can remain in office. yesterday he met with his senior staff, called them in for an urgent meeting that was not scheduled. he met with his cabinet. we're told this has been central in those discussions, whether or not he can continue to serve effectively as governor. that has been the standard he's said as to whether or not he will choose to remain in office. we're not heard from him since saturday. as he ways his options going forward, there's a lot of calls for him to resign on the state and the national level. some saying even if it was not northam, his shifting explanation and admitting that he wore black face on a separate occasion are enough that he needs to step aside for the state and the party, trace. >> trace: virginia's lieutenant governor is responding to an assault accusation. >> yeah, that's right, trace. we heard for him for the first

time on camera a little over an hour ago. the allegations come from a report and it alleges that this woman claims that he was sexually assaulted 15 years ago at the democratic national convention in boston. the lieutenant governor has denied those allegations. he says they're completely false. in speaking to reporters, he said this. but everything was consensual. not only that, the same person called me some time later and wanted to meet with me, visit with me. we went to columbia law school. wanted me to meet her mother. said that years later. months later in this case. years later, now, we have a totally fabricated story out of the blue against me. >> now, he also said this relationship that he had was consensual. he questioned the timing of this release given his just about to become governor and this has not come up in the 15 years since.

he stressed that he's been vetted twice by the fbi, hold as high security clearance and this issue has not come up in those vettings as well, trace. >> trace: garrett, back to you with any breaking news there. president trump getting ready to deliver his state of the union tomorrow night. he's not ruling out another government shut down in less than two weeks if he doesn't get money for a border wall. rich edson has more. >> senior officials say the president's message is one of unity. the politicians in washington can move past the partisan divide and accomplish things for the american people. democrats and republicans are still at odds over board security funding with the white house blaming congress. >> he believes that we have a crisis on the southern border. congress has failed to do their job, this congress, the last congress and for quite a while.

what we need is a physical barrier wall, steel flats. it's the additional border patrol personnel, the immigration juggles, tackling tps and daca. >> under the trump administration, republicans controlled both houses of congress except the last couple weeks. it's nancy pelosi seated next to vice president mike pence tomorrow evening behind president trump for the state of the union address. pelosi has said there will be no funding for a border wall in any potential agreement on border security and a budget deal. if negotiators fail to break this impasse, the president has warned he could declare a national emergency and unilaterally divert funding away from other things and move it towards building a wall. to that, the white house says that the president is viewing that as a last resort. but that he is not ruling that out. mitch mcconnell says the

negotiations on border security have been challenging but he says he's for personally whatever works to avoid a government shut down and to avoid giving the president the feeling that he has to declare a national emergency, trace. >> trace: rich, we're learning that president trump spent about 60% of his working hours in executive time. that's according to axios, which reports that they interned while house scheduled from the last three months. the white house responding that president trump has a different leadership style than past presidents. let's go back now to rich edson reporting live for us on the north lawn, rich. >> this axios report saying the president the last three months has spent 300 total hours hoff executive time compared to less than 80 hours in meetings. the white house is pointing out this is the structure of the president's schedule a very instructured schedule. in response, the president's director of oval operations tweeted what a disgraceful breach of trust, to leak schedules. what they don't show are the

good luck. defense attorneys claims el chapo has been framed telling jurors you don't have to give in to the myth of el chapo. bryan llenas reporting live in brooklyn new york, bryan. >> trace, el chapo faces ten federal charges, most are drug trafficking charges. but the first, leading a criminal enterprise. if found guilty on that charge, he will be found guilty of life in prison. now, today we're looking at the fact that the stakes are extremely high. two years ago, el chapo was extradited to the united states from mexico. today, matthew whitaker made a surprise appearance to thanks the prosecution and wish them good luck on this case. the jury was sent back to begin deliberations about two hours ago. so far three notes have been

sent back to the judge. the first note was a legal question. is a drug war considered part of a drug trafficking crime? with specific reference to the weapons charge that el chapo was facing. the judge instructed that they may consider evidence of drug wars when consider if he's guilty of running a criminal enterprise or varying degrees of trafficking. they can only find him guilty hoff a weapons charge if he's found not guilty. in the second charge, the jury asked for extra charge sheets. in the third note, the jury asked two questions. one, how long would it take to get evidence and pictures sent to the deliberation room? the judge said they're working on getting that evidence back in that deliberation room. the second question was whether or not ephedrin is considered a methamphetamine. the judge said he will refer the jury for the record on that

particular note. trace, a little over two hours of deliberations and it's been active. >> trace: what more do we know about the jury? >> we know the jury is made up of four men and eight week. they have been partially sequesters for the duration of this trial. that's about three months that means the jurors are able to go to their families back at home but they're being brought to court in secret. they're doing everything they can, taking extraordinary steps to protect their identities. remember, bag when jury collection was happening, one juror was sent back bade she was fearful for her life. their identities are very important. the other thing we realized, several jurors knew about el chapo before they were chosen to be on this jury. there's a couple of them that are fluent in speaking spanish. we also know that a few of them have pretty liberal views of legalizing marijuana. some are indifferent. others say it should be legalized.

we know one of the jurors just last week asked the judge whether or not it was interested in finding out if el chapo paid for his lawyers personally and whether or not he's the one that came up with the defense for his own trial. the judge said that none of that information was relevant given the fact that it wasn't introduced during the duration of this trial. so pretty fascinating, trace. >> trace: it is fascinating indeed, bryan llenas reporting live for us in brooklyn. back to you. one month after a mother of four went missing in kentucky, police now say that 22-year-old savannah spurlock left a bar in lexington with three men and ended up in a home 40 miles away. she had just given birth to twins in december. her mom describes her as a wonderful and very responsible person. matt finn reporting live in our midwest newsroom. matt? >> trace, police are giving us a better idea of what happened to

this young mother of four at she vanished in january. savannah spurlock ended up in a rural home an hour south of lexington. video shows her leaving a public around 3:00 a.m. she stayed the night in this rural house and left around 8:00 a.m. the next day. savannah's mother said she didn't buy the story. she said savannah didn't have a coat and would have left on foot. >> is a vanna -- savannah had no coat, no money, no car. where would she go? i don't believe that. >> so far police have searched a home and seize add car in this rural county. they have not indicated if that is the house where savannah ended up. trace? >> trace: matt, a group of

volunteers drove from louisiana to help police. >> yes. they're call the cajun coast search and rescue crew. they drove 900 miles to assist kentucky police. right now they say they're searching the nearby kentucky river for any evidence. savannah's mother says savannah was a very responsible young mother who was always in touch and even paranoid about her phone dying. her mother is heart broken and confused for not hearing from her a month later and tomorrow would have -- will be savannah's 23rd birthday, trace. >> trace: matt finn reporting live. thank you. president trump's convicted former campaign chairman in court today in washington d.c. prosecutors say he repeatedly lied to the feds in the special counsel's investigation. his lawyers said he didn't lie and has tried to correct any errors he made. in september, manafort pleated guilty to conspireing to defraud

the united states and obstruct justice. lying to the feds would be a violation of his plea deal and could lead to another decade behind bars. the chief intelligence corresponde correspondent catherine herridge reporting live. catherine? >> judge jackson who is handling the special counsel case against roger stone cleared the courtroom to hear secret evidence gathered by the government that paul manafort lied to special investigators and thereby violating his plea agreement. manafort's legal team including kevin downing arrived at the district court here in washington. there's five main areas of disagreement outline in heavily redacted court filings. one of the allegations is that he lied about his contacts with his russian ukrainian business partner. the ranking democrat took a shot at the president's lead attorney on the russia case and then addressed the wider issue.

>> as we have watched what rudy guliani said in the morning and then contradicted in the afternoon and then contradicted in the evening, we have lost sight of the bigger picture of what is happening around the world. we've lost sight of the fact that russia's interference in our affairs was not an isolated occurrence. >> manafort's team has argued that he did not intentionally lie to investigators and in some case they say their client was quizzed on events and e-mails with the benefit of refreshing his memory with paperwork which is standard in complex criminal cases. trace? >> trace: to we expect to see a transcript from this hear something. >> in the last few minutes, we confirmed that the hearing has concluded about 4 1/2 hours. that's an extremely long hearing. we know even though it was sealed, that they had hundreds of records, texts and e-mails that they had to go over.

what we also understand that at some point a transcript will be released and a lot of news in that hearing. the question is whether we will know about it and that will depend on the number of redactions that we see. to put that in context, it was sealed for a reason because it's secret evidence and they have to do it with ongoing investigations. all of that sensitive information will likely be blacked out in this case. >> trace: thanks, catherine. somebody lost some big bucks after brady and company's big win according to several reports. an anonymous guy known as better x now out nearly $4 million. he apparently made separate wagers at three las vegas casinos. you probably shouldn't feel that bad for him because he had a solid run this past year winning more than $25 million on bets with the astros and eagles would win championships. not bad. the oakland raiders may announce

a winter storm creating blizzard conditions in some parts of california and forecasters say flash flooding could hit areas already devastated by deadly wild fires. meteorologist adam klotz live in the extreme weather center. adam? >> this is a big winter system we're talking about. around the snow, rain, along the coast, the upper elevations where this turns into a big snow event. we have warnings spread across california and spreading across the rest of the west as well. everything you're looking at in the red, the lake tahoe area, those are blizzard warnings. the elevations high enough, that will be snow. right along the coast, we could be talking about flash flooding because of the wild fire burned areas. four or five inches of rain coming down quickly, could be causing mudslides and flooding. a big issue the next couple days. it's rounds and rounds of rain. here's a big low pressure system moving throughout the day monday

and tuesday. this is one of several rounds of low pressure that will sweeping across the country. by the time we get too wednesday, this works its way into the middle of the country. what you notice is, no longer snow by the time you get to the eastern half. everything in the pink, ice accumulation. it's gotten warm after a week of the coldest temperatures we've seen. everything has changed. these are the old numbers. negative 23, coldest numbers in chicago. now 50 is the high in new york city. the high of 60 degrees. last week we got down as low as 2 degrees. a big change here on the east coast. the next couple days will be dicey as these storms roll across northern california. >> trace: thanks, adam. federal investigators are trying to figure out why a small plane crashed into a home in southern

california last night killing five people. william la jeunesse has more. >> the plane took off from fullerton airport at 1:30 sunday. ten minutes into the flight, it was about 7,000 feet. radar showing it dropping like a rock. some residents heard the buzz of it coming down. the cessna slammed into a two-story house and burst into flames. residents say it sounded like a bomb. >> i walked outside and i saw debris flying everywhere. part of the plane, i guess which was the motor, flew down into the garage like a torpedo and hit the garage and blew up. >> two men and two women were inside the house at a super bowl party. they died as well as the pilot. the ntsb will examine maintenance records and radar
