a short time ago. >> the president needs to come to his senses and end the shutdown now. i don't think he persuaded a soul with his talk last night. it was the same old, same old. mistruths. divisiveness. didn't have the effect that he had hoped. >> that is chuck schumer's opinion. we will see soon see if it did have the effect of the president hoped, as he made his case that there is in a crisis on the border that needs addressing. schumer said, we all want border security. there's a difference about how we want to get to it."

but the priority for the democrats is to open the government and then negotiate about border security. president trump knows history well enough. he knows back in the mid-1980s, donald trump that's a promise from congress. he got amnesty for all of the people who were here in the country illegally, never got border security. we are now told, melissa, well within the two-minute warning of the playback of the president's comments. we will have those for you and a few seconds now. >> melissa: absolutely. john roberts, thank you for that. real quick, bring it back out to the couch here. i wonder if the momentum has switch shifted. standing there saying no. go ahead. >> harris: a couple things, we had three republicans and now lisa murkowski come across and say they would consider voting with democrats to reopen the government on certain issues. we know in the house, where the democrats have majority, there has been some loosening talk. i watched represented have heard out of texas talking today about

areas he thought he and republis could work together. and democrats. it could be some new ground. >> melissa: and lindsey graham saying "let's just put deals on the table that makes sense." that's where to go from here. so analysis into the president. >> thank you very much. i appreciate you being here. has it been so long? late last night. we are having some very good times in our country. we are doing very well, except for the border. the border is a big problem. it's a very dangerous problem. i can talk all about the job numbers and how well we are doing on the economy, the stock market is up. i guess now we are over 30% since the election. so many good things are happening, but we have to take care of the board. we are all working together. i believe the democrats and the republicans are working to give it. something will happen, i hope. otherwise, we will go about in a different manner. i don't think we will have to do that. but you never know.

she has worked very hard on this. it's very close to her heart. deputy secretary sullivan, administrator green, acting director rotella, assistant secretary johnson, and -- >> melissa: we will keep an eye on this as the president is here talking about the bill signing, and less about the topic of the day, which is border security and the fight that's going on as the government remains partially closed. at the end of this, he is going to talk more about where we are in the progress on this back and forth fight. when he gets that part, we will back to it. don't worry, you won't miss anything. in the meantime, katie, i wonder -- the democrats are making the point of the president has shut the government, he was happy to own that. he's throwing a temper tantrum come as close as a result. last night, i wonder if that dynamic shifted as at all as lindsey graham said "let's put solutions on the table that people want." there's maybe this push forward on some legislation that would fund all of these things that

come in the past, democrats have wanted to do. the fence and, more patrol, more security, more camo, more technology preyed all of that stuff in addition to opening the government. you see chuck schumer and nancy pelosi stand locked together in an uncomfortable looking position, saying "no, no, no." how have things change? >> katie: is becoming increasingly clear that chuck schumer and nancy pelosi have a goal of attacking president trump. you see just now, president trump in the oval office, he is still talking about how this affects real individual people. he is going into detail about human trafficking, what that actually means, to women and children. he was describing the way women are taken, they take their mouths and put them into advance never be seen again paid that's the kind of things people he talk about, watching the saying "this is a big problem, there is a human cost. and yet, democrats are only sending their staffers to meet at the white house." nancy pelosi and chuck schumer aren't showing up themselves to

have these conversations. they are dug in not unnecessarily the issues of providing more resources. they say "we are all for border security, close go but they aren't providing real details about what that means. the white house come on the other hand, talk about the wall and more resources as a whole for the border patrol and ice. >> harris: i bring up the case of the person let go from prison and going free after spending all of her maturing teenage years in prison. she killed an attacker. she was human-traffic in this country. that was a big case for celebrities. when i see a president signed a bill like this and go into detail, this is something that hollywood has stepped into and made a difference on. people like kim kardashian paid not only the prison reform, but this was something important to. others in hollywood. i just wonder, is there some sort of -- what's happening? where those voices now? the president is making a difference on something that we

can meet on the middle on. >> pete: they are gone, harris. they are gone. they are far gone. campus reform did a video recently where it read quotes from nancy pelosi and chuck schumer, and hillary clinton about the wall. from 2005 and 2009. they pretended it was trump. all the kids were like "those are racist terrible comments! they are so divisive eczema" but then they revealed it was said by democrats. all of the sudden -- the reality is, the democratic party has gone so far left is unrecognizable. common sense things like a wall and border security are still sensitive to regular americans, no longer -- >> harris: but it's going on right now. >> melissa: they will make fun of him, kennedy, right? but he's describing people with tape over their mouths. >> pete: it doesn't matter what he does. they will hate trump no matter what the bill is called. >> kennedy: they will trivialize the president because they want to win at all costs. they don't care what it takes. they don't care what the collateral damage is, in terms

of federal workers who don't get paid, or border agent positions who aren't filled. they want to win the presidency. they are hoping to do as much damage to the president as possible, on every issue. particularly, on this one. it's not having the same kind of traction that it was when we were having the family separations at the border. this is a larger issue. this is the president's signature issue. he has soften his language, democrats have yet to do the same. >> katie: can i say one more thing real quickly customer at the american people are starting to see that open borders are any main, and the open borders do not promote good behavior or a safe path for people to come to the country. it's very dangerous and the president has laid that out repeatedly. >> pete: he had some good lines about that last night. >> melissa: all eyes are already on iowa as democratic voters from the hawkeye state prioritize a candidate who can beat president trump. can any of the candidates emerging beat president trump? and are women in the democratic party hamstrung by the likability issue was to mark

take care of the situation. i know you want to. everybody wants to. who wouldn't want to? right now we have a problem. we have to take care of this and it's quicker and easier to do this individually. but we'd like to see real immigration reform in this country, because we need it. it can be a beautiful thing. with all of the companies coming into our country, we have seven car companies now that are announcing or have announced this recently. we have many car companies at other companies come as you know, they are flowing in. we have the best job numbers, virtually, that we have ever had. for african-american, the best ever. hispanic, asian, the best ever. the best in 50 years. soon the overall number will be beaten. we have the best job numbers. we need great, qualified people. we want them to come in. i think it's a great time right now because of that. we need people, rob. in ohio we need workers. i know you feel the same way. i don't speak for chris, but everybody wants to see immigration reform.

something that i thought was really interesting. that is, how this plays in middle america and the importance of that. >> katie: yeah, i don't want to come off as not having empathy for the federal government workers. i know a lot of them. a lot of my friends work for the senate and the deferment of justice. they have been furloughed and they are not getting paid tomorrow, as far as we can see. the fact is, in the private sector out in america, if you lose your job you don't get paid, either. the company goes under, they walk into your office on monday morning or friday afternoon and say "sorry, but we know longer have a position for you." there is no backpay. there is no furlough. there is no guarantee that your job is going to be there in four weeks, five weeks, two months when the government shutdown is over. i wonder, with all these questions coming from the press, it's concerning about d8 donna e dea and the secret service. when i question is being asked out of concern, i wonder what the average american working in the private sector things about that. >> kennedy: if it's not
