ballpark by, i don't know, july 1. most watched, most trusted, most grateful to spend the evening with us. a special night for me. my son patrick graduates from high school tonight. we're proud of him. good night from washington. >> good evening, welcome to tucker carlson. tonight, a lot going on for a thursday night. despite the best efforts of prosecutors to hide the details, the show has obtained documents that revealed jussie smollett did fake his hate crime and showed how prosecutors responded. possible he never planned to charge him in the first place. details on that in a few moments. the president announced new taxes on mexican imports. the president tweeted this, quote, on june 10, the united

states will impose a 5% tariff on all goods coming in to the country from mexico until such time as illegal immigrants coming through mexico come into our country stop. the tariff will gradually increase until the illegal immigration problem is remedied at which time the tariffs will be removed. not a small thing. in a follow-up statement, the white house said the tariff will rise by 5% every month until there's a 25% tax on every single import from mexico. every car, every computer, every piece of avocado put on toast at brunch. if this happens, it's a big story. we'll keep you posted on it as it develops. likely it will. that's not the only thing happening in washington. impeachment seemed like a remote possibility. the speaker of the house was not for it. joe biden, the leading presidential candidate had not come out in favor of it. now, just a couple of days

later, it looks almost certain. why? because we haven't learned anything new about the president. we've not. not a probe of documents, no blurry iphone video where the president swears femalety to vladimir putin. that's not going to emerge because it doesn't exist and never has. despite years in the investigation and many millions trying to find it, no one found evidence that the president colluded with russia to win the 2016 election. doesn't matter, robert mueller delivered a statement in which he said essentially i couldn't prove the president committed a crime. then i couldn't prove he didn't commit a crime. on the basis of that, suddenly, the democrats appeared to be united tonight, we must impeach. >> anybody who looks a the politics of this. it's a thorny path. but i this i history is going to look back at this moment and what we choose to do and see if we do the right thing. the right thing right now is to hold the president accountable for his acts. >> we have to get the show on

the road. we have to have these investigations done on tv under the banner of an impeachment inquiry. i don't think there's any way around that. >> make everybody vote, make everybody in the house vote, send them on the senate and make them vote. put them on the record and make them live with those votes for the rest of their lives. >> impeachment is a process, not a thing. they need to move toward it strategically. and that i need to make sure that they're bringing the american people along with them. >> i would suggest that he told us enough to interpret what he said as a referral for impeachment. >> so that was the democratic politicians, also presidential candidates plus one fake republican strategist. they're going to be for impeachment. the regular press is going to allow some context and level headed analysis of what it might mean. it's not what we've gotten, it's been an unending stream of hyperbole and hysterics. a small sample. >> a litany of lies from the

president of the united states, one day after special counsel robert mueller, again, but this time on camera, explained he did not clear the president of a crime. >> the president who theoretically can break any law that he wants going forward so long as 34 senators decide to stick with him. >> mueller did not say the "i" word, no one was bracing for that today. that's not how bob mueller rolls. >> he considers this as emergency. he considers this a very serious effort by russia to interfere with our elections that it happened, that it's going to happen again. >> a litany of lies, an emergency. a president can break any law. you know what? if you're that exciting go, ahead and impeach the president. the democrats ran last year on health care and income inequality, things that voters appear to be interested in. how excited will the voters be to see the next year and a half blown on an impeachment trial that will not succeed, waste time and money, and achieve

nothing. pelosi may be extreme, she's not stupid. there's been a reason she's been against impeachment from day one because it will hurt her own party. her party doesn't care. so go ahead, impeach them. telling another fact. robert mueller said a lot more about him and the investigation than it did about the substance of the investigation. mueller said it was important that the office's written work speak for itself. the written work, of course, is his report. we had that for a month and didn't justify impeachment. so mueller decided to speak up and tip the scales in a different direction. that's the point of yesterday's comments. he said he was unable to exonerate the president of criminal activity. so it's up to congress to decide what to do. of course, in a fair society, in all fair societies, prosecutors never exonerate people. prosecutors either charge people with crimes or they leave them alone. prosecutors are not supposed to release embarrassing material about private citizens unless it directly relates to a criminal

offense. like some of the other people in washington, though, mueller and his team forgot the basic principle, so thanks to their work, our country will be suffering through another year of pointless political theater while the real problems fester and get worse. opioids, student loans, the border, the rise in china. take your pick, there are so many. none of those will get fixed. instead, we'll have a pointless impeachment show trial that we'll dutifully cover. it will be depressing but we'll have no choice. shawn davis has watched this very carefully. he co-founded the federalist. he joins us tonight to tell us what this reveals about the mueller investigation. trump, thanks a lot for coming on tonight. what have we learned about -- i don't think we learned anything new about trump yesterday. we learned probably new things about mueller. what were they in? >> i think it was breasting in my view he -- it was interesting in my view that he held this conference. the report, 448 pages long

released almost six weeks ago. if it truly spoke for itself, he wouldn't need to speak for it yesterday. speak for it, he did. the most curious thing that he did was -- it was twofold. he came out and said, one, we charged the russians for some stuff. but by the way, everyone -- even the russians are presumed innocent until they're found guilty of a crime. then he immediately pivoted to trump and said by the way, this american who hadn't been charged with anything, we can't say he's innocent, but we can't say he's not, not guilty. he inverted our typical standard of the rule of law which is innocent until proven guilty. and he did an extreme disservice both to the rule of law, to his reputation, and to the department of justice in general. >> he didn't need to do this. of course, because as he said, and you reiterated, the report reportedly speaks for itself. so why did he do this? >> that's the million dollar question. we know from past experiences watching mueller that he is keenly sensitive to media

narratives and how media tend to cover himself and his team. he complained to mueller or to -- to barr, eck 'cuse me, after he announced the principal conclusions of mueller's report and said you don't like how the media is covering this. then that letter found its way to the media shortly there after. the question i have is why should an independent, supposedly impartial investigator like mueller care what the media is saying especially if the work speaks for itself. how the media covers the report when it's out there for all to read shouldn't be relative to him. i think it's obvious that he was trying to pour gasoline on the impeachment fire. that he was displeased with how the narrative was proceeding. he felt he needed to go out and personally reset the narrative. that's not his job. >> he wanted trump impeached because he's an angry moral iiz like so many prosecutors. the democratic congress didn't do that. he came out to prod them.

"saturday night live" as a certain federal prosecutor. that was acting. now we're going to hear from real federal prosecutors. i have so much admiration for their intelligence and dedication to their work. recently, 1,000 former federal prosecutors who served under republican and democratic president have united to sign a statement to help americans to understand what's in the mueller report. the conclusion should trouble us all. in the words of the mueller report, no person is above the law. >> no person is above the law. but certain, rich, well-known people would like an outsized role in guiding what america does next. robert de niro fits into that small category. that's part of a long-term obsession he has with donald trump. another example. >> it's beyond surreal what this guy has done. >> you called him a mutt. >> he's a mutt. >> you still believe he's a mutt. >> every word i said to him, i mean today.

themselves as exemplars of ordinary everyday americans, trump cannot have won, which is why this whole russian collusion thing got going. and it's interesting to me, for example, that we're doing real damage to important aspects of our society in letting robert de niro making the running on this. he introduces a group of about 12 prosecutors on that video representing 1,000. democrats and republicans. who -- who say that trump is guilty of obstruction of justice. now, two things -- if you thought trump was really guilty of obstruction of justice and you wanted to do impartial justice, why would you stick a man who's most famous for saying f-trump at the tony awards on the front of that video? whatever that is, that's not even the potential impartial justice. secondly, to go back to what you and shawn were talking about with this new standard whereby you have to be proclaimed

innocent by the state, it's not enough just to be not guilty, you have to be proclaimed innocent, we have something weirder going on with these thousand prosecutors. we have a jury of prosecutors. that is complete alice in wonderland-ification of the balance of common law law for 1,000 years. it's a complete nonsense, tucker. >> but doesn't it make it easier? i mean, you don't really have to worry about the outcome when you have the prosecutors acting as the jury, you know the verdict is going to be guilty, right? is that a streamline process? >> yeah, i know. especially the dirty rotten stinking corrupt justice as what we said on the show before. this is why it's important to know the date at which -- at which robert mueller knew there was no collusion or conspiracy. because everything after that just goes to the american method of the processes that -- the

not. we believe mexico can stop people coming in from our southern border. if they do that, the tariffs will not go into place. this is not the white house is saying part of the trade dispute. it's purely about immigration. apparently, the white house spoke to republican leaders or leaders of both parties on capitol hill and says that the republican -- the republicans they spoke to are for it. so this may be one of the most significant developments in the immigration saga in quite sometime an obviously will continue to follow up closely. a major development we told you about in the jussie smollett case, new documents contain hundreds of pages. what do they reveal? trace gallagher has gone through them. going to give us a view of that. trace? >> in the pages of documents, one of the big reveals concerns the ticktock or the timing of when the charges against smollett were dropped.

kim foxx dropped the 16 counts and chicago police said they were blind sided but the documents tell a different story saying nearly a month earlier on february 28 the day smollett was indicted, the assistant district attorney said she thought the case would be settled with smollett paying $10,000 in restitution and doing community service. that's what happened when chicago police said this. >> we found out about it when you did. prosecutors have their discretion, of course. we should have to work with the state's attorney's office. i'm sure we'll have conversation after this. >> now chicago police say the settlement was supposed to include smollett admitting guilt. that's not what the documents say. that's clearly not what happened. we're learning in a supplemental police report that jussie

smollett said the attackers said this is maga country. he identified them saying he could see through the eye holes of the ski mask but now we know through the eyes of the attorney smollett refused to look at the photo lineup that included the brothers. when the brothers were arrested, he admitted he knew them but told police they could not be the suspects because, quote, they are black as sin. smollett later said he assumed his attackers were white because they said maga country. the police videos are coming next week. we'll have those for you, tucker? >> trace gallagher. amazing, thank you for that. kevin graham is president of the chicago order of police. he joins us. thank you very much for coming on. these details. do they add to your understanding of what happened with jussie smollett. >> certainly there were facts that came out today that i was unaware of. certainly i believe when the prosecutors told the police that

they thought, the detectives thought they believed that's how it was going to end, i don't believe they thought it was going to be true. i think they thought that was one of the attorney's opinions. they were concerned about putting it in the report. i don't believe i've ever had an assistant state's attorney tell the police to stop investigating the case. which is what occurred in this case. >> before i get to how that happened, there obviously is a story here, obviously. have you ever seen a case where a prosecutor declines to prosecute with an agreement without requiring the person, the guilty person to admit guilt? >> never seen it. never seen that. >> never seen that in 35 years of police work. >> so clearly, somebody talked to somebody. no offense. it's chicago, of course that happened. what do you think actually happened? >> at this point, it's

speculation. i know that files from the state's attorney's office, from the prosecutor's office, and kym foxx, those articles will be coming out soon. i think they'll be interested to find out who she talked to, when she talked to them, and what transpired. because that is coming. look, we've got a crime problem here in chicago. and kim foxx is not prosecuting the criminals. this is one case. but we have a number of cases. that's why the police chiefs in cooke county stood with us more than a month ago and complained about this prosecutor saying she's just not doing her job. we need a prosecutor to prosecute. we need people to be held accountable for the crimes they commit. otherwise, it doesn't mean anything. >> so her response is the criticism of her is racism. how do you respond to that? >> you know what? i mean, it's ridiculous.

pirates of the caribbean now demands that you approve of abortion or they'll punish you. netflix is onboard with this. that company currently films a number of shows in georgia. if the state doesn't appeal the abortion law, netflix says it will pull out. this is a remarkable change in american life in a short period of time. it wasn't that long ago when citizens boycotted companies they disagreed with. now it's corporations who boycott citizens. what happened? it's not hard to figure out what happened. for generations, consumers and voters held the real power in this country. not anymore. now corporations are in charge. they're happy to boss you around on behalf of the activist left. they'll lie and tell you it's a matter of conscience. right, as if they had conscie e conscience. netflix filmed its show, marco polo in malaysia. if you haven't visited malaysia, being gay is a crime. most of the country lives under sharia law.

abortion is illegal in malaysia. the company didn't seem bothered by that. disney, by the way, just filmed the upcoming live action mulan film in china which is in a police state where huge parts of the internet are banned and people are executed for having the wrong opinion. in some cases, abortion is mandato mandatory. no, disney and netflix are not worried about the rights. the real concern, the only concern is power. women with children might be tempted to put the needs of their own family before the needs of shareholders, abortion solved that problem. families shrank or disappear entirely. women are free to devote their lives to the company, reliable little worker bees. the corporations get to expand labor pool, lower wages, increased profits, all while giving pious lectures giving women opportunities, we're feminists now. it's grotesque, but it's remarkably effective. somewhere in the late 1990s, corporate america realized this.

they learned if they did the bidding of the left on the social issues, they would get a pass on everything else. they could freeze wages, they could destroy the environment, strangle free speech, eliminate privacy. in general, public life could be much worse, all the while they could get richer than any class of anybody in human history and nobody would say anything. that's exactly what they did. and they're still doing it. sales force is a major tech company that sells software to businesses. today, sales force announced it won't work with people who sale semiautomatic fire arms or magazines that hold what gun control groups say are too many lines. last year they would not allow stores using semiautomatic weapons to use their credit card services. that's what it is today. what if corporate america decided to punish gun owners in addition to gun sellers. you have a firearm, you can no longer buy car insurance. you can't use facebook, you can't open a checking account, you can't have a credit card,

you can't stay in hotels. libertarians say that's just fine. free market at work. if you don't like it, open your own credit card company. but you'd have to be a moron to believe them. in fact, that would be the end of the second amendment. the words remain in the bill of rights but they would be symbolic. big companies render them meaningless. it's not a right if you can't exercise it. that's where we're heading. that's not far off. conservatives have been trained to see government as the only real threat to human freedom. for much of the last 100 years, that may have been true. it's not true anymore. the tyranny of woke capital is real and terrifying. just because they're selling you products doesn't mean it's not a dictatorship. left coast news in california, ethan joins us tonight. i would think this is one subject you and i might find common cause and i'm amazed how many on the left are more than happy to give up their principles that they defended for generations because some big

>> it's absurd. >> it went to the supreme court. >> question. do you think that it is -- that a woman's first loyalty should be to the company she works for or to her family? >> i think her first loyalty to be to herself and her family and if she believes in god, it should be to god and her country. companies shouldn't be the first place of loyalty, not usually, tucker. >> does it make you a little bit nervous. does it -- well, it's the position of companies that your duty ought to be to them and to shareholders. than's why they're weighing in on a question as intimate as the question of abortion. okay? so, does it make you a little bit nervous that disney or netflix have strong feelings about abortion? that doesn't bother you at all? would it bother you if they had strong feelings about eugenix. >> that's a much bigger discussion of why companies have first amendment rights. i debated it.
