[laughter] [applause] >> melissa: hilarious. his speech today coming after he released a video promising to be more respectful of people's personal space, but he did not directly apologize for the alleged actions. yesterday a former senior

advisor tyler clinton saying biden's response didn't go far enough. watch this >> i think he's got the taker's possibility. that's what women are waiting to hear him do. this excuse that societal norms have changed just doesn't wash. that sort of paternal behavior toward women, in a professional setting, has been making women feel uncomfortable for generations. the only societal norm that has changed is that men seem to be taking it seriously when we complain about it now. so the idea that this behavior used to be okay and now it's not just really doesn't wash. >> melissa: and one of biden's accusers in an op-ed in "the washington post" today calling them to accept morris on stability, writing, "joe biden often calls on others to have the courage to speak the truth. i hope we can find it with himself to do the same thing." brother democrat's been railing to his defense, including the wife of a former obama administration economic advisor. she says biden had a very positive impact on our young

children, writing in the atlantic, "it seems irrelevant t that he is touchy-feely with not just women, but men, also. he previously kidded around with them, but he wasn't just physical. he turned and emotionally. no doubt from a character counts. i come up for admire his deviant decency." interesting way to go about freezing that. what do you think? >> matt: i think and making light of it as his speech, this is a vintage joe biden. he is spontaneous. a lot of people view him as charming and funny and witty, and he's going to do that. on a topic like that, it's dangerous. these are people who are making serious allegations. i also think that what laura trump said was interesting this morning on fox. "a lot of people who like to biden or his friends that great thing about it for years. all the sudden -- i don't mean the victims, but other politicians. they are in this feeding frenzy

because he is a big threat. most republicans will talk to you will say, "who do for the most?" and they will say joe biden. he talks like people talk in scranton, really works. >> melissa: told me, is the palooka pylon? >> tomi: of course. i think the women of the democratic party are the ones really don't like waging this war. i've been saying all we can it's open season on men. i think people like women are living this, if not part of it. i think we will see more and more teasers coming out about more men who entered this race. maybe except for mayor. i think this is going to be open season on men just in general. >> melissa: jessica? >> jessica: i don't agree with that at all. i think if you watched kamala harris and elizabeth warren respond to questions about joe biden, it was clear they were pained by this and very uncomfortable. every single candidate in the race has said this is something that is up to him to address in whatever way he sees fit.

i think that joe biden's character is something that is universally renowned in both parties. he has been a friend to republicans for decades as well as to democrats. in terms of the joke he made, i think he was doing his folksy thing which connects with the audience. he did that in the video as well. i understand people being upset that he didn't use the word "sorry" or say "i apologize." he had connected and what he has been for decades and has served him quite well. to your point, matt, saying he shouldn't have done that -- when you look at how donald trump has taken on accusations of real sexual assault -- >> melissa: we can't pipit to whataboutism. >> jessica: is not a private. >> melissa: when you can't bring up, every time every democrat does anything, someone says, "it's okay because of the president." >> jessica: that's not what i was going to say, if i can finish my sentence. the reaction to it, saying that's a mistake when other people have successfully pivoted away from accusations by making

light of it or pushing it aside, that has shown that it's a strategy who that can work for people. >> melissa: you're right, and i apologize. >> jessica: thank you, melissa. >> matt: that's nice to hear, "i apologize." it would be nice if joe biden would start with that. >> jessica: i disagree. >> dagen: he can't do that. again, this is what the new left is going to do to this man who has spent his entire life in service. demand an apology at every turn. at some point, if he doesn't think he did anything wrong -- and maybe he is touchy-feely with men, women, and everyone -- so what if he doesn't apologize, quite frankly? that's what they will demand from him. i want to point out this peggy noonan column. if you get a chance, read it. if biden runs, they will tear him up. the new democratic party is colder, less human, and divisive." she started by saying, "don't do it, joe. don't run for president."

i want to read this. again, this is the party of self. it's not the party of service. "america is not the good guys ie new democrats. "it's crabs in a bear with the one who gets to the top getting yanked down to the bottom. deservedly. your very strength that you enjoyed talking to both sides, that deep in your heart you see no one is deplorable will be your weakness. you aren't enough of a lawyer. you are sweet, you are weak, you are half-daffy, you are meh. that's exactly what this party has become, and it's a shame that he has to face is right now." >> melissa: maybe this makes him less meh. if you apologize and just is himself. if he had been authentically him now through this whole controversy -- "look, i'm not apologizing for this, because this is the way i am. i didn't mean anything by it."

i don't love that is not acknowledging that he made people uncomfortable, and that's not okay. >> matt: that was the problem. that was the problem with the video, i understand what he's trying to do. upon the decision to get out there and address what people a. i just feel like you can't have it both ways. the other thing, not to talk about other politicians, but he was pretty brutal towards trump with the allegations and such. if you're going to stand up there and make those charges against the president, you better be pretty squeaky clean. >> dagen: i want to point out that he standing in front of a union audience. that's why he got laughs, particularly at the beginning of the primary season. union voters in iowa, then onto new hampshire. union voters in nevada. in a very strong backing by the african-american population in the state of south carolina. >> melissa: more on this. in the meantime, the president poking fun at former vice president biden, tweeting and altered version of biden's video response to the allegations. if you haven't seen this yet, here it is.

gotten so much criticism from so many people saying, "what are you doing that you have time to do this question for" all that kind of stuff. the problem for democrats in the situation is that it's sanctimonious, that's a school marm-y place to be. i understand their point, for sure. it is not presidential to retreat something like that. it's not funny. it's not a great look. >> matt: i would say that president trump communicates in a way that breaks the mold for presidents. we have changed forever. that's why joe biden's counter punching on twitter. it's the way it is. it's always going to be. elizabeth warren at that wacky video, drinking a beer. what the attic was that? what is aoc putting together? an ikea shelf, while she is drinking wine? politics has become very

democratized through social media. i would have to be honest with you, as much as the allegations against joe biden -- i think we have to take it credibly. i laughed when i saw the video. i'll be honest, i did. it was clever. and that is the social media age we are in. at times it's disrespectful and sometimes people say, "is that really what you should be doing?" but it made a point. the point was that joe biden is a little hypercritical on this. >> melissa: jessica, was ironic about the whole situation is that president trump made it so that you can be a president and not be what everybody says was presidential. which means the things that killed joe biden in the past, his gaffes and stuff, we are immune to it now. so it seems like he has paved the way for biden to come back in with his own behavior. >> jessica: i don't think he's going to be a getting a thank you from the donald trump. when a reporter asked president trump if he's the right messenger for this, he

said, "yeah, i'm great messenger," and i'm not trying to be -- this is my time to do it. we have 16, 17 women who have credibly accused him of sexual harassment or assault. he has cheated on all of his wives. this is not someone of moral fiber or character that can even get anywhere close to joe biden. when we use the same terms, "allegations," "trump allegations," joe biden, these are such different types of things. i think that's why joe biden couldn't get himself to "i'm sorry" for this. because talking about hugging and kissing the back of a head, not grabbing someone's leg. >> matt: but there were legs grabbed. >> jessica: not jessica leads grabbing of the leg. tell me, do you think when you are rich they lead you anything? grab her by the dash

>> dagen: president trump, who did once call himself "tariff man" insisting he has not changed his push on to secure the southern border. he is now en route to the u.s.-mexico border in california where he will join the homeland security secretary. the president saying a border shutdown is still on the table after warning mexico that it has a year to help stop the flow of migrants and drugs into the u.s., or he will slap tariffs on his cars imported into the u.s. the president today also calling on congress to deal with the migrant crisis. >> congress has to act. they have to get rid of catch and release, chain migration, visa lottery, they have to get rid of the whole asylum system because it doesn't work. frankly, we should get rid of judges. you can't have a court case every time somebody steps their foot on our ground. very important that congress acts. >> dagen: >> dagen: and dhs chi,

about tariffs first, okay, dig and? >> dagen: nope. >> matt: i will say this. from the time donald trump started his campaign, they were reticent republicans about what he was talking about, the language used. go forward two years and i will tell you he is winning this argument because the facts on his side. we have not addressed the problems at our southern border for too many decades, and we are going to have people who try and come into this country illegally than come legally. we have 1 million green cards a year. they are on track of having more people enter illegally. we have an illegal immigration system more than we have a legal immigration system. congress has to act. i don't think this is a partisan issue, i think most americans look at this and say, "most of us like immigration, but we are appalled by what we are seeing and by the inaction." >> melissa: especially that second one. >> dagen: tell me, i'm going to ask you this. because i've been hammering republicans when they controlled the house and the senate about what they didn't do for

president trump on stopping the flow of immigration. particularly starving sanctuary cities of funding, power of the purse in the hands of congress, the republicans didn't do it. >> tomi: i live in california, so how many times you have to deal with tragedy after tragedy being brought on by our sanctuary state policies? it's only getting worse in california. if that's not something the rest of the nation can take a look at it, i don't know what is. but you are exactly right. i am more upset with republicans and democrats, who did nothing when they have the opportunity to do it. now it's a cattle call. notice that we are having 4,000 apprehensions in a single day. march is one of the busiest months in history for people coming across because they know full well that if they come and there is not enough room for them in detention centers, not enough beds. by the way, something the democrats want to cap. democrats want to reduce the number of beds in detention and processing centers. why? because they want to catch and release. they know the fewer beds, the more people into the shadows of this country to have babies. and guess what? they are new illegal immigrants, new americans living in the

shadows. it's disgusting. >> melissa: if you look at what the president has tried to do on this issue, a lot of people, i think, our disappointment don't act that he has backed away from the threat to close the border. it would have caused a lot of chaos. number one, his strategy is to don't like to try and make it impossible for politicians to be politicians, which means to not do anything. he tries to create a situation where these people who won't get off their backsides and do their job, and write legislation and fix a system, can't do that anymore for political gain. both sides, on the immigration issue, have been so guilty of that. we haven't heard democrats mentioned dreamers in so long, republicans pretend like they want to fix the immigration system at the back the president but they haven't acted on it either. he did as a cost to himself lyrically "he's going to close the border, a billion and a half dollars!"

>> dagen: but he smart enough to know, jessica. he did back off, quite frankly, the threat of closing the border immediately. very concerned about the economic impact. >> melissa: because they don't want to do the job. >> dagen: he smart enough to know the difficult economic unrest, you cause unrest in mexico. actually, the migrant problem gets worse if people lose their jobs in the mexican economy collapses. and he's got to run for reelection next year here in the united states. >> jessica: he does, absolutely. but i really struggle to see how anyone could say this was a smart thing for the president to do or in any way a win, just as the government shutdown wasn't a win, or declaring a national emergency. and now he's pushed to do this. yes, people in congress do need to do with the problem. you've heard from jeh johnson now, dick durbin, people on the democratic side are acknowledging there is a crisis in central america. that means not cutting aid

there, in mexico and in the u.s. in the asylum system. when the president is up there saying to get rid of judges, making these broad proclamations and saying, "i'm going to add a 20% tariffs to mexican car's command," and all that, he's not actually taking the reins and saying, "let's talk about with the gang of eight was talking about." >> melissa: you're kind of making my point, though. i'm saying it's not a win for him. trying to get people to act. >> jessica: i'm saying there was nothing smart about him saying he was shot on the board. because now he's going to fit in the 25% tariffs and he has given mexico a year. >> dagen: but in the same breath he praised mexico for what they are doing to stop people from coming over the >> dagen: exactly, he praised them on twitter. i hate to be the trip i have to be the trump whisper explaining that he belis in fulfilling campaign promises to the people who voted for him.

♪ >> melissa: we are awaiting a possible response from congressional democrats after michael cohen's lawyer appealed to them in a last-ditch effort to help cohen stay out of prison. he is expected to begin a 3-year sentence in may. now his attorneys are asking democrat house members to vote for him, and they are dangling the possibility that cohen may provide more fodder for investigations into

president trump. cohen's lawyer's writing, "it is our hope that the authorities would consider this picture of corporation by mr. cohen, verified by house democrats, and the important new evidence he has made available, or could make available, to grant mr. cohen a reduced term. that his teacher portrait incarceration will be substantially postponed." this letter raising new questions about cohen's motivation. to give testimony back in february. at the time, he claimed that he had decided to finally tell the truth. even that testimony was questionable. cohen claimed that he had never asked president trump for a pardon. his attorney, lanny davis, later conceding that cohen did direct his attorney to seek a presidential pardon. davis said the comments were inaccurate but not a lie. house democrats have referred cohen to the doj for potential

perjury charges. dagen, what i love about this is when he was getting ready to testify again, republicans said, "why would you put somebody up there who has lied before? they are going to like again. he's just trying to help himself out in his prison sentence." and democrats said, he wouldn't dare lie again, because the penalty would be so stiff. and there was nothing that democrats are lawmakers could do to reduce his sentence. "he's coming because he finally wants to come clean about someone who is awful." it turns out both things were inaccurate. >> dagen: you also love the expression on my face when i was trying to stifle a laugh. "in front of congress, i'm coming clean! i never asked for or entertained a presidential pardon!" whoops. this is a play to stay out of prison longer, clearly. >> melissa: right. >> dagen: this sentence, at the time he was supposed to show up was delayed by some time because he had have shoulder surgery. let me just check this -- so the

fbi raided his home, his office, and the hotel room that he was living out of at the time. and they never got this information that he has just magically discovered? this is laughable. i love when you read accounts of what he's going to prison, they always mentioned the campaign finance violations. but it's also bank fraud, it's also lying to the bank, false statements, and lying about -- cheating on his taxes. >> matt: the point is this, we have thousands of lawyers at the irs. many of us have been tortured by these lawyers and other things. with this whole mueller investigation came down to, bob mueller knew early in the process there was no collusion. there are some terribly disruptive, dishonest, crooks that were caught up for not paying their taxes. it has nothing to do with having a special counsel. as far as michael cohen is considered, the reason he had to get shoulder surgery was because it's very hard to cross your fingers and put them behind your

back when you're testifying. [laughs] >> jessica: how long have you been working on that one customer [laughter] no one is alleging michael cohen is a good dude. that has never been part of the estimation here. what people wanted from him in congressional democrats wanted from him where the receipts, th. when he lied in 2017, that the president directed him to do that. what he has on this thumb drive, i'm sure there are some committees that will be interested in that. but this is how the writing system works. you get information on somebody else from someone who is unsavory themselves. >> melissa: he didn't say the president directed him to lie, when he got up there and testified he said, "well, he makes it known what he wants. and i understood the code." >> tomi: we know he's a snake. the fact that democrats would still entertain this just shows how badly they want to hurt this president. spew when i'm being told they have to go. secretary of state mike pompeo speaking out after an award for his work at freeing american
