days. where mayor is welcome to america's news headquarters. jillian: a showdown over humanitarian aid in venezuela, today is the deadline for president maduro to end the blockade and brian is here with more on the battle. >> reporter: this is a volatile situation, dangerous situation in venezuela. you have the opposition leader, juan guaido, who the united states and 50 other nations recognize as the president of venezuela urging the masses to come and help these humanitarian aid trucks from colombia into venezuela. the opposition believes millions of people on their side, the maduro regime, nicholas maduro and his thugs will allow these

humanitarian trucks filled with food, medicine and diapers to come into venezuela. we have seen one truck into venezuela with international aid, not specifically us humanitarian aid but brazilian aid. we saw yesterday two people killed on the venezuela brazil border. we know that juan guaido treated the first humanitarian trucks filled with aid has made its way past the border. he has been tweeting all morning he released a video moments ago, a message, those who are for maduro. take a listen. >> i will translate for you. this is a struggle for all venezuelan. the time is now. we asked to side with the constitution. today venezuela needs you,

venezuela needs all of us united. we call on you to defend and protect our people. the time is now. juan guaido sending a message to those supporting the maduro regime letting them know we need you to stand with us. there is a sense of momentum. you can see the people. there has also been violence already. we saw a red bus on the border, protesters with a bus on fire and tried to mess with the bus. there have been some standoffs where you see venezuelan military members and protesters looking at each other, tense situation. we are talking about a situation where teargas was used on protesters. protesters continue to gather. it is about getting military and aid inside. juan guaido was in colombia for a live aid concert which richard branson the billionaire put on. he made his way into colombia to

raise $100 million and he has been on the border all morning and on these humanitarian trucks and urging people to stand by them as they put these trucks in. you can understand why this is a volatile situation because president maduro is saying the humanitarian aid trucks are nothing but a farce, warning they are going to not allow these trucks in because they believe it is a trojan horse of sorts and the united states is trying to interfere and overthrow the regime. that has been going on all morning. the big question now is where the military is going to stand. we have seen video of three national guardsmen on the bridge between colombia and venezuela defects from venezuela to the side of the opposition and hope the opposition that more national guardsmen and members of the military will come towards the side of the

same type of humanitarian crisis venezuela does. at least a dozen or more countries with strongman dictators like nicholas maduro who engage in horrific tactics condensed their own people. why is what we are seeing now so important to americans no matter where you live? >> venezuela has been a strong ally of the united states for many years until chev is took over in 1998, a strong strategic partner because of their petroleum reserves. we have a clear and present close by interest in making sure the situation resolves itself. also the average venezuelan has lost 20 kg in two years, even the worst places in africa are not as bad as venezuela. leland: they call it the maduro diet, people who lost so much weight. you are on house foreign affairs. one thing to have a former ally in venezuela going through this and bringing it into the fold.

how does this relate geopolitically when you think about china and especially russia who were patrons of maduro and his regime? >> it will be a very interesting thing when this turns which i'm confident we are reaching a tipping point. i am confident it is going to turn but they say with all this cost and collateral they can't access. heather: there are reports cuban mercenaries and or cuban military have taken the place of maduro's closest presidential guard and some of them are running the show. also reports of the russians having advisors in venezuela. if they want to fight this thing out and decide not to go quietly, what are the options for the united states? >> first of all it is an interesting development, the cuban militia would be having to

take arms meaning the army is continuing to retract itself in the conflict which is a positive sign for us. i think the united states needs to back brazil and colombia, answer venezuela and offer them support as we make sure every venezuelan knows there's food all around the border waiting for them if we can just get it in. leland: obviously the leader of the venezuelan opposition, juan guaido, saying that as well. some american politicians disagree with you. among them bernie sanders. listen to what he has to say. >> is juan guaido the legitimate president of venezuela? >> what has to happen, there are serious questions about the recent election. many people feel it was a fraudulent election.

>> should he go? >> i think he has been very abusive. that is the decision of the venezuelan people. leland: why is he wrong? >> it doesn't get better than that. the socialist is siding with maduro against the rest of his own country and the people of venezuela and he wants to be president. leland: is there a lesson to be learned in terms of what happened in venezuela as we watch these prongs of people in venezuelan flags that are hungry and sick without food and without medicine? is there a parallel between the policies of maduro and chavez and the policies the democratic hopefuls are promising as well? >> we've seen all around the world for many years socialism and autocracy do not work. democracy and freedom and free enterprise are a better environment for people to raise

their families and provide for them. it is unsettling to see americans calling for socialism. leland: we appreciate you being with us. something we are going to watch the next couple hours and the next couple days and we will have you to talk about it. >> have a great day. jillian: donald trump is facing several legal and legislative challenges to his national emergency declaration on the southern border. even some republicans joining their democratic counterparts in opposing the declaration. how many republicans are set to jump ship and support the democrats resolution? >> reporter: in congress and the courts as well as through the court of public opinion. on tuesday the house will vote on a resolution of disapproval which would allow congress to end the national emergency, democrats and the number of republicans say there is no real emergency that justifies the

declaration. on friday in laredo, texas, nancy pelosi says congress has constitutional responsibility. >> we will be fighting him on this usurping of power, violating the constitution of the united states and congress and the courts and with the american people. this is the path i would not recommend we go down. leland: the legislation is expected to sail through the democratic controlled house and the senate will be more of a challenge. democrats need four republicans to support it. only two, so they may vote for. a handful of others expressed concern over the president that this use of emergency power could set. donald trump was confident republicans will support and even if they don't, there is no way he could sign it.

>> everybody knows we need border security, we need a wall. it is a bad subject for the democrats. we need a wall. will i veto it? 100%. 100%. i don't think -- we have too many smart people that want border security so i can't imagine it will survive. i will veto it yes. leland: it would be the first veto in the administration and not a lot of optimism congress combustor of the two thirds vote necessary to override it but this is just the first of many fighting this battle. jillian: don't underestimate the wrath of congress when they feel they have been circumvented by the president. leland: a fox news alert as we await a court hearing for our kelly, the famed r&b silver -- singer will face a judge today on 10 count of aggravated criminal sexual abuse involving four victims. at least three of which

according to police were underage. matt finn joins us from the windy city outside a courtroom of sorts. what do we expect? >> reporter: in a few hours, our kelly will stand before the same judge in the same courtroom where jussie smollett appeared 48 hours ago. the state attorney, not be released on bond today. one of the big questions is whether the judge will hand down a bond and if kelly epstein will have enough cash on hand to bail them out today. our kelly turned himself in to chicago police last night. the indictment against going to graphic detail about the alleged sexual abuse by four women, three of which were underage at the time. here is his attorney responding to these charges. >> the state attorney succumbed to public pressure, pressure from grand standards like michael avenatti and brought these charges. mister kelly is strong, he has a

throughout arizona after three days of heavy rain. jillian: donald trump is about to travel overseas to meet with north korean dictator heather nauert -- kim jong un. joining me to preview the president's agenda is his former national security council, chief of staff fred slice. you are fresh off of meeting a few days ago with the president in palm beach where you said is out for the comet is largely optimistic. that is great but what about the fact that so many of his own advisors seem to be saying they are not at all sure this is the right moment? >> the president was very optimist, proud of his achievements in the relationship with leader kim.

he said the halt of nuclear missile tests is a big step forward and he got some unexpected support in an article published in the washington post, a former director of los angeles our most national amateur, doesn't like republicans or this administration and he said clearly that what the president was done in stopping the nuclear missile test and sent back these dangerous programs. this debate, what will be agreed to, the president is not going to agreed to much in exchange for too little. jillian: he had some success in deterring kim from testing nuclear weapons and missiles but that is not the big kahuna. the big deal is denuclearization and all intelligence we've seen publicly shows he's not taken any real steps. isn't that the number one goal?

>> the word denuclearization, no one was talking about that before donald trump became president. the fact that is a slim chance or longshot chance for peace is something this president created and it will take work. north koreans are used to playing administration. i played people who would like to offer concessions in exchange for insufficient concessions from north koreans. the president is not one of them and mike pompeo keeping a close eye on this. >> how will it be if the president walks away from this? traveling overseas to meet with kim. the president's time is a precious commodity, takes a lot of energy and staff time. if he doesn't walk out with some document that he can show the world they agreed to this, this and this, how bad will it be? >> we are close to significant achievements at the summit, inspections of the nuclear site and missile test site. jillian: they will agree to

inspections face-to-face? >> close to getting an agreement on that and that would be a step forward. if we could get an agreement on the nuclear site, which is being discussed, that would be huge. i don't know if we will get to the summit but when i hear people criticizing where we are, where were we when the administration began when north koreans were ready to test icbms on the east coast of the united states, these were offensive weapons and the president stop the tests of them. >> the president put a lot of stock in his own interpersonal relationship with kim, not just him but all world leaders. he tends to evaluate the strength a bilateral relationship based on his interactions. in this case do you trust that whatever kim says is something that will translate into real output? >> the president has thrown out

traditional diplomatic rules. all these summits, it is precooked, nothing is negotiated at the summit and interpersonal relations play a small role and he got leader kim out of his backward socialist cocoon, showed him a movie of what a denuclearize north korea would look like and he is using this relationship to move it forward. so far he has achieved something significant. jillian: the latest fox news.41% of americans disapprove of how donald trump is managing north korea and 46% approve. a 5 point margin. how much of the summit is a big move the numbers further in the president's favor? if he focused on the optics, on domestic issues -- >> he is not doing this for his

>> special counsel mueller had until midnight to file the sentencing memo, never showed up his file on the federal court website but that doesn't mean it wasn't filed. it could have been filed but rejected. the news about manafort, it is not going to happen next week, we don't know if it could be the week after. court documents allege manafort shared polling data with an associate with ties to the russian intelligence community. metaphors played guilty to two counts related to his lobbying work, mueller wraps team plans to offer manafort some leniency but that went out the window when a judge found manafort lied to investigators after agreeing to cooperate. mueller will return his report to bill barr, donald trump was asked about this yesterday.

be the final tea leaves and he is ready to give the report. >> you are saying the president has input, what he tells him and what he gives him will influence when mueller decides to call it. >> how far he cooperate and whether mueller believes there's everything he can get from the president and that could make a determination. >> the president's supporters say this is gone on too long, nearly two years. it proves there is no collusion. the investigation is hanging by a thread. is that true? >> you can take some liberty with what is out there. we see indictments that have been made and factual information, nothing suggested collusion.

energy ideas the president tried to implement in 2009, his renewable act, ultimately played a big part in republicans having a huge 2010 election and here we are again, democrats once again pushing a green deal that voters are going to reject. jillian: lots of them throwing their weight behind the green new deal but is a winning strategy for 2020, a winning issue for democrats? >> i don't think it is. we have no idea how to pay for it, we have no idea what it means to get rid of fossil fuels in ten years that i think it would be a mistake not to understand the concern about climate, it is very real issue as the children's quite articulate comments reflected in david is right. of democrats feel they can talk down to the electorate, talk down to students and children that is a bad mistake.

promoted killing of u.s. citizens, should we call her isis bride or should we call her another terrorist? >> that's a good question. i'm not here to defend her or any acts that she has taken in her life or the choices she's made, you know, i think there's probably good case to make that she may be prosecuted as terrorist. leland: the attorneys are saying it's okay that she comes over as prosecuted, he wants her to be able to come home. there's the issue about issue u.s. citizen or not because she was born in u.s. soil, that's undisputed but at the same time she was the daughter of a diplomat from yemen, may have been not a a diplomat at the time, is this a winnable case for the attorney? >> essentially, yes, there seems to be some -- they appear to have some evidence that he was not a diplomat or not serving as diplomat at the time she was served. there was enough evidence for at least to present originally to the department of state a long time ago that caused the state

department to grant her passport and renew passport before she left to syria. this is her attorney on that point. >> if barack obama, state department didn't want her no the country, they wouldn't have stripped her of passport and visa. >> president trump declaring noncitizen not overreaching own authority but essentially giving her a free pass. he's saying the u.s. has no jurisdiction over her and letting her go. leland: this is very important point. is there a way to strip someone of u.s. citizenship or say even if you had it you don't have it anymore once you join up with a foreign terrorist group? >> under our current law, no. the constitution guaranties that if you're a citizen you remain a citizen and can't be taken away, however, you can give it up voluntarily and certainly acts that the immigration statute recognizes as potentially expatriating as you commit
