the answer is no. i'm not. i'm not happy. but am i happy with where we're going? i'm thrilled. we're supplementing things and moving things and and we're doing things that are fantastic. taking from far less -- really from far less important areas. the bottom line is we're building a lot of wall. >> shepard: that's incorrect. he's been saying it for a while now but it's not true. the facts are these. workers have replaced and repaired sections of the existing wall and fences, but so far they have not built anything new. construction is set to begin on a 14 mile extension in the rio grande valley later this month. and this just announced deal in congress could create 55 miles of new fencing and barrier. no wall. that is if it passes in congress. and if the president signs it. even then it's ten miles less than what lawmaker offered the

white house last year. long before the government shut down. still, there's some wiggle room that could allow the president to add more money for his proposed wall. and more money for detaining people. presuming, of course, this deal gets done. his rally last night, the president said the wall in el paso where he was having a rally turned a violent city safe. county officials passed a resolution condemning the president of the united states for that inaccurate assertion. in 2006 when congress authorized the el paso section of steel fence, violent crime levels were at historic lows. they remain at low levels as the republican mayor explained yesterday. >> i don't care whether a mayor is a republican or a democrat, they're full of crap when they say it hasn't made a big difference. >> shepard: so that assertion, the conference of mayors issued a statement saying this is

untrue. mike emanuel will have more on the border and all of that in a moment. first to john roberts reporting live from the white house. >> good afternoon. it looks at the moment and it's 3:00 p.m. on tuesday, congress is moving toward a deal that could avoid another government shut down and provide money for border security and some money for the border barrier for president trump. let's take a look at where they are with this. calls for $1.37 billion for 55 miles of border barrier. this would be build in the accessory you grand valley. the design according to the legislation will be limited to the currently approved bottle later while and would detain beds and improve custom and border detention facilities. president trump said that already he's been doing other things and you called him there

the bill. the president said he's not going to allow the government to shut down. listen here. >> i don't think you're going to see a shut down. if you did have it, it's the democrat's fault. i accepted the first one. i'm proud of what we've accomplished. people learned during that shut down all about the problems coming in from the southern border. i accepted that. i always accepted. this one i would never accept it if it happens. i don't think it will happen, this would be totally on the democrats. >> again, the money for a border barrier in this appropriation is $1.375 billion. the president is liking at moving money around so he can pluck that up. he has something called transfer authority. he can preprogram money inside certain departments. according to the rules, the president may be able to bend the rules, you can only plus up the appropriation for specific item by 10%. so that would mean unless he does something different, he could only get $137 million to

build the wall, which is well short of 5.7 billion. mitch mcconnell said he would have no problem with the president using transfer authority. chuck schumer has a problem with it. he says he believes that congress would not allow the president to do that under the authority the president has to notified congress ahead of time. i guess it's possible they could try to block him from doing that, shep. >> shepard: john, the matter of the scuffle and the bbc employee getting injured last night at the rally. what do you have on that? >> there's still a lot of question as to how this was precipitated. exactly what happened. ron scanes, a paragrapher with the bbc, he apparently was pushed rather hard by somebody wearing a make america great again hat. it prompted the bbc to say that ron was violently pushed by a member of the crowd last night.

the man was removed by security and ron is fine. the president could see the incident and check with all of us or check with us that all was okay. the president did stop there for a moment to check that out. it's clearly unacceptable for any of our staff to be attacked for doing their job. bbc's north american editor wrote to the press secretary, sarah huckabee sanders, asking for the white house and the trump campaign to review the security measures in place to protect the media. according to the bbc, there was nobody monitoring traffic in and out of what is known as the media pen. according to one of our fox news producers who was the pool producer, this person got up on the riser which is where he shoved the camera man. the white house correspondent's association weighing in on this.

this bill. sign it and don't cause a shut down. the leaders of the conference committee have found an agreement in principle to keep the government open. the details are still being hammered out. the tentative agreement represents a welcome path forward for our country and a way from the dreaded government shut down. >> democrats involved in the negotiations note it's a compromise. >> american knows we're facing the worst drug crisis in our history. 90% of the narcotics come from the ports of entry. we said in the beginning, bring in the technology that will stop or slow down the flow of these narcotics and we included it in this compromise agreement. >> a number of lawmakers sound pleased this is the way congress should work with negotiation and

compromise. >> shepard: someone is not happy about it. we keep hearing there's a possibility and i'm hearing a strong one that he might sign the bill and then declare an emergency and then attempt to move funds and to build the wall while waiting for the lawsuits. >> we've heard from some members of the white house. we expect to get on the phone this afternoon and speak with the president. some have said sign the bill, keep the government open, let's work around it. declare a national emergency if necessary and fight it out in the courts. others are more cautious saying if you declare a national emergency, republicans may not like it when there's a democrat in the white house that declares a national emergency for climate change or other priority that they want. >> climate change, which is a national emergency. now in virginia, one of the two women that accuses the state's governor of sexual assault is

set to make her first appearance since coming forward. he's released her name and everything. he wants her name out there. vanessa tyson set to take part in a panel discussion on the me too movement tonight. a spokesman for the governor of fairfax's second accuser, a woman named meredith watson who put her name out. she sent facebook messages in which washington says fairfax raped her. the message from 2017 while justin fairfax was running for lieutenant governor. one reads as follows. >> shepard: fox news reached out to justin fairfax's office for a response but we have not heard back. he denied the sexual assault claims. lieutenant governor fairfax is one of three top democrats in

you know i didn't after the university responded when i reported corey magette. after a redacted portion, she said he did it on purpose because of what corey did and he knew i would be too scared about it. of course i wanted to say something. he shouldn't be running for office. i don't know what i can do. those messages reveal that it was duke basketball star corey magette who watson claims raped here prior to fairfax. her attorney knew about the first rape and said he decided to rape her as well because he knew he would be too scared to report it. magette completely denied the allegations to "the new york times." duke university says they're investigating watson's claims that she was brushed aside by school administrators when she brought her initial rape allegations to them. state lawmakers are trying to figure out what to do with this hearing and how to move forward to investigate the allegations.

a winter storm bring snow to hawaii. check out this video out of mau maui. officials say it could be the lowest elevation for snow ever recorded in that. and part of the midwest and northeast, snow, ice, heavy winds have forced airport officials to cancel more than 2,000 flights so far. meteorologist adam, live from the fox extreme weather center. >> this is the large system and it is including the snow come out the ice, and heavy rain stretching as far from pittsburgh, running down into areas of nashville have seen some flooding. it is a large system that is bringing everything. these are highlighted flood warning areas from the pittsburgh area running out into eastern tennessee. it's becoming a wester system. we have seen the snow and ice, especially ice around new york city. these are watches and warnings stretching all the way up to new england. i will continue throughout overnight. some areas across the country that are seeing some of this, still as part of south from d.c.

to philadelphia, just like rain. as you get up into new york, that is where you're saying the light snow and ice as you move up for the tour the boston area. where the lines currently sit, this is what we are going to see. it is going to continue throughout the evening hours, but if you're currently seeing ice, that is the way it will stay. in the southern new york area and running in the connecticut. i think it is going to be the most severe of this bout time you get up to boston, that turned into all snow, really the heavy snow. that is getting into the northern portion. you're getting up to 6 inches or foot of total snowfall. if you're dealing with this, you're going to have to deal with it through the evening commute. it does clear off to the overnight hours. shep, i think by tomorrow cleared of any snow it will melt away, but we have another several hours that will be paying attention to this one. >> shepard: not a bad winter at all so far. here it has been pretty good. thank you, thank you. we have much more head on this

busy, busy news day. the top commander of u.s. forces in korea has officials have made little to no verifiable change to the military capabilities. plus, a nurse accused of killing her husband so she could marry a murderer. i will tell you why a mcdonald's sandwich could have helped them solve a case. the first, cops in houston say a man was looking for a place to smoke some weed and came across a tiger in a garage. so, he called it in, turns out, it was not because he was high. well, he might have been, but he really did see a tiger. this particular tiger, inside an abandoned house where all tigers belong, along with a bunch of meat that cops say he thought he might've been hallucinating. they thought so too. and they saw the big cats, officials say they are sending it to a sanctuary. no word of whether the owner of the house will face any charges or what the tiger thought about any of it.n

>> shepard: police have arrested the ex-boyfriend of a woman who turned up dead. the mother of 24-year-old valerie reyes called the local television station that her daughter had broken up with the boyfriend days before she disappeared and was afraid somebody would kill her. police have not confirmed it is the same guy they arrested. they say they looked at hundreds of hours of video surveillance before bringing the suspect in. he also say, he used the victims atm card. he's facing federal charges. a prison nurse in missouri is accused of killing her own husband with antifreeze and setting the family home on fire. so that she could marry a convicted killer. this is a real thing. investigators say, she told them a different story, but they say, a mcdonald's sandwich may help

prove her wrong. laura ingle reporting live here. >> shep, amy murry worked at the jail work-related love interest spent his days and nights behind bars and was apparently working for a new life without her husband and aunts. now the 40-year-old who is also a mother to an 11-year-old boy was arrested last thursday, took a month after her husband josh what was found dead in their home which investigators later determined was set on fire from the inside. police believe that murry poisoned her her husband and he died before the house was torched. she called 911 to report that her house was in flames. she can get is out because the house was filled with smoke. the house was seen here. this happened in iberia, missouri. police arrived at the couple's home and said they found a mcdonald's sandwich on the kitchen counter, which didn't match up with their story. investigators then reportedly discovered murry had been having

a romantic relationship with an inmate at the jefferson city correction facility where she worked. and found recorded phone calls between the two in which murry told him she wanted to divorce her husband to be with him, then told him and later calls after the fire that he was dead and "out of the picture." here is, he is serving a life sentence in prison for fatally stabbing a man in prison. murry is facing a list of arches including first-degree murder and could face life in prison or the death penalty if convicted. murry was released on $750,000 bonds today. shoemaker first court appearance tomorrow. >> shepard: laura ingle reporting live from new york. thank you. the funeral service for the longest serving member of congress in american history, taking place in his home state of michigan, today. ♪ this was in dearborn michigan this morning.

former congressman died last week. he was 92. rick leventhal reporting live from dearborn this afternoon. speak of the funeral was delayed for half an hour because of this snow and g-7 storm that made the roads treacherous. including a jet with a congressional delegation that flew out from washington, house speaker nancy pelosi was on board and representative john lewis who is supposed to speak at the funeral today is circling the airport for an hour and went back to d.c. inside the church today, representative john dingell was remapped, remembered the hard charger including the civil rigt of 1964. a man who helped shape the nation. he elected to congress 30 times. he served longer than anyone had, 59 years, he first took the seat of his father had a 1955 when he was 29, and then his wife, debbie took his place when he retired in 2015.

>> shepard: the actor of the fox television show, "empire" says he was a victim of a hate crime has turned over his phone records to police. this is new, but this part is important. investigators now tell fox news correspondent that some phone calls are redacted, and the phone evidence is insufficient. this month, the start of the fox television show told police that he was on the phone with his manager when two masked men attacked him, yelled racist and homophobic slurs at him. splashed him with a chemical, and put a rope around his neck. jesse smallette is black and openly. detectives refused hundreds of hours and couldn't find the attack. investigators say jesse smallette initially

refused to give them his cell phone, a spokesman for jesse smallette telling tmz that jesse is a victim here that he "voluntarily provided his phone records." and police have repeatedly informed them that they find jesse's account to be consistent and credible. so, that said, police say they have the surveillance video of most of the area where he says the attack took place. but no video of any attack and no video of any suspects, no witnesses had come forward, and there was no evidence to back smallette's claims. the aunt a kentucky woman missing for more than a month now says she cannot imagine her knees running away from home and leading her porch with her behind. police say savannah spurlock disappeared and jittery fourth, we've been profiling her for quite a while. she disappeared after leaving a bar with a group of men and election she had just given birth to twins in december. with us now, savannas aunt.

savannah who just can't imagine life without her. and, we really, really need to find out what happened to her. >> shepard: who is taking care of her kids? >> well, the father of the younger kids is taking care of the twins and their 2-year-old and he's doing a marvelous job. they look beautiful. and then savannah's father is taking care of her oldest, her 4-year-old. >> shepard: they said this is a difficult question. what do you tell a 4-year-old? >> i don't know. we have a 4-year-old who is five days older than her 4-year-old. and, i just can't imagine what -- how you approach that appeared and, i know that they're having to to do that very soon. and, it is heartbreaking to think about. we are exhausted. we are devastated. and, we just want answers.

we want her home. >> shepard: i know a couple of 4-year-old. and, i can't imagine either of them not just going ballistic. you know, where is my mommy? i wonder, mom is gone, mommy will be back. >> yeah, and i know they are taking him to a counselor. they are dealing with it in the best way that they can. but, you're right. there are some questions that don't have answers. and, i think there are a lot of people involved, a lot of family that are supporting my sister, savannah's mom. she has a lot of great friends. savannah, herself had so many friends that are looking for her and missing her. they have got that support that we need to know where she is. >> shepard: very thankful for that and hope you find resolution soon.
