>> president trump: i think she is a disgraced. she disnt a talented person. i tried to be nice to her. she is incapable of doing deals. she is a nasty, vindictive, moral person. they thought their good friend bobby mueller was going to give them a great report. he came out with a report with 13 angry democrats biased against me, a couple worked for hillary clinton and they added five more, democrats. 2 1/2 years, think of it. from before i even got elected they've been going after me and they have nothing. >> great interview. even the liberal left agrees nancy pelosi went a bit too far with those prison comments >> doesn't the counter argument become is this the democrats' version of lock her up? >> we have the leader of the opposition saying the other guy ought to be in prison. we saw this in pakistan.

defeat the guy and then hang him. >> not productive conversation when you try to put something together and legislate for the american people. >> congressman sean duffy and shane harris and president of people's alliance for justice. thank you for being here. sean, i'll start with you. it is pretty shocking to see the liberal media admit nancy might be a bit off her rocker on this one. >> a little bit of truth coming from the liberal media. that's right. nancy pelosi is not crazy. nancy pelosi is throwing out some harsh words about sending donald trump to prison. she is trying to derail the effort by the liberals, radicals, socialist in the democrat party to impeach him. nancy pelosi understands in 2010 she passed obamacare. america hated it. it rose our healthcare prices, didn't do what they promised it would do and lost the majority. she sees she is back in the majority. if they go forward with impeachment they will lose the

majority again. we'll talk about prison but let's not do impeachment. she is crafty and smart trying to derail the impeachment caucus. >> sthe is caught between two sides of her party. shane, i want to play some sound by collins of georgia. some folks are blinded by rage. >> they're so blinded by rage what's going on with this administration they're willing to make false accusation and that's where the american people, the breakdown in the honesty with congress has got to get better. democrats have gotten way over their skis in promising their rabid base that we'll do these things. at the same time they much rather focus on this because they have no legislative agenda. >> what is the legislative agenda? is it possible if you are blinded by hatred for this president? >> i'm glad we're having this conversation. when i wake up in the morning i eat a banana. what is going on in this country is bananas. the reality we're seeing the bickering back and forth is a

real issue. here is what i want to take a look at while we're talking about nancy pelosi and this whole push of this version of lock him up. here is the deal. the president has proven time and time again that he is unfit to be president. i mean, he broke the law when -- what he did with stormy daniels. that should mean jail time. he clearly broke the law when he began to deal with obstructing justice in the investigation, the mueller investigation. that should be jail time. so here is the real deal. we're dealing in a country where we want a one side not to be a conversation while on the other side it's all right. >> hold on, shane. >> taking on hillary clinton saying lock her up. he led the lock her up movement. we have to talk real here. >> if he broke all these laws why is nancy pelosi so hesitant

to actually proceed with impeachment? >> nancy pelosi is very smart. she knows how to play strategic. she is not going to go straight in for this or that. she will be very strategic about her approach and she has always been that way. so to ask -- i get what the congressman is saying. to ask the question why is she trying to get on this is because she is strategic. she didn't just jump to impeachment when others would. she didn't do that because others would. she is a strong woman and knows exactly where to pull the strings at clearly. this president is bothered. >> what i think is bananas is the fact that democrats craft a fake dossier and start a fake investigation on donald trump and then they claim he obstructed their fake investigation and by the way, he didn't. robert mueller said he got complete compliance from donald trump. don mcgahn after he testified for more than 30 hours. your real claim is he attempted

to obstruct a fake investigation but he didn't obstruct it. you mentioned this. we have to go back how did this crazy investigation start? we'll find that out. i think you'll see democrats running for the hills and wish they would have never gone down this road. >> if you're all about getting to the truth and justice are you equally concerned as to sean's point of the origins of this that maybe our own institutions took a lot of latitude in investigating a presidential candidate? >> no, i don't. because the reality the that this president showed real concern coming into his campaign. forget when he became president. in his campaign there was lots of things that happened. also let us be reminded that under the obama administration, not one indictment in that administration. under this administration, multiple indictments while the mueller investigation went on. clearly there is something wrong. clearly there is something wrong with what is going on and

clearly there was a real call to action around this investigation. >> this has been litigated so much on fox and other network. the only russia we saw was hillary clinton and democrat party, ob ra tifshs from russia to draft the documents. we should look at that. mind-boggling mueller didn't do that part of the investigation. how about hillary clinton and democrats? when you hate donald trump so much you do get blinded by the rage and pete, i'm from wisconsin and you were from minnesota, this economy has never been better. people love donald trump. he wakes up every day and says i'll fight for you, make your economy stroerng, opportunity greater, your wages rise. i might not love every tweet or fight that he might get in but i love what he is doing for me and my family. my kids graduate from school and get a job and move out of my basement. it couldn't be better for me and my family across america. out of the bubble in dc.

>> impeachment is not necessarily advancing the ball for democrats. stand by. on another note there are three separate investigations right now on how the russia investigation began in the first place. including the one by u.s. attorney john durham who is investigating corrupt former intel leaders. chief intelligence correspondent catherine herridge has exclusive new details on that from washington tonight. >> the investigation into the investigators is accelerating. sources within street justice department confirming to fox news u.s. attorney john durham has been meeting with william barr on multiple occasions in recent weeks. separately sources tell fox news durham is dialed in asking all the right questions about alleged surveillance abuse in 2016 and how a surveillance warrant was obtained for trump campaign aide carter page. that relied heavily on the dnc/clinton campaign dossier unverified though christopher steele was well-known for the f.b.i. from other

investigations. the heavily redacted public records suggest the surveillance application did not rely on the so-called mosaic of intelligence involving multiple streams of information from independent source. as former f.b.i. officials have claimed. in a recent cbs interview the attorney general said there is a significant disconnect. >> probably more questions and that some of the facts that i've learned don't hang together with the official explanations of what happened. >> before the mid-terms republicans who controlled key house committees tried to tee up potential targets for future investigations. lawmakers point to discrepancies over the handling of the dossier and justice department official bruce ohr. his wife nelly worked for simpson also. republican congressman mark meadows made a criminal referral for nelly ohr over

other discrepancy. durham would handle the prosecution of any illegal acts if he uncovers them. >> you heard that report from catherine. she is a fantastic reporter getting to the bottom of this. we hear durham is dialed in met with barr multiple times. do you dismiss these investigations following through where it came from? you seem to before. if you find things will you dismissal that as well? >> you know, i do because i think again, i think that we have to be real here about how all of this began. and -- >> this is being real. >> we have to be real because there is real clarity in how all this began. there has been real issues from 2016 clearly showing that this president has been interested in hiding the truth from the american people rather than bringing it forth. i think that, you know, again, it's very important that this

continues. >> they worked with bob mueller, the white house counsel against most people counsel spent 30 hours with that investigation. mueller didn't look into the fisa process which others now are. do you think it means they'll get to the beginning? >> i think it does, pete. the bottom line is this wreaks to high heaven. i was a former prosecutor. to think an investigation using tools we refer to people like terrorists were used for the trump campaign. i'll sit back and wait for the three reports to come out and i'll take those reports on face value just like democrats should have taken the mueller report on face value. i think there will be a lot of meat on that bone and a lot of people held to account inside the obama administration for breaking rules and potentially breaking laws. >> barr and mcgahn clearly lied and refusing to allow congress

to have any oversight in this. >> refusing to allow congress? >> what are they refusing? >> we have separation of powers. the president doesn't have to send his people over to the congress to testify. there was a two-year investigation, shane. you think a few panels for three-hour hearings inside the congress are going to do bert than bob mueller? i heard you and liberals for saying just wait for mueller report to come out. he is a good investigator. he found nothing. so what, jerry nadler. >> he did find something. he said i'm not going to go this way or that way. >> nothing illegal. >> he said this is what the real facts are. i will not determine. >> and he handed it to congress and nancy pelosi thinks there is such an iron clad case that she is talking about locking him up instead of moving in impeachment hearings. if they had a close and shut case it seems they might move with it. thank you very much for the

impending new tariffs. kristin fisher is live in washington with the late breaking details. what do you have? >> tonight president trump was successfully able to use the threat of tariffs to get mexico to the negotiating table and commit to take several concrete steps to help reduce migrants from illegally entering the united states. he made the announcement as he often does on twitter by saying, quote, i'm pleased to inform you that the united states of america has reached a signed agreement with mexico, the tariffs scheduled to be implemented by the u.s. on monday against mexico are here by indefinitely suspended. mexico in turn has agreed to take strong measures to stem the tide of migration through mexico and to our southern border. so here is what mexico has agreed to do. it will deploy national guard troops to mexico's southern border on monday. that's the entry point for many of these central american migrants. it will allow migrants awaiting conclusion of their u.s. asylum

process to be sent to mexico while they wait and it will provide job opportunities to those migrants. mexico will also try to dismantle human smuggling and trafficking organizations and if that doesn't work, mexico will consider taking even more actions. in return, president trump will not impose that 5% tariff on all mexican goods which was set to go into effect on monday. the deal came after three days of intense negotiations here in washington and despite all of those concessions from the mexican government tonight mexico's foreign minister called the deal fair. >> i think it is a fair balance because they have more drastic measures and proposals at the start and we have reached some middle point. for instance, they accept to support the program we propose in central america and extended

version, to accelerate the deployment of the national guard. >> president trump has taken a lot of heat from democrats and republicans for threatening mexico with the tariffs. the president said he likes the use tariffs to negotiate with. so far it has not worked with china but pete, tonight that strategy worked with mexico. >> pete: kristin, thank you very much for the latest information. joining me now to react is an attorney and trump 2020 advisory council member and an immigration attorney. you and i are hearing these results in realtime. i have the u.s./mexico joint declaration in front of me. mexico national guard to their southern border. migrants looking for asylum sent back to mexico. and the whole thing reviewed 90 days from now to see whether or not mexico is fulfilling it. when you look at this and consider what america gave up, which is a tariff that never was imposed but was threatened, your reaction.

>> tariffs are not the favored tool of most conservatives, pete. desperate times call for desperate measures. here it worked. i think it is a great result for america and a pretty good result for mexico as well. because mexico has been getting the benefit of allowing the current situation. a lot of remittances, $40 billion going back to mexico every year. it is not working. so neighbors need to work out their disputes and now in addition to the terms that you mentioned, it is also going to include the national guard standing throughout mexico interdicting gangs and smuggling rings and helping with that and also providing some support and even potentially jobs to those asylum seekers waiting for their applications to be processed in america. i think it will be great for those people who are seeking to come to this country as well. they can be in a safe environment and be supported in mexico while america makes a determination whether they're eligible or not. >> pete: francisco, you

understand how dysfunctional this operation is. is this a win for the white house and the american people? >> it is smoke and mirrors. people, we aren't even talking immigration reform. guys, not only are we now admitting we can't get the wall built. we're now admitting. -- mexico is not going to pay for the wall and worse, we're going to pay for the development of jobs in mexico. not only are we admitting mexico won't pay for the wall. we'll give them money to employ the central americans who don't come here and >> pete: that's not what we're doing. >> we're not giving them any money. >> read between the lines. they're saying employment -- >> i'm reading the lines. the lines are that mexico will offer jobs to folks who have convenient in the migrant caravans. we're not paying for the deployment of their national guards, we're not paying for asylum seekers sent back to

mexico. ultimately -- how can you not knowledge -- hold on, guys. francisco. >> the reason people are coming from mexico is because mexico can't provide jobs for its own citizens. >> it doesn't want to, not can't. >> they cannot. >> pete: would you acknowledge their own government and the cartels are facilitating this. if we can get a crackdown as people are coming into the country it's a win for both countries and the humanitarian crisis at our border. why can't you acknowledge -- >> sticking our head in the sand. >> pete: steps in the right direction. >> there is no step. we'll end up paying for it. at least as long as you guys agree that we aren't going to build a wall. is that what you guys are agreeing on that? >> we're not talking about that. that's a separate issue. we're talking about what is happening in the next few days. >> pete: you can take it up with the courts disrupting the president's plans. that's not -- you're trying to

distract away from a clear victory. >> it isn't just a political victory. it is a human rights victory. children are being smuggled and abused. girls raped. this is a human rights perspective. we have to do something about it. we can't wait for democrats and fake republicans who aren't willing to protect our country. we have to do it today. >> pete: how are you not pointing at congress? >> i am pointing at congress, absolutely. they failed to do their job, absolutely. which caused us to come with with these crazy ideas. >> pete: it brought an opportunity where we have new concessions from mexico and we'll review them in 90 days. how is that not a win? >> mexico won't pay the tariffs. you and i were. our prices would go up. >> there are no tariffs. mexico is paying for the national guard and paying to

1988 or 1984 with walter mondale when he was the vice president and the extremists then got him to contort his lifetime policies so that he embraced positions that took him out of the mainstream. this abortion position is an extreme one that he is embracing. it is not authentic and it just is a sign of many of the changes to come that we are going to see as he struggles to try to get the nomination. >> pete: this could be the first of many. leo, joe biden has long been pro-choice. within that stance he has had personal choice. i don't believe our tax dollars should be used to pray for abortion. that's fairly reasonable. the reversal now is it not moving toward an extreme position and why do folks like cory booker have to make it about race? >> well, i'll tell you simply. this isn't 1984, it's 2019.

you have states like alabama, ga, that have made it impossible for people of color, poor people, to exercise their right to have an abortion. you can't get an abortion. and you talk about federal funding. it would be >> white women as well. there is no racial litmus test on this. >> if you look at the numbers of people in georgia and alabama who have utilized the abortion rights it is a disproportionate higher number of minorities. those are facts. i'm sorry, those are facts and check it out. >> absolutely. you ought to be with me on this. you ought to be joining me in saying let's not decimate the minority community. whether you are poor, whether you are rich, we absolutely shouldn't -- >> pete: let him finish. >> with planned parenthood's mission from the beginning, to purify the races in the united

states. the idea -- >> pete: that's a fact also. >> go ahead. >> with all due respect what gives you the right as an african-american man, as an american to tell a woman she can't exercise her rights under the law and we are a nation of law. roe versus wade. >> we do that on national television. >> we're a nation of law. >> pete: hold on. it has been the error of roe -- >> we've reached a consensus that people who do not -- we as americans have reached the consensus that our own personal dollars will not go to a cause that violates our conscience and our blaoefs. >> whose conscience? >> that's within the context of roe versus wade.

>> pete: it's highly contested the hyde amendment has not been overturned. it is recognized a person's choice, a lot of us who are pro-life believe it's a false choice because it's a life doesn't have to be supported by tax dollars who don't believe in it. i don't understand why that distinction can't be made. >> it was reaffirmed by president obama, biden's filibuster: >> here is the issue. this is -- look at what is happening in the southern states and what is happening to alabama, georgia, missouri. these states have blocked -- >> elected officials passing laws. people they voted for. >> all he is saying is residents in this jurisdictions have sent to the state capital pro-lifeers, people who are pro-life. >> pete: let him talk.

a civil war in this country. >> pete: just playing it straight. >> they're not liberal at all. they take every leftist position on every issue that's out there. a lot of people at cnn aren't honest with themselves. they think of them as middle of the road network that has no agenda whatsoever. night after night it's not true. >> pete: what does he tell himself to justify that? >> well, i would like to think it's a simple lack of self-consciousness that he places himself squairl at the center of the political spectrum and only measures politics as it moves to the left and right of where he is sitting. but that kind of innocence i think is hard to justify when we live in a divided country. it is very obvious there is a wide political spectrum and very obvious that don lemon is

considerably to the left of that spectrum. to refuse to admit that i put it not to ignorance but simple deceit. >> pete: topic two. next example. joe biden slammed for mraijorizing the -- >> don't you go to the experts' website and list some of their terminology? >> pete: you lift it. it is pretty clear she is on board with biden taking things that don't belong to him. here is what she said back in 2016 when melania trump faced similar charges. >> the point is, without acknowledging it, what does that say about the campaign and their tactics? >> pete: back then we just lift it. >> you know, someone once said that behind every double standard there is a single standard waiting to be uncovered. i think what's going on here not there is a kind of contradiction or double standard, they have a single

standard. cover up for their side and attack the other side. and they do that with actually relentless predictability. so ultimately when we recognize that we're dealing not with a straight republican/democratic fight but a democratic party that has hollywood, academia, and the media in its corner, then i think we know what we're up against. >> pete: vice president biden is the frontrunner on the democratic side and it is dismissed away. >> this is quirky uncle joe. it's just part of the public persona and we're supposed to be okay with it. >> pete: you forgot sniffing. third example. a solemn week marking the 75th anniversary of d-day. this is how the view's whoopie goldberg come -- commemorated it. >> this is why it's important

that people remember what folks fought for. we fought for the right to help people from other countries. we've done it as long as i can remember. >> pete: how do you make d-day about illegal immigration? >> this is what happens when you are so woke that your brain falls out of your head that you can't remember basic history. that is not why we fought. we fought to help other countries but not the right for which we fought. part of the values that we fought for against tow -- i'm not sure how you can reach that far to make this somehow about illegal immigration. i just am not sure how you got there. >> pete: is this willful con -- con flation. >> the united states got into world war ii kind of late. we didn't do it to help anybody. we did it when we were directly

we got to the other principal and they basically told me that they were suspending me from school because of a picture that was posted on facebook. not by me, but by my fiance. posing with guns. >> diamond has a second amendment right just like everybody else. maybe pointing at the camera, which is not necessarily good protocol is something that people reacted to. i'm not sure. either way, where is her due process? what recourse does she have? >> you hit the nail on the head, pete. it was an instance where the school administration acted as judge, jury and didn't give her due process. didn't allow her to put the photograph in context. it was her and her fiance, my bonnie to my clyde. no threat made against anyone and the school overreacted.

but that overreaction violated her constitutional rights. >> you are going to school to become a nurse, correct? >> dental assistant. >> pete: i'm sorry, my mistake. but there is nothing in your background at the school as you are going to become a dental assistant that would raise red flags, harassment, reasons why you have been a threat to anybody. >> no, sir, i have all as, my gpa was a 4.0 when they suspended me. >> pete: 4.0. was there ever a doubt in your mind living in the united states of america with a second amendment every person has a right to maintain arms, was there ever a doubt this would get you in trouble? >> no. i didn't think it could cause me everything, my career, my schooling. i didn't know. >> pete: it's amazing. why would you? what is happening next in this? >> we filed the lawsuit in
