"outnumbered" starts right now. >> harris: we will pick up on the breaking news now. controversy in virginia escalating. the state attorney general, democrat mark herring, now says that he too wore black face to a college party back in 1980. herring is number three in the state behind governor northam, and then-lieutenant governor justin fairfax is embroiled in controversy, too , for gang controversy of assault. ralph northam is still clinging to power after being asked to resign. he is reportedly hired a private investigator to identify the people of the picture. virginia's attorney general just released a statement. "although the shame of the moment have sought to be for

decades, and though my disclosure of it now pains me immensely, what i am feeling in no way compares to the betrayal, shot, and deep pain that virginians of color may be feeling. this conduct is in no way reflective of the man i have become in the nearly 40 years since." pete, i say the word "also" because we know that northam has said it wasn't him and that your book photo, after saying that it was, and apologizing. but to the actually wear black face or bigoted garb on another occasion? to honor, somehow, as he says, michael jackson? >> pete: eventually that fact would come out. so you could deny it, but he found out that later on you actually had done that at a party, impersonating michael jackson, and i've got a double whammy. so you try to clear at one time. we don't know, but that's likely what's happening. i'm guessing this attorney general is getting out front of a revelation that, indeed, he did wear black face

in 1980. >> harris: also started, leslie, with northam's comments about what the president has called "super-late-term abortion." he was on the radio show, he issued a secret to clarify that, and then another statement. and somebody did some sort of a deep dive and picture started coming up. what does this mean for the democratic party in virginia? >> leslie: well, right now i think the democratic party is having a "come to jesus" moment with some of the past. whether it's 30 or 40 years ago, with individuals specifically right now on state of virginia, over issues of race. at first, if you remember, the governor came out and said, "that was me in the photo." lemme tell you something -- i was one of the first no caps to come out on this network, on "special report," saying that he should resign. and this is why. it's not just because he admitted he was one of the people in the photo at first. he picked the picture that went on to that page. the school, the yearbook that did it, like in some schools.

approximately a quarter of the voting population of virginia are african-american. there are other people of color in minority groups in virginia, as well. i feel the people need to decide, in addition to republicans and democrats in politics, they are asking them to step out and there clearly saying that he must step down. >> harris: i would point this out, too, katie. the original comments about late-term abortion where what got the focus on him. it was becoming politically complicated for democrats in several states where that is being talked about. the way that he forensically described a newborn baby, the discussion that would be had away from that child about whether to end that life. and we don't have to interpret or guess about that. those were his comments. he felt they were strongly enough, if you will come out refuted in terms of the public. and then being actively upset about it, that he needed to issue several segments. more than one. >> katie: yeah, and the left is very out of touch when it comes to even pro-choice around

the country who don't believe that late-term abortion is acceptable. but back to the news of the day, which is mark herring admitting that he wore black face 1990s. he said this was a one-time occurrence that he takes hold responsible before, and that in no way reflects the man he has become in nearly 40 years of life. okay, i'm willing to accept that all three of these democrats -- by the left standards, they should be fired, run out of town, resign, never have any other job ever again. that's the standard they have set. i'm willing to say, "okay, you made some mistakes, he did a horrible thing, you are apologizing for it now. america is a very forgiving country. people get through things, and forgiveness is something that is offered to public officials." but the problem here is that democrats and virginia have been accusing republicans, and ed gillespie who ran against ralph northam for the governorship, who barely lost, of being the exact thing that they wear. and they haven't apologized to ed gillespie. they haven't apologized to the foot is for lying about it and

not disclosing it. for them to continue to use race as a weapon against republicans where it does not belong, that's on them. so we can either offer give each other and move on or we can continue this back and forth over whether you should be run out of town or forgiven or whatever. but if democrats continue to use it in an unfair weight against her republicans with no evidence to back it up, and here we are with people admitting it and photos and kkk garb, and yet there is no consequent support. >> harris: typically when you see an admission of this level, it's because someone is trying to get out in front of something. we don't know what that could be, whether they were other people at that party, if there are pictures of this, or whatever. i would say this -- melissa, as we look at this in total, keeping in mind what katie just said, a lot of this has to do with who is allowed to be right about these issues and who is not. politically. and it's confusing sometimes. like, if it's wrong, it's wrong, it's wrong. >> melissa: yeah. so, this whole series of story

hits on two things that i really hate about politics. i think a lot of our audience probably feels the same way. the first is what you said -- hypocrisy. when you hold someone to a standard that you can't live up to on your own. so this is something where all these things keep servicing, the background, and like you said, they have thrown "racist" as other people and they have a solution going on. it's not that things weren't different or were not different that many years ago. they are so quick to yell "racist" and" it appeals. and the hypocrisy this smacks up to me, i wonder about everyone's ulterior motives. here we are, we have kicked through the top three people in this state. the number four in line is the speaker of the house, who is a republican. >> harris: kirk cox, speaker of the house of delegates in the state of virginia. by the way, just couple of days ago he had already issued a statement calling for the resignation of governor northam. so here he is, it would be lieutenant joe governorate jusn

"the washington post" obtaining a copy of warren's 1986 registration card for the texas state bar, which licensed her to practice law in that state. on it, she wrote that her race was "american indian." this is a previously unreported example, in the first known instance of war and american ancestry in an official document. in her own handwriting. last week, senator warren apologized to the cherokee nation for priestly taking a dna test in an attempt to prove that she had native american ancestry. the senator telling "the washington post," "i can't go back, but i am sorry for further confusion on tribal sovereignty and tribal citizenship and the harm that resulted." that at least one historian and member of the cherokee nation

believes that the senator needs to go further. he said, "i want her to go on national tv. i wanted to do a video like she did to announce her dna results. it just seemed very lacking." so, pete, elizabeth warren has said repeatedly that she never used her native american status -- which is 11,024th, may be -- to get ahead. is this an example of her lying about that? >> pete: it might be. the issue of her misrepresentation was that she used for advantage. it was advantageous to her career path at harvard on the circuit i want to know, was advantageous in the state of texas for her to declare that as opposed to caucasian, say? i never give credit to elizabeth warren. maybe she really thought -- at one moment, maybe she really thought, "i was told that's what i am, i am." i don't know. we can't know. i don't know her motivation in 1980. >> melissa: i want to address this contemporaneously.

it's 1986 when she wrote this, when she was getting into the bar at the time. it was 1995 when she was a harvard professor and they listed her on their federal affirmative action form as being native american. when i was an undergraduate at harvard university, there was a rule -- and i know i heard marie harf say in the less ever, who are we to be the dna police? i knew someone who lied on his application and check the box, and he bragged and said he had gotten in. and he wasn't. this is something that people have used in order to get ahead. it's very hard for me to give her the benefit of the doubt, especially since we have seen the dna and we know it isn't one 16th. there is an established, in order to claim yourself to be a minority when you are trying to get advantages, like being claimed by harvard's forms. >> harris: at least at harvard university.
