online, thank you for helping to make it a bestseller. i had a great time meeting you on the road. 2:00 pm, can't wait to say hello. most-watched, most trusted, most grateful you spent the evening with us in dallas, i am shannon bream. welcome to a special edition of "hannity" "justice in america." i'm dan bongino in for sean. we'll start with a fox news alert. just minutes ago president trump announced he is suspending the threat of economic tariffs against mexico. after the country agreed to take tough legal action against illegal immigration. we'll have full coverage of this coming up. but first we begin with the big breaking news from catherine herridge who is reporting u.s. attorney john durham is "dialed in" to his ongoing investigation in the origins of the russia witch hunt. according to sources durham is asking the right questions and getting to the truth.
1:01 am
durham is working in coordination with the d.o.j. inspector general horowitz investigating the fisa abuse and the top democrats are worried that the ongoing probes could throw cold water on impeachment dreams. not just the congressional democrats fantasizing about impeachment. form lawyer baker is now praying to the impeachment gods. watch this. >> imsimilar a political process. to -- impeachment is a political process. if you don't have the support of the american people it won't go forward. that requires educating the american people. that is what congress needs to do and focus on and figure out how to do that in an effective way. >> that is what the so-called nonpartisan f.b.i. looks like. under comey's dreadful leadership. we are learning michaelflip caught the attention of the federal investigators as early as 2015 and was a target of stephen halpert. the informant that spied on
1:02 am
papadopoulos and page. joining us now is robert gates and mike turner -- matt gaetz and mike turner. one of the problems that i have with this is that the mueller report appears more like the day like an extended op-ed. we found out about the doctor that nancy pelosi video in we found out that the transcripts from president trump's lawyer john dowd, the transcripts to, there were the keywords missing. is mueller writing op-ed or doing an investigation? >> we continue to see chinks in the armor. i'd point you to the great work of john solomon who appears on this program that points out that mueller identified as an individual connected to the russian intelligence was actually in the state department working with our government. so if robert mueller wasn't able to ascertain who was spying for the russian and who was reporting intelligence to
1:03 am
our own government i think it would call in question substantial portions of his work. but there is three real levels of what mr. durham's doing that are important. fisa abuses, the lies before the courts that should not have occurred. also the illegal leaks. your point about james baker highlights the extent to which under james comey leadership the f.b.i. wasn't conducting the investigations and looking for the truth. they were trying to shape public opinion. and i think most notably the corrupt origins of the investigation inside the obama white house. where we weren't just violating the rights of our own citizens but britain and others that we could haven't done in the united states. that's bad news. >> i want to get back to kolinick. you are on the hill and you see what is going on every day. do you sense the tide is turning feeling on the hill
1:04 am
where the democrats realize there is something going on here? that there was clearly, this was not, to quote susan rice "by the book f.b.i. investigation here." listen, your colleagues up on the hill are the democrats. we may not agree with them but they are not stupid. they have to know there were severe abnormalities here. are they worrying that this is coming out and it may rebound on them? >> something they worry about is the authority that barr has with respect with the declassification. it's not the ohr investigation but the american public getting the truth and the actual information. michael cohen came to testify on the committee i serve on and there were leaks about what was in his testimony. the story sort of came to a screeching halt the moment that the cryp the transcript was released and people saw what
1:05 am
was in it. they move forward with the investigation of the origins of this, which i had to live through with the intelligence committee. they will find holes in the story but they will release this information to the public to read it themselves to see that not only was there no "there" there but there were misdeeds done. it's very obviously i think clear to the american public that comey, clapper, brennan and baker when they stand on the television sets now and are clearly anti-trump bias, that bias predated their leaving the government. it was there when they were over the agencies that were so important that were tar getted at the american citizens. >> congressman gaetz on the point you made about kolimnik this is disturbing. we find out that there were sins of omission here. mueller i don't want to leave weissman out of this. andy weissman, his fingerprints are all over this. you brought up the fact that they damn manafort in the
1:06 am
report for the discussions and whether they are appropriate or not is up to you to decide. he wasn't charged for the conversations but kolimnick was the source for the state department for the obama administration. we find out that one of mueller confidential informants in the case, allegation, of course, but apparently was arrested for the child pornography of all things. this was mueller's source? this is getting uglier by the minute. >> this continues to trend if there are reports that are not damaging to the president then they try to keep that aspect away from the public view. you see it in the mueller report where that information was not cast in accurate light. but even before then in the fraud that occurred before a secret court with no defense attorney present you had the department of justice and the f.b.i. presenting information that seemed to indicate that george papadopoulos was colluding with are russians when the reality is they had a transcript where brits run
1:07 am
intelligence against papadopoulos and papadopoulos denied ever having engaged in the unlawful acts. so, they are presenting information to try to reinforce their bias. rather than put forward the information that would have spared our country from the 22 months of division. because from the beginning it was on that there wasn't collusion but they allowed the investigation to persist. >> dongman turner, so we have seen -- congressman turner, we have seen information come out but very little accountability. i'm thinking of the best way to phrase it. i get e-mails a lot and on twitter where people are upset. they see people getting off. there is allegation of a senior f.b.i. official accused of leaking. and the d.o.j. didn't want to prosecute that case. why does it appear if it involves a trump-associateed person, mike flynn, george papadopoulos, paul manafort, the heavy hand of justice comes down on them hard. early morning raids, severe
1:08 am
prison sentences, and paul manafort is in solitaire confinement on rikers island. i was a cop. you don't want to be on rikers island. no less solitary confinement. but if it's a democrat they seem to get off. will we ever get the accoun accountability? >> inequity is troubling. from the perspective of the intelligence committee and as you are aware from the oversight committee. criminal referrals have been made. as a result of the inaccurate statement that people made, lying under oath. this will go to the heart of the inception of the investigation. the people around trump were pursued for the purpose of trying to turn them against the president and say things that are not true. mueller investigation found no collusion. they did not conclude. they found there was no evidence ultimately to conclude that the president committed a crime on obstruction.
1:09 am
but they put pressure on the people around them including ruining their lives and pursuing the criminal prosecution. there are criminal referrals that have been made that will go to the heart of people being dishonest and abusing the power and being dishonest. i think the attorney general will undertake it and the american public will get answers. i think we need to change the laws. >> let me follow-up. i understand and i get you can't go out and physically put handcuffs on people. you are a legislator, not your job. you make referrals. i get that. but the frustration is, you know, is there any pressure that we can put on the d.o.j. and people to do their jobs? it seems like the inequities are leading to a real imbalance. the republic only matters if the people have fidelity to it and believe that the constitution means something. it seems to mean something for one side but mean absolutely nothing to the other side of the political debate. my question better phrased is what from your side can be done about this? >> i think the general investigation --
1:10 am
[overtalking] >> that was a follow-up. i'll go to you congressman gategaetz for the last word. congressman turner? >> if you look to the barr investigation and the attorney general investigation, these will get to the heart of were there laws broken or the procedures broken? it with us not done by the book. there were abuses of the product. we'll get data and the investigation from which the investigations can lend themselves to the criminal prosecutions hardest and the referrals from the intelligence committee and the government oversight committee. >> congressman gaetz, last word. what can be done? people are getting frustrated there. >> the american people are sick and tired of a double standard that seems to pave a yellow brick road to the exoneration for hillary clinton. when they were clearly crimes committed there. while at the same time casting the aspergeses on trump without a basis as a result of bias. the only reason people have been thrown in jail is jeff sessions did a terrible job as
1:11 am
attorney general. now we have a real attorney general. mr. durham is on the case. the information now indicates at every level of the corruption will be accountability and restoration of the justice and the recall of law. i can't wait for it. >> congressman gaetz and congressman turner, thank you. now we have more evidence and corruption at the highest levels of the bureaucracy. july uncovered documents show the copped witho conduit of thee bruce ohr was given a bonus and a raise compliments of you, the american people. during the very height of the russia witch hunt. but that is not all. yet another discovery from the judicial watch is revaling how the clinton e-mail investigation was so botched that the important investigatory notes are totally missing and others are damaged beyond repair. knowing to see there, folks -- nothing to see there, folks. joining us with more is judicial watch president
1:12 am
fitton and the fox news analyst gregg jarrett. there are information appearing all the time that kolinick is russian guy but the government used him. this was so horrible for the don trump but he worked with the company and it was paid for by hillary. but information on the clintons it all magically disappears through the black hole. >> unequal justice and selective prosecution became hallmark of the obama administration and james comey and rul alan robert mueller. abedin said there was no hacking of the clinton server. documents show it was simply untrue. the chinese hacked her server and she knew it. so that was a lie. they also told the f.b.i. -- again this under oath -- we don't know anything about
1:13 am
hillary clinton using a private unauthorized server. they were talking about it and communicating about it. but they weather never prosecuted. comey was asked about it. why didn't you prosecute that? oh, failing memories should be forgiven. so if you a friend of hillary clinton you get a free passion. if you so much as cough and sneeze in the vicinity of trump the full force of the federal government will come after you with a vengeance. >> and mike flynn's failing memory and george papadopoulos's memory wasn't forgiven. they went to jail. and judicial watch has done great work and the recent discovery of the missing information of the f.b.i. i have a theory. tell me if you think i'm right. that is the inspector general of the intelligence community note with the f.b.i., correct, some missing? >> right. >> is it possible -- you know better than i do. you f.o .i.d it.
1:14 am
is it's a damage assessment done by the intelligence community about the hillary clinton e-mail if it was hacked and what was out there? >> well, the dates line up. the missing meeting notes are from a meeting that the intelligence community had with peter strozk and company, it looks like. about a month after the i.c.i.g. referred it to d.o.j. so they had the intelligence committee refer to the justice department hillary clinton for the investigation over the missing e-mails and the national security implications. they have a meeting about the issue a month later. the notes are nowhere to be found. it looks like it lines up with the discussions that the agencies had about whether the chinese gained access to her e-mails. the notes are gone. because of a lawsuit. it's not voluntary disclosures. to me it shows they didn't care.
1:15 am
a sham investigation. they lost the notes. who cares? last week they admit 302, four witnesses, interview statements were missing. if you don't care about the investigation and you know it's wired you won't do the basics like keep notes of the meetings. and be diligent and record everything that happens. >> something i saw in the judicial watch report is the potential that some of the hillary clinton information on the server may have appeared on the dark web. some of it was classified. with the classified markings marked out. >> sure. >> this is staggering information. we are talking about the secretary of state. she is not trafficking in low-level information. i was an introductory secret service we worked the treasury check cases. they were nice to work but not national security cases. this is the real deal. she was the secretary of state. >> absolutely. she jeopardized the national security. she didn't care, obama didn't care. obama went on national television, on fox news with
1:16 am
chris wallace and said she didn't jeopardize national security. she was a little careless. that was the clarion call to comey and the department and justice to stomp the foot on the scales of justice. and clear hillary clinton even though they knew she committed crimes. more than 100 of them representing 110 classified documents on her unauthorized server. comey twisted the law and converted the facts to absolve her making the announcement on the day that his f.b.i. furtively meeting in london with the author of the phony dossier. that was the beginning of the russia hoax that beget the witch hunt. >> doubling down on what greg had to say. the beginning of the investigation has become a scandal in and of itself. the f.b.i. story doesn't seem to make any sense when you analyze it with the clear eyes. they said it started with a george papadopoulos tip to downer at the end of july. july 31.
1:17 am
but the problem is we have f.b.i. two weeks before, middle of july, before july 31 in london meeting with the christopher steele and the dossier. is the big scandal the fact that the f.b.i. is not telling us the full story the entire time about the origins of the case? is that what bill barr is going to give us? >> mueller didn't tell us the full story of the origin of the case. they suggested that it started later than it did. the f.b.i. hasn't told us anything. it's all been leaks and supposition. mueller was supposed to tell us the truth. as you have seen the mueller dossier is shown to be a sham. if i were the a.g. i would issue a black box warning with the mueller report. you can't trust it. we disavow it. it's there if you want to look at it. there may be facts you can double check but we can't vouch for it. we have documents coming out for instance that bruce ohr is
1:18 am
getting unusual bonus, at least given the recent salary history in the middle of the russia gate investigation. just about the time he is launched by the f.b.i. and the d.o.j. to be the back channel as you pointed out. to christopher steele. after the f.b.i. fired him. so he gets a big bonus. then it comes out he was dealing with christopher steele on the down-low because evidently sessions and company didn't know about it so they removed him. you know what? they kicked him upstairs to the international group and gave him a raise. >> gregg, i hypothesized from the start ohr is the key to the whole case. he is information launderer. not money laundering but laundering information. making ill lel jit mate information look real because it came in through his position with his wife and the d.o.j. now it looks legitimate. simpson and ohr the stories don't make sense. simpson said he contacted them
1:19 am
after the election in thanksgiving. and contacted ohr around thanksgiving. but ohr is saying he made contact with simpson in august. so obviously the stories can't marry up. >> and nellie ohr received a criminal referral because of that very fact. bruce ohr and elto glenn simpsos testimony don't match up. he is in a world of trouble so that is why he invoked the fifth amendment. >> he said i just met ohr after the election in november. when in reality -- that changes the whole story and it will give simpson a motive to say that. >> there are so many bad characters in this. glenn simpson, christopher steele, bruce ohr, nellie ohr. the ohrs, by the way, are profiting by this at the same time they are peddling the phony dossier. now we learn today thanks to tom fitton and judicial watch
1:20 am
ohr is getting $28,000 bonus for the work he did that resulted in his demotion. only in american government can you profit by malfeasances. >> we paid for it. your tax dollars not hard at work. >> the attorney general should look at the documents. his agency and the f.b.i. give to judicial watch. he can do the prosecutions that he needs to based over that. incredible. it is all there in the public domain already. >> i hope he does. this is a slap in the face that the taxpayer dollars are financing the malfeasances. >> i got to get that job. >> it's not chump change either. democrats are in an impeachment frenzy. plus, trump responds to nancy pelosi's prison comment. we have a debate with austan we have a debate with austan goolsbee and congressman

"justice in america." the ongoing battle between president trump and speaker nancy pelosi escalated when pelosi reportedly told fellow democrats she wants to see trump "in prison." isn't that nice? president trump responded to the speaker during an interview with laura ingle. watch this. >> president trump: i think she is a disgrace. i don't think she is a talented person. i have tried to be nice to her because i would have liked to get deals done. she is incapable of doing deals. she is a nasty, vindictive, horrible person. the mueller report came out. i was a disaster for them. nancy pelosi is a disaster. let her do what she wants. i think they are in big trouble. >> dan: trump wasn't the

1:27 am
is congressman tom mcclintock and former adviser austan goolsbee. austan, going to you first. what is with the police state bent of the modern democrat party? i don't get it. first a spying scandal. no democrats are coming out to call out the government spying on president trump. now we have calls from the speaker of the house to put president trump in the handcuffs. i guess she thought it wasn't going to slip out to the general public. she said it behind closed doors. do you have a problem with this kind of stuff? >> i have somewhat of a problem with that i'm glad it wasn't a public statement. i wasn't there. i can't verify she said that. if she did say that, i think that is over the line. this is a line that the president of the united states to be fair is quite familiar with stepping over, too. calling for people to be investigated for treason, pronouncing them guilty before there is any investigation. but i certainly don't think that it is appropriate to
1:28 am
either say you want the president in jail, or to say that you think that the president should be impeached when there has been no investigation. we haven't had any fact-finding. that is stepping over the line. i do have a problem with it. >> dan: congressman, your take on this? we have seen this increasingly hostile position from the democrat party. it's really hard to believe when you see this. you have even people on msnbc complaining like we are in a third world republic here. this is outrageous. this is the speaker of the house talking behind closed doors. no one has yet to refute it conclusively, talking about putting handcuffs on the president of the united states after he was spied on by their party. they should apologize to him. not calling for his jailing. >> this tendency to criminalize our political process is disturbing. it goes back to the persecution of the tea party by the i.r.s. i still know tea party activists who won't go near
1:29 am
politics because they are scared to death of bringing the i.r.s. upon them. so this regrettable. i will say this. it was behind closed doors. politicians sometimes talk loosely behind closed doors. sometimes they talk loosely out in public. but i do think that she is legitimately concerned over this obsession that thed are call left within the democratic caucus has with the impeachment. they are in danger of running a foul of something that the air force pilots talk about. it's called target fixization. when a pilot is so fixated on a target he flies his plane in a mountain. the democrats campaigned as the problem solvers in the 2016 election. they have been nothing but trouble-makers in if days since then. the american people are getting tired of it. >> dan: i know i kind of hinted at this before, austan, but it concerns me. i'm not being hyper bawlic.
1:30 am
bolic when i say this. where are the democrats in your party speaking out about this and the spying scand? we know now, we know conclusively the president was spied on. that is not up for debate. the only part of debate is was it predicated? i think it's false. where the democrats and people like yourself speaking out saying we are going down the wrong road? >> i'm not speaking that specifically. that is the wrong phrase to say that the president was being spied on. >> what would you call it? >> well, if someone is investigated that is not being spied on. >> dan: but they admitted they had a spy. ahe is called a spy. do you call him surveillance? >> you say "he" are you talking about attorney general barr? >> no halpur, who spied on the trump team. what do you call him? >> i would say that they were being investigated and the mueller report shows that if
1:31 am
they were being investigated for good reason. the russians -- >> dan: what reason? >> the russians were heavily trying to influence -- >> dan: so why not spy on russians? why spy on trump? >> because they were con commuting with the trump campaign -- they were communicating with the trump campaign. >> what do you mean they were communicating with the trump campaign? >> do you want to go over point of the mueller? do we have time for that >> dan: so should we have surveilled hillary clinton since she communicated with the russians? >> so we are clear, rudy giuliani was working for the campaign and was talking to the f.b.i. behind the scenes. the f.b.i. agents and finding out information that was not appropriate about what was happening in the campaign. he was being investigated. is that spying? >> dan: is it illegal to talk to russians?
1:32 am
i have talked to russians. is that illegal? >> sometimes it. depends what you talk about, dan. don't tell me. i don't want to be an accomplice. it depends what you say. >> dan: thank you, congressman and austan goolsbee. i appreciate it. next, ilhan omar is having legal trouble and trace gallagher has details. joe biden commits one of the biggest flip-flops of all time. kayleigh mcenany and matt schlapp will have reaction. stay with us as the "hannity" specia

trace? >> good evening. this goes back to when democratic congressman ilhan omar was a minnesota lawmaker. now minnesota campaign finance officials ordered her to pay back about $4,000 for repeatedly using campaign money for unlawful purposes. including personal travel and paying a law firm to correct her income tax returns. but some conservatives say the real story here isn't the misuse of campaign funds. it's her tax returns. here is why. the initial complain was that ilhan omar used campaign money to help pay for her divorce. state officials investigated and found that was not the case. but it does appear that omar may have filed joint tax returns in 2014 and 2015 with her current husband. but at the time, she was reportedly married to another man. the i.r.s. only allows joint filings if the state legally recognizes the marriage. so conservatives are now accusing her of tax fraud,
