organized a hate crime hoax leaving a massive trail of evidence. >> he stated he wanted to appear to attack him on the evening of january 28th, 2019, near his apartment building. defendant smollett further detailed he wanted able to attack him, not hurt him too badly, and to give him a chance to appear to fight back. he wanted them to place a rope around his neck, pour gasoline on him and yell, this is maga country. he provided him with a $100 bill to purchase the rope, gasoline, ski mask, gloves and the red baseball caps that resemble the ones saying "make america great again". >> sean: the prosecutor saying smollett paid two brothers to stage this. paid with a check. records show the actor called them before and immediately

after the incident. another brilliant move. and texts show the trio coordinating the alleged hoax. other texts revealing that one of the brothers even sold designer drugs to smollett. police are now saying smollett likely scratched his own face to make the attack more believable. that kind of takes hating trump psychosis to a whole new level. smollett allegedly spent himself a threatening racist letter containing a white powdery substance. smollett wasted precious law enforcement resources in a city where young people and women and children are shot, people are murdered every single week in chicago, lots of them. it appears he used his celebrity status and race to smear and slander the people of chicago, trump supporters everywhere.

according to police, he did it for attention, sympathy, and because he was unhappy with his seven-figure salary? the judge called these alleged actions dispicdispidispiccable. this was one of the single most powerful press conferences i have ever watched. take a look. >> this announcement today recognizes that "empire" actor jussie smollett took advantage of the pain and anger of racism to promote his career. why would anyone, especially an african-american man, use the super bowli symbolism of a noose to make false accusations? how could someone look at the hatred and suffering associated with that symbol and see an opportunity to manipulate that symbol to further his own public profile. bogus police reports cause real

harm. they do harm to every legitimate victim who is in need of support by police and gairinvestigators well as the citizens of this city. >> sean: it was just one week ago that smollett went on "good morning america." this is it what he said. >> how can you doubt that? it's not necessarily that you don't believe that this is the truth. you don't even want to see the truth. it feels like if i had said it was a muslim or a mexican or someone black, i feel like the doubters would have supported me a lot much more, a lot more. and that says a lot about the place that we are in our country

right now. i respect too much the people. i'm one of those people who has been attacked in way. you do such a disservice when you lie about things like this. >> sean: jussie smollett is no longer speaking with the media. there are reports tonight that he is back on the set of "empire." his lawyers stated they are planning a "aggressive defense" and that their client be given the presumptions of innocence. just a few months ago he tweeted out #i believe dr. christine ford. we recognize that being innocent, presumed innocent until proven guilty is a right even afforded to those with no principles. in this particular case, the evidence is beginning to look overwhelming and incontrovert

incontrovertible. remember that case? i will give him the presumptions of innocence that he never gave judge kavanaugh. and he got cleared. they cleared him of any wrongdoing. despite the massive amount of evidence against the "empire" actor, you have to assume he's an innocent man until convicted in a court of law. that is standard for anybody. but tonight, this is about so much more than an over paid, attention seeking, wanting a raise, trump hating actor. it represents another example of what i have been saying since '07 and '08. journalism in this country is dead. in case after case after case, the mainstream media they devour

any story that just fits their radical extreme extension of the democratic socialist party agenda. that america is scary, racist, sexist, homophobic, the media mob will shift into full gear without even picking up the telephone without any kind of investigation. not even five minutes' worth. look at what they did to this 16-year-old covington high school student. off a 15-second blurb. accused him of assaulting a 65-year-old activist. they tried to ruin this kid's life. character assassination. they accused justice kavanaugh of gang rape, every other weekend, he and his friends were drugging teenage girls and

literally, you know, lining up in the hall for gang rapes that nobody ever reported and of course they tried to ruin his life. tried to call him an alcoholic. they falsely accused the uva students of rape. remember the duke lacrosse players? they accused them of rape. they bought the story hook, line, and zinger without any evidence. i went to meet some of the family members, some of the kids, doing my own due diligence. george zimmerman, everybody was saying he was guilty, but there was an eyewitness that showed up. in baltimore, everybody was a sure they were going to get guilty pleas. none of them did. as we speak, they're falsely accusing president trump of russia collusion. that, too is a hoax while ignoring what is now a mountain

of evidence of the single biggest abuse of power, corruption scandal in history where they tried to rig an election, and then undo the elected president of the united states. the media, way too complicit. but they buy these stories again and again, hook, line, sinker vilifying innocent people in the process over and over again. k when the stories are exposed, so-called journalists and news organizations, they move on. they just pretend like it never happened. like nbc news, they were talking all about this until this started happening. they were all over the jussie smollett story. monitored all of msnbc conspiracy tv's prime time shows. they totally ignored the charges against smollett now. after they were pushing the hate crime narrative for weeks and weeks, they back down like it

never happened. nbc news, prominent democrats they employ the same tactic. kamala harris calling the smollett incident a modern day lynching. today after a meeting with the reverend al sharpton, she totally ignored any questions about smollett. take a listen. superintendent eddie johnson. that was the most demonstrative i have ever heard him at any press conference. he said real life is coming hard and fast at jussie smollett right now. he finally had his camera die bu and it was anything at all but a red carpet experience. cameras descended on him that i personally have never seen before. we shouted questions at him. he got into the back of a black suv shielded by his body guards and then went to the set of "empire" where he was expected earlier in the day today before he got arrested. that courtroom, when he was in there posting bond, the tension you could cut with a knife as the assistant's state's attorney was reading these charges, a mountain of evidence. you could see smollett staring daggers at her. the evidence was so detailed down to the fact that this man able was his former drug dealer

and even down to what jussie smollett wanted them to do and say in the attack. take a listen. >> he also stated he wanted the brothers to catch his attention by calling him an empire f empire n. defendant smollett further detailed that he wanted able to attack him but not hurt him too badly and give him a chance to appear to fight back. >> and even the judge had some firy rhetoric for smollett saying that he is presumed innocent until proven guilty. but if these statements are true, the judge saying it is outrageous and despicable. he decembscribed the noose that jussie smollett used as a symbol of evil in this country. i'm going to read this to you. today we witnessed an organized law enforcement spectacle that has no place in the american legal system.

all right. amid the whirlwind of news of political violence in america, lost in the coverage was a very disturbing event at uc berkeley on tuesday. turning point usa's uc berkeley affiliate had a table set up in the college's plaza where members were recruiting students to join. an unidentified individual approached the table before

physically assaulting hayden williams, an individual helping turning point. the actual punch was caught on camera, but not what led up to it. take a look. [ bleep ] [ bleep ] [ inaudible ] [ bleep ]. >> sean: uc berkeley released a statement saying in part, "uc berkeley condemns violence, harassment of any sort, for any reason."

that you did nothing to provoke this? >> absolutely. so i'm a field representative, as you said, for the leadership institute. it's my job to help organize and train conservative activists throughout california. on tuesday, i was invited to uc berkeley's campus to help a conservative group, turning point, recruiting members. while i was there, some students took offense to our sign that we had that said "hate crime hoaxes hurt real victims." and this person claimed we were promoting violence on campus and proceeded to take his aggression out on us. >> sean: how many witnesses do you have? i'm watching -- i train mma and that shot was a cheap shot, especially at the end. when did you start filming? at what point in the encounter? >> as soon as the gentleman -- and i use that term lightly --

approached our table and began acting very erratic, i feared for my own safety, so i started to record at that moment. >> sean: all right. now, did you try to diffuse this? did you try and say -- i guess one of the posters said this is maga country. i don't know what the trigger is for liberals and make america great again. walk us through the very beginning. this guy, what did he do, when did you start filming, and how many people were there with you? >> that's right. so i had the president of the club with me there and we were talking to a potential new member when this happened. and these two people just approached our table as i said very erratically and started cussing at us. that's when i knew this was probably a troublesome situation. i pulled out my phone to start recording, and his friend -- one of the gentlemen that approached our table -- smacked my phone out of my -- >> sean: there were other people

videoing thankfully, right? >> that's right. >> sean: how long into the confrontation did video begin that you have seen? >> six, seven seconds. >> sean: wow. lawrence, i've known you for a long time. you know about this group really well. give us -- i know you've been investigating this for us. tell us what you found out. >> sean, you know, we don't rush to judgment on this program or on this network. we try to get all the facts. we have contacted three students that were surrounding this event. they have backed up what hayden had to say here. we contacted the university. the university police. and we've even asked if anyone has any other evidence that could give us a full picture to give that to us. this is what -- >> sean: we do know there were witnesses from the get-go, correct, numerous ones? >> we know there were three witnesses, but i think it's also important to note, sean, this is not new for uc berkeley. this is a school that's been
