[laughter] >> juan: i know how this goes! a >> lisa: smart man. >> melissa: let's get to it. steny hoyer singh basketball as early as today on the proposed border security deal. the plan provides nearly $1.4 billion for reported barriers. the top negotiation senator richard shelby saying the agreement as a down payment on the ball. other top republican saying the president may accept it and declare a national emergency to get additional funding. the president tweeting, "i want to thank all republicans for the work you've done in the radical left on the border security. not an easy task. the walls being built and will be a great achievement and contributor toward life and safety within our country."

press secretary sarah sanders echoing that. watch. speak out the president himself said yesterday he's not happy about it, but he's okay because he is going to get the job done no matter what. he's got alternative options and he is going to keep those on the table. again, we will see what the final package looks like in the president will make a determination on whether he will sign it. you can rest assured the president promised he was going to build the wall and he's going to deliver. >> melissa: republican senator lindsey graham says the president appears to be moving toward signing the deal. >> i spoke to him last night. there's a lot of if going on. if you can actually spend the money on barriers, as he would like. in places he would like. if there is no real cap on detention bed space for violent criminals, the president is inclined to accept the agreement, move on, and try to find money elsewhere. was likely to declare an emergency i think is generally

the plan. >> melissa: democrats say the president doesn't have much choice. with another shut down such a kick in late friday if the deal gets rejected. >> we believe that the president took a major political hit over the trump shut down. that he recognizes the folly of shutting the government down as a bargaining chip or a leverage point imposing negotiations. that's not how we do it in the unit states of america. i don't think we will go back to that. there will be a revolt in the country if it happens again. >> melissa: juan, i predict that if this goes through everyone will spin it as a win for themselves. is that a crazy prediction on my part? >> juan: nope, totally accurate. i think everybody will feel the need, especially the president, who has been boxed in to save face. and he can't see the face right now, especially with the right wing talk show crowd. they are still critical.

they wanted a total victory. so you have to look at the measures on say, "well, within this range, here's what we've got and here's why we are citing the deal." but if you go back to december it was a bipartisan deal that had been put forth and actually would have given the president more money for very funding. the question is, why did we have a shutdown? it was very political, very symbolic. at this point both sides need to claim a victory. >> melissa: katie, i look at this and i see other points of time -- juan is right -- i could see point of time where both sides have more and now they have less. for example, there was no talk of anything for the dreamers and a longer. >> katie: right. >> melissa: so when democrats -- nancy pelosi, you remember what you got rushed by the dreamers who said she wasn't working for them? they aren't even asking for that right now. totally silent. he is right on the point of the president is getting this tiny amount of money for a fence, and also democrats are getting nothing for dreamers. >> katie: it's a long way from

$26 billion to be $1.4 billion package that includes 55 miles of some kind of fencing which allows people to walk through. the entire purpose is to stop humans from coming across, illegal immigration. that doesn't really help. mitch mcconnell is talking this up as a win, the language the white house is using is very interesting. folks are saying we are looking at the restrictions this bill puts on. as lindsey graham says, how many beds will they allow? are they going to try and restrict i.c.e. from detaining a certain amount of immigrants, which will be a safety hazard for american committees? where they restrict how the president can use this measly $1.4 billion that he has? the bottom line is this is not an issue that is going away. it's in a decades-long challenge to every president that we have. this will be a 2020 issue. the president one back on in 2016 and he will use it again in 2020. the dreamers will come up, border security will come up. as we continued to have this

asylum crisis where people are claiming asylum falsely, until congress deals with this issue the caravans will continue to come and we will continue to see this humanitarian crisis on the border. >> melissa: lisa, do you think once we get past this hurdle there is an opportunity for some type of larger immigration reform which everyone can agree is totally necessary? >> lisa: no, i don't think it's going to happen. [laughs] sorry. i don't actually know if it's even just >> melissa: . i think both parties can say they've gotten something for it or at least denied the already don't like other something. they can say he's gotten some money for a wall, which he is going to. $1.4 billion. additionally, on the other sticking point, the i.c.e. detention beds which katie mentioned. republicans can gain some beds. congress funds around 40,520 under the most recent deal. my understanding it's it's 274, with an additional $750 million that could be reprogrammed to increasing the i.c.e. detention

beds. while that is important, he could keep this issue a life of the 2020 election and make the argument that democrats don't care about border security or cracking down on illegal immigration. democrats are trying to make the argument of getting rid of i.c.e. detention beds and not allowing i.c.e. to do its job, enforcing law enforcement and the interior. >> melissa: go ahead. >> kennedy: i want to piggyback on that because i think that's right. he took about 2020 and implications, you look at the people who have been on the forefront of this appropriations special committee, and it's no one who was running for president. obviously -- when we are talking about detention beds and fencing, it's like addressing the cause of a cold by arguing kleenex versus sudafed. really, you need researchers in the lab trying to figure out how to combat and defeated cold. nobody really wants to tackle those structural immigration program like problems. that's where some of these

contenders could come forward, particularly the democrats in the senate really want the job to say, "this is what fixing immigration looks like." amy klobuchar said, "we should punish people for hiring illegal immigrants." you have a lot of businesses who need the labor right now. there is, for the first time in the a long time, a labor shortage in this country. you have to practically tackle those things. still, even though we've made some progress, it's not enough and it doesn't fix the immigration -- >> katie: and democrats have to define what they believe is illegal immigration. you had bob menendez, a top senate democrat, yesterday implying that drunk driving as an illegal alien shouldn't then reassess you as a criminal alien in america for deportation. they need to decide who is allowed to come into the country, they are embracing immigrants who are illegal immigrants. they are going to have to have that debate in 2020 about whether they think it's a crime to come into the country, and whether they want to put people who don't do it the legal way

into a very long line of people who want to become american citizens. >> juan: i think melissa had it. we need conference of immigration reform and it would be good if we could stop the finger-pointing and the yelling. and actually talk about what kennedy was talking about. let me just say, on the wall, for today -- it's like 60% of the american people say, "forget this one. why do we need the small?" hang on, let me finish. it's not lawlessness. we will talk about the beds, for example. from the democrats perspective, it was trying to limit i.c.e. from going after people who were not violent criminals. go get the violent illegal immigrants. and put them in there. stop with busting up families and acting like -- >> lisa: the government needs to find a better way of -- >> juan: we know who is here. >> lisa: who wants to work -- >> juan: and how they do it. in other words, it ain't about a wall. it's about overstaying, visas

tyson wants to file a complaint. lawyers for tyson and a second accuser also calling on the state legislature to do their own investigation. tyson's counsel writing, "we expect the virginia legislature will oversee a thorough, fair, and expeditious investigation and take appropriate action to hold lieutenant governor fairfax responsible for his conduct, both past and present." the governor's office releasing a new statement. "we continue to welcome investigation by the fbi as a follow-up to the two previous fbi background checks, and is confident that all fair and impartial investigations would clear his name." dr. tyson is speaking up for the first time since making her accusation. she peered at a long-planned event on sexual assault, but shd not address her own claims. watch. >> one thing i noticed with sexual violence is that there

are many people who would like to glance away from this. maybe they would do it subconsciously, maybe they do it consciously, maybe it's just too much. i understand, it's one of the ugliest aspects of humanity. trust me. but what and who be glance away from says so much about what our priorities as a society. >> kennedy: is incredibly lonely and daunting for some of these victims to come forward, especially in high profile cases like this. do you think the public and the press are doing enough to sort of grant the grace they have in the past two other victims of sexual assault, justin fairfax's accusers? >> i think so. we are all aware of it, we're sitting here talking about it. they should become as one of being fair to both sides. remember, going back, republicans always talk about brett kavanaugh and due process. here comes fairfax, and he is saying, "go ahead, have an investigation. have hearings." in the case of the state legislature.

i think miss tyson is saying something broader. i think she's been a victim of sexual abuse prior to this, and now this. any of a a second accuser who says not only was justin fairfax involved, but then she points to a basketball player at duke and says maybe he had abused her as well. >> kennedy: she also said she had filed a complete with the university. they said they are looking into it and trying to figure out if there is, in fact, a paper trail. >> juan: i must say, for a lot of people it's like, "wow it, justin fairfax has been around." and he says he's being smeared. but you listen to the passion of this dr. tyson, and i don't think she's playing games. >> kennedy: i don't think so either. you can't necessarily tell -- it's always difficult, and that's why you have to be a little bit more sensitive sometimes. of course, it's politically inconvenient, but if these allegations are in fact true, what do you do? >> melissa: i think that's why you have to have an investigation of some type. juan is exactly right.

it doesn't matter what political party anyone is from. it doesn't matter what is at stake in the present. you have to go at it with the same tools that you would know matter what the circumstance is. and of the suffolk county district attorney's think it's still within the statute of limitations, that are offices there and she is happy to help investigate this. but it becomes -- it's up to the victim to come forward. at the same time, katie, as somebody else on the side of it was waiting for their day in court so to speak. >> katie: out of the queue should be impeached before the due process is over. i think it should be a thorough investigation. there is plenty of evidence to show that this did happen. there is cooperation, text messages, facebook messages showing that these women did talk about this happening back at the time when it did. then talking about it later before it came up now. the d.a. in massachusetts is not just talking about these cases. she is also saying, "look at, our office is open to anyone who may think that they were a victim of this person.

and they don't have to filed charges to take a badge of the services we offer for victims of sexual violence." and they are opening the door to saying open we are opening investigation potential. if you want to come forward, we are here. she deserves a thorough investigation and due process and patience. i would say and point out that the left has been, again, refusing to live up to their own rules when it comes to this. if he was a republican -- >> kennedy: there are shifting standards. kirsten gillibrand is not coming out think she's a credible witness, i believe, but either woman. >> juan: i'm just saying, i do think there was anywhere evidence here than there. >> kennedy: that's not true. you do have a timeline and a potential complaint that was filed with the university. there is a good deal more evidence then you had in the brett kavanaugh case. >> juan: i think the complete was not filed about justin fairfax, it was the best ballplayer. >> lisa: justin fairfax has admitted there was some sort of relationship that happened.

brett kavanaugh categorically denied that that event happened. you want to listen to women bringing for these allegations, but also not deny the accuser due process rights. i believe that supplement fbi investigation helped brett kavanaugh. help cement the republicans' ability to vote for him. i think having some sort of investigation for justin fairfax could inevitably end up helping him. >> kennedy: more speed bumps for senator amy klobuchar's presidential campaign rollout as questions about her roughed up treatment of staffers continues to dog the democratic hopeful. will they derail her bid, or is there sexism involves customer that's what her support his claim. we've got reaction from the couch, plus president trump and vice president pence ripping the freshman democrat ilhan omar and calling for repercussions even after she apologized for each week to many, anti-semitic. now one house democrat said claim the high ground on the issue. we will debate it all, next. ♪

i think she should either resign from congress or she should certainly resign from the house foreign affairs committee. what she said is so deep-seated in her heart that her lame apology -- that's what it was, it was lame. she didn't mean a word of it. it was just not appropriate. >> melissa: the vice president tweeting that omar's remarks "were a disgrace, and her apology was inadequate. anti-semitism has no place in the united states congress, much less the foreign affairs committee. those who engage in anti-semitic tropes should not just be denounced, they should face consequences for their words." but house democrat max rose, who also condemned omar's tweet, accusing republicans of hypocrisy on the issue. watch this. >> she is a friend. i take her at her word. i know she wants -- we share values, she this to be a great country.

i want to point it out to all of you that when kevin mccarthy said that it was bloomberg, and when it was george soros, pulling the string behind the scenes, none of you camped out. there caucus street united and had his back. that caucus can't beat chicken [bleep] in the face of anti-semitism either. >> melissa: he is referring to the deleted treat of then-house majority leader last october accusing george soros and two other jewish billionaires of trying to buy the election. let's start with omar first. one of the reason the house committee chair jerry nadler was critical of this remark is because he said it was part of a pattern. before she tweeted about israel hypnotizing the rest of the world, so he had said it's part of a pattern of behavior. it's not just about this one remark. what do you think? >> juan: i think he's right. the whole thing with hypnosis

goes back to the nazis, and the whole notion of "benjamin's," which is what she said aipac was doing. have trips to israel and support for pro-israel stances in our congress. i think that nadler was right. when she picks up on money and they hypnosis thing, those are tropes that have been used to advance anti-semitic causes globally, not just in the united states. we see a rise in anti-semitic violence here in the united states and globally. so he is exactly right and i think he has every reason to be cautious. i would say this -- you know what, she is a freshman. she has every right to say that she disagrees with israeli policies, vis-a-vis the palestinians. i don't think that means you are anti-semitic. i think those arguments take place within the jewish community as well. when i see president trump say, "she should resign, she should quit," i can't believe -- this is a man who gave a speech to a jewish group in which he said,

"i know that you are going to give your money -- because you like to buy political support from politicians. i want your support but i don't why your money." that's almost verbatim from president trump. so now here he is saying "she should resign." he didn't resign. >> katie: first of all, he moved the u.s. embassy in israel to jerusalem. he finally did that. benjamin netanyahu has a big poster up and i with president trump, shaking his hand. pretty strong to win the elections, he probably will. i like that argument is really gonna fly. but ilhan omar's pattern of behavior goes beyond anti-semitism. this big problem with her being on the foreign affairs committee for a number of reasons. the first being she lied about her position on the boycott divestment and sanctions movement against israel. she said she wasn't for bds to get elected, but then she got into congress and she's all about it. she appeared to blame the united states for al-shabaab attacking a kenyan mall, which is a terrorist organization. she asked a judge in minnesota

for leniency for a group of men who pledged allegiance to isis, saying they shouldn't be held in jail for too long. finally, she is speaking at an event coming up with a man who believes it is beautiful that guns and bombs are used against jewish israelis to murder them. yes, she has every right to criticize israeli policy, the jewish community certainly has those debates, but her issue is that she is palling around with people who believe in the murder of his release. she's not just talking about having two state solution to coming to a peaceful conflict. she is sympathizing with people who want to carry out murder on a daily basis of innocent israeli civilians. >> lisa: you also have her she digitally put out a map of basically getting rid of israel and putting palestine in its place. so katie is right. there's a big issue here for the left to address. i think the criticism of kevin mccarthy's fair. if you look at tom steyer alone, he spent a hundred $23 million in the u.s. midterm election.

if i may add to that, we have to the dictatorship. obstructing the access of humanitarian aid is a crime against humanity. we have to ensure that the humanitarian aid gets to the venezuelan people, and colombia is highly committed to receive the humanitarian aid from the u.s. and other countries so that it can access venezuela and help the venezuelan people.
