live in washington for us where the president and the top democrats are still in the standoff, good morning, griff. griff griff good morning, yeah, the lights are on in the capitol but i don't know for how long and federal workers are coming back to work on shaky ground because fight with president trump and democratic lawmakers are far from over. lawmakers striking deal before funding runs out again in 3 weeks telling the wall street journal, quote, i personally think it's less than 5050, you have a lot of very good people on the board. the president did not rule out another shutdown saying it's essential an option this as white house chief of staff mick mulvaney took to sunday shows condemning case on the president's sticking point, the wall. >> it's not a made-up magical number of $5.7 billion, it's the wall where we need it the most and the quickest. that's what's driving this.

>> no, definitely continue to be an issue. they have been for years. all the border patrol -- the first one back in april of 2018 and the vast majority of those came into the country and we leased into the country because of catch and release program, caravan after caravan showing up to border. heather: are you seeing increase in caravans over the span of time that you have been at the border? >> yes. like i said, we had them for years but the first -- another one about 12,000 now already at the border. every time one comes up to the border and makes it here another comes. heather: what happens

specifically when they do make it to the border, area where there isn't any type of border wall or anything like that to stop them, what physically do you have to deal with? >> well, they find vulnerabilities within structural barriers that we have now and they enter the country illegally and give up patrol agents so they can be transported to the station and be caught and released later. heather: that's really their goal is to basically get 2 feet across the border and turn themselves in so that that process can begin? >> that is correct, yes. heather: what about the dangers that you're dealing with down there every day? >> well, the border, we have people come across illegally

>> great to be here. heather: let's look at factual numbers dealing with venezuela's collapse, nearly 90% of venezuelans live in poverty, inflation, 10 million percent and collapse led to shortages of food, medicine, other basic goods as well, 5,000 venezuelans fleeing the country and that's just daily. so, ken, is this a huge warning sign that some on the left are missing? >> without question, heather, venezuela is an absolute disaster from a humanitarian perspective and from an economic perspective. the poverty rate is absolutely unacceptable, inflation has devalued every single asset in the entire country, people are fleeing, the murder rate has doubled, economic system that has failed and time to put it where it belongs in the history books. heather: joel, we have people like senator warren proposing

annual wealth tax with 50 million in assets, different types of things suggested by people on the left. >> yes, heather, let's not confuse things here, venezuela is a corrupt dictatorship and senator marco rubio calls, it's not socialism that's causing the problems it's the corruption and the dictatorship in venezuela. president trump has actually been pursuing multilateral policy, economic pressure on maduro that is working, that is gaining traction and that is having a positive effect on the dynamics there and we should not start to call it socialism, that was undermined our ability and president trump's ability -- heather: but what about -- what do you make of the statement specifically from the new york city bill de blasio, joe, i want you to comment on this, plenty of money in the nation, it's just in the wrong hands.

good morning, tracee. tracee: tax season officially starts today with the government back open and running the irs workers will now be processing tax returns, also those tax refunds which is good news for a lot of people but we can expect there to be delays, irs workers have said they have millions of unanswered taxpayer letters to get to. so you've got to be patient but here are the deadlines you need to remember, april 15th, that is the deadline to file for most taxpayers, april 17th deadline in dc, maine because of local holidays, october 15th, the last day the irs will accept returns filed online, so once again, be patient if you are coming across any delays because, of course, the irs, they have a big job this year with tax laws that have also changed. heather: on top of that getting back to work today. let's talk about this -- the new apple products that may detect some dangers including poisonous

with or without congress. heather: immigration takes center stage on capitol hill as the white house pledges to build the wall but can it be built without congress by declaring a national emergency in here to weigh in constitutional law attorney jenna ellis, thank you so much for joining us this morning. >> good to see you, heather. heather: a lot of folks questioning this, bottom line can this be done without congress, national emergency, can it be done? >> absolutely. the reason is congress has delegated authority to the executive branch specifically the president under the national emergency act and so if congress doesn't like what the current president is doing, there's actually a 1980 supreme court case that has addressed specific issue saying that even where congress has delegated authority to the president he can do action even if they disagree with how he uses his authority, that's a policy issue, they can't then try to block it just because they don't like it. heather: once he does this and declares a national emergency and it's in the process of

happening, they have no other alternative at that point in. >> well, they can -- they can go back and they can always modify the national emergency's act but we do have precedent for this under reagan as well as bush that was specifically about the border protection and so we see that we do have precedence for this, if congress wants to take this type of authority from the president, they have to do their job and legislate and modify act. >> would that put everything on hold? >> that might change if they are going to legislate but that will take a while. in this particular instance we only have 3 weeks and so everybody is saying the government is reopened, only period of 3 weeks, they need to get their legislative act together and make sure that they are fulfilling their responsibility, they are providing common sense solutions to immigration that would be the best-case scenario, president trump is clear country over party and if congress is doing

their job, they would look at their responsibility and they wouldn't push the issue to make him have to decide to use the national emergency. heather: interesting over the weekend, if you looked at responses on social media and the responses from pundints and the president lost in this, who has the upperhand in negotiation. the president willing to put country over party and negotiate, this is what negotiation is. >> absolutely, we have seen that over the last 2 years with the president and other border issues like so-called muslim travel ban, urging congress to act. dictators using the authority, he stayed within the margins of constitution, that's conservatism, that's conserving the rule of law and the legislature, he's consistently urged congress to act, they are

the ones that need to make sure that it's country over party. heather: something else we need to talk about, earlier we were talking about migrant caravans which have increased approaching our border and according to texas attorney general ken paxton, 58,000 noncitizens voted in texas since 1996, from 1996 to 2018, so how big of a problem could this be nationwide if you have noncitizens voting? >> well the whole idea of voting is not a right, it's actually a privilege and the difference is that our fundamental rights are prepolitical. but privileges are aspects of particular system of government which includes voting, we have to qualify in order to participate in the element. heather: showing some sort of id, some states not doing that

anymore. >> they should, the reason they don't is because there are illegal votes, that's the only way that the progressive agenda can actually get pushed through because if we look at voting and how that element of our democracy is to preserve and protect america first, then what the progressive left wants to do is actually have conflict of interest and have illegals that have voting in order to advance their agenda and that could fundamentally add conflict of interest and so the bottom line really is that nationwide if this becomes more of a prolific problem, then we won't see that american citizen able to participate in that element of democracy. heather: also includes numbers and increases potentially the amount of representation that some states like california or texas would have in congress versus some other states. >> yeah, there's absolutely no reason why anyone who is concerned about america wouldn't want only citizens to vote.
