agents on the ground, talk to the people dealing with this problem every day and that is where you will get the true rhetoric. rob: what some say is the gimmick, everybody claiming asylum at this point, numbers through the roof, up a tremendous percentage. you can claim asylum even if you have a wall from coast-to-coast, you can get onto us ground on the other side of the wall and claim asylum. the question becomes does a barrier prevent that and should the money be spent on places to house asylum-seekers and judges rather than a barrier itself? >> it is a multi fold problem. we need to deal with the problems of the border. sign an executive order for deploying immigration judges and asylum officers, 17 consulates in central and south america. at the border put a partial walling to funnel the traffic. then -- rob: will not prevent

asylum-seekers. >> they can come through ports of entry. why don't we have asylum officers, a temporary deal. if we don't hire -- when you start getting into this complex problem you need to look at the other aspect of special agents. and to dismantle the smuggling organizations with claimants. >> do you see something happening down there, productivity wise, changes being made? >> know. you have proactive agents, people doing their job. you need to have that funding to hire more agents, 150-200 agents per year for attrition.

that is homeland security investigations alone. border patrols losing 750 a year. we are looking at 16,000, rough numbers of border patrol agents that patrol to the southwest border. those border patrol agents are dealing with a 24 hour rotation. rob: the public perception is changing somewhat, democrats in my opinion are losing ground. every day that goes by people see numbers that show there is a problem down there. you have to be pragmatic about this, apprehensions at the border, february and march, 70,000 is a big number, getting close to 1 million a year in big numbers and in march on pace for 100,000. it is a flood at this point. everybody that works at the border, if you have 1 million, the immigration judge says

state's popular vote, not the national popular vote and there's a really good point there. if you have a direct national popular vote i could see instances where there is more voter fraud. we have an instance of voter fraud restricted to that state and what's the point of campaigning and individual states if it is just a matter of the national -- >> the constitutional? >> if they get to 270 electoral votes, i guarantee in an hour there will be a lawsuit and it is unconstitutional. you can call this an electoral college, electors doing it. this is still a direct national popular vote and directly contradicts the constitution. of this goes to the supreme court my vote would be, my guess would be they would sign with a framework because they don't want to go against the framers intention. jillian: let's talk about popular vote laws, you will notice the numbers there, the

total number of electoral votes is 181. that would need to get to 270. do you see that happening? >> it may. this will take some time and even if they get to 270 and a lawsuit happens and they say what should you do? if they really want to change they should pass a constitutional amendment, two thirds vote in the senate and house and have 3 fourths of the state to ratify, the quickest constitutional has ever gone forward, usually takes many years. for an issue like this don't expect in my opinion this will affect the 2020 election. jillian: possibly beyond that. >> may be a fight but the way the current system works it will be upheld unless they get the map. jillian: what about the challenges? >> i think people will be upset about this especially in red states and smaller states. how will they be properly represented? it is a big issue. we can talk about everybody
