>> harris: you topped it with a red tide to go with the buttonhole. >> tyrus: that was an accidental stroke of genius, but i will take it. we do work over here. >> harris: let's get to the news. the deal would keep the government open. but it provides less than a quarter of the $5.7 billion the president requested to build a wall on the border with mexico. the president has taken executive action -- he has floated taken executive reaction to get the money. they have expense concern. here is texas republican mac thornberry. >> i think it's a deal most people are not very happy with. the question is, is it good enough to move forward? it does include a lot more than $1 for order wall. it has some good, and some bad. we have to go through. >> kennedy: the facts of life! [laughter] >> harris: did you just say that's the facts of life? >> kennedy: i'm saying, you take the good and you take the bat! is be when she had a little attitude there. >> melissa: an '80s moment.

>> harris: they say he face backlash from his own party of the shutdown is triggered. watch. >> i think the white house has no choice but to sign this bill or face, frankly, a revolt in the republican ranks here in congress. i don't fake republicans want another shutdown. it was disastrous to them and their brand, and it really hurt this president. they don't want to repeat that. >> harris: vice president mike pence is in poland saying the president is keeping his options open as he considers the bill. >> i know the president is considering that, as well as other authority has. as president of the united states, to address what is a very real humanitarian and security crisis at our southern border. the president is evaluating what's in the bill. he is also evaluating the authority that he has, and i know he will be making a decision before the deadline this friday. >> harris: meanwhile, when it comes to a budget deal, a new poll finds 66% of voters favor a

broad immigration deal which includes a border barrier, security, and humanitarian aid. at the same time, support for a wall has reached its highest level since 2015 with 46% for it, 50% against it. a statistical tie. tyrus, why do you think that's happening? why do you think more people are in favor of a wall? >> tyrus: a kind of mirrors the way our country is now. we are split on the middle and everything. if you live close to that situation or you are dealing with a family member who is dealing with drug addiction and stuff like that, setting up a wall is very important to you. if it is not affecting you, if you are nowhere near that situation, or if you benefit or profit from not having a wall, then of course you are against it. again, we are split. me, personally, i'm for the wall. just because of the drug epidemic alone, and a deterrent, it's a great solution. >> harris: kennedy? >> kennedy: unfortunately, it's not a great solution. the war on drugs has been

somewhat of a -- prohibition of substances and people always put you in the same place. with the black market. i understand that a majority of people want some sort of border security, and that's fine. kat and i have talked about that a lot. that means you have to grossly curtail the entitlement states in this country, because you can't have both. you can't have something like a green new deal, which i know we will talk about later. which is a grab bag and a free-for-all for everyone. in every stage of life. no matter if they are unwilling to work. you can't have that, through the door up, and say, "all commerce, come on inside!" >> kat: open borders and a welfare state of the same time -- i'm not sure how democrats think that supposed to work. >> kennedy: unsustainable. >> harris: why do you think at this point -- you got situation for the president says he wants to read it all. it's over 1,000 pages, so that will take 18. i know i saw congressman garamendi, the democrat from

california, just a short time ago on "america's newsroom." he was asked if he had read it and he said, "no, absolutely not. not yet." it will take some time to do that. but the american people are sliding in their support. so something is happening. >> kat: he absolutely has assigned this prayer there is no other option. he can't shut down the government again. i think he may try the executive route, but that would be a bad move. in order to do this, he has to seize a lot of private property. if you do it through congress, there are protections. rather, authorizations that protect the government and allow them to do that. if you do it through executive power, those aren't there. lawyers will have a field day and it could kill the whole thing. >> as with president obama. >> kat: doing at the executive we could really bow back fire on trump. >> harris: it may be feeding to this, melissa. let's take a look at the latest gallup poll of the united states. he is a privilege back to preshutdown levels. bucket 44% approval right now. during the shutdown, it was at

37%. prior to that. that number at the bottom is from october, we before the shutdown. is that 44%. how do you account for this? >> melissa: i think it has to do with the state of the union address that he gave. when you look at the way that people received it, i think the larger media tries to present it like he is trying to build this racist wall at the southern border to keep people out. really, what it has more to do with is this idea that we need to have some type of organization in terms of who comes into this country and who doesn't. based on the fact that there is a war on drugs, as you said, but also we can't support everyone and give away stuff to everyone. he has sort of laid it out in a way that people got to. that we are not talking about the great wall of china, a racist thing to keep other people out. we are talking about a border barrier that is logical. >> harris: you know what else he did? he talked about those other two prongs and whether or not they could work with out all three of the stool legs. he talked about technology and

about the people, staffing up border patrol. but he said a barrier or a wall -- he still loves the word "wall," no matter the semantics. it is necessary for those other parts to work. >> tyrus: to look at the bigger picture, this isn't even about the wall anymore. >> harris: what's it about? >> tyrus: is about 2020. it's about reelection. >> melissa: that's a good point. >> tyrus: the democrats can't allow them to be successful. >> harris: but they are allowing it. >> tyrus: kind of. it's for broad -- >> harris: but the speaker of the house said $1. this is more than a dollar. >> tyrus: they are also -- >> kennedy: you've got an 1100 page document and you've got a time crunch. that means there is a gun to their head. they have to pass this legislation in order to avoid a politically toxic government shutdown. the second one. why would you write an 1100 page bill when what you need is

pretty straightforward? it should not require 1100 pages. that was done intentionally by someone. i don't know whom. it seems to really meyer the process. >> harris: this is why people really give congress those low double digit sometimes single digit approval ratings. because the last time we saw something this press up against the clock was the aca. the affordable care act. that's what nancy pelosi said. those are not her words this time. as you point out, and i said before, it's going to take a team of people. it can be done. >> kat: why would it take so long? b1 becomes 1100 pages? >> kat: why does it take so long license wise assuming pages? i don't understand. if my work isn't done, i'm not allowed to leave work. >> harris: well, that's everybody. >> kat: i can't say, "i'm not done but i'm going to go on vacation." they are allowed to do whatever they want.

>> harris: i'm looking through some of the paragraphs, and the $1.57 billion for the fencing with imitations to address environmental concerns is the first thing that is listed per the homeland security appropriations bill, have the money would be spent. it's fascinating, melissa. we are so far afield from that $25 billion of the president wanted. but if he can get this in other ways, as cat don't ask pointed out, how does that play politically >> melissa: he says it's a down payment on what is planning to do. you can spend as a way forward. this is the first step of many to come after. the zero was a big problem. >> kennedy: can add something onto that? i think the president's message of unity of the state of the union -- he wants to make good on that. he does that by signing this and then figuring out other ways to keep his base happy. i do think seeing that seven-point poll bump after the nadir of the shutdown, that's

important for him. and he's going to sign it because it will get him more goodwill from those critical independence. >> harris: well, krugman garamendi -- and certainly others, but congressman garamendi first -- they are certainly going to try and protect funding for the allocation of crises or weather or whatever it would be. away from the president's hands in terms of allocating money. >> tyrus: like i said, they are trying to put him in a box so they can say "this is what he tried to do, we stopped him, so it's a victory for us." another republican site is going to say, "well, we got something and it's only just the beginning." >> kat: democrats used to talk about physical barriers of this is more about politics than anything else. >> kennedy: prophylaxis! >> tyrus: good word. >> harris: we will scoot pay [laughs] the problems for virginia democrats are not going away. an attorney for one of the accusers of lieutenant governor justin fairfax says he threatened her client with legal action of his own. the lieutenant governor denies both the assault allegations

headaches as his panel gears up to investigate through justice department and review mueller's final conclusions whenever they release. over in the senate, senators richard blumenthal and chuck grassley have already introduced a bill that will require the mueller report to be made public moving the decision from the attorney general. they are already firing up and setting up to dispute the outcome of this report, kennedy. we don't even know when -- >> kennedy: we have no idea what's in it! anybody who thinks they know it is that it based on who has been indicted, who has been interviewed, the fact that the grand jury was extended for several months, the length of time -- it's almost two years since the beginning of the special counsel investigation. nobody knows what's in it. therefore, if you have no idea, get set up a defensive posture. it's a ridiculous. i do like that has a bipartisan effort, because no matter who the president is or who is bring the charges we deserve to see if

who's in it. if it has taken this much money and time at oxygen, then -- >> kat: not just that much money, but that much of our money. the government is supposed to work for us. there's no reason we should be able to see everything possible to see about this. we should know what they're up to them what they are doing, because they work for us. >> melissa: tyrus, is anybody going to be happy with the outcome? >> tyrus: absolutely. except maybe me, that it's over. >> harris: oh, you like it? >> tyrus: i would like to be over. it's the biggest spike in the division of this country, is this report. on the report comes out, it's valentine's day. it's not as sexy as everybody wanted to be. it will be unbelievable findings. it'll be flat and maybe some ham flaps for those who made mistakes and are prosecuted. they are still on attack mode, so they have to try and find something out of this. there's got to be something we

can use in this, because all this goes -- if this doesn't land a huge devastating blow to the president of the united states, they are now in trouble. >> kat: something that would result in impeachment, the democrats will be very upset. i don't see that happening. as tyrus says, they will make huge mountains out of any little molehill, they can find. the three unwanted investigations in congress. >> harris: can ask your question, kennedy? it was like a wimp or a post risk coverage this week, the senate bipartisan findings of no collusion here that coming to a conclusion. yes that -- wide e-cig it's been so quiet and coverage? >> kennedy: will know when the coverage comes out. democrats in charge of the house intelligence and judiciary committees, they are doing their own investigations. that's when you know something is political and there's no more objectivity in washington. when you have two committees into houses looking at the exact same thing, coming to vastly

different conclusions. in a way, they cancel each other out. to tyrus' point earlier in the show, this is why people are so frustrated with congress. >> melissa: harris, we watch william barr when he was testifying, when they were talking to him. >> harris: the confirmation hearing. >> melissa: thank you. he was so calm and didn't take the bait when they went after him from so many different angles. does that make you feel confident about how he's going to handle the attacks as he takes over? >> harris: i have two theories on that. one of them is because, been there, done that. he's got this. that kind of rides in its own lane. the gravitas of sheer experience. >> melissa: he's already had the job. >> harris: the other is, we found out from that that he actually is pretty close, professionally aligned, with robert mueller. >> tyrus: a lot of mutual respect. >> harris: there was a lot of talk about that mutual respect, but also like mindedness in

terms of getting the job done. and making things as transparent as possible. when he didn't do, melissa, as we watched together, he didn't let any of the lawmakers box him into a promise about something that he hasn't seen yet. in terms of that report, what needs to be redacted and what doesn't. so he's not going to sign on the dotted line to say, "yeah, i will just turn it over to the public." because we don't know what's in it. >> kat: even asking that is absolutely crazy. "what are you going to do with this thing you haven't seen?" >> kennedy: [laughs] >> harris: politically, do they want to be on the record as having pressed the candidate? we already had words that he will be voted for. doug jones in alabama said he would come early on. >> tyrus: i would have huge concerns if he was answering hypothetical questions of factual answers. i would have an issue with that. "absolutely, i'll do whatever you want me to do." that's not what nag does. >> harris: all right, we will scoot. responding to claims from former fbi director andrew mccabe in a new interview with 60 minutes.

he ordered an investigation to whether the present obstructed justice as a way to protect the russian visitation from political interference. watch it. >> i was concerned that i was able to put the russia case on absolutely solid ground in an indelible fashion, that, where i removed quickly or reassigned or fired, that the case could not be closed or vanish in the night without a trace. >> harris: mccabe also reportedly said that top justice department officials discussed whether to recruit cabinet members to invoke the 25th amendment to remove president trump from office, and that deputy fbi director rod rosenstein was serious and has offered to secretly record the president and where a wire. the justice department responded this way -- "the deputy attorney general never authorize any recording that mr. mccabe references, as the deputy attorney general previously has stated burst on his personal

dealings with the bases. there is no basis to invoke the 25th amendment, nor was the deputy attorney general in a position to consider invoking the 25th amendment." the president weighed in as well come on twitter. "many of the top fbi brass, forced to leave, fired, or left. mccabe 'his wife received big money from college and people forget pain. he gave hilary a pass. he's a disgrace to the fbi into our country. make america great again!" just a short time ago, vice president pence had this to say about the 25th amendment. >> i find any suggestion of it to be absurd. look at what this president has accomplished. i have never heard any discussion of the 25th amendment by members of this government, and i would never expect to. >> harris: mccabe was with the fbi from the fbi last march, after it caught lying to fbi agents about his contact with the media. i want to unpack the answer to the beginning with you, tyrus. the thing that stuck out -- and

i heard you speak on it -- one man said he had to protect the entire investigation should he leave. i thought it was a team effort. >> tyrus: unfortunately, this has nothing to do with truth or justice. this has to do with book sales. he needs something to come out to get people to buy his book. i always thought -- when i think of the great man of the fbi, when you ask them about their career or the other stuff, that's business. they don't discuss those matters. it is to be integrity and honor. >> harris: did james comey change that? >> tyrus: can be changed it. that's another thing, also up also. these guys are cashing in on the trump book. when you read about trump -- which i think we should all do, we could make some money -- and with the mueller report coming out, he tried to get that last little stuff in. if it doesn't match up with what he's talking about, his book is a dog. he dropped these hellacious things were his peers are like, "what are you talking about? it is untrue." it's about a book. it's not about honesty and integrity. >> melissa: you make the point

that he was fired for leaking and then lying about it. the only problem with this one is that they sought in the room and talked about wearing a wire, the 25th amendment. we know that the fbi general counsel, james baker, is on record corroborating evidence saying it was true. that they did have that conversation and they were considering it. in my mind, these people standing the room and talking about this is really pretty scary. because you are talking about a duly elected president, they talking about getting rid of him. it reminds me of the ruling class that exists in washington. these entrenched players on both sides of the out. republicans and democrats who have ascended to power and are desperate to hang onto it. i think they are terrified of somebody who doesn't have those ties and doesn't want to just kowtow to the ruling class. that includes these politicized officials of the top of our government agencies. even journalists. people who are very invested in washington, the way it is and has been, and the status quo and

the power that affords them. >> harris: what i would slide in there are the facts of these text messages that we know about from the two lovers, lisa page and peter strzok. it gave that textured idea of, no matter who it is, they are in control. they had a plan to keep the president of the white house. according to this text messages. a >> kennedy: to melissa's point -- and i think you are touching on something important here. you had a very small group of people sitting in a room trying to figure out how they could surreptitiously undo a presidency. that's incredibly serious and totally unacceptable. the claims that mccabe is making in his book, that he launch these two investigations because there was so much malfeasance within the new presidency, that this man had to be removed or at least the institutions had to be protected -- he has been referred to the u.s. attorney for criminal prosecution after his dismissal, mccabe. so unless he is 100% factually correct about the president's

necessary removal, through the book at him. that is evidence right there. >> kat: it shows so much bias that he was having his conversations. sure, fine, listen to what he says, but take into account that he is a liar. we know he is a liar. we know that he wants trump out. he always has, he has proved his bias over and over again. also, he was fired. >> tyrus: wasn't he fired one day before -- he lost a lot of money, as well. >> harris: my point bringing up the text messages, yes, what kennedy and millis are saying speaks to the idea of trying tot trump out of office. my point was that there was at least some texture or conversation or tone that was going on to keep president trump out of the office. and anti-mccabe's name was mentioned in some of the text messages between the two. >> kat: you should be investigated for the sake of it. >> tyrus: the compressive cells preload science true, the collusion stuff. you compromise unification with

ilhan omar for tweets many saw as anti-semitic. yesterday the house approving an amendment condemning anti-semitism. it was seen by many as a rebuke of the congresswoman, and speaking nancy pelosi forced to come out to the congresswoman's defense yet again. pelosi telling reporters and member of congress has apologized for their remarks. it took them what 13 years to know to notice steve king question return even waste your time on that. not to do the agenda of the republican party, to hold the new young member accountable for something the president himself did not apologize for. and for her part, congressman omar getting tired of answering questions on this. >> what is wrong with you? >> a question about your tweet. you had a tweet saying the president -- >> yes, i tweeted the response. you can run that, and have a nice day. >> melissa: meanwhile, jewish leaders from her hometown of

minneapolis saying her tweets show a pattern of behavior and that they spoke to her about anti-semitism last summer hoping she would change. minnesota state senator ron lantz says, "we were hopeful she would be more careful about what she treated and said if she got elected. instead, she keeps repeating her mistakes, if you can call them that. post would harass, you have a lot of extremes of this part of the country and this group together. they are saying that this -- she has a history of this, and that now as she sits in a place to influence foreign policy, that she has done things in the past. like show her support for people that have been fighting on the side devices, and this sort of thing. that it makes people nervous. >> harris: i don't want the tie that necessarily to minnesota. i think that minnesota politics came into play here because she was spoken to about these things. but where she is now is in a place where she is supposed to be serving everybody in her

group and her constituency, meaning her voting group. whether they agree with her or not, whether she agrees with them or not. that includes media access. so when i see a woman walking down the hall and snapping at her reporter after putting out pretty incendiary things on twitter, it does beg the question of accountability with her. and where she think that should come from. should it come only from the politicians in minnesota, where is everybody now allowed to react who she is as a leader on the national level? i do take exception to those on the who have said, "well, she is young!" she's in her late 30s. a lot of us were doing a lot of things in her late 30s. i think not even in the experience would even be an excuse at this point. i would really like to hear from her, her point of view. and whatever reporter can get her to sit in that seat, i will watch, riveted by that. i want to try to understand. >> kat: i just don't know what she was thinking.

>> harris: that's what i want to ask. >> kat: the thing about twitter, it's so great. you don't kid paid three tweets but they can run your life. i don't understand why any of us even tweet at. the thing she tweeted, she's alluding to these anti-semitic tropes and she think that'll be fine? i kind of wonder how she would feel if it was reversed and there was some republican politician tweeting some offensive things about her religion. i'm sure she would never stop talking about that. >> harris: you know how she feels. >> kat: exactly. i'm sure she would want that person to resign. to do it repeatedly when you are supposed to be representing people that include people of the jewish faith? it's absolutely ridiculous and she needs an answer for these things. and not just snap and be rude. hey, lady, you did this to yourself. >> melissa: we want to show him on the screen right now, too, that right now the senate confirmation vote is going on for attorney general nominee william barr. that is underway. it is expected to go through, but that is what is happening right now on the senate floor. we are going to show you the

results of that when it comes through. kennedy, let me ask you -- there is a deeper topic underneath this. i do hear people like jasser, who talks about the difference between radical islam and muslims who are pro-democracy ae worldview is more in concert wi. and he has tried to make the point that he does think this shows that she's coming at this from a different point of view. and that could be dangerous. it's at least worth getting that out and talking about it as opposed to, "well, this one said this resisting. this one said this." it's more a question about what her values are and where she is coming from. >> kennedy: and what are these deeper guiding philosophical principles, and who are the people that she aligns yourself with? because a lot of that is problematic. i know republicans including the president have asked for her to resign or to be taken off the foreign affairs committee. i don't think that's necessary right now.

i don't think that she is young and naive and brand-new. she is a rational adult. she knows exactly what she is saying. this is an informed opinion that she has held for a long time, and she is expressed in a myriad of ways pretty consistently. which means she's going to do and say something really stupid in the future that shows her true stripes. at that point i think it's time for action. right now, take her to word and let this go on. because she feel something very deeply that will manifest again. >> melissa: absolutely. all right, reaction from some democrats as republicans in the senate moved to vote on one of their biggest new agenda items. that green new deal. but some democrats don't want to talk about it. we will debate by that is, and why republicans may be calling their bluff. ♪ newday usa helps veteran homeowners get cash
