the democrats on the house judiciary committee are in negotiations with special counsel mueller report to come and testify and they aim to have the hearing take place may 15, 10 days from now and this morning david sicily was on the committee say it representative from robert mueller agreed to testify, but he later walked back those comments saying nothing has been agreed to. here he is with chris wallace. >> we think the american people have a right to hear from him and tell the day comes we never have an absolute guarantee. the white house indicated they would not interfere with his attempts to testify and we hope that won't change for mac this morning another front a step to get tougher on securing the border. mark morgan is his pick to lead i.c.e. seine i'm pleased to inform all those that will leave in a immigration policy that mark morgan will join the trump

to be honest his policies to rebuild this economy have entered us into a tremendous prosperity cycle and i don't see any end right now. you could say i'm being partisan. i am not, but dad and fax support that and i think americans love it. i think americans love it, economic approval for the president is very high. leland: when cory booker in the report was taking aim at the president saying this is not a recovery across the board and really it's obama's policies. there was light which you probably want to retreat that you are on the air, but you had some thoughts. >> the evidence shows if you look at the payroll numbers, the blowout number of 263,000 at 3.6% unemployment with no inflation, let's go below that. on the wage front rising 3.2% overall. at the bottom quarter

4.4% wage increase. of the top quarter three and a half percent. leland: you are saying the bottom quarter feels it more? >> well, first of all both are good at it and rising tide, but the point i'm making is it the blue-collar people that have the fastest job expansion and blue-collar people that have had the best wage growth. what mr. booker and others are saying is not true factually. leland: you make the point you don't see how this can and. warren brough-- warren buffett we can agree is probably one of the greatest investors. this is what he had to say in an interview 2-year old network cnbc, no economic textbook i know was written in the first couple thousand years discussed even a possibility you could have this sort of situation continue and have all of the variables stay more or less the same. he continues, so i think it will change.

ima free trade guy in the president's carrots, however, have been useful in negotiating. we believe china needs to deal more than we do. there is always costs with these tariff stories. they are minor costs in the usa. farmers and we help them out. what he is suggesting here is we have these talks this week, the vice premier is coming and they will be negotiating and we will probably be involved in this. we will see how it clarifies. leland: do you worry there is not a deal? >> the president as i think if he issued a warning that we have bent over backwards earlier and we suspended the 25% tariff to 10 and then we left it there. that may not be forever. if the talks don't work out. we've made great progress structural issues of enforcement issues remain. i went to be careful here. we have made great

testified? >> absolutely. i think there is some dick's scrap it and see about the way that attorney general william barr portrayed the more report when it first came out so it will be interesting to ask special counsel mueller with the differences between what he thought the reports should be in the one given by bill barr. molly: what do you think of nancy polizzi's accusation that a crime was committed by the attorney general? >> yeah, well, she said she thought his testimony was untruthful and that's arguably the case, so we will have to wait and see. molly: moving things forward, let's talk about this very wide field of democrats running for president. you have been quoted as saying you are essentially with joe biden at this point and that he's a friend. is his victory in the midwest, those areas in

the rust belt he has proven to be popular packing union halls. >> absolutely. i think joe biden is more of a blue-collar candidate than we have in the field. i think we need to win pennsylvania, michigan, ohio and wisconsin. i think joe biden gives us the best chance to put a democrat in the white house. molly: michigan would be big, but mr. biden now under attack. he's running as a candidate and will catch some flak, but among such broody giuliani tweeting out a link to the "new york times" article regarding biden's son's business dealings in the ukraine writing to appear to be ignored and should be investigated quickly and expeditiously. this relates to biden's son, hunter. a lucrative-- after reporting it they can $50000 a month from a ukrainian energy company

during the obama administration. biden was the vice president. you is using loan guarantees in the country and the successful effort to get the-- your thoughts on conflict of interest here? >> well, i have to look at it. is the first we have heard it. i'm not sure what year that was. certainly, whenever we have americans that are active in other countries and obviously there is a position of power there in the vice president's office, joe biden occupied europe we will take a look at it, but by all means i think until there is something unsavory that is disclosed i think joe is an honorable man. molly: a lot of looking at ukraine lately overall. let's talk about jobs, 253,000 jobs last month, the lowest unemployment in 50 years in the president crowing about

this as well as republicans. we are in a campaign season and we see sort of a course for democrats saying they see the numbers, but think the average working person doesn't see the benefits. your thoughts on that? >> well, it's below 4% unemployment and that's pretty darn good. i would say, though, that i so what warren buffett was getting at, things will change. the american people will go to the polls in the fall 2020 and so whenever economy is prevailing at that time, that's the one president trump will be judged by, so i agree with mr. buffett. things will change and we will see whether the stimulus the president instituted for the tax cuts mostly high income people will carry the day in september, october, november 2020.

the host doric kentucky derby upset. tweeting the best horse did not win the kentucky derby. from louisville kentucky with more as the controversy unfolds. reporter: molly, president trump one of many americans who feel strongly about the unprecedented decision here the kentucky derby at churchill downs yesterday. for about 20 minutes maximum-security was declared the victor of the 2019 kentucky derby. of video shows horse crossing the finish line well ahead of his competitors, but confusion and even a poor as to jockeys filed objections saying maximum-security broke the rules and basically cut them off fixed spectators and participants held their breath for the decision and for the first time in kentucky derby history the winning horse was disqualified.

maximum-security out and country has declared the new victor. one co-owner of maximum-security call this decision the most egregious in the history of horseracing. a trainer of countryhouse said it's bittersweet that he would preferred a clean finish and people online including the president very opinionated about this historic reversal with one tweet quote i'm amazed at the reaction to this peer to this happens all the time and horseracing. the stewards did the right thing to do there are rules and consequences and if you break the rules just because you lost money doesn't make it wrong. another person tweeted: shame on you guys. you ruined the kentucky derby like that incidental contact your view should be ashamed of yourself. yesterday the payouts were put on hold until the final decision was made so it wasn't like anyone cashed in on maximum-security and walked out. $41 million in total bets, $6 million on the original winner

guilders saturday pure democrats in congress aren't waiting until 2020 as they have introduced a medicare for all bill in the house with hearings this week. we bring in general men from oklahoma congressman tom call, you are the ranking member on the committee that had these hearings to do you get a feeling that for democrats this is more about the optics and politics, this thing may pass the house but it certainly won't pass the senate and the president won't sign it. >> it's very much about the optics. it's a great sounding phrase, but the reality is it's a bad idea, 32 trillion-dollar minimum price tag and its one-size-fits-all, 170 million americans that have healthcare will throw them off their plan. 70, 80%-- leland: do you think the name is fair? would be medicare for all? most think medicare advantage for their parents, grandparents. >> everyone that has

medicare advantage would lose it and that's 22 million people in addition to people on private plans. it's really medicare 49. the medicare system is going bankrupt or maybe we should fix the one we have. leland: details. this is important, you pull medicare for all and depending how you ask the question if you say are you for medicare for all the polls pretty well. are republicans doing a good enough job explaining the issues and the costs? >> i think we will have an opportunity to do that with the campaign. we have democratic candidates and their and your prints all over this thing so i think it will be a topic for discussion and the hearings are helpful in that way. it's kind of a stacked hearing with the rules committee having a nine-four democratic advantage, but i think our witnesses made the point and the more we talk about it the more people understand the price that you would not have an option and you lose your healthcare. your grandparents would lose my think we win the debate.

leland: you didn't win the healthcare debate in 2018. we will put up a poll at how voters looked at healthcare. it was the number one or number two issuing 2018. healthcare top issue 40% of democrats, 31% of independent voters, 31%. do you worry that if you are against medicare for all and not your own plan the same thing happens in 2022? >> i do. to be fair we passed a plan through the house within one vote in the senate but there needs to be a signature republican plan that we produce and the president-- leland: is a reasonable for voters to doubt republicans? every republican in 2016 ran on repeal and replace. you had house, the senate and the white house. doesn't get better than that, but you still couldn't get it across the finish line.

should voters be reasonably skeptical when republicans talk about healthcare? >> we defeated out of the house and we failed by one vote in the senate. we had 52 at that point, but regardless we had three people that franklin didn't keep their campaign pledge and that's regrettable but you don't need 60. again, it's like football. leland: i guess the question is do you think voters will give you another chance on that? >> i think voters will look at whatever is in front of them. i think they will be critical. leland: it will be critical when people offer free stuff. >> the american people are pretty street smart and no medicare for all possibly be free. you pay into it for a lifetime before you are eligible. people that literally have not done that are able to get into the system so it's a budget buster.

you could see how sloppy it is with a lot of horses on the track. how do you make that determination between what is just accidental contact in what goes too far? >> the question is where any of the other horses affected potentially getting a better placing and when you had three horses interfered with directly when the shift out occurred for maximum security the question then becomes could any of the horses probably have finished higher in the running order if that interference had not occurred and the belief from the stewards , again, strictly interpreting the rules in kentucky agreed to that and said so and it maximum security was placed all the way back to 17 behind the worst who was long-range toddy. molly: listen to a little bit of this from yesterday. >> disqualified. >> they did, so for the

first time in the history of the kentucky derby the horse that cross the line first has been disqualified after the objection. country house wins the kentucky derby. molly: what does it mean for the people watching and the people betting, people really into horseracing? should there be something done about the removals? >> well, i think so, molly. it's a result that's difficult to justify for anyone who back maximum security and that was a lot of people. he was the second choice in the race. the rules is-- as they are an american horseracing are different state by state by state and what we don't have here is an adoption of an international standard. every other jurisdiction across the racing world from england to hong kong to australia use one set of rules and under those rules maximum security would not have been demoted.

he was a clear length" three-quarter leader. what i think will happen is that the horseracing industry in america, which is worth tens of billions of dollars in the economy and hundreds of thousands of jobs across that were cultural sector, i think they will have to take a hard look at adopting an international standard which is in place everywhere else. it would be a more fair consistent outcome for not just the people who bet on the horse but the owners, racing fans and all stakeholders across the industry. molly: pat cummings, thank you for sharing your thoughts. it's fun for us to tune in every once a while even if you're not big horseracing fans. >> thank you, molly. leland: there are more democrats running for president that horses ran in the kentucky derby here is joe biden on the stump this weekend in south carolina quoting the african-american vote. >> last year 24 states

more independent voters? >> when you look at joe biden and what he was saying yesterday, there has been somewhat of a deterioration of a voting rights in the brendan center for justice at in 20164 cases of in person voting fraud were proven but we have spent hundreds of millions of dollars abiding voter fraud. the reality is voting fraud-- i'm a veteran and one thing is when i served in the army the right format for us to choose their leaders as the greatest right i think we have as american citizens and so allowing people to have that right especially if they have served their prison time is something that's resonating. why do we deny people on the streets being able to vote? as far as people in prison, that is more of a debate i think democrats have to hatch out. leland: they would hash out. seems republicans are relishing this. >> i can't imagine they would it be. by the way i understand
