all the subpoenas from the house democrats. in particular and first, one targeting the former white house counsel, don mcgahn. he's mentioned more than any other administration official in the special counsel robert mueller's 450-page or so report on the russia investigation. >> the subpoena is ridiculous. we have been -- i have been the most transparent president and administration in the history of our country by far. >> shepard: president trump told "the washington post" there's no reason to go any further in allowing his aides to testify before congressional committees because it's very partisan. the house judiciary chairman, jerry nadler of new york, says the president doesn't have the power to stop mcgahn from testifying in front of lawmakers. nadler saying it would be one more act of obstruction from the white house. the way to stop the testimony would be for the president to

exert executive privilege over the conversations. under the law, he can't. that ship sailed long ago. when the president allowed his later to testify before mueller's team, that was a waive of executive privilege. he can't unwaive it now. legal analysts say the law is clear. so why the fight? well, here's the reality. it's one thing to have words somewhere in a 450-page document that the president told his lawyer to fire the special counsel and directed him to lie about it. it's quite another to have mcgahn say on national television in a live hearing. the president directed me to fire the special counsel but i wouldn't. later the president directed me to lie about it to the american people, but i didn't. as a former television producer that is likely not the president's desired after program on 10 different tv channels at the same time.

and there's more. this battle could set up other legal show downs as house democrats step up their investigations to president trump after the mueller report's revelations. john roberts is live out in the yard. hello, john. >> good afternoon to you. the argument that the chairman of the house judicialry committee gerald nadler is all he wants to talk to don mcgahn about is things that retalked to robert mueller about, things included in the mueller report, things that the white house did not claim executive privilege on. gerald nadler saying the moment for the white house to assert some privilege to prevent this testimony from being heard has since passed. the white house is concerned that if mcgahn gets before nadler's committee, he will say those things in a public forum and also the mueller report might just be the jumping off point for questions to mcgahn. so the white house is preparing a case that may wind up in court to keep mcgahn away from the committee. i asked the president about that on his way to atlanta this

morning. >> we're fighting off the subpoenas. these aren't like impartial people. the democrats are trying to win 2020. they're not going to win with the people that i see and they're not going to win against me. the only way they can luck out is by constantly going after me on nonsense. >> the president pointing out during that conversation that we had on the south lawn that he allowed robert mueller to interview anybody from the administration that he wanted to with the exception of the president, of course, that mueller looked at this for two years and now the democrats want to relitigate it all over again. those through a very partisan lens. shep? >> shepard: john, at the opioid event the president attended in atlanta, he talked about the southern border. >> yeah. the president has linked border security with the opioid epidemic. there's a natural connection there. he pointed out 418,000 people have crossed the border or

apprehended crossing the border illegally since the fiscal year began october 1. the president also weighing in on what the mexicans are calling the mother of all caravans coming up from honduras. the president tweeting a caravan of 20,000 started up through mexico. it's been reduced in size but still coming. mexico must apprehend the remainder or we'll be forced to close that section of the border and call up the military, the coyotes and cartels have weapons. again, as i pointed out, at that opioid summit, the president linking the drug problem to the need for better security and immigration reform. listen here. >> congress must also act to fix, however, our horrible obsolete, weak, pathetic immigration laws. we could solve the entire

problem -- i say 45 minutes but it could go quicker than that. let's bring it down to 15 minutes. if the democrats would agree to do certain basic common-sense things. >> the president also linked the border crisis to the census and the proposed reinclusion of a citizenship question on the census. the president tweeting -- >> and to bring things full circle because we like to do that here in our reporting, this brings us back to the issue of subpoenas. the house oversight and reform committee headed by elijah cummings subpoenaed john gore, from the department of justice, wanting to depose him on the need for including a citizenship question on the 2020 census. in a letter the department of justice said that john gore is not going to appear before the committee unless and until a

department of justice attorney is allowed to be in the room with him just in case there's questions that get to executive privilege or other executive items that the department of justice does not want him to talk about. the oversight committee has refused to do that. as there was with carl kline tuesday, which was yesterday, there's a standoff now over the subpoena of john gore. the mother of all subpoenas, the one of don mcgahn yet to be adjudicated. shep? >> shepard: john, thanks. there's no obama bump for any 2020 candidate, not now. our correspondent mike emanuel's reporting quoting a source that former president obama will not immediately endorse his friend and vice president of eight years, joe biden, once he enters the race tomorrow we're told. mike reports the source says president obama might not endorse anybody during the primaries. it would be true to form. he didn't endorse hillary clinton in the last campaign. she got the nod from the former president after she already

clinched the nomination. he was the president at the time, not former. anyway, our senior political correspondent mike emanuel is in d.c. mike? >> long-time senior adviser eric schultz told fox that president obama wants to help democrats win. that's why he's been happy to speak privately with candidates, seeking his guidance on the best way to lead the country. joe biden was at the president's side for eight years and there for major decisions. take a listen to how biden described himself recently. >> the progressive left should be welcome. we should have a debate about these things. it's not a bad thing. the idea of all of a sudden the democratic party woke up and everybody asked what kind of democrat -- i'm and obama biden democrat. i'm proud of it. >> julian castro served in the obama administration as hud secretary from 2014-17. biden is not the only 2020 candidate with obama ties. the vice president would outrank

the head secretary. a former dnc chair and fox news contributor praised the obamas for letting it play out. >> the bombs are the hottest ticket on the democratic side and independents as well. i'm glad they're holding their powder. in 2018, they played a very important role in helping to expand the electorate. >> heading to a very crowded democratic field, an endorsement from the obamas would help, shep. >> shepard: what if other past presidents have done in this situation? >> shep, there's been several ways to approach it. jimmy carter endorsed his former vice president, walter mondale in august 1983. so that was before the primaries and more than a year before the 1984 presidential election against president reagan. as for reagan, he did not endorse his vice president, george bush, until may 1988. that was well into the primaries of that campaign cycle. mr. bush had been his vice president for two terms.

>> shepard: breaking news in california. police say a man drove into a crowd and injured at least eight people including a 13-year-old. the fbi is now involved in the investigation. now for the first time we have video of the suspect after the crash, during the arrest, shouting, "praise the lord jesus." >> shepard: it's obviously difficult to hear from the camera. witnesses on scene confirmed the quote. this happened in sunnyvale, california just outside of san jose. about 35 miles south of san francisco. cops there arrested the suspect

and say they're still looking for all possible motives. a public safety official says they're considering the crash an attack. because it looks to them like the driver did not try to brake at all and may have intentionally hit the people. once witness tells the "mercury news" that he was stopped at a red light when he saw the driver going passed them at 60 miles an hour. feet were straight up, flipped around and one person landed in front of my car. the witness said the driver eventually crashed into a tree and seemed dazed when he got out. local reporting now, jesse garry is on scene, a reporter for ktvu, fox 2 for the bay area reporting from the crash scene. to you now. >> shepard, good afternoon.

local and federal investigators trying to determine the cause of the crash, which witnesses say appears to be intentional. the impact can be seen on the tree and this sign for a strip mall from behind me. now to the video that shepard just referenced. this is new cell phone video. the suspect handcuffed sitting on the ground as police officers take him into custody. he can be heard phrasing jesus and the prophet elijah. he said "thank you, jesus." "thank you, elijah." i talked to the woman that shot the video. >> not just sunnyvale, it was a beautiful day, a hot day. people were just out doing their normal thing. my girlfriend works down the street. she works at wells fargo.

it's concerning me, what if that would have been her? >> the accident is being investigated as a possible hate crime. that happened around 6:30 pacific time tuesday night. unseasonally warm here in the bay area. many people were out walking, biking, et cetera. the suspect's car was traveling northbound on el camino real at the intersection of south sunnyvale avenue. the driver plowed into a group of eight people at the northeast corner. the youngest victim, 13 years old. many of the victims suffering serious injuries. the sunnyvale police department will have a briefing at 3:00 p.m. pacific time. however, they're not doing it in person. they say they're going to record the information and make it available. additionally, police are right now searching the apartment of the suspect. we'll have more on that later today. live in sunnyvale, california,

>> shepard: fox urgent. looks like the number of measles cases in america will smash records. health officials in 60 new york city are reporting 60 new cases since last week. that would make this the worst year nor measles in america since 1994. this is just april. federal officials updated the

count monday. the cdc reports that its reviewing the latest numbers. the electronic cigarettes that you may be using to quit smoking may be contaminated with bacterial and fungal toxins. that's according to a study out of harvard. researchers analyzed 7,500 e-cig products which have a reputation of being safer than regular sill rests. a quarter of the toxins had e. coli and chlamydia. more than 80% had a contaminant found in fungus, which could lead to asthma and other lung problems. scientists say the fruit flavored e-cigs could have more toxins in them. alicia acuna is live with more. >> harvard researchers say they specifically tested e-cigarette cartridges and liquids. not pens, pods or mods.

they found fungus that can create in addition to the health problems you mentioned other problems like air flow obstruction, respiratory symptoms, reduced lung function and of course asthma. they looked at products from the top ten selling brands in the u.s. in 2013. notably a harvard spokesperson said one of the current top makers of electronic cigarettes, juul didn't have reportings because they didn't exist at the time. there's a growing concern over adverse affects in respiratory users. according to the centers for disease control, e-cigarette use is on the rise, especially in teens. the researchers say more studies need to be done in part because these same toxins can be found in cotton, which is important because the wicks that are used in a lot of these e-cigarettes are made of cotton. shep? >> shepard: there's push back on

this, yeah? >> yeah, criticism that specific brands were tested had not been listed for the public. the head of the tobacco, vapor electronic cigarette association said there's no standards that exist. he said if there were standards, we would be better off. the american vaping association says with many adult smokers believing that vaping could be as dangerous as cigarettes, it's disgraceful to release this study without a comparison to cigarettes. there's studies that show that e-cigarettes are not as dangerous as the traditional ones. >> shepard: alicia acuna live. thank you. the boy thrown off a balcony at mall of america has zero brain damage. police say the 5-year-old fell

40 feet after a stranger walked by, picked him up and threw him. the pastor said the child has no spinal cord or nerve damage and doctors compared his injury to those from a bike fall. family members have not confirmed the pastor's comment. they have asked for privacy. prosecutors say the suspect was looking for somebody to kill. that's a quote. they say the man was angry because women rejected him. the suspect is facing an attempted murder charge. more than 12,000 boy scouts, 12,000, may have been victims of sexual abuse over the past 70 years. that's according to courtroom testimony from a child abuse expert. she said she spent years reviewing how the organization handles sexual abuse accusations and she examined documents known as the perversion files. her research shows that between the year 1944 and 2016 more than

7,800 boy scott volunteers faced accusations of sexual abuse there were 12,254 victims during that time. the boy scouts of america released a statement that reads -- >> shepard: trace gallagher reporting live from the west coast news hub. trace? >> we've known about the perversion files for nine years. it's basically a database of ineligible volunteers. experts say the most shocking part of the perversion feels is they reveal the extend to which the boy scout concealed perversion within ranks. the allegation is the names never went public so the

community at large was never alerted. here's an attorney for some of the victims. watch. >> it shouldn't be us disclosing the names. it should be the institutions, the boy scouts. they should be up here issuing the names of their leaders. >> the accusation is significant considering fbi research shows that unchecked, each abuser has more than 100 victims over a lifetime of offense, which would be many thousands of more victims. shep? >> shepard: anything else from the boy scouts on this, trace? >> the organization contends that many of the names in the so-called perversion files are publicly available if you dig through police records. boy scouts of america released a further statement quoting here.

>> the boy scouts have paid out tens of millions in damages and still facing hundreds more lawsuits. its insurance companies are threatening to stop covering the suits so the boy scouts are talking about filing chapter 11 bankruptcy, which could halt exiting and future litigation. the lawyers for the victims say a bankruptcy filing would have a chilling effect on a exposing more predators. usa gymnastics and certain catholic diocese have used bankruptcy protection to stop new lawsuits, shep. >> shepard: thanks, trace. a policy that keeps asylum seekers in mexico while they wait for immigration hearings in america is facing another test today. a panel of federal judges hearing arguments from both sides. we'll get a live report from the courthouse next. hi i'm joan lunden.

headlines. a u.s. marine accused of busting into an embassy in madrid and beating officials inside. the so-called kissing bug on the move in the united states. there it is. one little girl has felt its bite. what you should do to protect yourself. and if you think you see a space ship, speak up. the navy coming up with a plan for pilots to report ufos. all of those stories in the next 24 minutes, a federal judge in oregon says he's going to block president trump's new abortion rule, which would strip funding from organizations that perform abortions or refer women to places where they can get the procedure. the judge, an obama appointee said it's a hand-fisted approach to health policy. the judge says he will grant a preliminary injunction to stop

the rule from taking effect next month. planned parenthood, the american medical coalition sued to block the president's abortion rule. one of president trump's immigration policies is back in court today. a panel of three federal judges hearing arguments about whether the united states can force central americans asking for asylum to stay in mexico while that it wait for hearings in the u.s. the policies started in january. a group of central americans sued the ninth circuit court of appeals which has stopped other trump policies is hearing the case. analysts say this might have a chance to survive. claudia cowan reporting live. >> shepard, that's right. it's a temporary win. based on the tenor of today's arguments, it may not last. the trump administration got this liberal court to put a stay

on a lower court ruling that would have essentially ended this program altogether. that judge ruled the stay in mexico program violated the u.s. law because he says the government doesn't have the authority to keep asylum seekers south of the border. the administration appealed and sure enough, the ninth circuit agreed to keep the policy in place while they gave the matter further review. the hearings lasted an hour. it was spirited and ended with the law for the aclu cautiously optimistic of a favorable outcome after two of three judges expressed concerns with the government's argument. now we wait. shep? >> shepard: historically this court is no friend to the president. >> you can say that. the judges here have argued against his travel ban and in support of sanctuary cities and more than any other court, the

ninth circuit does represent the judicial resistance to many of the president's policies. >> they have struck down repeatedly numerous trump administration initiatives for the environment and so on. i don't think the trump's criticism of the ninth circuit will get to change it until he can appoint more judges and balance out the ideology. >> if the three-judge panel argues against the administration and decides to lift this temporary stay, the department of justice has promised to appeal to the u.s. supreme court. >> shepard: claudia cowan live. the u.s. navy is preparing new guidelines for pilots on how to report sightings of ufos. the navy reports that there's been strange sightings in recent years but no confirmed with encounters from somebody from another place.

the navy is updating its process so investigators can look into each individual report. jennifer griffin is live with more. hi, jen. >> the pentagon closed their office that dealt with ufo sightings in 2012 when congress stopped funding it. now after a series of unusual encounters by navy jets like this one in 2017 showing an f-18 super hornet encountering a ufo, the navy has to figure out a way to record the events in case they're some kind of advanced aircraft sent by the russians or chinese to spy on the u.s. military. the u.s. navy and pentagon are trying to trying trying to de-stigmatizing of

reporting ufos. a new message to the fleet to detail reporting is in draft and response from members as well as aviators that reported hazards to safety. for many years it was considered a career ender to report the unexplained encounters, so many military personnel down played them, shep. >> shepard: is there anything to the timing of this? >> since 2014, there's been an increasing number of encounters. most of them are suspected drones. after the 2017 f-18 incident and the release of this video showing pilot's reaction to the strange aerial encounter, the pentagon wanted to study the recent phenomenal at the urging of several u.s. senators that set aside $25 million for the new office.
