♪ ♪ ibly28 good morning from new york city. the senate yet to come up. i don't know where spring is because it is really cold here. you are watching fox and friends first thursday morning, we appreciate it as always. our top story, fox news alert, the breaking point has arrived, the nation's top border chief sounding the alarm as 8000 migrants are caught crossing into the us, 8000 just this week. a new caravan is on the way to the border. calls increase for congress to fix broken immigration laws. >> the numbers are mind-boggling. a high number for border patrol is 4000 in custody. 6000 is the crisis point but by tuesday this week they have 13,000 people. how did this happen? on monday cpb apprehended the highest total number of migrants in a decade, 4000 on monday,

4117 on tuesday. that broke records. they expect to apprehend 100,000 people this month alone and if that trend continues we are looking at 1 million migrants this year. >> legislative relief closing the vulnerabilities and legal framework is the only way this flow is reduced and we can restore integrity to the immigration system. >> reporter: the president declared a national emergency last month and this week the pentagon authorized $1 billion to put up 57 miles of pedestrian fencing along the border. the president once again putting pressure on democrats to fix the border. >> we are capturing people that are coming in illegally, we are not just releasing them. in some cases we are running out of room. in many cases we are running out of room. the laws are so bad normally you just bring them back but the laws don't let you do that. our laws that could be easily changed by the democrats but

prosecutors dismissed 16 felony charges against the empire actor. agents for the fbi looking into whether federal charges could be associated with this hoax. the police union asking us attorneys office to investigate, the prosecutor's office denies special treatment but fox news has obtained an internal memo asking for other examples of similar cases. that memo coming in the department of the cook county prosecutor's office saying in part, quote, we are just looking for further examples of how we as prosecutors use our discretion in a way that restores the victim but causes minimal harm to the defendant in the long-term. kim fox is speaking out. >> right now there's a lot of emotion and i wholeheartedly believe i work cannot be driven by emotion. we have to be driven by facts.

abca6's legal team insisting they followed protocol but the fbi deputy director mark morgan says it is unusual for certain players to be involved in a case like this. >> in my 20 years of law enforcement i've never seen this. this is absolutely a miscarriage of justice. the chicago police should be outraged. the police department should be and they are outraged. not just for this and defensible decision but also the way they did it. i have never been in a situation where the investigators in the prosecution team didn't have a symbiotic relationship. they would have talked about this and had discussions back and forth but they did none of that and they disrespect to the police department by not doing that and then they found out about it at the same time you and i did. if i was the chief i would be demanding the state attorney give those hard-working detectives an apology. >> fox recused herself from the case because of conversations she had with a relative of the

empire actor. the house judiciary chair is worried congress won't see the formal a report as soon as they would like. jerry nadler saying, quote, i'm very concerned that it is apparent the department of justice will not meet the april 2nd deadline we set and i'm disturbed by that and went on to say i asked him when we would see it and he couldn't get specific. he said he will provide a more complete report within weeks. the faa grilled on capitol hill over safety concerns surrounding boeing at 737 max planes. >> you think the faa has the responsibility to tell these airlines they cannot change safety. the fact is the faa -- >> it is part of the fabric of what we used to be, save as we are today.

dimitri roberts. thank you for joining us, we appreciate it. your former chicago pd, what do you think of what has gone down so far? >> i don't think this send the right message to the community or the country. she is right when she says we need to look at facts and the fact that in one direction in that direction is abca6 lied from the beginning and did it for his own personal gain. unfortunately in today's political climate we don't need things like letting somebody off the hook for such a serious offense? ibly23 says we need to look at the facts when they didn't look at the facts, they look have listened to people he was either related to or relationships he had further up the chain? >> i don't think her job is very difficult in cook county particularly with what is going on but nevertheless i do think they made a misstep in this case

and when she says look at the facts that needs to be looked at a little closer and that is why the fbi is looking into this. ibly20 we have a next from an internal email being sent around the we are requesting a formal investigation of the state attorney's office regarding high profile criminal investigation by the chicago police department of the abca6 case, that came from the chicago fraternal order of police dated march 15th so they were asking for an investigation into what was happening in that office. >> because if you've been in this business long enough you see the writings on the wall. anytime you have someone in a position of political appointment or you have someone with political power to chicago you run into issues in cases

like this. we have seen this with rahm emanuel and cases you have dealt with. the city over all, the state attorney's office is not dealing with this in the best way they can but with the fbi stepping in it is the right thing to do for the community in the country. ibly20 what about kim fox? has she had issues in the past unrelated to the smollett case? >> kim fox came in after i left but i spoke to her father on several occasions and she's a professional who does the best she can given the circumstances. this is not me saying kim fox should be taken out of office but what i am saying is missteps were made but they should work more diligently to rectify the situation. heather: something she said yesterday in terms of

immediately feeling the case, she said was an accident, not her office that did that. it that one of the ways she can begin to rectify this? >> of course. transparency is always a good thing in situations like this because folks need answers. they will not let them off the hook when it comes to egregiously going above and beyond to make an unfortunate decision in their life but we have to send a message to folks that this is not the right way to do anything. starting to be transparent, we will rectify this sooner than later. and dealing with this issue. and looking at how many police resources source this effort and that is a big problem. heather: more than the $10,000, we appreciate your time.

and democratic strategists antoine seawright. thank you for joining us. i will start with you. what do you think about the comment? the numbers are staggering. 4000 arrests in one day on monday. over 4000 the next day, clearly there is an issue. >> i hope and wish these politicians would stop being fake and identify this is a crisis. this is no longer considered illegal immigration. this is an invasion of our country. people are running through our border even waiting border patrol, depleting our resources. it is an emergency and we need to take it seriously and i believe most americans understand that but people in the government need to get her stuff together and deal with this issue. heather: is mind-boggling how these statistics, these numbers keep coming up. we have leaders who are on the border saying this is a serious

problem but when you hit dc somehow the message is lost in a lot of democrats. >> we all know immigration is a major issue in this country. most polls indicate it is at the top two or three things on people's minds particularly those who go to the polls. democrats have said consistently donald trump's border wall is not an emergency. just like the migrant caravan, when we get closer to election that is an emergency. 60% of american people want to fix immigration in a bipartisan way. 68%, 68% think washington dc should be doing it but not a lot of people serious about the border wall. heather: let me ask you a couple things, you said it was a crisis of convenience, not a crisis of convenience to those individuals who are killed by illegal immigrants entering this

country, kate steinle, corporal ronil singh. you talk about it as donald trump's wall. is that what part of the problem is? they collect donald trump's wall where it has always been a wall that was needed, they vote in favor of it before. >> a couple things, to your first comment about people being killed. if you want to make that argument then gun violence is a crisis, healthcare is a crisis in this country because people die from those things every single day. donald trump's wall because the republican party and the president, this was his number one campaign issue in this is what he wanted. what democrats have never been afraid of saying is we want border security. nancy pelosi and clyburn schumer laid out what they want. let's do a smart wall where convenience and add more patrols and judges and all the things to fix it in a comprehensive way and that is what democrats have supported.

heather: sounds like what donald trump has been talking about. >> the gentleman is saying democratic talking points are not realistic. the facts -- >> what is not realistic? >> we need to build a wall to secure the border and use resources to do other things. it's not realistic to runaround and say we will do something about the wall with open borders but have no solutions. technology that hasn't been proven. >> you don't make sense what you are saying. heather: you have been to the border, you are there, you know what is happening. >> i patrolled in southern arizona. i understand how drugs are coming through. border patrol agents are telling the american people they need help and need a wall. it can't be more clear to them. they have no idea what they are talking about, they are not there on the battlefield. local law enforcement are.

control of space. five years is quite doable. heather: i have to ask about this. we were talking about betsy divorce, a lot of departments dealing with budget cuts. why should more money be put into the space program? >> this is a priority congress sets. the democrats are in control of the house. this is something we will look at. we always make trade-offs what is important and what our priorities are. i said earlier this has unbelievable implications for america to be the space leader, have americans something to rally around. we can all get together on this and infrastructure as a sidebar. it is important for america and congress to come together and sit those priorities into more things in space exploration is important. heather: i remember back in the day being in school everybody would pause and turn on the tv
