were a few minutes of trouble yesterday. a bit of news yesterday, right? dean: especially if you were this guy. pete: we will get to that before we get to that president trump went out to the rose garden yet. we were 35 days into a shutdown. everyone wondered what the next move was. the president said, hey, it's time to end it. it's time to operate in good faith. let's end the shutdown and talk about how to secure our border. here was the president yesterday around 2:00 in the afternoon. watch. >> over the next 21 days i expect that both democrats and republicans cooperate in good faith. this is an opportunity for all parties to work together for the benefit of our whole beautiful, wonderful nation. if we make a fair deal, the american people will be proud of their government for proving that we can put country before party. we can show all americans and people all around the world that both political

parties are united when it comes to protecting our country and protecting our people. katie: after president trump made that now. announcement. he got some push back saying he was caving on the wall. no money for the wall and initial deal of him opening up the government which he was trying to negotiate a way from nancy pelosi and he tweeted, quote: i wish people would read or listen to my words on the border wall. this is a no way a concession. it was taking care of millions of people who are getting badly hurt by the shutdown with the understanding that in 21 days, if no deal is done, it's off to the races. so the press secretary sanders followed up with that to reiterate the president's message. 21 days president donald trump is moving forward, building the wall, with or without the democrats. the only outstanding question is whether the democrats want something or nothing. pete: that is the question. the deal is three weeks, reopen the government negotiate on border security

otherwise the government shuts down again or declare a national emergency. what do you make of yesterday? dean: this is the classic like in a film you have the ticking clock. so here it comes. you have two weeks? pete: three weeks. katie: february 15th. dean: at the end if he doesn't get at the will declare the national emergency. emergency. pete: this is what the democrats said they wanted. reopen the government and then we will renegotiate. nancy pelosi was never a good faith partner in this. try to flee to hawaii. try to flee to afghanistan. didn't get a chance to do it. ultimately said i will not even speak a word. will not give you a dollar unless you reopen the government. dean: one dollar. katie: have you forgot about what they said about that we remember what they said. look. >> much harder to achieve a good negotiation while the

government is shut down. we will continue to negotiate. we will continue to the first order of business open up the government. >> the president proposed yesterday increasing border security. i will use that as a starting point, but you have got to start by opening the government. >> open government and then give us a short period of time, three weeks has been suggested, in order to come up with a homeland security border security plan. we all agree to work in good faith once government is open. >> we are very firm in our support on how we secure our borders. let's have that discussion after we open up government. pete: there is so much good faith from the democrats. so much on their of border security. so after the president, in good faith, said i will reopen the government so people can get paid so we can negotiate about the border wall. what did nancy say? this is what she said. >> have i not been clear on a wall? no, i have been very clear on the wall. our values unify us. and i'm sure it's the same in the senate. and the fact is that our diversity is our strength differences in so many different ways including

differences of opinion. that's our strength. but our unity is our power. democrats are committed to border security and we think we have some better ideas about how to do so that protect our border honor our values and are cost-effective. katie: senator chuck schumer said the same thing yesterday after president trump made this concession to negotiate. he said look there is a lot we agree on with border security there is a lot we agree on that. we disagree on the wall. katie: i think it's clear that the democrats are not willing to move forward with that. brian: loolunancy. nancy pelosi says diversity is the of our strength: and then their unity is their power. unity to obstruct the president is a power. they didn't move one iota and one inch. they were fine to have the government shut down. won't talk about the wall. even though everyone knows it works. where it goes from here,

dean, without a declaration of an emergency, i don't know. dean: here's the thing for me. sitting there listening to the argument back and forth which i do we hear we don't want a wall. there is no way there is a wall from sea to shining sea. i heard eric swalwell saying that yesterday. everyone know it's not going to be a contiguous wall. katie: that's never been the argument. dean: they say. obviously a barrier is some part of it. going to go in and there going to happen. it's a matter of how and when. it has to happen. if you listen to customs and border patrol. they are screaming about it this is the best way to do it and other places some combination thereof. they need to get together and really fix the immigration problem. pete: i don't know if they can. we say that because we are used to say it where will the democrats give one inch. katie: clearly they have proven that they won't. as sarah sanders has said, if it's going to happen it's going to have to be through a national emergency and make sure this happens.

senator lindsey graham who has been negotiating with the white house and trying to be a liaison between the white house and capitol hill over the last couple of weeks gave his prediction on capitol hill, watch. >> come february the 15th, if the democrats still say go to hell on the wall, you get a dollar, that's it. they basically tell trump i'm not going to do with what you did with you with bush and obama. then i hope he will go the emergency route. we don't need to shut the government down. we need to secure out border. to me, the last best chance to do this win-win is between now and february the 15th. pete: that's why this was not a cave. you get frustrated because the wall money still doesn't come. you can't make a deal with someone who won't even sit down with you. katie: i can understand why people felt it was some kind of concession. at the same time, the president is opening up the door and saying, again, i'm being the one who is reasonable. i'm allowing democrats to come to the negotiating table. getting people paid so we don't have families suffering as the democrats have argued for.

democrats are the one us who voted against people getting paid in the federal government. three times and, yet, we are using them as political pawns to say look at the republicans. they are not wanting to people to get paid. he is saying let's stop the consequences of what is happening with the airports and everything else now and come it the table and actually talk about what's going on. he is so serious about this that he is willing to, again, declare a national emergency and get back to where we were. nancy pelosi and chuck schumer have already said they are not interested in any kind of barrier wall. dean: not interested in any kind of barrier. you need it there customs and border patrol say you need a barrier of some sort, some place. it's got to happen. funny thing is for him to back down and take away the talking points everyone is getting paid so that whole part is gone. oh, they are doing a big victory lap the democrats and nancy pelosi doing a victory lap. it's actually not that big a cave. i really don't think it is a cave. looks bad now and willing to take the lumps to get what he needs. pete: whoever's idea was he

pete: whoever's idea was he should walk out to the empty podium and walk back. whoever was in charge of putting out press conference yesterday was terrible it played into the hands of democrats which i don't think they should be playing any victory dances. nothing has been solved. dean: nothing has been solved. pete: when this comes to national emergencies. there have been 58 states of emergency declared since 1976. 31 are still in effect. clinton did 17, including about burrma. w. bush did 13. zimbabwe, syria and a country i cannot even pronounce. obama about the flu. yemen. yemen. for trump to declare a national emergency after everything he's done to try to work with congress to get a legislative solution, everyone says constitutionally it's bullet-proof. that is -- that is his trump card, you might say. three weeks, you gout a chance, do it on your terms, make a deal, otherwise i'm building it, boys. you can sue me all you want. i'm building it and we will secure our border. katie: we want to hear from people watching this show

patriots action honorary chairman jenny beth martin. thank you for being here this morning. i appreciate it you met with the president before the decision was made to cut the deal to reopen the government. what do you believe the calculation was, you are a conservative. do you feel like this was a cave? how are you looking at the president's decision this morning. >> the whole point of this exercise is to secure the border. and what we know for certain is that we're going to wind up with a secure border with a physical barrier. the president made that clear yesterday. really the question is how are we going to get there? is congress ever going to come to the table and negotiate with the president on this or is he going to act through the national emergencies act? pete: it sounds good to talk about congress doing something but that would require democrats and democratic leadership to in good faith to actually talk about a physical barrier. they want to talk about border security without acknowledging that that's required. do you have any confidence

at all that they will actually come to the table and negotiate? >> no, i really don't. i think that speaker pelosi in the last 24 hours, not just i mean in the last month but even in the last 24 hours has shown her true colors. she has made it very clear she is not willing to negotiate as far as a border wall or physical barrier, whatever you want to call it, what president trump has promised, she is not willing to negotiate on that. she is gloating. she is spiking the ball. she is more interested in defeating the president, that's what she is focused on, than an our nation's security. so, we have seen that. we see her true colors right now. the president has been willing to negotiate. he has been willing to go further than some people may even want him to do who are his supporters, but they understand they are trying to give him the leeway to negotiate. she hasn't been willing to do that at all. pete: you are exactly right. the pundits have been say hog wins, who caves, who doesn't. who is to blame for the

shutdown. what do you think average voters, the american people think about nancy pelosi's conduct, the fact that she says not -- just one dollar. that's it. not even willing to talk about it? >> i think that people are going to see three through. this and maybe it may take a little bit of time because in the heat of shutdowns that's sometimes how things work. during this process, what the president has been able to do is shed more light on the problems at the border, to educate the american people on the deaths that have happened at the border, the illegal drug us that have been coming across and the need to secure the border with a physical barrier, increase border patrol and other law enforcement. also increase the number of beds for the influx of border crossers that we have and have technology to detect narcotics and weapons. he has made that clear. he is educating the american people on what the problems are right now.

in all of that area. that's a big, beautiful area. and now it's one of the poorest places in the world. that's what socialism gets you. katie: our next guest was born and raised in venezuela and has a warning to 2020 democrats campaigning for socialist policies at home. debby d'souza joins us now. tell us about your upbringing in venezuela and how it's changed. >> growing up in venezuela, i had everything that, you know, was available to us, you know, food, clothing, just, you know, really luxuries that people can't even imagine looking at venezuela today. venezuela was a very prosperous country, very beautiful country but prosperous. the government believed in the constitution. they followed it. the government has always

been corrupt but i think that it's really hard to find a non-corrupt government anywhere in the world. and so that was no exception. but they did follow the constitution. it was not a ter written tyrannl dictatorship as it has now. dean: nearly 90% of all venezuelas live in poverty. inflation forecast at 10 million percent. million. and the collapse led to shortage of food, medicine and other basic foods. 5,000 venezuelans are fleeing the country every single day. do you see any danger what the 2020 dems are calling for now. they are saying it's impossible. it could never happen here. what is your experience? >> well, you know, my family said it could never happen there. they were convinced that hugo chavez was not going to turn the country into a communist country. and he did it for the last 20 years venezuela has been on the road to socialism.

socialism is equal misery. anybody who thinks otherwise needs to go to venezuela and witness it for themselves. you know, everybody, you can't find food, you go from grocery store to grocery store just to find the basics. you line up, and if you don't get in by the time they close, you don't get food. there have been reports of people actually eating their own pets. it's horrific. and i can't imagine that anybody in america would think that something like this was a wonderful thing. it's a terrible, terrible way to live. it's horrific ideology that i can't imagine anybody thinking is a good thing. katie: debby, there have been a number of democrats hollywood leftist praised venezuela as a place where can you get to the american dream faster than you can get to it in america. have you elizabeth warren warren saying she is proposing a tax on the

wealthy, richest of americans only affect the tippy top. those with a net worth of over $50 million and calling it the ultra-millionaire tax. as margaret thatcher said the problem with socialism is running out of other people's money. venezuela used to be one of the richest countries in the world. what is your response to people creek in with the socialism here in america? >> well, that's exactly how it happened there. it was actually socioeconomic havoc on the people that were hard-working and making money. and so what happened is that their money went nowhere. the regime actually imposed price controls on business owners. they couldn't make a profit anymore. so, you know, a lot of the middle class and you were middle class, they started moving out of venezuela. so, yes, they ran out of

you have nancy pelosi and chuck schumer they are the ones i blame for the impasse here to getting to yes means getting rid of all of the getting rid of all of the objections. so the democrats they said oh we can't even talk to you because we are in the middle of a shutdown. okay, that's gone away, oh, mr. president, we can't allow to you speak to the chamber in the joint session of congress in the state of the union, that's gone. so the president gets to make that case to the american people. and is going to expose over the course of time that nancy pelosi and chuck schumer have no plan for border security but it's going to force their members to stop hiding and to go into this conference committee which is the way it is supposed to work and actually talk about this and eventually get a border wall. i have total confidence that donald trump will build that wall. we are only still in the middle of the game but the president will achieve it. katie: what's tipping point because we were at day 35 yesterday. the president vowed to keep moving forward if there was no funding from democrats with the wall and here we are now with reopening of

the government for three weeks and no down payment on the wall. >> i think at some point the republican leaders in the senate went to the president, sat down with him and said, look, this is where we are at. this is how we are going to move i this forward. something had to change. again my focus, my blame is on schumer and pelosi. that's the problem here. katie: do you think it's going to be any different in 15 days? >> i know it's a technical thing go to conference committee force the two sides to sit down and have this discussion. the longer we keep talking about border security and need for physical impediment the president wins he wins that argument. pete: the president cannot afford to walk into that conference committee and walk out cut a deal. gave them daca and i got $2 billion. he will get hammered for that. >> this has got to be republicans and democrats, house and senate getting together. the president is the last step here.

them so in 2020 they can say he didn't do what he campaigned on. pete: that's correct. talk to an expert. mark morgan former border patrol chief under former president barack obama. mark, thanks for joining us this morning. you hear nancy pelosi saying, you know, we want a with our values that's cost-effective. president trump said just like the wheel, walls have been used forever to keep people out and maintain sovereignty. what's your take on where we are right now? >> it's easy for me and it's based on my experience as a law enforcement officer for over 30 years. yesterday when the president spoke to the american people, and he outlined his case, he is absolutely right. we absolutely need additional physical barrier, wall, whatever you want to call it at strategic locations along the southwest border. we need additional personnel. personnel. we need additional technology at the ports and in between the ports. the experts will tell you and they have been telling and they have been telling congress for a long time that's party of the

multilayer strategy, infrastructure, technology and personnel and the president yesterday laid all that out. we need to do it all including the wall. the additional thing that i will say that we need to do and the president has been asking for this is for congress to get together do their job they have been elected to do broken asylum call and case precedent like flores to remove the incentive for immigrants to come here and take this perilous trek and risk their lives and get here and overwhelm our system. the president is absolutely right with what he has outlined. dean: you are the expert of experts when they keep saying we want to listen to what the experts tell us. what you just said is not what the democrats are advocating and seems completely common sense to a regular person like me. what is the problem here? is it just politics? >> i tried to stay out of politics at the end of the day this issue is so infused with politics it's impossible to stay away from

that. the only conclusion that i can draw because as you said, dean, this is common sense is that the opposition is being driven by their own political ideology. and if i could say any silver lining that's in the shutdown is any other time in american history americans are aware and awake about immigration crisis. they are starting to change a little bit. instead of aligning with political ideology listen to the facts and truth and listening to the experts. that's what the president has done and is doing and the reason why i know the president has listened to the experts, because i provided the same service information that the president is talking to the previous administration. and it was ignored. katie: yeah. we have seen a number of democrats come out and say we just need to listen to the experts. the experts need to talk to us about this. and yet they're ignoring guys like you who have done it for republican and democrat administrations in terms of the information that they're giving. we will see what happens with that. pete: who are the experts they are talking to then? if they're not talking to you,. katie: who are they talking

find a solution to the border crisis. democrats say they want to talk about it, but they still want no money for the wall. the president went up to that podium and said we will negotiate. at the end of those three weeks, if we can't get there by february 15th, i have constitutional powers and prongives that i will use. people reading into that thinking that might be a national emergency. katie: president trump also receiving some criticism because he reopened the federal government without any funding right now for his wall. so he tweeted to clarify. he said: i wish people would read or listen to my words on the border wall. this was in no way a concession. it was taking care of millions of people who were getting badly hurt by the shutdown with the understanding that in 21 days if no deal is done, it's off to the races. dean, it was interesting he mentioned millions of people. he wasn't just mentioning the 800,000 federal workers. talking about the broader economy. especially after yesterday, seeing those flights getting delayed and other things happening. dean: smart thing to do if he is going to declare a national emergency. he will challenge in court.

president is listening to the experts. i provided the same information that the president is talking to the previous administration and it was ignored. pete: easy to instantly react and be frustrated the shutdown was about the wall and wall funding. the more i think about it be careful what you wish for moment for democrats. they will don't have a solution. they said we'll talk once you reopen the government. so they have lost their leverage there now they have to talk. they say they want border security but all the border experts say that includes a physical barrier. they only have three weeks to do it. at which point the president has proven through lawyers and others he has the constitutional prerogative to declare a national emergency which is a lot more of the emergency than the 58 states of emergency declared since 1976. katie: take a listen to democrats in their own words promising to necessary united states on the border wall if trump reopened the government. >> it's much harder to achieve a good negotiation while the government is shutdown.

us now. first, let's get your reaction to this new bill. >> well, as you just said, very well, it was the celebration of abortion which, to me, is a celebration of death. it's a dehumanization of a whole class of human beings in our society. the child in the womb who clearly is a human subject from the moment of conception. all the science proves that so, even though it has been advertised as a bill that brings more equality to women, it excludes a certain class of women, the unborn, half of all abortions are females. so, i do not see it something that i would celebrate. as a matter of fact, it extends -- actually, it takes away protections that previously we h and in no way is it as many of its proponents say a track in roe v. wade. it goes way beyond roe v. wade in so many ways.

so, certainly, i don't see it something to celebrate. katie: bishop. the governor talked about hits faith in the state of the state. i want to hear your reaction to that. >> i happen to be roman catholic. i'm a former altar boy and my relationship with the church is important to me. i have found the differences painful over the years. katie: how does that square? how does this catholic faith square with this new proabortion bill that he celebrated in the name of women's equality this week? >> well, as his words are in themselves many, many catholics have differences with the church on a number of issues. but this is a very radical separation from the catholic communion in the way that he presents this not only as something which is a matter of law but also which actually distances him from

one of the basic moral teachings of our church and that is the sanctity of all human life. of course, pope francis has been very, very outpony outoutsn about the sanctity of all human life. although the governor understandably would like to align himself with pope francis in this regard he is light years away. pete: bishop, walk me through the mindset. it's one thing to be a reluctant advocate for women to make a choice early on in their pregnancy and say i think there is a right for abortion. it's another thing to celebrate bringing on late term abortions. what is -- to me, they are the same thing but light years apart. what is the mindset that celebrates versus reluctantly argues for it? >> i wish i could understand that. personally, i can't get into the mind and heart. it may be some form of denial. it may be something else.

i don't know what is actually in that mindset. i mean, the kind of procedures that now are possible in new york state, we wouldn't even do to a dog or a cat in a similar situation. it's torture. and as you probably are aware, dr. bernard nathanson who formally described himself as an abortionist and performed many, many abortions not a man of the catholic faith but came to recognize the inhumanity of the young he was aborting. he famously produced a documentary called the scream. in which he detailed the incredible pain that a human being feels in the womb even at early stages. dean: there are a number of people screaming for governor cuomo to be excommunicated from the catholic church. what are your thoughts on that? >> i can certainly understand the outrage and the anger. and i, and many bishops have

been asked to consider that sanction. as you know governor cuomo is not a resident of my diocese so i would not have what we call jurisdiction. i'm not his county executive so to speak. that's a technical question. excommunication is a very -- is a last resort and as the governor continues to distance himself from our communion, it may unfortunately result in that. my hope is that since his faith is important to him, he will consider -- reconsider the importance of maintaining that communion and not continue to distance himself. there are different forms of what we might generally say excommunication. one can put themselves in a position whereby morally they cannot receive communion at the altar rail and governor is in that situation right now. katie: long-term abortion an -- late termabortion and celf

everybody agrees with that at that point you donate the proceeds to offset the losses of the folks laid off during the shutdown. i think that's a great idea. katie: take an act of congress to get retribution for this call. dean: it was a horrible call i'm a former defensive back. it was overturned. i'm sorry for you who dat saints that certainly was going to be a win. get the money and give it back to the people losing money during the shutdown. what are your thoughts now on the shutdown, sir? you had a lot to say yesterday about the saints and the rams. how about the shutdown? >> i'm glad the shutdown is over. and if the product of this is the american people are more aware of the need for a barrier at the southern border and, by the way, on a bipartisan basis now, everybody but pelosi is conceding that barriers work. we need more of them and we should have some. and then the outcome will ultimately at least have a silver lining. that we will have more protection at the southern border, hopefully we will see if that plays out.

democrats already said yesterday pelosi and schumer are not willing to build the wall. >> i will be introducing legislation next week which combings up with alternative way. we have talked about it in the past, in which you take proceeds that have been confiscated from mexican cartels and use that to build the wall. it won't be taxpayers, it will be the mexican cartels will be advancing that, hopefully that will be a middle ground. katie: how much is that over the course of a year? >> that's a lot of money. >> there is about 4 to $5 billion confiscated per year. pete: why are we even talking? senator, why are we even talking? that's the easiest and most common sense solution i have ever heard. why would they not say steal from the drug dealers and from the drug dealers and build a wall. >> because it's become an article of faith among pelosi and her kind of inner circle that they cannot give trump a victory even if it means securing our southern border. even if it means stopping unrestricted immigration to our country. now, that's a sorry state of affairs but i'm hoping that we can push through that.

wanted and what he needed, what the officials and those brave men and women i just mentioned said they needed to protect this country. he put that out daily. democrats would not negotiate, they would not come to the table. but in the course of that conversation, in the course of that shutdown what changed was that we had democrats from rank and file positions come to us and say, listen, we ran on safety and security. our constituents don't think walls are immoral, they don't think locking their doors at night protecting their own families is immoral. we are not chuck -- we are not like chuck schumer. we are not nancy pelosi's puppet. we want to work with you guys to come to a solution. when we open the government to actually build barriers along the southern border to protect the american people, and when we heard that, we realized the dam was beginning to break on the democrat side, and we could get something accomplished. that's why the president decided to open the government and pay those hard working federal employees, 800,000 plus. the government's now open, and now it's time to secure the

border. dean: hogan, after this all happened yesterday, 17 days, three weeks to make a deal. but minority leader chuck schumer says he hopes yesterday, he said he hopes that the president learned his lesson. listen to this. >> working people throughout america empathize with the federal workers and were aghast at a what the president was doing to them. hopefully now the president has learned his lesson. katie: so, hogan, if this is the attitude of democrats, do we actually expect them to do anything especially since schumer said, look, we agree with a lot of things on border security, we do not agree with the wall. >> the democrats can't just not negotiate. they can't offer anything -- offer nothing and expect something to get done. listen, while the government was shut down democrats, talk about tone deaf. nancy pelosi hauled off and went to hawaii, democrats partied in

puerto rico, and then they took four-day weekends. so they weren't doing anything on behalf of the american people. they used these federal workers as pawns. regardless of what they try and say and the tears that stream down their cheeks, they did nothing to protect the american people, and they did nothing to open the government, they did nothing for these 800,000 federal employees. we think we can get something done because we've had newly-elected democrats come to us and say we are not going to stand with the leadership who is completely tone deaf to the needs of safety and security for the american people. we think we can work with them. we had conversations with our highest level of staffers on our side plus newly-elected congressmen and congress women who said, listen, we need to come to the table and offer an agreement. their constituents demand it. and, listen, they have minds of their own. their not beholden to chuck and nancy like so many others are. pete: critics of the president will say you know who else got nothing? the president.

the government reopened, which is what the democrats wanted. you're giving a lot of good faith to the democrats, which i've yet to see. and i don't know who these unicorn, moderate democrats are, sounds nice, but count me as skeptical. if you get to the end of three weeks and there's no magical deal, is the president declared to prepare a national emergency or another measure to make sure the wall gets built? >> all those options remain on the table. the president has taken nothing off the table. and the fact that he made that point yesterday in the rose garden, listen, we are facing a national emergency, he's prepared to announce that and do everything necessary to protect the american people. so i think that's an important point here. but, listen, we are where we are because with democrats refused to negotiate, as you just said. there aren't as many unions as you think out there. plenty of folks have actually said they want to negotiate, so hopefully that happens. katie: do you see that caucus, the moderate democrat caucus, putting -- pete: unicorn caucus.

i want to hear about all experiences, including positive stories, but is this really about exposing christian schools, or is it about portraying or amplifying the differences that the media has with christian ideology? >> yeah, that's a good point because even the word "expose," that insinuates there's some sort of dark, deep secret about christian schools, something they're hiding from us, so we need people to come out and be whistleblowers, essentially. obviously, there are people who have had negative experiences, there are bad christian schools out there, there are men that are more secular institutions that are more expensive and maybe have a cross on the wall. those sorts of things exist, but generally speaking, you know, this campaign to sort of undermine christian education in and of itself,, that i think, is the problem. katie: i think you made a good point about the public schools. people certainly feel threatened by private institutions who are teaching values and things like english and math and also science. dean: shame on them.

fight another day. now you are fighting on their terms. others say it's a cave. what do you make of it? >> it's a tactical play, only for three weeks. i'm one of the ones, being a campaign person, if you go into a fight you play to win when public opinion is on your side. 63% of the american public in our november poll said they oppose open borders. only 28% said they were in favor. that's what this is about. plus, 75% in june told us it's unfair that they allow illegals to jump the line on the millions of people waiting to get into this country legally. so public opinion's on the president's side. you got to fight it to win. if he has to call an emergency, he should so maybe he postponed that for three weeks. pete: still he has it on the table at the end of three weeks which gives him leverage. we have seen cracks on the democrat side. pelosi says walls are ineffective and immoral but guys like steny hoyer acknowledged that physical barriers are effective. is there a place where certain democrats might cross the line and work with republicans to

actually address the physical barrier portion of border security? >> i'm not so sure you are going to see democrats go forth and put -- allocate funds towards a wall along the entire border. i think what they have voted for in the past is increased border security. democrats are not for open borders -- pete: that's a lot of code talk. that's fair. everyone likes to talk about border security. that's fine. talk to any expert, they say there's three aspects. personnel, technology and infrastructure. infrastructure means a physical barrier. do you believe democrats should acknowledge that a physical barrier is necessary? >> i don't think it's necessary along -- pete: i'm going to build it all the way across winding down the river if i could. >> use eminent domain and seize lands from private citizens? you can't. pete: in order to build the new jersey turnpike, i'm sure they used plenty of eminent domain. >> you are in favor of seizing land from private citizens? pete: there's plenty of precedent for eminent domain to

and completely vindicated. katie: our next guest says stone's indictment follows a concerning pattern in mueller's investigation. pete: here to explain, harvard law school emeritus professor, the esteemed professor alan dershowitz. professor dershowitz, first of all, why hit roger stone with a heavy duty s.w.a.t. brigade and cnn cameras, why do it that way? >> obviously to put pressure on him, tell him they mean business and to say look, if you're not on our side, we will go after you. we will go after you in every possible way, maybe we will go after your family and friends, that's what prosecutors do. but if you join our team, if you cooperate, if you sing and of course, when people sing, sometimes they compose, then we will be on your side. there was no reason for that arrest yesterday. they should have simply sent his lawyer a notice saying please show up to the federal court. government admitted he was not a

flight risk. they consented to very, very low bail, basically released on his own, and it was just a show, and how cnn learned about the arrest and was there at the time also raises some serious questions. look, as judge ellis, who presided over the manafort case, said about manafort, mueller isn't interested in going after this guy for his bank fraud. they're interested in squeezing him. they're interested in getting information from him about the real target and that's donald trump. that's a very disturbing way of using the criminal justice process. also, this shows another disturbing trend and that is mueller has hardly indicted anybody for crimes that occurred before he started the investigation. almost all of these crimes, like this one, occurred during the investigation. they are process crimes. they're not crimes of substance. now, in the indictment, mueller tells an interesting story about wikileaks but he doesn't charge

him with anything like that. he can't defend himself against that at trial. at trial, he's only charged with lying and tampering with witnesses and obstruction with justice, all of which occurred after mueller was appointed. so far, mueller has come up relatively empty on crimes that occurred before he was appointed, which was his mandate. dean: so ultimately, what does this tell you about whatever picture mueller's trying to put together? >> it's going to be very circumstantial picture. he will not have, at least on the basis of what we now know, hard evidence of any illegal conspiracy between the trump campaign, certainly not involving president trump himself, and the russians. but there will be a circumstantial case that he will build, this obstruction of justice, this lying to congress, this call, and it will be a very critical report and that's why i think it would be fair to allow the trump team to come up with
