administration and what folks forget is president obama's twee selections he did make replace justices who had been appointed by republican presidents. jillian: you say doing this, packing the court would make -- undermine the court's legitimacy and credibility? why do you say that? >> the supreme court does not have the same democratic pedigree the executive branch and leslie -- legislative branch has. if you start having the judiciary be something based on something other than the rule of law it is a matter of counting noses, becomes a matter of increasing the number of justices, the outcomes you want, that is not a judicial process anymore. rob: the supreme court so political these days. pretty pragmatic guy, and those ten select another five.

is that even constitutional to implement that without a major change to the constitution? >> that would not be constitutional. having justices select additional justices would not be in line with the constitution. that would require a constitutional amendment and that would not be beatable. jillian: how do you feel about what appears to be a lot of people on the left trying to change so much of the constitution, so many rules just because they don't like who has power at this given moment, what does that do going forward? >> what that does is makes people concerned what motivations are here. if it is power folks are in search of which i think it is you have to be very skeptical about the long-term structural changes. you don't know what problems will come along.

it has worked well for 200 years, to change it based on current desires for power is a risky thing. rob: you think about ruth bader ginsburg and how long she has got on the court and if the president gets reelected and i suspect you would save hillary clinton in 2016, this would not be a conversation at all. >> that is right but this is something you hear talk about on both sides of the aisle, whispers on the republican side of the aisle that justice thomas should step down while donald trump is an officer the vacancy doesn't occur down the road. that is the parallel of what democrats are worried about with primarily justice ginsburg but also justice breyer. rob: it is so political right now. jillian: it is. how do you see this playing out

in the end? >> hopefully none of the reforms will come to pass. one of the things these candidates might be doing is trying to how to current majority on the court for voting the way it might otherwise vote and even if they don't get the reforms they claim to be wanting they might still have that interim affect. i hope it doesn't happen as well but i hope these changes of adding more justices to the courts don't come about because i think it would undermine the credibility of the supreme court in the long run. rob: thank you, appreciate your time. 18 minutes after the hour. he hasn't been office of will three months but aoc is the star of gop campaign ads. >> he has the media, she has the followers, bless her heart, she has some terrible ideas. her green deal is a bad deal for north carolina. rob: she is very popular.

deadly ethiopian airlines plane crash the senate is demanding answers, boeing under fire in the wake of two jet disasters killing 300 people. the latest on this developing investigation. >> lawmakers are going to go after the transportation department and the faa as early as next week, they want to find out why the faa deemed these planes safe in the first place. the investigation suggesting there are clear similarities between the ethiopian airlines crash and the lion air accident from last fall. we are learning the pilot of the lion air flight were scrambling looking through handbooks to try to stop the plane from diving. the justice department sent out subpoenas to gather information on how this plane was developed. right now investigators are focusing on the flight control software and the pilot training portion of this. at the same time the fbi is joining the criminal investigation into the faa certification of the safety of

this plane, and senator ted cruz who chairs the congressional panel said the hearing will examine the recent crashes, possible contributing factors and ultimately how we can ensure america's aviation industry remains the safest in the world. boeing is promising a software update pretty soon but the company feeling the pressure in terms of dollars. boeing stock down 12% since the ethiopian airlines crash. jillian: patrick shanahan used his official role to help boeing, a watchdog group filed an ethics complaint accusing him of promoting the company and making negative comments about its competitors. shanahan spent 30 years working there. promoting free speech on college campuses in a move amid

it seems that way to a lot of people, trying to change the rules to try to win. how do you defend it? >> thank you for having me on the show. i don't think that is the case at all. it is important to look at the electoral college and remember the founding fathers put in place because they didn't trust the public in times of change, people's vote should matter and every vote should count. it is something people should consider and think about, that your vote counts at your vote matters and we should discuss that issue about the electoral college. in regards to people -- rob: respond to that. the founding fathers didn't trust the public, should we be more trusting at this point? >> it shows lack of civics education. that is the fundamental problem with the base of the democratic party. we haven't realize why majoritarianism failed and the

founders railed against mob rule by the majority and with the electoral college does is protect political minorities, protects people in rural america and smaller states. right now the democratic candidates can't find anything redeemable about the american experiment for the american founding but this is one of those things that has been worth preserving and does have protection for states and people. rob: he makes a point about trusting mob rule. people vote for what is in their best interest, not necessarily what is in the country's best interests. you say vote for me and i will give you $1000, you will get a lot of people's votes. >> that is debatable but we should think about the fact that people vote and their vote should matter. the people should make a determination on who becomes president. that is important and the young voters, 16-year-olds should be able to vote and have the opportunity to do that.

rob: tell me why you think a 16-year-old who is likely to vote for whoever a celebrity wants them to vote for, why should they be able to vote with no life experience? >> there are three reasons why 16-year-old should be able to vote. one of the first reasons is they have knowledge about civics just as much as older people. second reason is 16-year-olds pay taxes and no taxation without representation, they should be entitled to vote. and thirdly, the fact the things that are affecting their lives and make a decision about it. there is a lot of movement by young people to make change and they should have the opportunity to vote. when young voters vote the american system votes for a longer period of time. rob: a lot of people say younger kids have been indoctrinated by universities and celebrities and

don't think for themselves. what do you make of that? >> policy impacts every american, if you are lowered to 16, why not 15? some sort of voice, 13 and so on. you made a great point, studies show the difference between 21-year-olds and 16-year-olds, very little in civics education, civics education, the problem is high schools and colleges are not teaching people about the american founding. the context of history, they aren't giving people the basis on how american government works, localities and local governments do most of what you see in daily lives, not the president of the united states and more than 30% of those under 30 would be voting. 30% voted in 2018. how about this? stick that problem first before

saying let's -- >> and change the electoral college so people's votes matter and count, absolutely. >> one last question. newest cnn poll shows bernie sanders popularity has come down quite a bit compared to 2016. 46% right now, 59% in june. what do you think account for this? >> i don't think it counts for anything. polls change sporadically but it is important we have a candidate who crosses party lines and brings people together and democrats will have that candidate. rob: we've got to leave it there but thanks very much for an interesting debate this morning. >> that paul that says scientists to your brain doesn't develop until you are 30. we are not there. none of us are. the fact checker who infamously smeared a veteran and ice here

we have more rain in the forecast in california and the southwest but we are watching this area of low pressure moving offshore and bring us our coastal low, a little colder, we would be talking a big snow event but because temperatures are in the 50s it is merely a rain wind event on the coast. however on the backside of this we will brought those temperatures and get some snow flurries in interior sections of the northeast and that is what we are watching. mainly rain, some areas could get some heavy rain and flooding and potential for several inches, half a foot of snow for interior sections of the northeast and new england. watching this coastal low dealing with another area of low pressure moving into the southwest from california and we are going to continue to monitor the flooding over the midwest which is an ongoing situation for many weeks to come.

not discriminate, the people that scare me the most are the people that say not my kid or not in my school. we are losing 192 americans a day. like a plane going down every single day. this is serious. jillian: how do we advance the conversation? >> doing what you are doing. i homeschool my kids. i'm a huge advocate that parents should parent their own children. i strongly believe schools should stick to reading, writing, arithmetic, social studies, science, send my child back to me because i am their parent. we are not benefiting anyone to pretend we don't have a very real issue on our hands. we have to get real about it and have these conversations. jillian: a number of states use narcan, new jersey, rhode
