[laughter] ainsley: thanks, jillian. you all eyes on the supreme court where justices are set to rule on two dozen cases including the 2020 citizenship question before their term ends in just two weeks. but, they have already decided some key cases. steve: here to break it all down fox news senior judicial analyst and host of liberty file on fox nation judge andrew napolitano. judge yesterday we heard about gerrymandering and this is not a surprise. >> yesterday the decision on gerrymandering was a decision to not make a decision. the state of virginia realigned its state legislative districts to favor democrats. and the republican house of delegates, the lower house

of the state of virginia sued and the supreme court said one house can't sue. it really means nothing. only both houses can sue. they threw the case out. bottom line a win for the democrats in state legislative districts. i have to tell you, courts are reluctant to get involved in redistricting. it is essentially a legislative function. and they only want to get involved in the legislature is way out of line, like say my legislative district in new jersey where i live along the delaware river and my congressman lives along the hudson river. it's the same legislative district. okay. but what has me steamed yesterday and we were talking about this during the break is the double jeopardy decision. the whole history of the constitution is a reaction to the excesses of british colonial rule. and one of those excesses was repeatedly trying someone until they got the verdict they want and the punishment they want. steve: only get tried one time. >> correct. that's why we have a clause in the fifth amendment that

prohibits repeated efforts to convict. the supreme court said yesterday the government can do that the same event. let's say a bank fraud, which is both a federal and state violation, you can be tried twice. convicted twice. and punished twice for the same. steve: who wrote that impact. >> that may very well impact pawrstd as we speak being transferred from a federal institution in pennsylvania to holding cell in new york to be tried in new york for the same crimes for which he has already pleaded guilty in federal court in virginia. the whole purpose of the double jeopardy clause is to prevent this from happening. i love the dissent. i love the dissent because it shows that justices can sometimes do the right thing and say right thing and break the mold. you have the most libertarian, natural law theorists on the law and most liberal theorists on the court. neil gorsuch and ruth bader ginsburg the whole history of the country are against you this are going to let it

happen. ainsley: paul manafort seven years state crime does he serve 14 years or just seven. >> no, he serves the 146789 by the way if he is convicted in the state, it will be longer than seven years. it's a manifest injustice and the supreme court is allowing it to happen. dan: judge, this nullifies a presidential pardon. have every entrepreneurial democrat attorney general who wants to be the governor of their state is then going to seek to attack the trump administration through charges later on even if people like mike flynn or whatever. >> use paul as an example. if paul manafort were pardoned tomorrow by president trump that would not nullify the state prosecution. same as the case for anybody else that he would pardon. steve: coming up it, sounds like the justices will rule on the 2020 citizenship question which has been a political hot potato. >> some cases are going to come down, some decisions are going to come down thursday morning at 10:00 and some next monday at 10:00. i believe the citizenship one will be last.

i have a feeling the president of the united states tonight during big kickoff is going to be talking about our next news story. it is a fox news alert. the president tweeted out last night that apparently ice is going to start the process of deporting millions of people who are in this country illegally. ainsley: this is what he tweeted. he said next week ice will begin the process of removing the illegal aliens ii will his sithly found their way into the united states. they will be removed as fast as they come in. mexico, using their strong immigration laws, is doing a very good job of stopping people before they cross the southern border. guatemala getting ready to sign a safe third agreement. the only ones who won't do anything are the democrats in congress. they must vote to get rid of the loopholes and fix asylum. if so, border cries will end quickly. steve: the question is who is he talking about? we have heard estimates there are 12 million people in this country illegally there was an administration official who spoke anonymously to one of the

newspapers here in new york. they say they are going to focus on the 1 million people who have been deported. but are still here. but dan bongino, you have been in law enforcement your whole life. dan: yeah. steve: typically a large scale operation like this is kept secret so you don't tip people off. dan: yeah. we saw with the oakland mayor, remember the oakland mayor was of course a liberal who tipped off locals that the there were going to be immigration raids on people here illegally. you are right. not like we haven't seen this before. large scale operation thought dialed down to one specific area at this point the cat is out of the bag. ainsley: also announcing. state department announcing cut off aid to three central american countries. they said, this is worth hundreds of millions of dollars. they are saying if you are not going to listen townhouse and still come up here and send your people up here and not enforce the laws, then we will not continue to give you money. they said roughly $400 million worth of aid that's already approved for projects in 2017 and 2018 in those countries will

continue. morgan ortegas is the state department spokesperson now and here she is. >> we will not provide new funds for programs in those countries until we are satisfied northern triangle governments are taking concrete action tolsz reduce the number you have illegal migrants coming to the u.s. border. working with congress, we will reprogram those funds to other priorities as appropriate. this is consistent with the president's directions and with the recognition that it is critical that there be sufficient political will in these countries to address the problem at its source. steve: so, that's interesting. you know, you are talking about real money. keep in mind it was a couple weeks ago the president of the united states said hey mexico talking about 5% tariffs unless you start doing something. this should get their attention. one other note regarding the remove of the illegals. apparently the administration has been pushing the department of homeland security to get -- to do something like this for a number of months.

and in particular, it looks like they are trying to remove those deportation orders were expedited by the department of justice as part of a plan known as the rocket docket. dan: we have already seen upwards of 90% of people making asylum claims to ho get a court hearing do not show up. if there is no penalty at the end, what's the pointed? we effective li have no border at all. it looks like another win for president trump on this issue. ainsley: if you are illegal immigrants, you know where to go. many are heading to california where they're talking about giving you free healthcare if you are illegal. seven states plus d.c. i believe are saying if you come here, can you get a driver's license and bill de blasio our new york city mayor also running for president, he agrees with that, everyone should get a driver's license. he put this on twitter. could we scroll that up so i could see what he wrote on twitedder? oh. it's a sound bite. listen to this. >> i believe in drivers licenses for all. i believe that all new yorkers, regardless of documentation status, need to be able to get a license

enforcement. we have this crime here where this 16-year-old child coming home from a library working part time, honor student had a whole life ahead of her. had all of tomorrows stolen in the most brutal way imaginable. i have seen some horrible crime scenes in my time. this ranks up there. dan: even reality it last night a tough statement. board members based their decisions on whether the standards are satisfied by law. before making a final decision, the board members must follow statutory requirements which take into consideration many factors. end quote. what can governor cuomo do anything about this? he seems to speak out about everything else. >> we are getting comments such as. this if that was a piece of paper i would tear it up and throw it away right now. i never heard such nonsense in my life. this criminal was on parole when he committed the crime. he has never shown remorse. he has never taken any more accountability than the

i feel like we get basically another go at it and a second chance, basically. ainsley: stephanie, what happens next? >> so next we'll go back to the oregon court of appeals. the supreme court decided to take this case. they completely threw out the original opinion from the oregon court of appeals. and going to go back and make sure that this -- that melissa has a fair hearing and we're going to be trying the issue of whether the oregon administrative agency here acted with religious hostility toward the clines. ainsley: melissa, you decided not to bake this cake. tell us why and how that decision affected your life. >> i mean, it definitely affected our lives. it was a very -- it wasn't a very easy decision at all to make. we lost our business. it's been six years now and it's definitely taken a toll on our family and it's been very challenging.

stars and stripes on his shoes and patriotic colors on shirt and golf bag. steve: here to reflect on the big win on sunday kansas' pride and joy golf champion gary woodland. >> thanks for having me. i appreciate it. ainsley: tell us your story. how did you get here? >> i don't know. a lot of hard work. i have been blessed to be surround by amazing people my whole life and we believe. sometimes maybe not everybody believes but we believed within ourselves and we stuck with it. we had positive attitude on sunday. so contagious. my caddie and i had a great energy going on all day and we pulled it out. steve: so daunting. we watched all three days. but particularly on sunday. we were thinking you must have ice water in your veins because brooks koepka was launching an attack on you and it looked like he was going to take over. >> right from the start playing unbelievable from the beginning. amazing player. i saw what was happening in

front of me. you hear all the noise. i tried to stay within my 168. i was in the same situation with him last year when he won the pga. fortunately i had been in this situation before and tried to control myself because i couldn't control anything else. ainsley: you all are friends you hugged afterwards. >> it was nice. a lot of good guys there after i got done made it special. steve: hugging them like you are hugging trophy now. >> hard to let go. steve: i know you have been in series of hotel rooms since the big win. >> yes. steve: how far is that from you at all times. >> i can touch it at all times. that's what 2345eubgs it real when i wake up and see it next to me i realize it's not a dream. steve: one of the traditions is you take that top off and the champion does have a beverage out of it. what was your beverage? >> we had vodka quickly sunday night. it's going to get some good use in for the next year can i tell you. dan: when does it hit you? you just won the u.s. open? man, the u.s. open. do you wake up the next was i dreaming that. >> when i saw the trophy the

next morning. that night so much going on and excitement and friends and family it didn't sink in. seeing the trophy when i woke up it wasn't a dream. dan: what a great story. >> thank you. ainsley: what i love about your story. you have had some hard times. your wife had a miscarriage. and had your son and now she is pregnant with identical twin girls. what is so touching you have so many layers to you and so many wonderful stories that have come out of this. we all watched when you were face timing with your precious friend who has down syndrome. tell us about her. >> amy, i was fortunate enough to meet hei her in phoenix. we got to spend some time on the 16th hole. we asked her to play the hole with us. she got it up and down the bunker and made par. i was more nervous about her playing that than i was any time sunday. amazing story and love for life. that's what this world needs. we need a lot more of amy in it. steve: there you are playing a couple months ago i believe in arizona.

right after the big win on sunday, after you did some obligatory interviews you face timed her? >> it was special. we staye stayed in contact. she sent moo video singing happy birthday. when i have been sick she sent me stuff. amazing young girl. ainsley: that was her watching you win. >> go! [cheers] [laughter] >> that is awesome. ainsley: sweet. those are her parents. >> her parents and a friend. >> that's great. what goes through your mind when you watch that? >> it's heart-warming. like i said, she is an amazing young girl. i have been honored to meet her and call her friend. steve: yeah. you and i actually met about a year ago folds of honor down in oklahoma and i was lucky enough to give you the brooklyn award on behalf of folds of honor. a friend of ours, major dan rooney who started it. >> yeah. steve: knew you were going to make that putt even

though it was like 30 or 40 feet because it would have wound you up 13 under par because 13 is very important. >> it's special. obviously, major dan has been a huge influence in my life. he got me to understand that freedom isn't free and there is men and women that sacrifice and do so much for us so i can go out and play a game of golf and live my life under freedom. he has helped me understand that and, you know, i'm fortunate enough to wear patriotic colors with piewmma. we partnered with volition and folds of honor to give back to the men and women. ainsley: 13 number of folds in the flag that's why they call it folds of honor. we had flag day on friday we celebrated on fox square. steve: the deal is because volition was so struck by you wearing their gear they make a big contribution to folds of honor they doubled it through the fourth of july. >> i love it. i absolutely love it. dan: we have the best and worst golfer in the world not you, steve, me.

steve: i'm the worst golfer. dan: at 90 degrees not even physically possible i can do it. ainsley: we are all parents and raising these kids. how do we do that? how did your parents -- how did you get instilled with golf? steve: how does a kid from kansas? ainsley: what age were you when you started playing. >> when i started of walking my dad had me on the golf course. my dad worked nights when i got home from school i was able to hang out with my dad play golf, baseball, basketball. i loved every second of it. it's special to spend this with my dad on sunday. steve: in your dream though when you were a kid you were going to wind up in the nba championships thought the uso. >> i gout asked if i practiced that putt in the kid. no i was practicing being michael jordan. steve: what happened. >> i realized i was short and slow. i needed to find another sport. ainsley: what did your dad say on sunday when you won. >> he was at a loss for words. tearing up. something he dreamed of

orlando where president trump officially is going to kick off his 2020 campaign. that happens later today but are democrats seeing the same enthusiasm on the other side? fox news contributor, former obama economic advisor robert wolf met with joe biden last night. he joins us to weigh in. hey, robert, great to see you. >> great to be here. ainsley: what did joe biden say to you? >> it was overwhelmingly positive event for joe. i think he feels really good. one he always had tough times raising money. he is raising a decent amount of money which will allow him to run his campaign. what my opinion is he comes across as a real guy that cares about people. when he talks about american struggles, kitchen table issues everyone is talking about. ainsley: what are the struggles he was talking about? >> spoke last night a lot about health care. obviously what his son went through. what he is seeing on the road. he was the number one surrogate for midterms at our elections.

when he goes out there, to connect with the people as good as anyone in the country. ainsley: crowds really matter. >> yes. ainsley: when you look at a crowd lining up out there, spending two days camping out to see president trump with his re-election campaign what goes through your mind? >> there is no question, call it 35% of this country that are fully in for the president trump. they will stay in lines. they remind me of, you know, obama's type of lines. people will want to see the president. he is a president of the united states and those people who are staunch supporters when they have the chance to meet him, they will meet him. listen, i know they're saying he is launching his campaign tonight in orlando, but he has been launching it since he was elected. it always has been rallying -- >> is biden scared to go up against him? >> biden has to get through a primary. clearly last night, i would say, that i don't like to say this lightly but his dislike for the president is just real. i think he feels that the president is disrespecting the

considered to be violations and infractions by at least 15 unidentified people. the department calls the investigation serious and disciplinary actions are currently pending. we don't have any details. however we do expect to wrap up in september. ainsley: in other news, don't mess with texas. governor greg abbott unleashing common sense freedoms all across the state signing 927 bills this month. steve: what? one of those is the save chick-fil-a bill. so as you can see right here behind the banner, we have got pretty much all they are selling at this hour at chick-fil-a. dan: lines are open, i was eating it. steve: governor has his chick-fil-a. ainsley: good morning, governor. dan: there you go. >> anyone who, anyone who knows me, knows that this is not a prop up here because i eat chick-fil-a about five days a week. there is a standard order, when we drive through chick-fil-a,

abbott one or the abbott two? this is common sense. steve: common sense. can you explain to the folks watching from other parts of the country where they look at washington, governor, and nothing is getting done, nobody is passing any bills, how were you able to get through the legislature and sign 927 bills? >> well there was so much done. i credit the leadership we have in the capitol with the lieutenant governor and speaker, all members of the house and senate. you're talking about some of the fun bills we signed. more important than this, we signed legislation that actually cut property taxes in texas, that reformed our school finance system, that paid our teachers more, and addressed mental health. we did so much in just 140 days. you know in texas we only meet every other year for 140 days. we're working to change that. we want to meet two days every 140 years. steve: that would be great. ainsley: folks in texas talk what you have done with

chick-fil-a, lemonade stands. i read about you're cutting property taxes there. i lived in texas, we didn't have to pay state taxes, but property taxes were astronomical. that is awesome. tell me more about that. >> listen, property taxes have been going through the roof. we did two things to reduce property taxes. we took five billion dollars of money coming into the state of texas to buy down the property tax rates and then we put a limit on the ability of taxes authorities to be able to raise your property taxes in the future this will be both immediate and lasting property taxes in texas that help our businesses, especially our small businesses as well as our homeowners. dan: i want to congratulate you first. i think the single worst technological development in human history is the red light camera which you banned in texas. we create more traffic in texas as people move to texas to get away from red light cameras.

on serious note, a relatively close election between ted cruz and beto o'rourke, surprised a lot of people. are we having a issue with the republican party having an issue in texas? >> not really. same election i won by in double digits. listen the state of texas will remain red. the president is going to win the state of texas. we will continue to dominate. know this, that it has been something like 24 years, more than that, since a statewide candidate won who was not a republican. so texas is a dark red state. it will stay that way. steve: governor, we know it is nice of you to get up early right now but your chick-fil-a is getting cold. i know you want to dig into that. ours is here. thank you, governor. ainsley: thank you for increasing teacher pay too. my mama and my sister. that is awesome. they don't get paid enough. thank you for that. >> we'll take care of our teachers. >> great. steve: thank you, governor.

identical twin daughters. that is why she couldn't be there to kiss him when he won. he and his dad got to share the moments on father's day. his dad was at a loss for words. there is his dad. his dad was real emotional. steve: it took a long. it has been a long road. here is what he told us about that. >> i've been blessed to be surrounded by amazing people my whole life. we believed. sometimes maybe not everybody else believed, but we believed within ourselves. we stuck with it. we had, positive attitude on sunday, which was so contagious. my caddie and i had great energy going all day. major dan has been a big influence in my life. he got me to understand freedom isn't free. many women sacrificed do so much for us so i can play a game of golf, live my life under freedom. he helped me understand that i'm fortunate enough to wear patriotic colors with puma. we partnered with volition and folds of honor to give back to men and women who sacrificed.

represents. i had never heard that before. it was so powerful. so the 13 folds represent different things. it is worth looking up on our show. dan: great to see that profile, gary just ooze patriotism. you and i noted authenticity. totally genuine. just incredible guy. ainsley: down syndrome, the pressure girl he remembers is good's friend with. dan: he recognizes her during the press conference, amy, watching that video of her cheering when he won. tell me that didn't get to you a little bit? steve: a lot of great people on the pro tour but he is one of the best. so humble, very deserving. ainsley: wonderful stories in our newscast today, with the rock, getting on stage, having that wonderful message with him. these are role models that our kids can look up to. people we're all really proud of. dan: gary was great. really authentic. steve: he was inspiring. meantime dan and i are, we're in a tight competition for the

worst golfer currently in the new york city. dan: it is not tight. you have no idea how bad i am. steve: jillian is very good golfer. jillian: i wouldn't say very good. decent. i am learning. dan: i heard you're quite good. ainsley: that is something you and your dad share together. jillian: my dad taught me. i play with my dad and uncle. get caught up with the news. a new jersey man is the ninth american tourist to die in the dominican republic in the last year. joseph allen's family left heartbroken what they call a real nightmare. he was found dead in his hotel room on thursday after complaining about not feeling well. allen's cause of death has not been revealed but his son says he was pressured into signing documents to authorize embalming. dominican officials have not responded to our requests for comment. the story continues to grow. it is scary. 18 people show up to eric wall well's anti-gun rally. the 2020 hopeful outlining his

plan outside the nra headquarters in virginia. his proposal suggests banning military-style rifles and adding new requirements to owning a gun. smallwell invited people to the event, including the father of a shooting victim and other nra activities have. the nra mocked his rally saying quote, no wonder is polling at 0%. a toddler is nearly hit by a umbrella. you can see the sharp bottom of the umbrella miss henry by just inches. this happening on windy north myrtle beach in south carolina. his parent are sharing video to warn people of the potential dangers of flying umbrellas. two people were impaled by beach umbrellas last year. they are offering a free scoop if they can cite the pledge allegiance by memory. >> i pledge allegiance to the flag of the united states of america, and to the republic for which it stands --
