bottom of it. ainsley: the covington high school story. steve: we told you after they met with the police covington catholic high school decided to close their doors yesterday to everybody. they apparently deleted their website facebook page disconnected their phone number put out the message to please keep covington catholic high school in your prayers because of the social media outrage after this image went viral. initially, it was look at that kid in that maga cap. is he smirking. and is he mocking that native american. we know that narrative is not true. it's been turned on its head and that young man in the red hat is actually going to be on another morning show later on today and he said look i was not disrespectful to that person. ainsley: they released a clip. actually hearing from both of them. first play the sound by the of nick sandman and savanna guthrie asked him do you feel you owe anybody an apology? this was his response. >> as far as standing there,

i had every right to do so. my position inside i was not disrespectful. i was respect him. i would like to talk to him. i mean, in hindsight i wish we could have walked away and avoided the whole thing. brian: that wouldn't have diffused it even if he had walked away it didn't seem like it anyway. turn and walk and not show up your your protest and sat there and stared. that's not aggressive. nathan phillips found out something about his background. he wasn't in vietnam. is he not a vietnam war veteran but did he write this in the enquirer in a response to the -- in response to this whole incident. he, meaning the kid you just heard from stole my narrative. from the time i hit that first beat of the drum until i hit the last beat, i was in prayer. now all of a sudden he's the prayer guy and the pacific one. ainsley: he was never deployed to vietnam.

"the washington post" had to make a correction on that. he did serve in the marines from 1972 to 1977. steve: during the vietnam era. meanwhile, you know, for a lot of people, they are are looking at how this all started it looks like a social media family numb. fen phenomenon. the image went out. they thought it was from a california school teacher but then they realized this is from a blogger in brazil. twitter can't tell exactly where it's from. nonetheless, they took down that particular website on twitter. but at the same time, there are a number of people who are tweeted things about those kids, calling for their death and their family's death and everything else that are still up. we're going to have very shortly with us an attorney who is representing some of the children for free to go after the people who have not yet taken down or apologized about the story they tried to spread like wildfire that is wrong. ainsley: also have two students that released that

video that were sitting down behind the table that were on yesterday we had them on. yesterday on "the view" they were talking about this. whoopi goldberg asked the panel why do you think the panel was rushing to judgment? this is what joy behar says. >> why is that? why do we keep making the same mistake? >> because we are desperate to get trump out of office. steve: we heard something like that from one of the mothers who is actually a chaperone. she joined us yesterday. she said something similar she felt that the young men were targeted because of their maga hats and because of their religion as well. brian: other major story that stev doesn't seem to be coming to an end after historic 33 day partial government shutdown that effects agriculture and justice and other departments. two votes. both are expected to pass. mitch mcconnell's offering much like the president's speech 5.7 billion for the border barrier. three years daca recipients protection and three year protections for temporary protective status. and there are other things there with more border agents. 75 new judgmen75 judges. the democrats are saying we are going to put something up there that essentially says let's talk, reopen the government up until february 8th. both aren't supposed to get

60 votes. ainsley: two bills. one for the daca protection and one to keep the government running and fund the government through february 8th. both need 60 votes in order to pass. steve: they do. so, you know, how many days have we been, so many? where is the counter offer from the democrats? there simply is not one. there is going to be okay we will reopen the government temporarily until we figure something out. but the president doesn't trust the democrats and the democrats don't trust the president. ainsley: every idea the democrats put on the table does not include any money for the wall. steve: there is no negotiation about how to go forward. steny hoyer was on yesterday with newscast an neil cavuto its extraordinary sound bite what he said because, keep in mind, nancy pelosi has made it very clear they are not going to get more than a dollar for that barrier wall. but steny hoyer yesterday said it's not immoral and barriers work. >> i think physical barriers

are a part of the solution. >> you don't share nancy pelosi's view though a wall is immoral? >> look, i think it depends on what a wall is used for whether it's moral or immoral. if it's protecting people it's moral. if it's imprisoning people it may be immoral. that's not the issue. the issue is we want border security. brian: there is another congresswoman alyssa who is also getting -- saying things different from nancy pelosi. nancy pelosi says it's immoral. it's a nonstarter. i'm not going to build it she said we all have a fire under us to get something done. we will try to figure out this dynamic between all of us and the leadership is still trying to figure out how to manage this ennet jet particular and outspoken class. president's approval rating nothing has changed. according to the harvard-harris poll he has 45% approval rating throughout this historic shutdown which he says blame on me.

steve: big question is what is going to happen next tuesday? is the president going to give his state of the union at the house of representatives? nancy pelosi has not officially pulled the rug out from underneath him. they did, the white house the advance team did ask on sunday for a walk through on monday. it did not happen. apparently the white house is preparing two different versions of the state of the union. one to be delivered at the capitol with nancy pelosi sitting right there and the other somewhere else in the united states. we also hear that apparently it sounds like behind the scenes white house team is working with some u.s. senators to come up with a bigger bargain of sorts. just in case what happens tomorrow at 2:30 doesn't work. ainsley: last week when nancy pelosi asked the president to delay the speech or just put it in writing. we were all talking about, that's a week and a half away. that's next tuesday. i was thinking surely the government is not going to stay open that late. now there is a good chance that it could. brian: remember, almost a year ago a year ago to the day there was an offer out there.

surveillance video shows pena holding on to olivia and leading her away from another man she was seen leaving a bar with. this happened on saturday. he will be in court today. the trump administration is asking the supreme court to decide on the citizenship question. the request, which bypasses the court of appeals demands a final ruling by the end of june. that would leave enough time for the question are you a u.s. citizen to be printed on the 2020 census. last week a federal district judge ruled to block the question. and the saga continues, mans, new orleans saints fans headed to court over a controversial play on the field. a pair of season ticket holders filing a lawsuit over the saints ending playoff loss. they say the nfl caused anguish and emotional trauma and loss of enjoyment in life. they want the league to reverse the results of the game or schedule a do-over. we are not going to hear the end of this. brian: i would like to sue the giants were not as good as they were supposed to be.

[bleep] steve: that is rapper cardi b. not holding back on her thoughts on the government shutdown. then came a huge fight on twitter between cardi b. screen left and on the right our next guest tomi lahren. tomi joins us now from the west coast. tomi, what happened? >> well, to put it pretty simply, i saw that video that she had posted and, you know, i imply that maybe cardi b. isn't the person we should be taking our political advice from and it took her a few days but she responded and instead of arguing about the merits of her political argument, she said that she was going to dog walk me. and, you know, viewers should look up urban dictionary what dog walking means. the point is simply to severely beat somebody up. we go from a political disagreement to i want to hurt you. steve: cardi b. tweeted the dog walking stuff after you tweeted looks like cardi b. is the latest greenous political mind to endorse the democrats.

ha, keep it up guys, maga 2020: she mentioned the dog-walking thing and out of nowhere alexandria ocasio-cortez came out and she agreed with cardi b. and she wrote why do people think that they can mess with bronx women without getting roasted. they act as though our borough hasn't been perfecting the clap back game since the sugar hill gang. y'all just found it on twitter. were you surprised to see that? >> i'm not surprised at anything alexandria ocasio-cortez does. but, again, i'm also impressed the way the left does the mental gym that the particulars to justify it. alexandria ocasio-cortez on all daily basis says that trump supporters and president trump himself incite violence and then she goes and applauds and encourages a tweet by a rap his or her threatens physical violence against me. so, again, this is a double standard at play and not just rappers. it's not trust trolls on twitter. these are elected representatives who are endorsing and saying the same thing. so, you know, it's really

puzzling and troubling. steve: you are saying that because she essentially came back and defended cardi b., who had said the stuff about the dog-walking regarding you, that is something that there is a double standard for and you would like aoc to do what then? >> well, again, i don't really want her to do anything. steve: she will do something. >> cardi b. can have a political opinion. alexandria ocasio-cortez can have a political opinion. we know we are not going to stop her from doing that i would just like to point out the left's hypocrisy. can you imagine if i would threaten to dog walk cordy b. or anyone else for that matter as a conservative, as a trump supporter, i would never get away with that but they are able to do it and the left applauds it now, again, if you look through my final thoughts i did the other day on fox nation where you just look at my twitter, you can see that there are leftist with verified accounts not only laughing at the fact of me being dog-walked they are tweeting out peoples of me in a leash with a collar with cardi b. walking me.

for having transferred the information to paul. ainsley: a russian outlet is reporting that after receiving a flash drive with secrets. if arrested he could receive 20 years in prison. brian? brian: eager to end the shutdown standing firm against the president's proposals compromise on border security. the senate will vote on two separate bills will be tomorrow. one is on trump's plan that you heard about on saturday and other is to reopen the government without funding for the wall and they will negotiate until february 8th. here now to debate it if democrats will come to the table or not, at least with a counter proposal is david, a radio talk show host and fox news contributor richard fowler. first off, david, both sides are going to get a vote on thursday. how many votes do you think republicans can get and how many votes do you think democrats can get on the proposal as you see them? >> as you predicted, brian,

not enough. this is the warm-up act. we have to find some creative solution. historically both sides have had a problem getting to what i call the missing middle of solution. if you look back on the two major accomplishments of the last two administrations, healthcare and the tax cuts, they got no support from the other side. we are in the middle of gridlock. we will need creative solutions to get out of the gridlock and challenge is the people don't trust the president certainly on the democratic side to hold his position because he has had at least three or four can i tick through and some republican senators hitch mcconnell's second kick at the mule here there is a last of trust. we have to rise above that lack of trust and get going here this is an intolerable situation. it's hurting the president politically more than your poll quote a couple minutes ago indicates. he is getting really hurt here particularly among independent voters. brian: i agree, the situation between favorable and unfavorable has widened. the last poll 45%. another poll has it at 40%. richard, also to be fair, barack obama got no republican votes for

obamacare. so having said that do you think it's time for the democrats to stop saying temper tantrum and hostage-taking and putting something forward? >> thanks for having me, brian. a couple things here. number one, have you seen the democrats, they have already tried to put something forward. they will c.r. that was passed in the september the continuing resolution would have kept the government open and vote you had by almost 100% of the united states senate and the president stopped it because he has moved his position on the border wall. at first he wanted 2.5 billion. then he wanted -- now he is at 5.7 billion. and the president's other problem is that in this new bill he has proposed is he going to lose republican votes. republicans all across the spectrum have a problem with daca as well as temporary protected status. what makes this even more interesting for this president while that's all happening, at our airports, our tsa agents are literally sticking out one day after another because they are not being paid. the president is in a conundrum and i don't think his messaging folks at the white house haven't helped him out any.

he hasn't figured out a way to talk to 800,000 government workers not being paid as well as the american people. brian: we could have had a similar segment 10 days ago. it becomes clear no effort to reopen and talk about anything but the border wall barrier. >> that's not true. democrats have said over and over again what we won't do is hold the government hostage. we have the debate on immigration. brian: what nancy pelosi keeps saying, david, no money for a wall. she does not -- is not pressed on barriers, steel slats, but the president's moved on that. if she says i will put the wall on the table, reopen the government until february 8th. wouldn't that move the ball forward, david? >> well, i think she is reluctant to give away something that's political base symbolism vs. national security solution. look at what john kelly said about the wall. look what lindsey graham said about the wall a year and a half ago. what the democrats have to do though to your point, brian, they have to do more

than say no. they have to get the government open. rise above it both sides have. to say give the white house some political off ramp and the democrats will need the same. they should be proposing tripling national security, upping port of entry security, new technologies, drones. brian: i have news for you it's all in the proposal. and i also say barriers work in certain places. absolutely. it doesn't work everywhere. that's clear. talk about anything else is ridiculous. we have 600 miles of fence we you wanted to improve it and make it better and now all of a sudden it's immoral to have it and we have had it since 1992. >> a couple of points there point number one is this, is that the number one reason why we have illegal immigration in this country has nothing to do with our southern border and everything to do with people entering points of entry and visa overstays. maybe if the white house addressed overstays and modernized immigration system that could be off ramp for democrats. all we have seen from this president is a proposal just for the wall.

some student parents are considg legal action. one attorney says he dual it for free. brian: i understand people emotionally taking sides where does the legality of this come in? because these are private citizens and in many cases minors were kids. the law is saying anything false about them is libel. and you don't have a defense of actual malice all you have to prove is negligence. a lot of these journalists that have been saying false statements about these kids. false statements about the kids that were at the lincoln memorial. false statements about kids in various photographs rated to the school. slurring and libeling the entire school and alumni for the school and prove they were negligent in doing so. by this standpoint in this point in time it is clear that anyone who continues to lie and libel about these kids has done so illegally and can be sued for it. ainsley: robert, why do you want to do this? why do you want to help the families? >> the nature of libel lawsuits generally very hard to bring. they cost between a quarter of a million and a million

dollars in legal fees to bring. that's how much powerful people will use for their legal fees to defend such suits. i wanted to equalize the playing field. these are people who couldn't afford to bring this claim on their own behalf. that's why i offered my services for free because somebody needed to stop this from reoccurring and happening to other kids across the country. steve: robert, i understand you are going to give a 48-hour notice to potential defendants to correct this or be sued. i understand you want to go ahead and lay out your plan for all the people who have put out tweets and said things that are simply not accurate. what is the plan? >> exactly. everybody is now on 48 hours' notice. so, by friday, everybody needs to retract, and correct any false statements they have issued about these kids that includes any major member of the media, that includes any major celebrity. that includes anybody with a substantial social media platform. if you have said anything false about these kids, they are willing to extend you a 48-hour time period. a period of grace consistent with their christian faith for you to through concessions get redemption

and retract and correct and apologize. if you do not. the next week you may be a defendant in a lawsuit. because those lawsuits will start to occur next week. brian: do you have a dollar figure with damages? to depend on the person that they tweeted or spoke out about? >> the nice thing about defamation law is when a particular form of lie or libel is particularly inflammatory, you are allowed to seek what's called per se damages. this means you don't have to prove any individual damages to you. it's just that it is so osceola that the jury gets to assign what those damages are those damages with range from 50,000 to 300,000 in the gawker case millions and millions of dollars. so, all these people that have lied and libeled better be checking their bank accounts if they are going to continue to lie and libel these kids. ainsley: robert, we have a list and can you put up on the screen a lot of the people that have retracted and made apologies you see meghan mccain there we have been talking about that over the last few days. jamie lee curtis. lots of celebrities have said look, i judged two

quickly and i'm sorry about that. i wish i had seen the whole video. who comes to mind though? what defendants are you really most disappointed in that has not retracted or has not apologized? >> people like maggie harasserston at the "new york times." she is a news reporter what is perceived leading newspaper in the country. she falsely made statements about these kids. basically invited their expulsion from school and ruining of their reputations. she did so based on inadequate review of the information. despite knowing from her own newspaper how false those original statements are she has yet to retract, yet to correct and yet to apologize. she will be one of the people sued if she doesn't do it in the next 48 hours. brian: have you heard from any families. >> yes. i represent families of three different groups. families of kids who were at the lincoln memorial who have been libeled. i represent families of kids who have been in some of the photos like the new york daily news libled them and made false statements about what the nature of those photos were from the school. i represent alumni who feel

ainsley: protecting the right to life is getting harder and harder as governor cuomo signs a bill updating new york's abortion law which legalized abortion up to birth and iowa strikes down the fetal heart beat abortion law. this as planned parenthood releasing its annual report and the numbers are shocking. the organization performed 332,000 abortions in 2017 in that fiscal year. that's 11,000 more abortions than the year before. that's also the highest number in any year since 2011 and 2012. our next guest says this new report disapproves the organization's own narrative. catherine glenn foster the

>> it's a three-step process that we've done here in california, building up to ballot harvesting. the first is automatic registration. that is what they want in california, everyone over18 is automatically registered to vote. we already have every 16 and 17-year-old automatically registered before they turn 18. the second thing is automatic mail ballot. everyone is mailed a ballot whether you ask for one or not. the problem with those two, a couple weeks before election day every mailbox is full of ballots. someone to go down the street and go yoink, steal ballots, fill them out. jerry brown two years ago signed a law to allah ballot harvesting. you don't have to mail in, drop off your ballot. you're allowed to drop off anyone's ballot. we had people in the last election dropping off carloads of ballots. that is ballot harvesting. steve: what could go wrong. >> ripe for abuse and fraud. brian: kamala harris, junior

crisis, the drugs coming across the border. they say they want to stop crime coming across our border. the president's plan addresses everything democrats claim they care about, everything democrats want to have happen. yet we haven't seen them come on board and support it. that is question everybody should be asking, democrat members of congest, why aren't you supporting this? brian: here is what senator schumer said today -- >> they don't want to help the president. brian: here is what senator schumer said to answer that question. >> that is not how negotiating works. that is not "the art of the deal." what we have here is just another one-sided, partisan proposal from the president. and contrary to the president's claims, it hardly represents a soften of his position. the president's proposal is just wrapping paper on the same partisan package. brian: so, he says it is just wrapping paper. what they keep saying what they are proposing what they are going to vote on is, okay, open up the government, then we'll

negotiate up until february 8th i think. if the president got word from nancy pelosi that the fence, the barrier was on the table, would he be more amenable to accepting that offer? >> brian, the problem his she flat-out told the president that wasn't the case. he asked her point-blank, if i open the government at that point, they were talking about opening for 30-day cr. he asked her if i open the government in 30 days, will you give me funding for border security, including the wall. she said no. it is that simple. the president has laid out a compromise bill that gives democrats the, access -- senator schumer saying this doesn't address democrat concerns. this isn't how negotiating works. the president had a number of meetings with democrat members congress, asked them directly what they want and these are things included in this proposal. whether it is more technology at the border, whether it is funding for more border patrol agents. whether it is, they voted for

secure fence act in the past. these are all things democrats supported. the only difference who is sitting in the oval office. democrats have got to stop playing politics. nancy pelosi has to start putting the american people ahead of partisan politics. hopefully we'll see is happen on thursday. if not, it's a shame to the 800,000 federal workers, and a real shame to the angel moms, rest of americans affected by human trafficking and drug overdoses in this country. steve: nancy pelosi, certainly not playing politics when she essentially asked the president to postpone the appearance on capitol hill. as we know, apparently the u.s. capitol not secure. she was worried about that although that has been disproven by everybody. >> i think we're all glad to see nancy finally care about the safety and security of someone including the president. i wish she would take that same level of concern and apply it to the millions of americans that live in this country that have been impacted by the fact that we have completely open border

and step up. she has got to come to the table, actually start doing her job. steve: there are stories, people in working in the white house are preparing two different versions of the state of the union address. one, if the president actually goes to capitol hill and is in congress, or, a second plan b, if he plan b location like our southern border. i know you don't want to tip your hand because nancy pelosi hasn't officially uninvited the president. how much of that story is true? >> look, we always like to have a plan b but the president should be able to address the american people whether he does that from the halls of congress or whether he does that in another location, the president will talk to the american people on january 29th. brian: one way or another? >> as he does nearly every single day. we'll continue moving forward with a state of the union. we'll see what happens. steve: okay. >> sarah, white house correspondents association is

christopher columbus has been under attack. what is the significance about this. >> which should remember our history. should not be covering it up. brian: what did he do for christianity? >> brought christianity to the americas. we can't cover up our history. at the end of the day we have to have a honest conversation. did bad things happen when columbus arrived here? absolutely. why were the indigenous communities,ism packed? absolutely. at same time can we forget that columbus arrive until america brought hope to millions of people around the world? columbus arriving here helped people fleeing economic persecution and economic hardship. it is not right to forget and cover up one side of the story. brian: why does it mean so much for italian-americans? >> if we could step back 130 years for a moment, think about what america was like back thin.
