little burned tonight. and beto o'rourke's smoke at an antiwar protest last night. he ignored our request for an interview, but we crashed his party. raymond arroyo was there, and he brings us his report later. but first, the border wall becomes the border stall. that's a focus of tonight's angle. i hate to tell you, i told you so, but i told you so. when the white house and the g.o.p. failed to act on the trump immigration agenda in the first 100 days of the presidency, his pledge to build a wall would be jeopardized. trump's initial instinct which is usually spot on was to veto that omnibus bill last year and i'm telling you, he was right then. but paul ryan and mitch mcconnell, promised him they would get this wall funded in full in the lame duck session, if that was necessary.

big shocker, that never happene happened. so after speaker "i need to spend weekends at home" ryan, handled the democrats, the president face an even higher wall of resistance. a lame old border deal was announced right before the president took to the stage in el paso last night, and by the morning, the details started trickling in. >> president trump: i have to study it. i'm not happy about it, and, it's all going to happen, we are building a wall. and now i will say we are finishing a wall. >> that won't happen though, not unless the president finds the money elsewhere. or, declares a national emergency which will immediately be challenged of course by the left in court. and tonight, after speaking to one of the republican architects, richard shelby, senator from alabama with the

latest deal, the president tweeted, was just presented the concept and parameters and looking over all aspects knowing this will be hooked up with lots of money from other sources and we will be getting almost $23 billion for border security. we will get into that in a little bit. so what's really in it. what's in a language hasn't fully been released. this is some of the basics of the deal is reported. $1.375 billion for barriers that are not called but look a heck of a lot like the steel slanted structure or barrier that trump had already approved. second, an average daily cap of 40,520 beds for detaining illegals. now that is almost 9,000 fewer than we are detaining now.

but trump would have the authority to boost that number pulling the money from other sources. now there is more to it, but it's simple to see what's going on here. the democrats ultimate goal is to codify catch and release. where if any legal makes it into the country, he or she will be welcome to stay along with any child he or she brings with them across the border. now, what does this do? this is not a difficult concept, it only encourages more illegal immigration. now remember, the president asks for $25 billion last year for the wall. and a bunch of other reforms as well. but, the dems wouldn't budge on issues like chain migration or diversity. then in december, moving into lame duck session, he asked for one fifth of that.

i'm still pretty good at math sort of, it's 5 billion of the 25 billion. now he perhaps thought that this would become some type of annual wall expenditure. well, fat chance. the current deal does expose just how far left the democratic party has gone. they've gone from this -- >> you simply cannot allow people to pour into the united states undetected, undocumented and unchecked. >> an illegal alien should not be treated the same as people who enter the u.s. legally. >> we must protect our borders. >> laura: to this. >> we know that walls do not save lives.

wolves and lives. walls and lives. >> laura: oh, really? so walls kill people? last year there were 1247 people slaughtered in a vicious fashion, many of them, by the cartels and others across the border in the warez. that was a 62% jump from the year prior to the killing field there. so beto can't possibly mean we should tear down the wall in el paso, could he? think again. remember this gem, it read tear down this wall. oh, boy, . that's a keeper. i can tell you that the people we met in el paso last night disagreed vehemently, and an undershirt reported fact is that about half of the audience of the trump rally where themselves hispanic. and they most certainly do not

want the wall between the cartel who are in juarez and el paso cut down. it was a really fun place to be and we loved meeting the folks that we met there last night. they don't want any part of juarez's way of life with beheadings and bodies that have been dumped in the street. >> president trump: last year warez had 1,200 murders. el paso had 223 murders. walls work. actually there is nothing like them for what we are talking about. we want to stop drugs and traffickers and criminals from coming in. walls save lives. >> as much as we wish things were different, the fact of the matter is, trump is vowing to continue this fight, right

through the 2020 election about the wall and keeping our country safe. another shutdown would have ended up hurting the president, distracting from this booming economy. here in texas it is off the charts. and there's a lot that could be distracted from if this thing continued and if it was shut down. and also let's not forget, while trump isn't getting everything he wants and definitely not what most of us want, democrats are also breaking pelosi pledge. >> is there any situation where you would accept even a dollar of wall funding? >> $1? $1. >> well try $1.375 billion. she may not want to call it a wall but that's what it is. and that's not all bad. and that's the angle.

here live from capitol hill, chip roy from texas and tom mcclintic of texas. you have to say the least reservations about this framework. what do you say to those who think, that's the best offer out there, and it's better than another shutdown where the president could get beaten up every day? >> good evening and thank you for having us on. i wish i was in texas instead of being here in the swamp or enforced to prevent republicans from making another boneheaded deal, but right now we should be focused on the fact that american people are with us. they want the border security. i was down in the real grand valley, where we see 400,000 people that will be streaming across the valley. 90% will be caught and released like you know because we allow judicially re-created catch and release to govern our border

security. the cartel has operational control of our border and it's time for us to do our job. this deal isn't doing our job. 1.75 billion as the baseline. we need to get the money that's necessary so the border patrol isn't on the border, and where fences are installed, they work. and it's time that we do our job. >> let's move the conversation forward. that has already been established, and you are right about that 100%. congressman mcclintic, first of all your governor has pulled back his national guard groups from the border. he made a big stink about that and we are not talking about the bullet train fiasco that blew up today. this broke from "the washington post," just moments ago. and i want to quote it for you, congressman. the bill was still being written and congress from both parties were pushing to include a number of favored provisions, called

pork provision. some but democrats democrats wanted to provide language that would provide backpay to federal contractors who were caught in the middle of the recent shutdown, but it's unclear if lawmakers will be successful in getting that included. there's a possibility if this thing going forward but people have to understand, we don't even have the language yet and we know stuff get slipped in at the last minute that it happened, and that's every single time to the american taxpayer. your thoughts? >> as long as the democrats control the house, nothing good will come out of the house of representatives and as long as republicans have given chuck schumer and the democrats a filibuster beat, veto over appropriation bills, we won't get a good bill to the senate either. the good news is the president has statutory authority to move ahead toward building the wall and he can actually draw about $13 billion to do so, far more than he is asking from congress.

he has the legal ability to do so and the responsibility to do so and ultimately that's the only way the wall will be built. >> i understand the white house counsel office is looking out a provision of the u.s. code. i think it's 287, which would allow the president to move money into wall building that has a relation to stopping the flow of drugs across the border. >> not only that but he will reprogram on obligated military construction funds for that purpose. that is back in 1976, and that includes the civil war and sierra leone. this is clearly a priority national defense issue and the president has a legal authority to declare that and pull those funds from other military construction projects and put it into the most important project that we have come up the defense of our southern border. to those that say it will come out of military construction

funds, my question is, what's more important, securing the border of iraq or securing the border of the united states? >> laura: it's so frustrating. and now, what everyone has to understand, everyone has to guess. and i want you to chime in on this. nothing in this proposal would deal with the family units crossing the border. the republicans frankly dropped the ball in the first hundred days. republicans should have handled the president's agenda and he should have insisted on it in the first hundred days. that was his instinct and he listened to paul ryan and the crew and that was a huge mistake in the end. but these family units can still cross the border. they can be released because the court makes them be released and will continue, a huge influx into this country. today "the washington post" wrote another piece about it. >> the asylum piece that we are doing, they created mandatory

catch and release. that's the core problem. we have to address that issue and not allow the judges to decide how we are securing our border. and the things we are not talking about are the extent to which the cartel had little operational control of our border. and and that's an emergency level and operation we are dealing with at our border and having the obligation to secure our border. we have to go, but thank you so much, we will have you back as this continues to develop. after some early morning criticism, some g.o.p. offices are pushing back against -- me specifically as it relates to i.c.e. and the detention beds. they say despite some of the democrats in the media this package will end up providing more beds than were requested in the president's budget since dhs and an end i.c.e. can use all of the

transfer that reprogramming authorities are given. but does that sound like a lot of gobbledygook to you? what does that really mean? with answers, we are joined by tom homan, former acting director of i.c.e. tom, who is more accurate here, the people who are all upset or, yours truly? >> you. i watch the republicans say what a great deal it is. they can still put lipstick on a pig and it's still a pig. it's a terrible deal. for them to stand there and say look what we have done, it's a shame they are funding eyes for 7,000 less beds than they have filled right now. this will cause i.c.e. to release criminals. that's the truth. >> so they have no place to put them and that is what democrats want to. you that from the democrats but you don't expect the republicans to try to make nice with this.

and i get it, they will try to move money around but when push comes to shove, when you have an influx of people crossing the border, 200 here or at three here, you have all these big pockets of people crossing. if you talk to an office person, no one was allowed to brief this. when we talk about moving money around, we do it every year. they've never funded i.c.e. at an appropriate level. what does that mean? it means taking money from the coast guard. taking money from fema, taking money from the secret service. it's ridiculous because they have issues too. they justify it on paper because right now they are holding 49 and releasing people as it is

because they don't have enough beds. he said it yourself, and the words of the chairman and the house appropriations committee, who are law-abiding and emigrant -- i should be touching you. >> you are in and no one will ever deport you. basically you will not be deported. they are saying, the republicans are saying because they are hearing from people like me, they are saying we will get up to 58,000 beds and you are saying, that's bull. >> show me on paper with that money is coming from because you have to take it from someplace. i mean, are you going to take it from the coast guard, tsa or fema? it's ridiculous. >> laura: we are going to play mcconnell, for you. if mcconnell green light something, the president agrees and it's going to go through.

immigrant saturated school districts where half of the new students are from immigrant households. "the number of children from immigrant households and schools is now so high in some areas that it raises questions about assimilation." now this cannot help but to create significant challenges for schools often in areas already struggling to educate students who come from disadvantaged backgrounds. joining us now is the man behind this study, steve cammarata. now steve, people will say the fact that we are even talking about this is mean-spirited and anti-hispanic and i would say, we are calling you on your you know what. this is about kids and learning and the wonders of america.

and they don't seem to understand the enormity of the problem. >> everybody agrees that the people we let into the country, we have to educate him and the american public. that doesn't answer the fundamental question, how should we let people into the country? and that's from an immigrant family. all the kids in public school are in an immigrant family and even in a state like minnesota, you are looking at 49% of all the kids in public school in poverty in the state of minnesota that come from an immigrant family. so these are important questions. a moderate pace of immigration, enforcing moderate laws. these things with tend to take a lot of pressure off of public

schools, making it easier to educate the kids already here which i think is important. >> laura: i think in st. paul there is obviously a very large somali population, the largest outside of somalia in the whole world is in st. paul, minnesota. about 80,000 people -- we are talking about elon omar represents that community. but when you have both the welfare state and you have public schools that have pulled back somewhat for a variety of reasons for inculcating traditional american historical values, and the right books, and that is a tricky mix, is it not. open borders as a state that teaches some kids to really hate the american founding. as a night nightmare for assimilation.

there is much more elite, including public schools and people who ran the public schools in the big cities where the immigrants settle and there was an idea that we should americanize immigrants. that doesn't just mean that they learn english, although it's incredibly important, it also means that they come to identify with their country and come to see america's founding as the founding of their country as well. and not see that is something that dead white men did. the other thing is the numbers are so big. one of the ways immigration assimilation works is that immigrants in in and their kids interact with so many kids from native backgrounds so that assimilation becomes kind of a foregone conclusion. >> laura: it's made it easier not to be in your enclave when there is the television network, and i guess things change but, of ronald reagan in his final address to the american people as president talked about the

about doing their own investigation. you have to remember that most house democrats are depending on mueller to give them the road map and the cover that they needed for impeachment, and now they are thinking, what if he doesn't. we are hearing about more and more house investigations. >> laura: all right, the former lawyer for the president said he doesn't expect mueller to write a report at all. now who knows, who knows if that's the case or not. he calls it a witch hunt and everyone gets all upset. while this thing was started on a fraud. there was an investigation in search of a crime, but this investigation started on a total broad but this president has had to deal with this for the last two years.
