try and stake their claim to the 2020 presidential race. ♪ welcome to america's news headquarters from washington on a saturday. just when you thought it was going to be a quiet super bowl sunday weekend. >> never ever going to be dull again. leland: when you thought friday was the end of the news cycle. >> do you ever think that anymore? >> i dare to dream occasionally. >> well, i'm molly line. leland vittert, of course, as well. we're talking about our virginia governor ralph northam today. he's slated to make a statement at 2:30 this afternoon and one virginia lawmaker tells fox news that the governor is now questioning whether he is in that controversial yearbook photo less than 24 hours after apologizing for being in that photo. our garrett tenney is in richard, virginia with the latest on this unfolding story, garrett. >> well, molly, despite the

growing calls for his resignation, the democratic party says they've gotten word that governor ralph northam will not be resigning this morning. he's expected to have a press conference at 2:30 eastern time. on friday he admitted it's time in the picture from the 1984 medical school yearbook and describes the costumes as one man wearing black-face and the other wearing ku klux klan, and he didn't know which was him. and now he says he's not for sure. he did reach out and say it's not him in the picture and he's not resigning. here is what northam said in a video last night. >> i am deeply sorry. i cannot change the decisions i made nor can i undo the harm my behavior caused then and today,

but i accept responsibility for my past actions and i'm ready to do the hard work of regaining your trust. >> now, that was not enough for the state party though, which is still calling for northam to immediately resign saying he no longer has our confidence nor our support. he must end this chapter immediately and step down and let lt. governor justin fairfax heal virginia's wounds. if he does not resign there's a process where he could be impeached. there are questions whether or not this picture from nearly 34 years ago, whether or not that picture constitutes an impeachable offense. >> an unfolding story for certain. and we'll look later this afternoon for word from the foreign. thank you, garrett tenney. leland: live coverage on that. to cause the fallout democratic strategist blake rutherford and former head of the democratic party in virginia. appreciate you being here.

either of you want to throw governor northam a lifeline here? >> not at all. [laughter] >> no, immediately. let me say this. i'm looking at this guy with more so of a side out right now. governor northam needs to take several seats. he's basically saying or somebody's trying to spin that his apology yesterday was or should be null and void because maybe it wasn't him in the photo? what does that say? that says that either this guy took a punch of pictures when he was in school of him in black-face and possibly him wearing a ku klux klan outfit and he doesn't know if that's the actual picture. maybe it's a different picture. it's ridiculous, this guy needs to step down immediately. leland: this is the statement from yesterday. earlier today, a website published a photograph of me from my 1984 medical school yearbook in a costume that's clearly racist and offensive. i'm deeply sorry for the

decision i made to appear as i did in this photo and for the hurt that decision caused then and now. you know, there is the shaggy defense, it wasn't me, but typically that involves saying it wasn't me from the beginning. >> in his case, he admitted it was him and even his story today is exactly as, you know, it's just disgust. well, this may not be the actual picture of me with sort of an open parenthetical, but perhaps already other photos. this is not how as an elected officials you deal with cries 101. the list of democrats that called for him to resign is exhaustive and extensive. the list of democrats saying let's see how this plays out, is very short because we haven't

found any yet. the question is, what does it mean as we zoom out. as garrett tenney pointed out, you can't force northam to resign no matter how many democrats call for him to. you've got democrats announcing almost daily new for the presidential race. this is not the conversation democrats want to be having. >> absolutely not, but this will get worse for governor northam. the calls will only be amplified. he's going to suffer, you know, i think really, really serious criticism, and you have someone waiting in the wings that it seems very clear virginia democrats want to ascend to that governorship. so he's in a really, really bad spot politically. i'm really not-- he may think and politicians are always the last ones to think that they need to resign, so he may be the very last voice of that in virginia. but i think eventually he gets there. >> to that point though, how long can democrats afford for this to be the conversation,

that a democratic governor, who, by the way, made race an issue in his campaign, and there was a lot of talk that his opponent, ed glessy was a racist, et cetera, et cetera, and saying it was time to call out racist politicians and yet now democrats have to continue to answer for him for as long as he's in office? >> that's right, so as long as he remains a focal point in conversations through media, through coffee shop conversations, water cooler conversations, this remains toxic for democrats who are trying to advance politically. so right now the best thing that can happen for democrats is for northam to resign and-- >> it may be the best thing. democrats seem to agree that's the best thing because that's what we're telling him to do. what if he doesn't? what are the options for democrats? >> they have to distance themselves from him immediately. leland: blake, is that possible? cause so many democrats are on record and on twitter and things

that perhaps didn't age so well, talking about how he was the answer to the racism that may or may not have existed in virginia? >> i think you'll see, leland, a lot of democrats say, wait a minute, if this was your yearbook, if you knew this was out there, why did you run for governor in the first place? you're putting all of us in a terrible position by doubling down on what i think ultimately is a nonsensical defense, and so, i think that's right. i think it starts with distance, but political pressure can be incredibly severe, and i do think there are people that ultimately governor northam will listen to. he's probably not listening to them today, but that may change 12, 24, 36 hours from now. >> this brings up an interesting point in terms of the arc of this story. if northam decides to stick around longer, if it's the 36 hours blake is talking about or longer, how do democrats try and change the conversation after one of their own doesn't listen

to them about resigning? >> i think they need to denounce that he is one of their own and start there. what you have seen are the progressives in the democratic party being really at the forefront of calling out one of their fellow democrats. in addition to that, beyond the right now political conversation, you have a presidential conversation. you also have a gubernatorial conversation. all of these-- all of these elements of politics must be contained somehow and this guy, this guy toxifies every single bit of it. so, yeah you've got to denounce it and do it quick. leland: many have. the list continues to grow. we heard from joe biden earlier today on this very issue. gentlemen, appreciate you guys being here. it's rare, but perhaps refreshing to have a panel where everybody agrees. >> yeah. leland: so we will await governor northam at 2:30 p.m. eastern, about two hours and 20

emergency, the deadline just two weeks away. ellison barber travelling with the president down in west palm beach. you know, ellison, you had to stick around over christmas up in d.c. we're glad you got some time in the sun. >> thank you, we're glad that it finally let up a little bit of the rain. we went from snow to now sunny and it's rain now and now it's turned into a beautiful day and the president is here this weekend. he is expected to be here through sunday. we're told that he'll spend some of his time this weekend, working on tweaking his state of the union address. president trump has said that those bipartisan negotiations, that bipartisan conference committee was negotiating on capitol hill to try to come up with some sort of border security package that the president will sign by february 15th. he says those are proving to be a waste of time. the president said on multiple occasions that he's prepared to declare a national emergency in the event of that negotiation, a deal was not reached by the end of those negotiations. president trump hinted at the white house yesterday that that sort of announcement could

actually come during his state of the union address. >> i don't want to say, but you'll hear the state of the union and then you'll see what happens right after the state of the union. >> there's a good chance that we'll have to do that, but we will, at the same time, be building regardless, we're building a wall, we're building a lot of wall. >> a senior administration official who briefed reporters at the white house friday afternoon declined to comment when asked if the president plans to use his address to make that sort of policy announcement, one senior republican on capitol hill, who i spoke with the, the senior republican aide don't necessarily think he'll do that and if there's the option and has things ready to go. the bullet in the gun, so to speak and told the new york times, that house speaker nancy pelosi is hurting our country and that he's quote, set the table. set the stage for doing what i'm going to do. here is what he told cbs news in records to how talks with house

>> the president getting a little time on the golf course. we understand he's playing a round of golf today with legendary golfers jacks nicholas and tiger woods. we'll see if there's any pool or update on the score. thank you. >> you bet. >> for more insight let's turn to top republican house members-- sorry about that. conference committee border during and ranking member, kay granger. congresswoman, you're an excellent person to talk to as the negotiations go on and trying to avoid another shutdown. give us some insight. you know a lot about how things are going. could we expect a better outcome than we saw with the long shutdown through january? >> you really can. the people that are on that committee are very experienced members of congress, and senators. we've negotiated many conference bills. this is a process that is used, that's been for a long, long time to settle differences and to bring together the house, the

senate, and most of us know each other. the chair and i have have worked on committees before so we're optimistic and we want to find the right solutions to keep our borders secure. >> the president is out there with the possibility of a national emergency being declared. your thoughts on that? >> i hope that doesn't happen. our job is it to find a solution and a compromise. if we can't do that, the president has to take whatever actions he decides. we've had a meeting where we talked about how important it was for all of to us work together. that border security, protecting our country is uppermost in our minds. i really think we could do this. i've been working on it. i leave tomorrow to go to the border. there are two texans on this that live on the borders. we we're bringing members of the

committee to see the border. >> you come from a unique perspective you're from texas. you've been to guatemala and seen the human toll. what do you think the right approach with a. >> when i traveled, i was asked by house speaker john boehner, when it started to be so serious, he asked me to travel the border, report to congress and then travel to the countries, guatemala, honduras and see as i put it, see what would be so bad that parents would send their children to a country they'd never been to with someone they'd never met. those countries are very, very dangerous. we've tried to help them be safer so this wouldn't occur. >> even now we've seen in multiple stories in recent weeks, women and children managed to dig under various border fences cross into america. what do you think is the right approach there along the border. are you someone who supports a

wall in some context? >> i support a barrier. i support-- and that's why we're going to look at the border tomorrow and the next day, and it's such a long border, and in some places it's going to take a physical barrier. we need the ability to have more people at the border. we need to have better technology. for a long time we've known we're not funding that border as we should, and that's part of what we're looking at. >> so, i'm hearing a kind of all hands on deck approach from you, but a lot of folks that are sort of dug in whether or not the wall or a physical barrier should or should not be a part of this and it seems to be a sticking point. how do you unstick that point and find a compromise? >> i don't think we should be making any decisions, certainly, it's left to the conference committee, but as we look at this, and as we meet, that's when we should determine what's necessary, and it's not going to be one thing across the border. it's not going to be one wall,

it's not going to be no wall at all. it depends on what the terrain is and what the risks are and that's why it's so important, i think, for people to see what we're dealing with. >> and congresswoman, finally, a quick question on news of the day, watching and waiting to hear from the virginia governor. i'm guessing you're aware of the yearbook photo that caused an enormous amount of controversy and many people in the democrat democratic party to not only disavow, but your thoughts. >> on situations like that, it always sort of hurts us all. we should always be aware that what we do at anytime in our lives could become public, and that some situations that seemed all right at the time are certainly not acceptable for today. >> a lesson for america's youth. and we appreciate your insight as discussions going on in washington. >> thank you. >> tune in to fox news sunday

united states and in the larger sense as president trump also deals with china. >> it's a big deal, leland. the u.s. is officially suspending the intermediate range forces treaty with russia. it's been in effect for decades and administration officials believe russia has been violating the spirit and letter of its terms for over a decade. the secretary of state saying enough is enough. >> we provided russia an ample window of time to mend its ways and for russia to honor its commitment. tomorrow that time runs out. russia has refused to take any steps to return real and verifiable compliance. molly: president trump is still hopeful. >> i'm hoping we can get everybody in a big and beautiful room and do a new treaty that would be much better. molly: at issue are the russian cruise missiles. in order to come back in

compliance, russia would have to destroy its arsenal including any equipment that goes with it. national experts say when it comes with russia complying, but there's hope, but no chance. vladimir putin is weighing in publicly today. and they said it sounds like he's jonesing for an arms race. >> we will do it this way. our response will be symmetri l symmetrical. and american partners said they stopped participation in the inf treaty and we stop. they stated research of developments of the arms and we will do the same. >> the u.s. first began warning russia it was in violation in 2013 though russia itself insisted it was in compliance. even after dozens of behind the scenes talks, they've never burdged. now officials are worried about the impact all of this will have on u.s.-military relations with china. china has never been a party to the inf treating so the

president he would be interested in adding any country. and it's got a thousand missiles in the arsenal that had that would be in violation. leland: and if they can hit guam, they can hit rumoscow tha russia would be worried about. peter from the heritage foundation with more on what the withdrawal from the treaty would mean and what we can expect from the russians. molly: more protests in venezuela's capital and cracks in the power base of nicolas maduro. our steve harrigan joins us on the ground from caracas. >> molly, this could turn out to be one of the largest anti-maduro protests here. people are coming from four parts of the city to meet in the

center and you can hear the sound reverberate with the mountains forming a dome behind me, horns, whistles, people honking, and yelling and in 25 cities across venezuela coming out to say they do not want nichol nicolas maduro, the disputed president as their leader anymore, there's a crack, a small one, francisco janez saying he will no longer back maduro, here he is. >> the transition to democracy is imminent. keep ordering the armed forces to continue their oppression against our people means more death due to hunger, due to illness and hope god does not allow it, the fighting between us. >> so that's just one general coming out, the first one and he said that 90% of the military is actually against maduro, but that remains to be seen. we could see a real test here in a few days' time. the u.s. announcing it's responding to the opposition

>> congress still hasn't decided how to secure the southern border. still arguing about that. meanwhile, hundreds of migrants are headed north through mexico to try and get here before they make a decision. griff jenkins travelling with them. the latest on the journey here, griff. i'm interested, are they talking at all about the debate in washington and whether or not they're going to be able to ask for asylum, et cetera? >> well, you know, leland, most know they won't qualify for asylum and many told me they think that democrats are not giving president trump the money for the wall, here is the deal. they all intend to come to the u.s. whether it's legal or illegal and you see behind me part of the 2500 plus migrants that began the journey in hondur honduras january 15th closing in. unlike tijuana or california this one is going to texas.

they were packing trailers and trucks and they've got cooperation from the states, the officials in the states of mexico and they're getting a welcome, open arms from the new president in mexico, manuel obrador. we rode on one of the trailers and here is what he had to say about the new mexican president. >> does it seem like, samir, that the mexican president is kind to the immigrants? >> yes, he's opened the doors and taking the opportunity to pass through the other countries. i think it's a good president. >> another big signal, leland, was the asylum, temporary asylum and temporary work program that he gave the signatures, capping at 12,600 because they had too many people doing it. bottom line, the message is very

clear with the new caravans, that is that mexico is helping. this is dr. juan hernandez of the state that we passed through the director of immigration. >> these 2000 people also, they say they're fleeing poverty, they' they're fleeing violence in central america so our heart is with them. the governor said, we treat these people first with the heart. it doesn't cost us a lot of money, a few bottles of water. it's a few sandwiches or tacos, in this case, and so, once again, we give them the right care so that they can push the united states to treat our people right up there. >> this comes as the dhs officials tell fox news that they intend to expand that remain in mexico program, that has migrants staying in mexico while their claims in us play out. two more caravans, february 7th

if that's about a sandwich or a taco, i find that a strange conversation because what we're seeing in the united states of america is, give us health care, citizenship, and anything else that we ask for. it's a fundamentally different conversation taking place. and i also would say that the president of mexico, obrador isn't doing us or himself any favors allowing them to come through. the people in honduras need to solve the problems in honduras. the able-bodied men need to stand up for their own country, the same as with guatemala. that the united states is a fantastic place to be. it goes without saying. it's true. should we have legal immigration? absolutely. and we should also be people who respects the laws here. that goes for the people of guatemala, the for the people of honduras, mexico or anybody else who wants to come in the united states. loving, caring, kindness is not something that supplants the

laws which is how we protect our citizens, loving caring and k d kindness. molly: it's a revealing report showing how much mexico may be helping the caravans. and back, the president has looming threat he may declare a national emergency. your thought on that. >> i have no idea what the president is waiting for. i'm not sure. and the first signal was the other day he's there having that presser and he says, republicans don't waste your time, don't bother. and nancy pelosi's going to be steadfast. she isn't interested in border security, she's not interested in protecting american citizens and don't care if 800,000 people if without paychecks. i think he wants it, but in the implementation he has a republican senate and possibly a larger republican caucus that knows once you go down this road, you've opened up a

pandora's box that may become problematic in the future and i think that's where the worry is. i don't think any doubt the president says to himself if i've got to live up to the promise and that's the only way, national emergency. molly: the next shutdown date on february 15th. bring you further north, there's a fascinating story unfolding in virginia, the virginia governor, this yearbook photo from his medical school days showing a klansman and blackface and he originally apologized for the photo and now he says he's not sure he's in the photo. your thoughts as you see this unfolding and democrats in the state of virginia not to mention the majority of 2020 contenders, senator elizabeth warren, kamala harris, cory booker, so many people come out and call for his resignation. >> they've called for his resignation on this. but when you endorse infantcide, you leave that aside.

treaty renewed in 2021, it's a strategic nuclear weapons agreement with russia-- >> it brings up an important point though, is the united states policy too much on russia, tough enough on russia? where is the carrot and stick here? >> i think it's tough enough with russia. we have issues with russia, in ukraine, syria, venezuela. we don't mention the ties between venezuela and russia today. so, this is a tough relationship. it's very tense, and we have to continue to press for our advantage. leland: when you say press for our advantage, how much needs to be invested now in these kinds of weapons systems as you pointed out the russians are pretty far ahead in? >> well, we-- >> we've been living by it. >> they've been cheating. we have to make the decision do we want to move ahead with these weapons in europe. and chinese has weapons, that 90% of them would violate the

keep people safe. >> what are the biggest threats they are focused on. >> right now the threat today are much different than they were almost 19 years ago in -- when the super bowl take place. we have to worry about terrorists and weapons of mass destruction. we have cyber threats and even human trafficking. >> when you talk about things that are happening to keep people safe, when you go to big events you see blockades to ensure big vehicles can't come through. snipers being taken to ensure that there isn't a mass shooting, that sort of thing. what is happening on the ground just for crowd control protection? >> well, this is show of force, there's so many different law enforcement agencies that are out there in numbers and a lot of things going on behind the scene that the public does not see. there's a massive operation center. there's so many people on standby right now just in case somebody goes bad and at the end

of the game when everything goes according to plan, everybody goes home and it was a success. >> one of the things you mentioned moments ago, i want to talk about human traffics, there's been some arrests in that effort that they tend to make it in every super bowl. how big of an issue is this for the law enforcement community down there? >> human trafficking is a massive problem, there was a number of arrests just the other day, i believe it was 34 individuals and even minors, certain people say that this is a victimless crime but sex trafficking, the victims here don't have a choice and so often the young victims that we see underage girls are online and they are answering ads to become models or dancers or something like that, so we have to really be aware.

massive amounts of emails, emails and they'll be saying, hey, look, there's a great deal, you can go to this party go, to this event, discounted tickets, we need to stop and think before we click, e-mail is the number one way the bad guys are targeting us. another way is wi-fi. we will see so many sites popping up, free, high-speed wi-fi, a lot of bad guys are putting up sites and trying to trick us to logging in and once logged in they are able to see traffic, so awareness is so very important during this time. >> all right, thank you so much for joining us and of course wishing everybody wonderful game and great appreciation to law enforcement community. thank you for your insight. >> thank you.
