heather: welcome back, half past the top of the hour, top headlines for you this morning, at least 8 people are dead including young children of -- as tornadoes and storms hit the south, more wind and heavy rain expected in the northeast today white house now says it is thoroughly reviewing president trump's plan to send detained illegal immigrants to sanctuary city, democrats call the idea illegal and political stunt and today is the 123rd boston marathon, expected to rain but that won't stop more than 30,000 people from competing, runners for more than 100 countries will hit the pavement along several people that were injured in 2013 marathon bombing. by the way, 7-time champ johnson

1:32 am
don't forget about this, the redacted version of the mueller report could be made public any day now, garrett tenney has more on the operation growing in washington. >> everyone in washington is anxiously awaiting the release of mueller report but not surprising for very different reasons, what many democrats are hoping for any damaging information with special council on president trump, attorney general william barr said in bottom line findings that mueller did not determine whether president obstructed justice but based on mueller's report, barr said there's not enough evidence to prove it. that explanation on its own is not enough for democrats including senator ben cardin. >> i think mr. mueller is looking at criminal beyond all reasonable doubt, let's take a look at source of documents, he did say there was clear evidence in regard to obstruction of justice.
1:33 am
the past week we learned the attorney general is very concerned by some of what he has seen to investigate how the probe began, on sunday morning futures senator lindsey graham defending barr's comments this week that there was spying on the trump campaign. >> by definition, the foreign intelligence surveillance that allows our government to silent people we think working that are working with foreign government, the question was was there any legitimate reason to believe that. >> the justice department inspector is wrapping investigation as to possibly surveillance abuse to trump campaign and that report expected to be complete in may or june. in washington i'm garrett tenney, fox news. heather: waiting for a lot of stuff. well, chris christie gives legal lesson in campaign spying, former governor of new jersey getting fired up after democratic chicago mayor rahm emmanuel played the surveillance
1:34 am
of 2016 campaign. >> there was a proof by the court -- >> what do you call that? heather: well, christie went onto explain that there's a difference between legal spying and illegal spying, the discussion spurred by attorney general's admission that he's looking into the issue. the same democrats who pushed those policies are slamming the idea. >> it's illegal and it's immoral, it's unethical, it's sophomoric and petulent and par for the course. heather: why do democrats refuse to standby their own policies, here to debate it mustafa and
1:35 am
republican strategist kimberly, thank you so much for joining us, we appreciate it. >> good morning. heather: mustafa, i will start with you, sanctuary cities counties and state, sanctuary for illegal immigrants so why don't you want them there? >> well, i think the problem is with the department of homeland security. a number of officials have resigned, some of them don't want to break the law and the president offered them if somehow they were prosecuted. the president of the united states offering someone to pardon for breaking the law. you cannot take people that ask for asylum hearing and bus them to a different part of the united states, when they have a hearing they would not be able to make the hearing, the president of the united states asking people to break the law and when they don't, they either resign or he fires them in
1:36 am
homeland security and that's exactly what happened. heather: it's interesting you're making the argument, a lot of people are breaking the law to begin with and -- >> asylum is an international and united states law, they're not illegal, they're asking for asylum, it's legal process. heather: kimberly. >> this is when we understand liberal logic, it's harder to understand. they're upset because president trump's administration proposed the idea of redirecting the caravans to sanctuary cities where they'll be safe and have lots of freebies by taxpayer dollars and this further proves the point that no matter what trump does it will not receive bipartisan support. nancy pelosi of all people made a comment saying the children of immigrants are being put in this to perpetuate and dehumanize immigrants when it was her not too long ago, recipients as government shutdown approach.
1:37 am
please understand the people that treat children with immigrants the worst are their parents themselves, from those that are being created not out of love but in the sole purpose of being anchor babies and forced to make track from cities like guatemala without food or water. imagine your mom taking you on a hike with her, it's a crime. heather: let me ask mustafa about this, you did bring up asylum, part of the problem is some definitions are changing and people are trying to seek asylum not solely because they fear for their life, that's why they are supposed to seek asylum not for economic purposes but i want to talk about what lindsey graham said, we need to change loopholes that involve children and bringing children here and people think if they do that they can stay. mustafa.
1:38 am
>> asylum seekers are people who are fleeing violence in their country and -- and the process, they get a hearing and they get to plea their case and either we send them back after the hearing or they get to stay if they have a valid claim. if you then just take people in and ship them to a different part of the country where they can't come back to hearing then they become illegal. president trump is actually trying to create more illegal people in the country than not and as far as people bringing their kids in, imagine, put yourself in shoes of a mother that is fleeing violence enough to be able to daughters or sons border, try to do this and the more we shut down legal ports of entry which is what president trump has done, the more illegal immigration. the president is looking at this as political issue not humanitarian issue, putting kids in cages is not american values. heather: the previous administration did as well.
1:39 am
>> you keep saying that but it's not true. heather: that is true. >> you have to look at facts and not alternative facts. heather: but that is true because we did speak with border chief under the obama administration and he said it himself that did not happen, the issues were prevalent during the obama administration as well. >> the issues were but not putting kids in cages. nobody remembers kids in cages during the obama administration. >> there are pictures in 2014 where that happened. look, if these officials in sanctuary cities don't want caravans redirected their way, then perhaps they don't actually want these individuals in their town. like any democratic talking point it's great until it actually happens. heather: all right, kimberly, mustafa, thank you for joining us, we will see what happens. >> thank you. heather: time now 20 minutes until the top of the hour, under fire for putting stickers on

heather: welcome back, the patriotic display has been called aggressive, since when date patriotism become a bad thing, peter blake councilman in laguna beach, california and joins me now with this, thank you so much for joining us this morning. >> morning, heather, how are you doing? heather: they look great to me, what is the issue that people apparently seem to have? >> well, i happen to think they look really beautiful. local activists h that's are trying to frame the debate around this american flag on the
1:44 am
car. it started out that they didn't like the black and white color, so, you know, when asked what was wrong with black and white police car they felt it looked aggressive, looked militaristic and wasn't friendly and then that debate changed to the flag and all of a sudden they felt that the flag was going to intimidate european visitors or immigrants and in some way was sending the wrong signal having the flag on a government car driven by government employees of the united states, somehow. >> another was going to create the wrong message. heather: yeah, about 23,000 residents there in laguna beach, about 50 miles southeast of los angeles, let's take a look at some quotes, this one is from one resident there who said we have such an amazing community of artists here and i thought the esthetic didn't really represent our community, it feels very aggressive. and then here is laguna beach police corporal who says every
1:45 am
time i came to a stop sign, every time i came to red light somebody is telling me the car looks great, we look forward to keeping them the way they are. so the outrage that you're hearing right now the minority or the majority there in laguna beach, what do you think? >> that's a vocal minority of left-over hippies that have been running this community since 1970, what you hear from the residents, they love the car and, you know, i -- i don't want to in any way vilify the artists that made the comment about the car not looking like something from artistic community. you know, i can appreciate thoughts and i can appreciate concerns, in the community if given enough time this could take 2 years while we figure out whether we want bunnies and canyons on police cars or
1:46 am
dolphins and oceans on police cars, the fact that we have the flag, the fact that we have a black and white car, the fact that we are able to make a decision in relatively short amount of time and get our police back on the road in a car that appears to be aggressive enough to deter crime is a miracle and i'm happy for them, looking forward to tuesday night where we can finally put this to bed, the latest california issue that we are having. california issue. heather: the flag has been approved for 7 out of the 11 squad cars, you mentioned tuesday night, they'll be another vote and maybe images will come down and off the cars? >> well, we are being asked in city council to allow the public to make comments regarding the flag which, you know, a misunderstanding, the council had originally pretty much approved 2 different flag
1:47 am
version. one was a very light and the other borter-flag version, as far as i'm concerned to allow the chief of police who we trust of the safety of the community to determine which one of those she wanted. when they went to print, the other image which was a more abstract version of the flag or the colors turned pink and light blue and it wasn't really fitting for police car. she made the obvious choice and chose the more bolder colors, we backed her up and then outrage among -- there's 300 people in this commit 'who i will call left-wing extremists that decided they did not want the car on their car and force it back to vote again and by law we have to give them the amount of time for public comment and that's what we are doing. heather: all right. >> the opportunity to come out and comment publicly in front of the council so we can remake the decision. heather: peter, thank you so much for joining us, please let us know what happens, it is a
