capitol hill after dueling funding bills fail in the senate. lawmakers scrambling to come up with another deal. griff jenkins live in dc. the president considers his next move. it is like a game of chess. >> reporter: it is like a wrecking game of checkers was asked the senate bill to come in and reopen the government, donald trump signaling he is open to considering whatever compromises they come up with including a short-term resolution that has a down payment on a wall. >> one of the ideas suggested is they pay a down payment, for the wall, and they need the wall. >> reporter: nancy pelosi who calls with the crisis the president created was quick to shoot it down.

lots of prayers answered. a trip to new york city takes a deadly turn overnight. one person is dead and 20 others injured after a major crash involving a tour bus on a new jersey hwy.. a witness said the bus coming from upstate new york slammed into this median and went airborne, 3 other cars were involved in all this, police investigating that cause and we will follow it up for you. caitlin was off-duty when she was at another officer's home, two other on-duty officers also stopped gun and shot her in the chest. officers rushed her to the hospital where she did later died. the simplest police chief says the incident is being

investigated as accidental. she served in the department for two years, the army veteran leaves behind a husband. the man accused of the deadly rampage in a florida bank makes his first court appearance, xavier charged in the murders of 5 women. among the victims is cynthia watson with marissa lopez and williams, a mother of 7, two victims have not been identified. police say they veer shot all 5 victims execution style. his motive still unclear. making his first court appearance, illegal immigrants accused of murdering four people in nevada. wilbur martinez guzman was tracked down by police after receipt and surveillance video from some pond shops. investigators say the man from el salvador stole from the victims, they are expected to file murder charges in the next few days. michael cohen will comply with

why can't they come to some agreement either side? >> reporter: divided government is messy. we've seen that before but yesterday you saw the first progress, the white house and the senate talking compromise. the discouraging time would be what you saw from the house with nancy pelosi reflectively opposing any compromise bill. heather: six senators who voted for the plan without wall funding, these names will not be surprising to some folks but only one democrat crossed over and voted in favor of donald trump's bill, that being manchin from west virginia. does that surprise you? >> not really. a lot of senators in red states got wiped out last year so increasingly they are from blue states, have no reason to compromise or show signs of working with donald trump that is nancy pelosi's problem, representing one half of one third of government but also has

the responsibility of governing. it is no longer enough to oppose everything donald trump looks forward to but she negotiates in good faith to move forward. heather: this has been happening since she became speaker. we've been in this situation and haven't been doing any governing, she's been saying a lot of no. when you break down donald trump's latest offer. so people can compare, this is his latest offer, a down payment on border wall funding, steel slats for a border barrier, funding for border security and 3-year protections for daca and tps recipients, compare that to his earlier deal from earlier this week. we are not talking a down payment, earlier this week he was asking $5.7 billion for the border wall, steel slats, additional funding for border security and 3-year protections but compare that to one year ago

tomorrow where the deal was taking place. he was asking $25 billion for the wall, solid concrete barrier, restricting chain migration and extension of daca. you break them down, you could see which side is trying to negotiate. >> this might be his fifth or sixth compromise offer but the issue, i don't think anyone doubts donald trump's commitment to securing the southern border in a way he deems fit, it is the issue that defined him, that he ran on and won on. on the other side nancy pelosi's hold on her speaker's gavel is tenuous and she knows she has a restless crew she has to keep in line. alexandria ocasio-cortez, any sign of compromise with trump is viewed as a huge defeat because a lot of new members think they were elected to fight and obstruct. they don't see a need to govern or compromise.

heather: you mentioned alexandria ocasio-cortez. texas congressman dan crenshaw was on with us yesterday and talked about last week, republicans voted twice on a motion to recommit which would send appropriation bill back to the committee in order to pay federal workers. separate from this bipartisan plan they would get back pay. federal workers would be paid in real time and democrats denied that. >> each time that vote comes for a couple democrats vote for it so that shows they are getting nervous. longer-term better solution is to open the government but i think as long as one half of one third of government is totally unwilling to compromise or be flex 1 billion any sense of the word will be a challenge. i also think what is making it complicated is what is happening at the presidential level because underneath this

spectacle you have a 2020 campaign underway on the democratic side and nancy pelosi doesn't want to agree to something that gets undercut by elizabeth lauren or any of these presidential candidates because it will make her look weak and take away the speaker's gavel. >> one year from january, trying to negotiate this instantly offered more of what they want and he was elected president based on this. the american people elected him. he ran on border security and this wall and nancy pelosi and the democrats are denying that. they are denying it to the american people who voted him into office. >> now that mitch mcconnell and schumer are talking, the white house is being flexible the spotlight will increasingly turn to nancy pelosi and what she is willing to give and that's not good for democrats because they

racist. i like to point out to people it was lyndon johnson, a democrat, they convinced black families we are stronger apart and pushed welfare dependency. it was bill clinton, a democrat, that push the 1994 crime bill that led to mass incarceration of black people in bernie sanders who in your video clip that actually signed the 1994 bill and supported it as well. and easy out to label someone white a racist because you can't prove or disprove it but that is what they are doing. they have nothing else to go on. heather: why aren't we hearing more about the things you just referenced? why aren't we hearing more about the benefits of the prison reform that he brought to the table? black unemployment, at 6.6%, historic lows? we have approval rating among latino voters which is up, 50% up, 19 point jump from december. why aren't we hearing more about

these positive things? >> they don't want to say anything positive about our president. what will happen in 2020, we will see the effects of the prison reform bill, we will see a lot of people that were locked up for long-term for nonviolent crimes start to come home and take advantage of the job training outlined in that bill and they will start taking advantage of the unemployment number and landing jobs and it will be hard to ignore that in the black community and people will question how racist our president truly is. heather: in the wake of this covington catholic high school issue that the viral video, now they are saying the red hats are a sign of racism. if you wear when you are a racist. it is moving beyond the president to anyone who supports him. >> i don't understand why the make america great again hat is a symbol of racism because many black people where it. i have to point out, people want to see racism they should look

don't make it. they don't last that long. take a look at the va. they are leaning towards privatized medicine. they passed the mission act because somebody can't get into cva doctors, it doesn't work. heather: let's look at these numbers. the kaiser family foundation poll found 45% of 18-29-year-olds, 28% of 30-39-year-olds, they favor this no primary care provider. this other pole that favors medicare for all, 56%. how do you justify those numbers? >> many variables involved. from the cost, the premiums, sometimes they don't have time to see their primary care doctor, their hours don't fit your schedule or some people think i am young and healthy and don't need primary care doctor. that is the wrong idea because
