1:02 pm
we are hearing leaks from the mueller team that didn't leave office in 22 months. we are hearing los angeles that barr represented what was in letter and made it look more favorable for the president than it was. >> the fight for president trump's tax returns will also play on capitol hill this week, the irs commissioner is scheduled to testify on tuesday before a wednesday deadline. the chairman of the house ways means committee said last week agency to turn over 6 years worth of trump's personal and business tax returns, on "fox & friends" today gop senator john kennedy criticized democrats for trying to weponized the irs. >> chairman niel says that he needs to see the president's tax returns for policy, he says not politics, he says that he needs to see trump's tax returns so he can evaluate how well the irs is

immigration. ellison barber has more now at the white house, hi, ellison. >> hi, arthel, a lot of back and forth on what exactly comes next when it comes to southern border, it's been confusing at times to follow what the president plans to do next. president trump started the week by starting to shut down the border despite both lawmakers on both sides of the aisle. if méxico does not do more to stop migrants probably impose tariffs on mexican products namely cars within the next year and if that didn't work, possibly close the borders, here white house chief of staff mick mulvaney explained it all on fox news sunday. >> a couple of different things he said this week, we need help right away on migrant crisis, we also have another longer-term issue with méxico on drugs. i think if you go back and look at statement, you know, we need help within the next year on
1:06 pm
drugs. méxico has done more in the last week to help our illegal immigration crisis than nancy pelosi and democrats in the house. >> president trump claims méxico started to do more after he threatened to shut down the southern border despite what the president and other members of his administration are describing as méxico's current progress in helping out when it comes to the situation at the border, president trump says still, all options are on the table. >> i don't mind loazing the border, a lot of these fakeers back there, they say, he will never close the border, i don't want to do it but i'm okay with it. i will do whatever is necessary to stop invasion of our country, that's what it is. border patrol officers with influx of migrants trying to come to the u.s. arthel: thank you very much, ellison barber. eric. eric: along the southern border custom patrol agents are pleading for more resources to handle the surge of illegal immigrants who continue to try to cross into the country. they said they have not to -- have to make many arrests in years. casey steigell live on the border in el paso, texas. hi, casey. >> hey, eric, yeah, this sector where we are in el paso which is pretty large, actually stretches off into parts of new mexico, believe it or not, it's been slammed and in particular with the larger groups of migrants largely from central america as you note showing up and turning themselves in seeking asylum but according to custom and border protection, as of last week more than 70,000 of those apprehensions have been made
1:08 pm
within the last fiscal year '19, the beginning of it. that's compared to 9,000 from the year before, so 70,000 versus 9,000 and that is according to data from u.s. customs and border protection. there has also been uptick in unaccompanied minors, children by themselves, traveling by themselves and may have been taken in custody in large numbers, the agents themselves tell us that right there is probably the toughest to see. listen. >> it's hard not to take that stuff home especially to see kids that are sick, kids by themselves, seen a 2-year-old, seen a 4-year-old by themselves crossing the border with no parents. >> 4-year-olds by themselves, in the meantime over sections of the existing fence or barrier that was put up under the secure fence act are getting replaced with better materials upgraded
1:09 pm
and certain vulnerable spots, you can see the video we shot of that happening, this is not new wall we should point out under president trump, again, infrastructure was already paid for and was already built. let's talk about detention space really quickly because with obviously surge in the number of apprehensions that means you have a surge in detention space as well and they are really tight with that in the el paso sector as well. in fact, overcapacity by about 280% according to dhs, the dhs secretary kristin nielsen toured facilities when he made stop in el paso last week and that was boots on the ground to get the latest update. eric. eric: thanks so much. arthel: u.s. trade negotiators saying they have made significant progress with china and both sides work to hammer out final deal that president trump says will be epic and he says he won't hold a summit with

chinese counterpart xi ginning ping until the deal is done. gillian turner has more from washington. gillian: china and the united states are set to continue those ongoing trade talks behind the scenes this coming week. the president's economic team getting a deal is top of their priority list. >> we have to have a great deal on trade with china. the deal that benefits american farmers, technology and so forth and hopefully a deal that will help china. that deal has to be enforceable, it has to cover all of the areas that are under discussion. >> senior american officials have been talking around the clock with chinese counterparts over the past few days, their top priorities are technology transfers, intellectual property protections, tariffs alternatives, services in agriculture and trade enforcement. the u.s. and china have raised tariffs on hundreds of billions of dollars of import and the u.s. has accused china of unfair

trade practices and stealing america trade secrets. president trump china's critic to when he calls unethical trade practices, though, he too seems now all in on the idea of a deal. >> we very much want to make a deal. we will see what happens. very complex deal, very big deal. one of the biggest deals ever made. maybe one of the biggest deal ever made. it would be great deal for farmers, technology intellectual property theft, everything is covered. >> larry kudlow said friday that negotiators plan to be in touch by phone promising they'll be no let-up in the negotiations. meanwhile the stock market did take notice friday soaring to new record highs based on these trade hopes. in washington, gillian turner fox news. >> all right, gillian, thank you so much. eric. eric: meanwhile back here at home another delay in the summer travel season. american airlines announcing that it's extending

1:18 pm
their own lives. >> let's bring in bob wells, retired navy captain and former national security adviser to vice president dick cheney. what's your take, to meet or not meet? >> i think not meet, i think the president has really done a good job elevating this particular issue. i think if you look at what he's actually doing he's calling attention to border challenges for the homeland security, customs and border patrol, the conditions that the poor people have to live in, finally put méxico right in the center of where the solution needs to be. he has diplomatic discussions ds with president obrador from méxico and has strategy to get to the next step. i think it's a long-term challenge but it's got to be a national security solution. i think the president is leading
1:19 pm
us there. >> so the u.s.-méxico relationship as you well know captain wells is codependent in various way and méxico's inability to manage migration and drug trafficking puts a strain on the relationship, so you start -- you sort of start to touch on it but what leverage should president trump employ that will really pressure méxico to get it together? >> well, i think he's already signaled that he's going to put the border leverage and the car leverage in terms of economic leverage, there's other leverage there which is all part of méxico's national identity, if you're looking at the problems, méxico has been challenged for the last decade to actually deal with the elicit networks that are bringing drugs and women and human trafficking to the united states border. that needs to be resolved in méxico's favor. méxico has resources, needs to have additional capabilities and capacities for law enforcement in order for them to succeed. they've bandage challenged
1:20 pm
through 3 mexican presidents in order to deal with the particularly ungomped areas -- ungoverned areas, so working with méxico more closely, a little bit of imagination like we did possibly with colombia, president trump did it with merida initiative, question have obrador initiative in some place in méxico. not this time to have summit of all the americas, solving it, working with méxico first is a good first step. >> yeah, they are always -- they are always risks involved in whatever you -- whatever route you choose. should completely shutting down the southern border ever be a consideration? >> i don't think so. looking at trade relationship as you mention, arthel, double-edge sword. you can actually do more harm than good. supply chains have been involved with méxico since nafta treaty was passed.
1:21 pm
we just had nafta treaty under discussion inside the congress, so we really need to think about the supply chains and looking at american business and don't impact our own economy, we need to think about that with regard to approach with méxico on the border. i wouldn't do it, i wouldn't recommend, but the president in his own style, in his own way communicating that this is a serious issue we are going to elevate it and turn the lights in the room and see where all the furniture is and that's what he's done with rhetoric and tweets and how he also leads putting the issue right front and center. >> should the u.s. continue giving aid to honduras, el salvador and guatemala? >> i think so. i'm a big supporter of diplomacy and also development to support helping build the partner capacities in nations. i've been part of that in national security in the bush administration, but i think if you're looking at what we are
1:22 pm
trying to do with the development aid which build law enforcement capacity in honduras, guatemala and el salvador, we need to look at the political economy. also recall vice president biden going out and doing the same thing and advocating a billion dollars worth of aid in previous summit attempt with central american countries. it won't be solve but tough situation with the elicit trafficking networks, they are challenging the government authority and certain countries and in particular méxico with their transit passage to our border. arthel: i have to leave it there. we will have you back again and continue this discussion because it's certainly not going away as there really is a crisis that's continuing at our southern border thank you very much, captain. >> thank you, arthel. eric: attorney general william barr will testify, the democrats looking to ramp up pressure for him to release the full mueller

or could it be different than i thought? i wanted to help protect myself. my doctor recommended eliquis. eliquis is proven to treat and help prevent another dvt or pe blood clot... almost 98 percent of patients on eliquis didn't experience another. ...and eliquis has significantly less major bleeding than the standard treatment. eliquis is fda-approved and has both. don't stop eliquis unless your doctor tells you to. eliquis can cause serious and in rare cases fatal bleeding. don't take eliquis if you have an artificial heart valve or abnormal bleeding. if you had a spinal injection while on eliquis call your doctor right away if you have tingling, numbness, or muscle weakness. while taking eliquis, you may bruise more easily... and it may take longer than usual for bleeding to stop. seek immediate medical care for sudden signs of bleeding, like unusual bruising. eliquis may increase your bleeding risk if you take certain medicines. tell your doctor about all planned medical or dental procedures. what's around the corner could be surprising. ask your doctor about eliquis.

general william barr expected to take tough questions on capitol hill this week which schedule today appear before two panels, testimony starting on tuesday, this comes as democrats are demanding the release of the full unredacted mueller report to congress, nothing blacked out, will they get it? mercedes, defense attorney, former prosecutor robert sclapp. he wants everything, nothing unredacted and if they don't get them they will subpoena them, will they get it? >> i don't think so. as of right now there's no judicial subpoena present that would require the grand jury minutes to be turned over. the grand jury is the most important aspect of it. it is the very basic principles of the criminal justice system and it is protected and private, you are given immunity, cooperating witnesses, you do not turn it over and case law supports that a recent district
1:31 pm
court, washington, d.c.'s court of appeals case state we don't turn it over unless it was judicial proceeding and the only thing would be impeachment proceeding. eric: mercedes, look, you're the president of the united states and you should see everything. >> well, it's interesting, there is that counterargument but frankly you're exactly right about that, it is true, there's so much support and even with the constitutional challenge that is have come in, there's so much support to allow those redactions to take place. the guaranty that you give the grand jurors, they have avowed to keep this obviously confidential, prosecutors involved in the process are also required to keep it confidential, stream of people that have to keep it confidential and there isn't any case that i know of where you have been required to release grand jury information. >> right, the big distinction between the star material and mueller report was that ken star
1:32 pm
was independent counsel. the laws are different. require him to turn it over. mueller not the case. he's special counsel for the department of justice, he is governed by their rules and their laws. >> the laws change, the laws change but ken star was independent counsel, he could report directly to congress. that's not what the law is. now the law is that the independent counsel actually reports to the department of justice which would be the attorney general, which is william barr, so very different laws in effect. a lot of people are making that mistake, they are conflating the two. it's specific law that's changed. >> you know why it's changed, critics are going say that they are trying to put the fix in. >> the laws changed because of what we are talking about, information that needs to be redacted. aside from grand jury, there's also national implications which could combo play as well.
1:33 pm
>> no one wants sources or methods that could hurt the country to get out. you know what they're going to say, you can't have black-out pages, whether or not they -- let me give you sound bite by adam schiff saying that classified material can come out, here is what the congressman had to say. >> well, look, if there are classified portions to have report, if there's classified annex, for example, that may be close fold. there may be parts that can be declassified. eric: what about declassified? >> listen, the report is going to give enough ammunition for people to make determinations, we would hope not assumptions but ask william barr specific more questions. this is why they are elected aspects unredacted. >> declassified or lead to some sort of impeachment proceeding
1:34 pm
which would potentially require the grand jury. eric: what about the origins of the whole case, devin nunes announced he's giving 8 criminal referrals to the attorney general in dealing with the origins of how this whole thing started, talking about clinton, dnc, fisa material, can barr address any of that, some of that is being to ig, do you expect that to come up at all? >> that's a great question. eric: investigating them. >> that's a great question. anything that's talking about the current or future proceeding should not be allowed to be discussed in that form. separate and apart from this type of fact-finding that they will do with william barr testifying because it has to be independent and has to be done and frankly whenever there's been challenges, challenges like that with investigations that they they want to speak to prosecutors, all of that secrecy to preserve that investigation. you can't start divulge the
1:35 pm
information that can compromise. >> we know based upon cohen's testimony that there's southern district investigation. there's no secret. they need to let that situation play out before they can begin asking questions very pointed questions that could potentially affect the investigation. >> wouldn't it be great that defense attorneys, both of us could go in and say prosecutor, we want to see everything that you have, tell us what witnesses you have, we don't have the luxury, there isn't a vehicle by which you can get during the course of investigation. we are we are finally, one of the issues that has been supported, fox news reported there are about 2 dozen sealed indictments in the district court in washington, d.c. do you know anything about what that is? it may not be something else, do we have any that mueller shifted this off? we need -- >> that's the beauty of the grand jury. we are not going -- you are not going to find anything about it until they unseal.

a say in the meantime and are all americans okay with this? >> well, i think we've already seen in public opinion polling that most americans will prefer that congressman and women are focusing on the issues that really impact them, health care, immigration, taxes and that's why you have not only the white house but also lawmakers on capitol hill including some democrats who have said that we shouldn't be focusing and shouldn't be focusing on president instead of govern, this is what democrats are saying, at the same time you have significant leaders within their party wanting to pursue changes like chasing the president's tax returns and investigating his financial holdings and campaign -- arthel: you know there are valid reasons for that too, it's not just political. >> there's still looming questions about why president trump doesn't want his tax returns to be made public that are valid and i do think that
