vacation in dominican republic, taking a drink from hotel mini bar, griff jenkins live for us searching for some answers. what do we know so far? >> well, you know, heather, news of a fourth gentleman passing in april, but let me show you where we are, we hit the ground, it's dark here, in the middle of the side. two resorts next to each other, we found about a woman, miranda, 41 year's old had taken drink from mini bar found later dead, 5 days later, a couple from maryland, edward holmes and cynthia day, they had become ill in their room, not responded to check-out time, went in and found them died as well, the authorities here saying that the

vajia principe saying it's a coincidence, they do not see any foul play, the fbi is assisting with investigations as is the centers for disease control in -- and slew of international organizations, we are learning about robert bell wallace, 67 years old from california at another hotel in town of punta cana, he was here for stepson's wedding, he has died and state department acknowledging his death. here is all that the state department said, we can confirm death of u.s. citizen in april 2019 in dominican republic. we do not have additional information to provide, now, what we have been trying to find out is what the dominican

unit, joining me now retired ice director and fox news contribute o tom homan, thank you for joining thus morning, appreciate it. >> good morning. heather: you and i discussed this before, people claiming to be part of family units, more than 200,000 have been released as a result of that, all of this comes down to what the flores agreement that says that they cannot be held in custody for more than what, 20 days, what needs to change here or can change to fix the problem? >> well, acting secretary is right, i think congress needs to fix flores agreement, 9 out of 10 lost case, filled airplanes up and border numbers went down because we clearly show we have consequence in deterrence to false claiming asylum, however,

when flores settlement came, you can't hold the families more than 20 days, i said to court back then, if you do this, if you don't allow us to detain them long enough to see judge, you will see a surge in family units, of course, i was caught a fear-monger, no evidence of this, look what's happened. because we can't detain long enough to see judge, they get released in united states, the ones that do show up lose case. congress needs to fix the look hole. heather: you mentioned seeing judge, backlog of 900,000 cases to even get to that point. >> there is, one other thing that we need to do u.s. government needs to surge immigration judges in southwest border, i get it, let it sit there, let it sit there in shelf and get judges to the border to deal with the ones that are coming through right now,

concentrated on the folks coming in and send them home that will send strong message of deterrence and consequence but what acting secretary didn't mention, ice needs to do a nationwide operation, look for people who have these final hearings, they've got order from the judge, we need to find them including family units, we need to locate them, arrest them and remove them, because of final orders by judge don't mean anything. we have not done that this year, we need to do that, we need to send the people home. heather: tom, i want to get to the next topic, the thing that's developing today, will méxico in your opinion follow through and stick to the new immigration agreement that we are hearing about? we can bring up some details, méxico agreeing this is new because increased the number of troops to their southern border, so 6,000, migrants will wait for

asylum, will offer jobs to asylum seekers and take action against human trafficking, do you think they'll follow through? >> i hope so. i think so. but i will be convinced when they actually do it. i mean, actions speak louder than words. they have committed of doing things in the past and have done it for short period of time, not sustained, so, you know, rather than doing dog and pony show for a week or two weeks, let's see them do sustained operation, committed in writing, that's what the media is missing, this is historic agreement and president trump should get a lot of credit for this, he has done a lot to try to secure the border so we ought to applaud efforts on this and this is great that he has agreement with méxico. again, we will monitor the guys on the ground, monitor activities to ensure that they're in agreement. if they don't, i can assure you the president will impose tariffs. heather: we can pull that tweet

up. we can always go back to those tariffs, that is not off the table completely to summarize tweet there. something you mentioned and i want today let people know about because this is huge that this agreement includes, what, a safe third country agreement, explain to folks at home what that is? >> well, part of discussion down there they came to third country, people from guatemala, they would have to claim asylum in méxico, claim asylum in first country that's safe, so what i'm saying, if you're escaping government persecution in guatemala and you get to méxico, that's where you need to claim asylum, if you're facing persecution n el salvador, honduras, you should be claiming asylum in guatemala, it's called safe-third country, so if you are in different country, then you no longer are being persecuted by your government because you're gone, safe third country, that's part of the agreement, has to be worked out, they have to work out fine

take a look at cnn poll that asked people in general should the president be impeached, 54% say no, so what are democrats trying to accomplish? >> well, democrats have been trying to get more people to want impeachment and they are trying to control the conversation, political conversation in this country, so if you bog down the administration by putting them on the defense and questioning and investigating the president, they might have an impeachment in the house, two prior presidents have had impeachment, andrew johnson and bill clinton as we know. so the problem is there are not enough votes in the senate, the good news is they have a mega phone and they will be able to bring in a lot of dirty laundry, bad news is at the end of the day he will not be impeached because there are not enough votes in the senate. heather: brandon, one of the things that we expect to happen, the star witness of the hearing today is expected to be john dean, of course, the key watergate figure, what do you

expect him to bring to the table? obviously not a president trump fan at all, he's made that clear through his tweets, social media comments that he's made. >> well, i will say this without double standard the left has zero standards, how can a guy be key witness that went to prison for obstruction of justice. i mean, it's laughable. and i think he's going to accomplish nothing, it's sad that we've gotten to a place in our democracy, we've gotten to a place in our country where these -- these people who were supposed to be elected officials are doing nothing for the american people and they are only doing self-serving things that can get them reelected or get them powered if they do not deserve, so it's very sad that they are using this guy but it's making them look really, really bad and the country doesn't need that crap, we need more people to stand up and work for the american people. heather: kathy, a lot of work is not getting done, instead, you know, potential candidates for 2020 talk about this, we have nancy pelosi, though, trying to

turn the tide, maybe the goal this week trying to play both sides of the aisle in terms of democrats? >> well, they are trying to control the conversation, it is about 2020 but if there was obstruction of justice and they believe the mueller report does state that there was obstruction of justice and that russia did interfere with elections, they want it all out there, they want the investigate the president for any financial dealings that were illegal, so they are trying to open up these cases and hearings and, yes, he did go to jail, attorney general counsel went to -- white house counsel went to jail for watergate but he's saying if i went to jail for watergate, this is a pizza party compared to what the president is doing right now, he's saying watergate is nothing compared to what president trump is doing and wants to get that out there. heather: brandon, you get the final word and two things that kathy brought up, the mueller report is done, it's over with,

what the 15th state, they'll join 15 other states, actually they would become the 15th state to vote in favor of this, how would this impact our national election? >> so far the number of states except for maybe colorado were all what we call blue states meaning they generally vote democrat at least in the last few presidential elections, colorado is purple state but shouldn't have any impact until the number of states reach 270 electoral votes which is what is necessary to elect the next president of the united states. heather: so currently what these states that are in favor of this account for 189 of the nation's 538 electoral votes; is that right? >> would be 196 after oregon which -- so the problem, of course, with this is that the united states as most people learn in grade school is not a democracy, it's a republic, union of independent sovereign states and the president of the united states is not elected by

a popular vote, it's elected by states, by the electoral votes, the ironic is it's supposed to be more democratic but one party of electing the president is democratic, that's when your state votes oregon is basically saying that someone other than their own state wins presidential national popular vote that oregon would cast vote for someone that its own citizens didn't vote for. heather: so you say it's opposite and undemocratic? >> of course, it has never been tested in court, if a state actually cast electoral votes for candidate who did not actually win the states popular vote but it is undemocratic for oregon to cast its votes, for instance, donald trump if he were to win oregon in 2020 and in fact, if elizabeth warren won oregon but donald trump was elected by the national popular vote they would be required to

cast electoral votes for donald trump instead of elizabeth warren, for example, that's not very democratic for the citizens of oregon. heather: undemocratic, unconstitutional, why are we talking about? >> effects that donald trump has had on politicians and some parties, extreme reaction to the few instances in history where california, new york and a few populist state, large run-up of popular vote by a few million votes, even though president trump donald trump won electoral votes or president bush did in 2000, enough margin in large state to make national popular vote winner the person who didn't win the presidency by electoral college, it hasn't happened that often and as the parties become more polarized this actually increases polarization by telling presidential candidates they don't need to campaign anywhere except the large states. >> not fair. byron henry, thank you so much
